1 Baltimore City Public Schools Construction & Revitalization Act of 2013
2 Established a Four Agency Partnership to Implement Act Maryland Stadium Authority (MSA) Baltimore City Public Schools (City Schools) Baltimore City Government (BC) Interagency Committee on School Construction (IAC) Memorandum of Understanding outlining roles and responsibilities available at
3 Oversight & Implementation Executive Committee Consisting of at least one member from each agency. Will administer provisions of MOU. It will meet quarterly, subject to Open Meetings Act. Collaborative Group Consisting of representatives from Baltimore City, City Schools, and MSA. Will focus on opportunities for apprenticeships and job training, local hiring, and achieving MBE goals. The Collaborative Group will report to the Executive Committee. Coordinating Committee Consisting of representatives from various Baltimore City departments, City Schools, and MSA. Will examine ways to maximize recreational opportunities and community revitalization efforts. Meets quarterly and reports to Executive Committee. STAT Committee Consisting of members from each agency and chaired by MSA, who will manage the program. Will meet monthly to monitor and review progress and report to the Executive Committee.
4 Roles and Responsibilities of Agencies MSA will leverage $60 million annually for 30 years for up to $1.1 billion of MSA bonds for the program City Schools will manage process for educational specifications, feasibility studies up to schematic design IAC will approve scope of program and projects to be undertaken MSA will manage NEW construction projects City Schools will manage RENOVATION projects MSA and City Schools will participate in all procurements for the program MSA will ensure State rates for prevailing wage are followed for ALL projects MSA will monitor compliance with State MBE regulations
5 Winter 2013 Schedule - Steps Completed Legislature passed Baltimore City Public Schools Construction and Revitalization Act of 2013 The Act required a comprehensive MOU be negotiated between the for parties on 16 main business points Spring 2013 Governor signed the act in to law MOU negotiations began Summer 2013 Negotiations completed on MOU Fall 2013 MOU approved by the individual Boards/Commissions MOU approved by the Board of Public works on 10/16/2013
6 Schedule - Next Steps Fall 2013 City Schools conducts Year 1 Schools feasibility studies MSA and City Schools implement staffing and training plan Winter 2014 A/E and CM preconstruction expressions of interest Spring 2014 A/E and CM RFP s for Year 1 Schools Year 2 feasibility study A/E selection Summer 2014 A/E and CM selection Year 1 Schools- Design Begins

11 CM Selection Process- continued Selection Committee will short list firms for interview stage and ultimately select Selection criteria will include technical and price Price component includes, preconstruction fee, fee, and general conditions After preconstruction, the contract changes to at risk relationship after trade bids received if a successful GMP can be negotiated
12 Maryland Stadium Authority Baltimore City Public Schools Financing Authorized to issue up to $1.1 billion in debt: (i) is a limited obligation of the authority payable solely from money pledged by the authority to the payment of the principal of and the premium and interest on the bond or money made available to the authority for that purpose; (ii) is not a debt, liability, or a pledge of the faith and credit or the taxing power of the state, the authority, or other governmental unit; and (iii) may not give rise to any pecuniary liability of the state, the authority, or other governmental unit (House Bill No. 860, Chap. 640, 2013).
13 Maryland Stadium Authority Baltimore City Public Schools Financingcontinued Revenue Bonds will be issued and secured by the following: $10 million from the Baltimore City; the Bottle Tax, 10% of the facility rent paid by the operator to Baltimore City for the Video Lottery Facility, and Table Game revenues generated by the Baltimore City Video Lottery Facility If these sources do not generate the required $10 million, the Authority can request from the State Comptroller the Income Tax revenues from Baltimore City $10 million from Retiree Health Costs shifted from Baltimore City to the Baltimore City Board of School Commissioners $20 million from the State Lottery
14 Maryland Stadium Authority Baltimore City Public Schools Financingcontinued $20 million from the Baltimore City Board of School Commissioners from the General State School Fund Total debt service of outstanding bonds can not exceed $60 million Expect to issue between three (3) to five (5) series of bonds between $150 million and $250 million Tax Exempt bonds with reimbursement of Architect and Engineer Fees already spent First series to come sometime in the late summer to early fall 2015 Each series is based on a set of schools ready to move forward, both renovation and replace
15 Maryland Stadium Authority Baltimore City Public Schools Financingcontinued Request for Proposals will include: Option for co-managers MBE component Creative financing to maximize debt service
16 MBE Participation All projects will follow State MBE law and policies MSA and City Schools will conduct MBE outreach initiatives for maximum inclusion MSA will work with the City MBE office to notify City certified MBE firms of opportunities and maximize State certified locally based firms MSA and City Schools will review MBE opportunities individually on each procurement to establish MBE goals A collaborative group, established by the MOU, will oversee these efforts
17 Work Based Learning and Hiring The collaborative group will work to maximize opportunities for City Schools students and City Residents The collaborative will engage representative from community, professional and trade organizations to provide input to the plan The Mayors Office of Employment Development will develop a comprehensive local hiring plan to support the goals of the program
18 Year 1 Projects It is anticipated that schools will be considered for approval as year 1 projects This total includes 3-5 new schools with the balance being renovations
19 Goals and Commitments Deliver quality schools on time and within budget Conduct procurement in a fair and competitive manor Maximize MBE outreach and inclusion efforts Maximize opportunities for City Schools students and City residents Abide by executive order for apprenticeship program inclusion
