Disclaimer Regarding Local Chapter 13 Plans Our goal is to make preparation of local Chapter 13 plans as easy as possible. As always, we welcome any suggestions and feedback you might have. It is important to understand that because these local plans vary greatly, we sometimes have to resort to methods of entering information that are less straightforward and that require closer attention on the part of the user than other areas of the software. Additionally, the Chapter 13 plan by its very nature is probably the most complicated document filed in a consumer bankruptcy case and requires detailed legal knowledge. Please understand that you must always proofread every plan to ensure that it has printed as expected and that the plan accurately reflects the debtor s intentions. This software is far from foolproof. It is very possible for an

2 inexperienced user to produce an incomplete or inaccurate plan. It is the responsibility of the attorney to review every plan prior to filing it. Best Case Solutions technical support staff can advise you on the operation of the software, such as how to get a claim to print as you want on the form, but the actual decision about how to classify a given claim is a legal question that must be resolved by the responsible attorney. The Best Case technical support staff does not and can not dispense legal advice. In addition, your local trustee can modify or change the Chapter 13 plan requirements, practices or the format of the plan at any time. It is the responsibility of the attorney representing the debtor to ensure that local rules and practices are adhered to. Notes About this Custom 13 Plan Attorney s Fees and Filing Fees: You can input attorney s fees and filing fees to be paid through the plan through the Claims tab in the Chapter 13 Plan Calculator. Attorney s fees and filing fees will then appear in the Administrative Expenses section of the plan. Arrearages: Your plan format does not include a separate section for arrearage claims other than on secured claims paid outside of the plan and cure claims on assumed executory contracts and leases. If the debtor would like to pay arrearages on secured claims through the plan when the regular monthly payments will be made outside the plan, you can specify the arrearage amount and treatment in the 13 Plan Treatment tab for the creditor. For arrearages on all other claims, you will always include the Arrearage amount in the Amount of Claim value in the 13 Plan Treatment tab, and you will also leave the Arrearage amount at $0.00 on the 13 Plan Treatment tab. Items Printed in Section 3. Supplemental Plan Provisions: If you enter Lump Sum or Step Plan Payments, Secured, surrender property plan classes, or enter text in the Other tab of the Chapter 13 Calculator, Best Case Bankruptcy will automatically insert a note in 3. Supplemental Plan Provisions at the end of the plan. Custom Entry Screens: Two custom entry screens have been added to allow you to enter and/or edit information required for your Chapter 13 Plan. Note that these screens are only visible when the jurisdiction for the case is set to Western District of Texas ~ Waco 13 Plan (Filename=TX-W-WZ). To check the jurisdiction of a client, open the client file then click the About button in the Toolbar. 1. Special Creditor Entry Screen: A special creditor entry screen has been added to allow you to enter additional remarks required in some sections of your Chapter 13 Plan. To access this screen, pictured below, open a creditor in Schedule D, E, or F, click the 13 Plan Treatment tab, then click the Local 13 Plan Treatment button, located in the lower left corner of the creditor entry screen. 2. Vesting of Estate Property: If you want to change the SHALL/SHALL NOT selections for Section I., the Vesting of Estate Property paragraph on the printed plan, you can make the changes on a custom entry screen. Please refer to page 3 for further instructions on editing the language for Vesting of Estate Property.

