MEMBERS' DECLARATIONS UNDER THE CODE OF CONDUCT IN RESPECT OF ITEMS ON THE AGENDA The Comptroller & City Solicitor referred to paragraph 32 of the report and advised Members that, when taking decisions regarding this Charity s business, they must act in the sole interests of the Charity. Therefore, where Members were appointed to other City of London School Committees, or one of the City s Academy Boards, and the school (rather than an individual at that school) had made an application for funding from the Charity, a conflict of interest and, more specifically, a conflict of loyalty, might arise. Members noted that the report set out the most defensible position for Charity Trustees in such cases, having regard to Charity Law requirements and the need for transparency and accountability in taking decisions. However, this Charity was also being managed in accordance with the City Corporation s normal procedures and, where the conflict of loyalty would not affect objective decision-making (i.e. bias or a personal interest would not arise), the participation of those Members might, in fact, enhance decision-making. Therefore, decisions in such cases must be taken transparently, with the interest being declared and reasons for the decision clearly recorded and published. Page 1
6 The Chairman thanked the Comptroller & City Solicitor for this advice and emphasised that the Panel dealt solely with objective criteria. Furthermore, he asked Members to be mindful that applications were from individuals and not on behalf of the Board. However, it was open to Members discretion as to whether they leave the room. Rev Dr Martin Dudley and Deputy Mrs Joyce Nash declared interests as Governors of the City of London School for Girls; in respect of 4 applications on this agenda relating to school pupils. Neither Dr Dudley nor Deputy Mrs Nash had any previous knowledge of the applications. 3. MINUTES The Minutes of the meeting held on 15 February 2013 were approved as a correct record. Matters arising In respect of the non-public status of the report setting out the applications, the Town Clerk advised that the appendices were non-public (by virtue of paragraph 1, Section 1A of the Local Government Act) until the decisions were taken. Therefore, the minutes would be a public document. The Town Clerk undertook to consider the best way to present the report in the future. Members noted that the grants awarded at the last meeting had been allocated and they would receive feedback at the next meeting. 4. EXCLUSION OF THE PUBLIC That, under Section 100A of the Local Government Act 1972, the public be excluded from the meeting for the following items on the grounds that they involve the likely disclosure of exempt information, as defined in Part 1 of Schedule 12A of the Local Government Act. Item No Paragraph No CHARITY APPLICATION DECISIONS The Panel considered 11 applications for funding from the City of London Combined Education Charity, which were deemed to meet the Charity s established eligibility criteria. The Chairman commented that very few applications had been presented in a way that was helpful to the Panel and suggested that future applicants be encouraged to provide as much supporting information as possible, including more details on financial eligibility and Page 2
7 updates for those which had been received more than three months before the Panel meeting. RESOLVED, that: 1. The City Academy, Hackney be awarded up to 3,000 to enable children from families facing financial difficulties to attend an inaugural ski trip to Italy in December The funding is condition upon the Academy identifying specific individuals in financial need. 2. The City Academy, Hackney be awarded 3,000 to buy clothing; which could then be used as a sustained resource for the trip in future years and assist those families unable to afford such items. 3. A pupil at the City of London School for Boys (SR), be awarded 1,000 to make a trip to Peru in aid of charity (Quest Change). Members noted that during the trip, the pupil would help to build a shanty town and teach local children. The pupil was also in receipt of bursary. 4. In respect of a London resident studying undergraduate Fine Art at Goldsmiths (KK), University of London, a grant of 500 be made for equipment; subject to confirmation that the circumstances had not changed and that the individual was still in need of financial assistance. 5. In respect of a HND student at St Patrick s College (PB), a grant of 1500 be made to support the purchase of equipment and travel; subject to confirmation that the circumstances had not changed and that the individual was still in need of financial assistance. 6. In respect of a further HND student at St Patrick s College (GM), a grant of 1500 be made to support the purchase of equipment and travel; subject to confirmation that the circumstances had not changed and that the individual was still in need of financial assistance. 7. In respect of an application from IS, a PhD Student at London South Bank University (who was a resident in a London Borough and had a family to support); a grant of 3,000 be made, on production of a letter from the Supervisor providing evidence of progress and an expected completion date. 8. In respect of a London resident (CH) accepted to a London based independent secondary school, an award of 3000 pa, for two years be granted, to contribute towards the cost of tuition fees. The applicant would be contacted and encouraged to apply to Christ s Hospital School and King Edward s School, Witley (both of which have links to the City of London Corporation); to explore any options which might be suitable for the applicant s continuing education. 