1 City s VALET program? Would you like to know about the The City of Dallas Police Department, Parking Enforcement Section regulates and permits valet operations within the City of Dallas. Any business that is interested in obtaining a permit for providing valet services may review and fill out our Valet application as attached. Businesses that provide adequate parking on site for their customers and have ample parking spaces to provide valet services would not be required to have a permit. However, if the business does not have enough parking spaces and a valet company is hired to park vehicles at a remote location or maneuvering onto a public right-of-way to get to a remote location would than be required to obtain a valet permit. Valet permits are renewed annually and require subsequent fees as applicable. Those fees are as follow: Application Fee: $25.00 Valet Sign Fee: $25.00 (one time fee) Podium /Stand Fee: $50.00 Valet Space: $ per space for the first 6 spaces and $ per space for any Additional space within the Central Business District. $ per space for the first 2 spaces and $1, for any additional space outside the Central Business District. Central Business District (CBD) is defined as the area bounded by Woodall Rogers to the North, Central Expressway & Julius Schepps Freeway to the East, I-30 to the South, and I-35 to the West. ALL COMPLIMENTARY VALET SERVICES MUST HAVE A SIGN STATING COMPLIMENTARY ON THE PODIUM. Effective immediately: ALL Valet Permit s will reflect the Fiscal Year October 1st through September 30th all fees will be on a pro-rated basis. A New Service Request type has been created to compliment or file a complaint against a Valet operation. Citizens can call 311 for this service. 2 City of Dallas Dallas Police Department Parking Management Division Valet Parking License Application Process and Information The completion of the valet parking license application is important for the applicant who desires to have valet for their customers. To ensure a smooth process it is the responsibility of the applicant to follow the instructions as it is given on the application. Once the application is completed along with the documents (insurance certificate for the applicant and the valet company; sketch, operational plan, parking analysis, and site plan) the applicant may schedule an appointment by phone or to set a time to review the application. At that time a $25 (non-refundable) application fee is due for the processing of the application. The office will only accept Cashier s Check, Money Orders, and established Business Checks. It is important once an appointment is set to discuss the application that it is kept. Due to my duties in the field promptness is very important. If you are unable to keep an appointment do call or leave an so a time can be re-scheduled. After the application is reviewed with the applicant it is submitted to Building Inspection for review of the site plan, parking analysis, the offstreet parking, and any other document(s) that may be needed on Building Inspections part. It may take 2 to 3 weeks for the processing of the application. The timeframe for this part of the process is determined by the applicant. If you are contacted by a representative of Building Inspection, document(s) may be required it is the responsibility of the applicant to have it completed. The response time of the applicant will determine how fast or how slow the process will take. When the application is received from Building Inspection to Parking Management Office it should be approved, if the applicant responded to Building Inspection in a timely manner and submitted the required documents. The applicant is notified and an appointment is scheduled. At that time the remaining fees will be due before the valet parking license is issued. What will determine the valet fees is the location of the valet operation; the number of valet spaces needed. There will be an instance that the valet operations move the vehicles from private property onto the public right of way (public streets) to park vehicles. In this case the cost of the valet parking license is $25 which is included in the application fee. Owner Consent Form, of the application: adjacent property owners consent at time this may mis-lead some people. Once the authorization is given to an applicant from the business owner, which is located within 50 feet of the business that will conduct valet operations. The business that will conduct valet operation is for that business alone. That does not give the applicant or valet company the authority to valet for another business that is located within 50 feet of the applicant business that submitted an application. If the other business owners desire to have valet a separate application must be submitted. Yes, it is within 50 feet, but there different addresses. Which will require a separate license? The valet parking license is valid for one year only. So, it is strongly recommended thirty to forty-five (30 to 45) days prior to the expiration of the license that an application is submitted. This will allow time for review, a smooth transition from one renewal year to another, and maintain the valet operation for your guests. For a renewal license the process is fairly fast if no information, no business owners, no routes, no insurance carrier, or valet company change. For a new license the process is a little longer it will require the verifying of information, routes, insurance carrier, site plan, and parking analysis. If there is a desire to have valet service for your guests it is strongly recommended that the application process starts thirty to forty-five days prior to your opening date or your additional service for your business. The Office of Parking Management is here to assist you the business owner in the application process for valet service, before that can take place the responsibility on time completion and submission of the application is the business owner. There are several options to procure a valet license application by walk-in, phone call, or . To have a valet service that is using the public right of way without a valet license is a violation of city of code (a). 