3 How Information You Enter Relates to the Printed Plan: Caption The division name for the caption on the first page of the Chapter 13 Plan is taken from the jurisdiction name in the jurisdiction section of your Setup Menu. Note that if there is a tilde character ~ in your jurisdiction name, it will not print on the plan nor will any text following the tilde. To include your division and jurisdiction name in the caption, e.g. Western District of Texas Waco Division, you must edit the Jurisdiction Name on the Basic Information tab of the Jurisdiction Section of the Setup Menu. Notice to Creditors This section includes a notice to creditors regarding amendments to the plan. No data prints in this section. General Payment Information A. The Debtor s Plan Payment information is taken from the Regular and Lump Sum Payments into Plan in the Summary tab of the plan calculator. The Pay Order or Direct Pay box is marked for you based on the information entered in the Wage Deduction tab of the plan calculator. NOTE: If you enter any dollar amount greater than zero in the Debtor s Deduction Amount field on the Wage Deduction tab, Pay Order will be checked. If the amount differs from the payment on the Summary tab, the Summary tab amount still prints. Entering an amount for the spouse does not affect the plan. The gross amount to be paid into the plan is taken from the Summary tab of the Chapter 13 Plan Calculator. B. The percentage paid to unsecured creditors is taken from the Summary tab of the plan calculator. If you want to change the percentage paid to unsecured creditors, follow the below steps. 1. On the Summary tab of the 13 Calculator, type a question mark (?) in the first payment field then press [Tab]. 2. Enter the length of the plan in months. (Typically 36 or 60 months.) If there will be any lump sum payments, enter those and the month during the plan that these will be paid. 3. A question appears in the bottom of the window which says: "Pay unsecured nonpriority claims:" Type the percentage that you would like the unsecured nonpriority claims to be paid, or use the [up arrow] or [down arrow] buttons to change the number by one percentage point at a time. (You don't need to enter the percent sign, just the number.) 4. Click the Calculate button in the bottom of the Summary Window. 5. The Best Case Chapter 13 Plan Calculator will calculate the monthly payment amount and how much each creditor will be paid and when. The total amount paid to the attorney, trustee, and creditors will be displayed in the Summary Totals section of this screen, as well as the percentage paid to unsecured creditors. C. The value of non-exempt assets is reflected in the Liquidation tab of the 13 Plan calculator, as the amount "Available to General Unsecured." The value is calculated by (Schedule A Market Value + Schedule B Market Value) - (Secured Amount of Schedule D Claims where lien is not being avoided) - (Priority Portions of Schedule E Claims) - (Amount of debtor s equity which is exempt) - (Administrative Costs). D. The Debtor s monthly net income is taken from Schedule I, expenses are taken from Schedule J, and the amount available for plan is the difference between the two figures. E. This section states that payments paid directly by the Debtor outside the plan are noted in Section VI(1.) below. No data prints here.

4 Vesting of Estate Property By default, the plan checks the box next to Upon confirmation of the plan, all property of the estate SHALL NOT vest in the Debtor(s), but SHALL remain as property of the estate subject to the automatic stay of 11. U.S. C Special Entry Screen: If you want to change the SHALL/SHALL NOT selections for your printed plan, you can make the changes on a custom entry screen. To access this screen, open the 13 Plan Calculator, then click TXWWA 13 Plan Info button in the upper right corner. On the next screen, pictured below, click on the radio button for your preferred choice. If you want to add your own text to this section, click on the Other radio button and type your text in the corresponding field. Click OK to save your changes. Note that this screen is only visible when the jurisdiction for the case is set to Western District of Texas~Waco 13 Plan (Filename=TX-W-WZ). II. Interim Disbursements of Plan Payments This section states that the debtor requests and consents disbursement of plan payments prior to the case being filed. No data prints in this section. III. Executory Contracts/Unexpired Leases Executory contracts and leases are listed on Schedule G. When entering items for Schedule G in a Chapter 13 case, you will notice an Intention box. Select the corresponding radio button to answer whether the Debtor will Assume or Reject the contract or lease. The name of the creditor and description of the contract or lease will print under the appropriate