8 9. In respect of SC, a student accepted at the LSE to study for an MSc, given that the application was incomplete, this be deferred to the next meeting of the Panel. 10. Four applications from the City of London School for Girls be declined as they did not meet the criteria. The Chairman commented that it would be useful for the Girls School to receive further advice relating to the guidelines which the Panel observed when making grants, and particularly concerning the requirement for applicants to demonstrate financial need. 11. The Charity s grants policy and application criteria be reviewed and a revised policy and application guidelines be circulated to Members of the sub-committee for discussion at their next meeting, before being submitted for consideration at the following meeting of the Grand Committee. 8. 9 Agenda Item 4 Committee(s): Date(s): City of London Combined Education Charity Panel 11 October 2013 Subject: Review of the Charity s Grant-Making Policy and Application Documentation Public Report of: Director of Community and Children s Services Summary For Decision The Charity Commission approved the Charity s revised governing scheme in The City of London is the sole trustee of the Charity and has delegated responsibility for the administration and management of the Charity to the Community and Children s Services Committee, as permitted under the charity scheme. A charity s trustees have an obligation to keep under review the focus, strategy and activities of their charity to ensure that it is operating effectively, that it is meeting its charitable purposes, and that beneficiaries needs are being met. This report recommends actions to further improve the clarity of the Charity s grant-making policy and associated information for applicants seeking funding. The revised eligibility criteria and application form will be accompanied by brief explanatory guidance notes to assist potential beneficiaries when making an application for funding to the City of London Corporation Combined Education Charity. These documents will be included in an information pack for applicants which will also be circulated to members of the Panel which is responsible for taking decisions regarding the award of grant funding The documents will also be made available on the City of London s website. Recommendation(s) The Panel members agree to recommend to the Community and Children s Services Committee for approval the Charity s revised Grants policy and Funding criteria, Application form and Guidelines for applicants. Main Report Background 1. On 10 th June 2011 the Charity Commission approved the scheme for the Charity now named The City of London Corporation Combined Education Charity (Charity Number ). The City of London Corporation, acting through the Common Council, is the sole trustee of the charity. The Page 5
10 Community and Children s Services Committee has been given delegated authority to manage and administer the Charity, as permitted under the charity scheme. 2. The revised objects of the Charity are for the public benefit: a. To further the education of persons (including persons both born or resident in the City of London and those attending educational institutions in the City of London and London boroughs) attending or proposing to attend secondary, further or higher educational institutions by provision of grants or financial assistance and by arranging or supporting education and training to extend or complement courses provided by those institutions. To provide grants for staff at maintained schools and sponsor Academies in the City of London and London boroughs to undertake studies either at educational institutions or at other establishments provided that such study furthers their development as teachers. 3. Consistent with its responsibility for management and administration of the charity, the Community and Children s Services Committee is responsible for settling any policy adopted to most effectively support the charity in achieving its objects. The Community and Children s Services Committee has further delegated to a sub-committee, The City of London Combined Education Charity Panel, the authority to take decisions regarding the award of grants in accordance with an agreed policy (with the Grand Committee being kept informed of the work of the Panel), 4. The Community and Children s Services Committee at its meeting on the 2 nd March 2012 resolved inter alia that: a. The award of grants be considered and agreed by a panel of Members (the Panel was constituted by the Grand Committee on the 20 th April 2013); b. There be a focus on awarding grants under the first charitable object rather than the second; and c. A review to be conducted at the end of the first year to determine whether the Charity is being administered effectively and whether the application guidelines should be reviewed to meet the needs of different groups of beneficiaries or to more effectively apply the Charity s funds. 5. Having regard to the decision of the Community and Children s Services Committee on the 2 nd March, on the 12 th July 2012 The City of London Combined Education Charity Panel agreed a policy and framework for considering applications for funding, and adopted the following additional criteria to assist the assessment of those applications to be reviewed in one year: Page 6