4 PART II H. SKETCH AND OPERATION PLAN: (Attach a sketch showing the proposed location of the on-street valet spaces requested and valet stand). (1) Include the distance from the nearest corner to the beginning of the first on street space and stand/podium. The sketch should be illustrated with arrows showing the driving route from the valet stand to the parking lot and from the parking lot back to the valet stand. (2) Include an operation plan outlining in words how the valet company will maneuver on the City of Dallas public right-of-way (public streets) to operate the valet service. The operation plan should detail the pickup location and route that the valet operators are to follow when accepting and returning vehicles to their owners. (3) A copy of the approved valet operation plan and valet license must be maintained at the podium/stand while the valet service is in operation and accessible for review by Parking Management Personnel and Dallas Police Officers. Sketch and operation plans may be reviewed and approved by Traffic Engineering to ensure feasibility and safety. I. PARKING ANALYSIS: (1) Provide a parking analysis that demonstrates all the users of the proposed off-street parking location. Include required and excess parking information for all establishments using the same parking location. ( See Example) (2) Provide a letter of agreement from the property owner of the off-street parking lot authorizing the applicant to utilize the lot for valet services. J. SITE PLAN: (1) Provide a site plan drawn to architect s or engineer s scale showing the legal description of the proposed offstreet parking lot. (Example included) K. HOURS AND DAYS OF OPERATION: (hours and days of operation should not conflict with other businesses approved to use the same REQUIRED SPACES ) AM PM PM AM DAYS THRU DAYS THRU L. INSURANCE: The licensee shall not commence operations and shall not exercise any such rights granted herein until licensee shall have furnished a complete insurance certificate to City, which certificate shall be completed by an agent authorized to bind the named underwriter(s) to the coverage limits and termination provisions of Section of Dallas City Code as amended. The certificate shall furnish and contain all required information referenced or indicated thereon. No officer or employee shall have the authority to waive this requirement. The business establishment must provide comprehensive general liability insurance of not less than $300,000 and list on the policy the City of Dallas as additional insured and certificate holder, the independent Contractor (valet company) must provide garage liability insurance of not less than $300,000 and list on the policy the City of Dallas as additional; insured and certificate holder as per Section (a) (b) of the Dallas City Code. M. IDEMNITY: As a condition of this valet parking service license, the licensee, and any independent contractor used by the licensee, agrees to identify, defend and hold harmless the City of Dallas and all of its officers and employees against an and all suits, causes of action, or claims or injuries, damages, costs, and expenses to persons or property, whether public or private, that may arise out or, or be occasioned by, the operation of a valet parking service on the public right-of-way or any act, omission, or misconduct of the licensee or his agents, representatives, contractors, or employees. The licensee agrees to discharge and all judgments that may be rendered against the City of Dallas or its officers and employees in connection with any suit, cause of action, or claim after the judgment becomes final and unappeasable. N. FEES: (1) Application Fee (non-refundable) $25.00 (2) Annual Fee (determined by the number of spaces, stand and valet sign and/or markings, services inside or outside the Central Business District) (3) Fees due and payable upon approval of application (4) Valet service will performed: Inside Central Business District Outside Central Business (5) Service Fees: I plan to: charge not charge patrons for Valet services (6) Other documents and fees may be necessary in order to complete the Valet license application process. Additional documents and fees will be determined by the City s Building Inspection Office. Applicant will be notified of the additional requirements by Parking Management Department.

5 OWNER CONSENT FORM ADJACENT PROPERTY OWNER S CONSENT: Applicant shall provide a list of names and addresses of all property owners or their representatives located within 50 feet, on the same side of the street, and located within the same block as the Valet parking service location either: (1) with signatures showing consent to the operation of a Valet parking service by applicant; or (2) without signature in which case Parking Management shall notify the adjacent property owners and obtain comments. Comments received may be used to determine whether the application violates any of the following criteria. (a) endanger the safety of persons or property or otherwise not be in the public interest: (b) unreasonably interfere with pedestrian or vehicular traffic: (c) unreasonably interfere with the use of a pole, traffic sign, traffic signal, hydrant, mailbox, or other object permitted at or near the proposed location of the Valet parking service; or (d) unreasonably interfere with an existing use permitted at or near the proposed location of the Valet parking service. AN ADJACENT PROPERTY OWNER REFUSING TO CONSENT TO THE VALET PARKING LICENSE IS NOT AUTOMATIC GROUNDS FOR DENIAL OF THE VALET PARKING LICENSE. IF AN APPLICATION DOES NOT VIOLATE ONE OF THESE CRITERIA, IT SHOULD BE APPROVED. CONVERSELY, IF AN APPLICATION VIOLATES ONE OR MORE OF THESE CRITERIA, IT SHOULD BE DENIED. 6 APPLICANT AND INDEPENDENT CONTRACTOR SIGNATURES The Applicant, Independent Contractor and employees agree to abide by the Valet Ordinances in Chapter of the Dallas City Code. Any violation of the Dallas City Code may result in license denial, suspension and/or revocation without refund. The Valet parking service license when issued and upon payment of all fees and compliance with provisions of Section of the Dallas City Code remains in effect for a period of one year from the date of issuance unless sooner terminated by the Director of Parking Management for the City of Dallas or by City Council. In addition, a Valet parking license may be denied if the applicant fails to comply with the requirements of the Valet parking regulations or other applicable law; or if the applicant make a false statement of material fact on the Valet application; or it is determined that the operation of the Valet parking service is in violation of elements within this application. The Valet parking service license may be renewed by making application in accordance with Section of the Dallas City Code at least 30 days before the expiration of the current license. (Applications and or documents may be submitted in person/mail/fax/ ). 7 Required Site Plans Required site plans must be drawn to an architect s or engineer s scale and show the following: **Please see the example site plan on the back** 1. The ENTIRE platted piece of property with property dimensions and data. 2. The size and location of all buildings, including fences and dumpster enclosures. 3. The use and size of each building and/or suite. 4. The location and dimensions of all parking spaces on the property. 5. The locations and dimensions of all parking spaces on the property. 6. Parking analysis can be on site plan or attached separately. See example. 7. Location of fire hydrants and fire lanes. 8. North arrow. 9. Names of any adjoining streets.