subheading for this section of the plan. IV. Motion to Value Collateral Pursuant to 11 U.S.C. 506 This section will print all Schedule D creditors classified as: SFP - Secured, fixed payment, SPR - Secured, paid prorata, and SLTP - Secured, long term, in plan. Secured, fixed payment and Secured, paid prorata creditors will be paid in full by the end of the plan with the interest rate that you specify in the 13 Plan Treatment tab in Schedule D for each creditor. While the Chapter 13 Plan is in effect, the trustee will make the regular payments to creditors designated Secured, long term, in plan. Since these are long-term debts, they will not be paid off by the time the plan ends, and the debtor will continue to make regular payments after the plan is over. Creditor information for these claims will also appear in Section VI.2.E. Secured Creditors. Arrearages for Secured Creditors Being Paid Through the Plan: Since your plan format does not list or treat arrearage amounts separately for Secured Creditors being paid through the plan, you ll want to include the Arrearage Amount in the Secured Amt. field in the 13 Plan Treatment tab in Schedule D. Even if there is an arrearage, leave the arrearage amount on the 13 Plan Treatment tab as $0.00 for these creditors. The Creditor/Collateral (Creditor Name/Description of Property), Estimated Claim (Claim Amount), Value of Collateral (Market Value of Property), Monthly Payment or Method of Disbursement ( Prorata if paid on prorata basis or the dollar amount you specify if fixed payment), Interest Rate, and Anticipated Total to

5 Pay (Claim Amount + Interest) will print on the plan based on the information you enter in the Creditor Information tab and 13 Plan Treatment tab of Schedule D. To add Remarks for a creditor in this section, click the special Local 13 Plan Treatment button, located in the lower left corner of the 13 Plan Treatment tab on the creditor entry screen. You can enter your remarks for the creditor on the Texas West Waco 13 Plan Creditor screen that will open, which will then print on the plan. V. Motion to Avoid Lien Pursuant to 11 U.S.C. 506 Creditors classified as SAL Secured avoid lien will appear in this section of the plan. The SAL Secured avoid lien class is used if the property securing the lien is claimed as fully exempt and the debtor wishes to avoid the lien. Essentially, this claim is then treated as an unsecured claim, and would generally be paid in the unsecured, general nonpriority class. You are only allowed to use this treatment class if the full value of the property securing the lien is claimed as exempt. The Creditor Name, Property Subject to Lien, and Amount of Lien to Be Avoided (Claim Amount) will print on the plan based on the information you enter in the Creditor Information tab in Schedule D. To add Remarks for a creditor in this section, click the special Local 13 Plan Treatment button, located in the lower left corner of the 13 Plan treatment tab in Schedule D. VI. Specific Treatment for Payment of Allowed Claims 1. Payments Made by the Debtor Directly to Creditors Creditors classified as SLTO Secured, long term, outside plan will appear in this section of the plan. Secured, long-term outside plan is the treatment class that you would typically use for a mortgage. The creditor will be paid outside the 13 plan (payments will not go through the trustee. This claim will be printed on the plan with the monthly payment amount that the debtor will be making, but will not be included in the Chapter 13 Plan Calculator's computations. For Arrearage Claims Paid Through the Plan: Arrearages on mortgages or other secured claims can be paid through the plan if the regular monthly payments will be made outside the plan. When the debtor is in arrears for a mortgage, you should specify the arrearage amount and treatment in the Arrearage section of the 13 Plan Treatment tab for the creditor. Classify the claim as Arrearage, Paid Prorata or Arrearage, Fixed Payment. The Secured Amt. in the Secured portion section on the 13 Plan Treatment tab is the amount outstanding on the claim, minus any arrearages that you want to pay through the plan. In other words, the Amount of Claim that you specified on the Creditor Information Tab will be the sum of the Secured Amt. and the Arrearage Claim specified on the 13 Plan Treatment Tab. Note that the arrearage claim will then print in Section VI.2.C. Arrearage Claims, and will not appear in this section of the plan. The Creditor Name, Debt Amount (Secured Amt.), and Monthly Payment will print on the plan based on the information you enter in the Creditor Information tab and 13 Plan Treatment tab in Schedule D. To add Remarks for a creditor in this section, click the special Local 13 Plan Treatment button, located in the lower left corner of the 13 Plan treatment tab in Schedule D.