11 a. Applicants should be one person or a group of people attending or proposing to attend one of the three City of London Academies or the City of London School for boys and City of London School for Girls or a further or higher education institution in the City of London or other London boroughs. b. Applicants must show evidence of financial need which must be accompanied by covering letter of support from the place of study. c. Applicants may not apply for a further award for a minimum of five years after receiving an award. d. Applicants must be of secondary school age or above. e. Grants may be given to individuals or organisations applying on behalf of one person or groups of people. 6. The Panel has also agreed to limit each award to 3, Applicants are also asked to provide the following information in support of their application: a. Clear evidence of the purpose and use of the grant and information of what will be achieved by undertaking the funded activity or course of study; b. A short written statement outlining the rationale for support by the charity; c. In demonstrating evidence of need, information which supports the claim of financial hardship such as details of state-aided support and benefits. d. Successful applicants are requested to prepare a short written or verbal report outlining the value of the contribution the grant award has made to a project or area of study. 8. Nineteen applications for funding have been considered by the charity Panel at two meetings held in February and July Fourteen grants have been awarded and the amounts awarded have ranged from 500 to a maximum of 3,000. The total amount awarded to-date is 46, Applicants have requested financial support to purchase items of equipment to benefit their education. This includes items such as computers, projectors and assistance with educational travel. A PhD student has been supported in studying different systems for performance optimisation for building integrated photovoltaic panels and specialist sports equipment has been purchased for children from disadvantaged families. 10. Following consideration of the application process to-date the eligibility criteria require revision. A lack of clarity has attracted applications which do Page 7
12 not fit the award criteria and has also led to difficulties in determining the strength of individual applications under the existing criteria. 11. The recommendation is therefore to revise the eligibility criteria, application form and guidance for applicants with a view to ensuring greater clarity for applicants. This information will also be used by the Combined Education Charity Panel when considering applications and the award of grant funding. Current Position 12. The revised Charity objects have supported Officers to actively promote the charity to ensure that a wider group of beneficiaries have access to charitable funds. In previous years the promotion of these funds was kept to minimum. Although the wider promotional activities have meant that a small number of applicants have not been successful in securing an award, this seems to have been due in the main to misinterpretation of the eligibility criteria or insufficient information in their application. The general information about the Combined Education Charity continues to be circulated to a wider group of beneficiaries. 13. Although the revised objects and a new approach to promoting the Charity have been successful in increasing the number of potential beneficiaries enquiring about financial support, it has become apparent that both those applying for funds, officers in assessing applications, and the Panel in considering those applications would all benefit from greater clarity in the eligibility criteria and application documentation. The proposed amendments to the Grants Policy, Application Form and Guidelines for Applicants are intended to achieve this clarity and give effect the obligations of charity trustees to keep their policies under regular review to ensure they support the charity in achieving its charitable objectives. (Refer Appendices 1-3) 14. The only substantive change which is proposed to the criteria is that only those over secondary school age may apply i.e. any applicant must already be in secondary school education. The suggested amendment will limit the number of enquiries received from applicants who are not yet of secondary school age. 15. The revised application form (Please see Appendix 2) combines two categories of applicant into one document. The first category is that of an individual applying for funds to support his/her education. The application form focuses on questions relating to cost of the activity/course, start and end date for the course and a request for detailed justification of need. 16. The second category of applicant relates to applications made on behalf of a group of pupils attending the eligible secondary schools. For example, a teacher applying for sports equipment for a group of school pupils or an application to support the attendance on a school excursion where the cost may be beyond the means of some families. The application will request names of all recipients and will also ask for evidence of need and hardship. 17. The guidance notes (Please see Appendix 3) explain what information should be included in each section of the application form. Page 8

