The course will be introduced by asking, What is bankruptcy? and What is a reorganization? There will be comparisons between formal bankruptcy and its alternatives, between reorganization and liquidation, between a chapter 11 reorganization and an out-of-court workout. There will also be a discussion of the constitutional limitations on the Bankruptcy Code.