6 2. Payments to Be Made by Trustee to Creditors A. Administrative Expenses To include Attorney Fees and Filing Fees to be paid through the plan, enter the amounts in the Claims tab of the 13 Plan Calculator. The fees will then appear in the Administrative Expenses section of the plan. Creditor: For the Attorney Fee, the Attorney s Name, will print under this section as it appears on the Voluntary Petition. (Note that the attorney s Bar Number will not print in this section). For the Filing Fee, Filing Fee will print here. The amount of filing fees and/or attorney fees entered in the Claims tab of the Chapter 13 Plan Calculator will print under Estimated Amount of Debt. For Payment Method, the plan will print Along With to indicate that Attorney Fees and Filing Fees are paid along with secured creditors. If you want a different payment method to print on the plan, use the Best Case Editor to make your changes. Under Remarks, Attorney fees and/or Filing fees will automatically print on the plan based on your entries in the Claims tab. If you would like to insert a different remark, use the Best Case Editor to make your changes. B. Priority Creditors All claims of treatment class UPR Unsecured, priority will appear here. These are generally all Schedule E claims. Each Schedule E creditor's class is determined by your selection in the 13 Plan Treatment tab on Schedule E. These claims are to be paid in full and are paid prorata. When you use this treatment class, an interest rate field will appear which allows you to specify the interest rate that applies to this claim, if any. Note that the interest rate does not print in this section of the plan. If you would like to print the interest rate on the plan, you should add a note in the Remarks section, as described below. The Creditor will appear on the plan according to the information you entered in the Creditor Information tab of Schedule E. Estimated Amount of Debt: For the Unsecured, priority class, this will be the amount you entered in the Priority Amount field in the Creditor Information tab of the creditor entry in Schedule E. For Payment Method, the plan will print After to indicate that all creditors designated UPR will be paid after secured creditors. To edit the Payment Method answers, use the Best Case Editor (See the section, Editing the Plan for details). To add Remarks for a creditor in this section, click the special Local 13 Plan Treatment button located in the lower left corner of the 13 Plan Treatment tab in Schedule E. C. Arrearage Claims Arrearage claims classified any as Arrearage, Paid Prorata or Arrearage, Fixed Payment for SLTO Secured, long term outside plan creditors listed in section VI.1, will print in this section. The Creditor/Collateral (Creditor Name/Description of Property), Estimated Claim (Estimated Claim Amount), Estimated Value (Estimated Value of Property), Monthly Payment or Method of Disbursement ( Prorata if paid on prorata basis or the dollar

7 amount you specify if fixed payment), Interest Rate, and Anticipated Total to Pay (Estimated Claim + Interest) will print on the plan based on the information you enter in the Creditor Information tab and 13 Plan Treatment tab of Schedule D. Arrearage payment to secured creditor will automatically print as the Remarks for all arrearage claims classified Arrearage, Fixed Payment or Arrearage, Paid Prorata for Secured, long-term outside plan creditors. If you want to edit the default Remarks for arrearage claims, you can edit the plan with the Best Case Editor. D. Cure Claims on Assumed Executory Contracts & Leases for Deed Arrearage claims on assumed executory contracts and leases are listed in this section. To list an arrearage amount for an executory contract and/or lease in this section of the plan, you will need to create an entry in Schedule F. Enter the Creditor in the Schedule F Creditor Information tab. If you don t want the creditor to appear on the matrix and/or Schedule F, then you should check the corresponding checkboxes on the Creditor Information tab, as shown below. The Creditor name will print in this section of the plan, regardless of whether you exclude the creditor from the matrix and/or Schedule F. On the Schedule F 13 Plan Treatment tab for the creditor, you should classify the claim as Arrearage, Paid Prorata or Arrearage, Fixed Payment, and enter the arrearage amounts and interest. Tip: The Arrearage, Paid Prorata class is preferable to the Arrearage, Fixed Payment class because it gives the calculator more flexibility to distribute funds among creditors each month. For Estimated Amount of Cure Claim, the plan will print the amount you entered for the Allowed Claim field on the 13 Plan Treatment Tab for the Schedule F creditor. Under Monthly Payment or Method of Disbursement, Best Case will print Prorata for creditors classified as Arrearage, paid prorata, or the monthly payment you specify for creditors classified as Arrearage, fixed payment. To add Remarks for a creditor in this section, click the special Local 13 Plan Treatment button, located in the lower left corner of the creditor entry screen. Then type your answer in the Remarks field on the following screen.