Further, a new strategy for promoting the Combined Education Charity is proposed which will include face to face tutorial support in addition to advice and guidance to those who are responsible for completing the grant application forms. Legal Implications 19. Charity trustees have an obligation to keep under review the focus, strategy and activities of their charity to ensure that it is operating effectively, that it is meeting its charitable purposes, and that beneficiaries needs are being met. 20. The City, as Trustee, also has an obligation to apply the income of the Charity for its purposes within a reasonable period. The revised eligibility criteria and application documentation will support effective decision-making to this end. Conclusion 21. The aim of the revised eligibility criteria and application documentation is to achieve clarity in the types of applications which will be considered by the Panel while ensuring that the charity effectively achieves it objects to further education for the public benefit having regard to the funds available, and meeting the obligations of charity trustees to keep these matters under regular review. The revised documentation will build upon positive work achieved by the Panel to-date. 16 The City of London Corporation Combined Education Charity (312836) Grants Policy and Funding Criteria (Adopted 11 th October 2013) The Purposes of the Charity: The purposes of the charity are to benefit the public by: (a) furthering the education of persons attending or proposing to attend secondary, further or higher educational institutions through grants or financial assistance, and by arranging or supporting education and training to extend or complement courses provided by such institutions; and (b) providing grants to staff of maintained schools and Academies in the City of London and the London boroughs to undertake study which furthers their develop as teachers. Grants Policy and Eligibility for Funding In order to target the charity s limited funds to most effectively and efficiently achieve the charity s broad purposes to further education, as noted above, the following grants policy and criteria have been adopted when considering all current applications for funding. Persons Eligible for Funding 1. Persons who are of secondary school age or above and who also meet the eligibility criteria set out at paragraphs 2 and 3 below. 2. Persons who are resident in the City of London or one of the London Boroughs. 3. Those who are either: (a) A person currently attending, or enrolled to attend, a further or higher educational institution in the City of London or one of the London boroughs. (b) A pupil attending one of the three City of London sponsored Academies located in the London boroughs of Southwark, Hackney and Islington, or attending The City of London School or The City of London School for Girls. (c) A current member of staff at one of the three City of London Sponsor Academies located in the London boroughs of Southwark, Hackney and Islington, The City of London School or the City of London School for Girls. Preference will be given to those persons eligible under paragraphs 3(a) and (b), above i.e. students, and includes applications made on behalf of a group of eligible secondary school pupils (per paragraph 5 below). 17 Any of the three City of London sponsored Academies, The City of London School or The City of London School for Girls may apply for funding on behalf of an individual pupil or on behalf a group of pupils attending the relevant school. Where an application is submitted on behalf of more than one pupil the school must identify the individual pupils who are intended to benefit from the grant and provide sufficient information to support the application being made on behalf of each of them. This must include evidence of financial need and details of the educational merit and value which would be achieved for those individual pupils should the grant be awarded. Individuals who are awarded a grant from the charity will not be eligible for further funding within 5 (five) years of the decision to award the grant. Activities which will be funded For Students, these include: (a) Course fees. (b) Equipment and or resources necessary to undertake a course of study e.g. specialist recording equipment, specialist technical equipment, purchase of books and reference materials. (c) Travel and associated expenses directly relevant to your course of study or education. (d) Expenses associated with school sponsored excursions and travel. (e) Activities associated with the individual s education (or expenses related directly thereto) where the educational merit or value of that activity has been demonstrated in the application. For Teachers these include courses and study for the purposes of professional development as a teacher. All those who benefit from a grant will be required to provide a written update to the charity of the outcomes and benefits experienced by those individuals in undertaking the course or activity funded by the grant. Maximum Grant The maximum funding which will be awarded to an individual is: 3,000. Where an application for funding is submitted on behalf of more than one person, the grant may exceed this amount but will not exceed 3,000 per individual. Evidence and Supporting Documentation The charity will only consider applications which have been properly completed in a timely manner and which have been submitted with all relevant supporting documentation. Please refer to the Application Form and Guidance Notes for Applicants for further information. Timings of Decisions Applicants will be informed of the dates for final submission of application documentation and the dates of the meetings at which eligible applications will be considered by the trustees for funding, upon request. Normally eligible applications will be considered in January, July and October, and all application documentation will be required at least 8 (eight) weeks prior to the meeting. Appendix 1 Page 13

27 The City of London Corporation Combined Education Charity (312836) Guidance Notes for Applicants Grants offered by the City of London Corporation Combined Education Charity are designed to enhance educational opportunities and outcomes for recipients experiencing financial difficulty. Applications will only be considered where the proposed beneficiary of the grant is already attending a secondary, further or higher educational institution. Please refer to the Grants Policy and Eligibility Criteria for further details as to how the charity s limited funds are targeted to benefit those in need of assistance. Where the eligibility criteria are met, applications can be made by an individual for his/her own benefit. Alternatively, for those in secondary education, applications can be made on behalf of a number of recipients by the secondary institution which those individuals attend. Our awards are targeted at individuals who are in financial need. Therefore, an application made by a secondary institution must be clear as to who the intended beneficiaries are and demonstrate their need for financial assistance in each individual case. Section 1 Applicant Details Please give the details of the individual completing the form here. This may be the intended recipient of the grant. Where an application is being made by a secondary educational institution on behalf of a group of pupils at that school, the applicant for funding will be the organisation and the institution should identify a nominated representative. Section 2 Recipient Details (i) (ii) If your answer is yes, and you are the proposed grant recipient, please go to Section 3(a). If you are not the proposed grant recipient, and you are applying on behalf of others, please complete section 2(b). You must provide details of the number of recipients and their names. Section 3(a) Application details (for an individual) This section is to be completed by an individual applying for funding. Appendix 3 Page 23

You should demonstrate how the proposed funding will benefit your education, specifically the educational merit or value to you of the proposed activity/course to be funded. In order to receive an award you will need to provide details of your current course and educational institution including place of study in addition to start and end date of course. We will need a contact at your place of study, a letter of support of your application from your place of study, and evidence of your enrolment. Please provide very accurate, detailed information about the amount requested and a breakdown of your costs associated with your application. It may be useful to show your income versus expenditure. Please detail previous education, academic and professional qualifications and achievement. You must provide the following evidence in support of your application. You may provide a copy but where the copy is not certified you must be prepared to present the relevant documents in person upon request in order for your application to be considered: (i) Proof of identity e.g. birth certificate, marriage or civil partnership certificate, UK driving licence, UK residence permit, EEC identity card. (ii) Proof of your address e.g. recent gas or electricity bill or a TV licence. (iii) Letter of support of your application from your place of study. (iv) Proof of enrolment e.g. Letter of enrolment. Section 3(b) - Application details (for groups of recipients in secondary education) (i) (ii) (iii) Please give details of how this grant will be used, if you are successful in your application. You may wish to illustrate the gravity of recipients need for assistance by describing the implications if funding is not achieved. This section is also an opportunity to make any further comments regarding the current circumstance of the recipients. In order to receive an award you will need to provide details of the course or activity that the recipients are involved in. 29 individual s case, whether the application is being made on behalf of an individual or a group of individuals. Please list any documentation that you have provided with your application. Evidence should include, as relevant: (i) Proof of current receipt of state benefits such as job seekers allowance, employment and support allowance, income support, council tax benefit, working tax credit and housing benefit. (ii) Details of any charitable or educational grants etc received currently or within the previous two years of this application. (This should include the value of the grant, the purpose of the grant, the period of grant and the name and contact details of the grantor.) (iii) Original documents or certified copies of supporting evidence. Where original documents are provided they will be returned to the applicant as soon as possible. (iv) Where the proposed recipient is in receipt of a bursary or other financial assistance, such as school meals, this would indicate that the pupil s financial circumstances have already been objectively assessed and financial need has been demonstrated. (v) References will be requested to support applications. Section 5 Previous Applications Please provide details of any applications for assistance previously made to the City of London Corporation or one of its charities within the last five years. Individuals benefiting from a grant (whether the application is made by the individual or by another person on their behalf) may not apply for a further grant within five years the grant being awarded.