8 E. Secured Creditors This section will print all Schedule D creditors classified as: SFP - Secured, fixed payment, SPR - Secured, paid prorata, and SLTP - Secured, long term, in plan. The Creditor/Collateral (Creditor Name/Description of Property), Estimated Claim (Claim Amount), Value of Collateral (Market Value of Property), Monthly Payment or Method of Disbursement ( Prorata if paid on prorata basis or the dollar amount you specify if fixed payment), Interest Rate, and Anticipated Total to Pay (Claim Amount + Interest) will print on the plan based on the information you enter in the Creditor Information tab and 13 Plan Treatment tab of Schedule D. F. General Unsecured Creditors This section asks you to describe the treatment for the class of general, unsecured creditors. Best Case subdivides the section into two groups of general, unsecured creditors: (1) claims treated as Unsecured General Nonpriority; and (2) claims classified as U Unsecured, Special Class, Pay 100%. (1) Unsecured General Nonpriority The following treatment classes are included in the first group of Unsecured General Nonpriority Creditors: claims classified as UGEN Unsecured General Nonpriority, the unsecured portions of claims classified as SFP Secured, fixed payment (if there are any), the unsecured portions of claims classified as SPR Secured, paid prorata (if there are any), and the nonpriority portions of claims classified as UPR Unsecured Priority (if there are any). Claims from the rejection of executory contracts (if entered on Schedule F, as well as Schedule G) are also included in this section. To include claims from rejected executory contracts in this section: Create a claim on Schedule F. Enter the Creditor and Amount of Claim in the Schedule F Creditor Information tab. If you don t want the creditor to appear on the matrix and/or Schedule F, then you should check the corresponding boxes on the Creditor Information tab (The Do Not Print/Total on Sch. F and the Exclude from Mailing Matrix checkboxes.). On the Schedule F 13 Plan Treatment tab for the creditor, you should classify the claim UGEN Unsecured General Nonpriority. Description of Treatment:

9 By default, Best Case will print the following description regarding the treatment of Unsecured General Nonpriority claims: General Nonpriority Unsecured debts shall be paid cents on the dollar and paid pro rata, with no interest if the creditor has no Co-obligators, provided that where the amount or balance of any unsecured claim is less than $10.00 it may be paid in full. The plan will print the percentage that unsecured, nonpriority creditors are to be paid, as it appears in the lower right hand corner of the Summary tab of the Chapter 13 Plan Calculator. If you want to change the percentage, please refer to page 3 for further instructions. Note that the name of each creditor will not appear in this section. Instead, the class will be described as a whole, as detailed above. Editing the Description of Treatment: You can change the default language on the printed plan for the treatment of Unsecured General Nonpriority claims by using the Best Case Editor, or you can change portions of the default language by selecting different printing options in your Setup menu. To change your Setup Options: 1. Close the Client List Window. Select Setup/Jurisdictions. 2. Highlight TX-W-WZ and click Edit. 3. Click the Misc. Options tab. There are two options in the Misc. Options window that allow you to change the default language printed for the treatment of Unsecured Nonpriority creditors. a. Print UGEN total payout on BC standard 13 Plan: By default, the percentage that Unsecured Nonpriority creditors will receive prints on the plan, but the total dollar amount that they will receive does not. If you check this box, a statement will be inserted in the description of treatment which reads The total payout to unsecured creditors at <percentage>% is $<total dollar amount>. b. Don't print "<$10" text on BC standard 13 Plan: This option refers to the text on the 13 Plan that reads provided that where the amount or balance of any unsecured claim is less than $10.00 it may be paid in full. If you check this option, it will be excluded. (2) Unsecured, special class, paid 100% Creditors assigned the U100 - Unsecured, special class, paid 100% treatment class will appear in this section. Usually, Unsecured, General Nonpriority claims get paid only a percentage of the amount they are owed. Using the Unsecured Special Class, Pay 100% (U100) class, you can give special priority to individual Schedule F claims so that they are paid in full, and are paid ahead of other Schedule F claims. You might use this class when the debtor wants to pay the claim in full because there is a codebtor, because the debtor wants to maintain a relationship with the creditor, or for certain student loans which are non-dischargeable. Creditors of this class are paid in full, and are of payout rank 3. They are paid prorata with other creditors of payout rank 3, which are generally just the Unsecured Nonpriority creditors. Description of Treatment: The plan will print the following general description above the list of U100 creditors: Special Nonpriority Unsecured debts which are co-signed or are non-dischargeable shall be paid in full (100%) as listed below. The Creditor will appear as entered on the Creditor Information tab.

10 The Estimated Amount of Debt for each creditor is taken from the Amount of Claim entered on the Creditor Information tab of the Schedules. To add Remarks for a U100 creditor in this section, click the special Local 13 Plan Treatment button, located in the lower left corner of the 13 Plan Treatment tab in Schedule F, and type in your comments on the following Texas West Waco 13 Plan Creditor screen. Totals This section lists the total value of all claims, not necessarily the amount being paid through the plan. The Total Administrative Claims, Priority Claims, Arrearage Claims, Cure Claims, Secured Claims, and Unsecured Claims are printed on the plan from the Summary tab of the Chapter 13 Calculator. Note, however, that claims classified as SLTO, SSR, and SAL are not included. 3. Supplemental Plan Provisions Information about lump sum or step plan payments, claims classified as Secured, surrender property, and any text that you type in the Other tab of the Chapter 13 Plan Calculator will print in this section. None will automatically print under Supplemental Plan Provisions if you do not type any text in the Other tab, or if you do not enter information about liens being avoided or lump sum and step plan payments. Chapter 13 Plan Preference Permanent Other Provisions There is also a chapter 13 Plan Preference that allows you to permanently add text to the section, Other Provisions Not Included Above. Saving (Replacing) the Plan with the Best Case Editor When you edit a document in the Best Case Editor, you are not actually editing the data record for the debtor, as you are when you enter information through Best Case entry screens like the Voluntary Petition window. Instead, you are editing a text document that has information about the debtor filled in for you. So that these forms will not take up a large amount of room on your hard drive, your changes to these documents are not automatically saved. 1. To save changes to the plan with the Best Case Editor, choose File/Save. 2. The Save Document in Case window appears. By default, the name of the form is filled in for you and Replaces Form is marked as the print selection. Click the Save to Case button to save the edited form. Note that changes that you make to the plan apply to this case only, not to all cases. 3. Close the Best Case Editor. The edited plan will then appear on the Forms and Schedules menu as the Replaced version of the original document. 4. To print the plan or create a PDF of the plan, mark the Replaced plan to print on the Forms and Schedules menu, and select your printing options. For all printing options, see Printing Forms in your User s Guide or Help menu in Best Case Bankruptcy. Opening Replaced Documents with the Best Case Editor To open a Replaced plan that was previously saved with the Best Case Editor: 1. Double-click on the Chapter 13 Plan in the Forms and Schedules menu. 2. On the next window, click the Edit button if you want to edit the plan with the Best Case Editor. The plan will then open in the Best Case Editor, and you can make additional revisions to the plan as needed. 3. If, instead, you want to return to the Chapter 13 Calculator after saving the form with the Best Case Editor, double-click on the Chapter 13 Plan in the Forms and Schedules menu, and then click the Options button on the next window. On the next screen, type DRAFT in front of the form name, and click the Do Not Print button.

12 Click OK on the next two screens, and then click the Close button. Double-click on the Chapter 13 Plan on the Forms and Schedules menu to open the calculator. If you want to return to your previous DRAFT of the 13 Plan, highlight the plan on the Forms and Schedules menu and click the Attach button. Click the Edit button to open the plan with the Best Case Editor.
