5 KEYNOTE SPEAKER: SPENCER A. OVERTON Professor Spencer Overton is the Interim President & CEO of the Joint Center for Political and Economic Studies, one of the nation s leading research institutions on public policy affecting communities of color. He is a nationally recognized expert on voting rights and is currently on sabbatical from his position as a tenured Professor of Law at George Washington University. Overton founded and led the Political Law Studies Initiative at the school, which provides an extensive curriculum, regularly hosts panels and conferences, and provides a neutral venue for government officials, scholars, practitioners, and policy advocates to develop ideas and create bipartisan professional networks. Professor Overton served on President Barack Obama s campaign, transition, and Administration from 2007 to During that time, he was a key leader on the Administration s policy efforts, including as the Principal Deputy Assistant Attorney General of Legal Policy at the Department of Justice. In that position, he participated in daily meetings with the Attorney General and senior Department leadership, and in weekly calls and regular meetings with the White House Domestic Policy Council. He also coordinated with leadership from various agencies outside of the Department of Justice, including the Departments of Defense, Health and Human Services, and Homeland Security. Professor Overton also partnered with White House officials to lead policy efforts on democracy issues, which included the Administration s response to the U.S. Supreme Court s decision in Citizens United v. Federal Election Commission to allow unlimited corporate spending in federal elections, as well as conceptualizing and implementing policies related to the Military and Overseas Voter Empowerment Act, the National Voter Registration Act, and the Voting Rights Act. Before this work, Professor Overton served as a commissioner on the Jimmy Carter-James Baker Commission on Federal Election Reform. He also served on the Commission on Presidential Nomination Timing and Scheduling, where he led the effort to encourage Iowa to restore voting rights to citizens who had completed their prison sentences (in July 2005, 98,000 Iowans had their voting rights restored). He has served on the Board of Advisers for the U.S. Election Assistance Commission, and as a board member of several nonprofit organizations focused on voting rights, including Common Cause, Demos, The Joint Center for Political and Economic Studies, The Center for Responsive Politics, and the American Constitution Society. Professor Overton s academic articles on election law have appeared in several leading law journals, and his book Stealing Democracy: The New Politics of Voter Suppression was published and released by W.W. Norton. Professor Overton is a graduate of both Hampton University and Harvard Law School with honors. He began his legal career as a law clerk to U.S. Court of Appeals Judge Damon J. Keith. 3

The Colorado Lawyers Committee is delighted to honor Geoff Klingsporn, Alex Myers, and Shelley Wittevrongel for their dedication to protecting the rights of voters in Center, Colorado. In early 2013, after a hotly contested recall election in Center, a lawsuit was filed to overturn the election results (Jones v. Samora). In June 2013, the District Court of Saguache County voided the results of the election because voter numbers were not removed from mail ballots before ballot counting began. Even though the Court found no evidence of fraud, undue influence and intentional wrongdoing or that secrecy had actually been compromised, it held that it must void the election because of the potential that the secrecy of ballots had been compromised.) In August 2013, the Colorado Supreme Court agreed to hear the case. These three attorneys filed amicus briefs arguing that the trial court s decision was incorrect: Alex Myers and Shelley Wittevrongel represented two voters from Center; Geoff Klingsporn filed an amicus brief on behalf of the Colorado Lawyers Committee. In January 2014, the Colorado Supreme Court issued a unanimous ruling reversing the trial court s decision and reinstating into office the individuals who had been duly elected in the recall election a success for the voters of Center. The Colorado Lawyers Committee sincerely thanks Geoff Klingsporn, Alex Myers, and Shelley Wittevrongel for their invaluable contributions in helping to protect the integrity of elections, and the will of voters, in Colorado. We are proud to honor you with the Community Contribution Award. 7

Elkind (Elkind Alterman Harston PC) Photo Courtesy of Hartmannphoto, LLC The Board of Directors of the Colorado Lawyers Committee extends its heartfelt thanks to Nancy Elkind for her outstanding leadership as the Chair of the Board of Directors. Nancy served as Chair from September 2011 to August During her tenure, the Lawyers Committee accomplished an impressive amount, including: an extraordinary effort in the school finance (Lobato) litigation including an appeal at the Colorado Supreme Court; two lawsuits were settled--one assuring all mentally ill individuals charged with a crime receive competency evaluations and treatment within a reasonable time period, the other re-establishing access to the Taylor Ranch via the Torcido Creek Road; litigation and advocacy efforts led to the repeal of a law requiring misdemeanor defendants to confer with a prosecutor before legal counsel is appointed; negotiations with Denver County resulted in a complete overhaul of its food stamps processing system, assuring individuals receive their benefits in a timely manner; 1,400 calls were answered at the Nonpartisan Election Day Call Center; the Hate Crimes Education script was completely overhauled; 20 nonprofits received legal audits at the Clinic in a Box event; and more than 6,000 individuals were assisted at Legal Clinics sponsored by the Lawyers Committee. Nancy also was instrumental in our fundraising efforts, helping to double the number of participants in the Chairs Roundtable, our major giving program. We are most grateful to Nancy for her excellent leadership and far-reaching contributions to the organization. Thank you, Nancy, for your remarkable dedication and commitment to our mission! 9

Though Jennifer was only able to serve as Chair from September 2013 to February 2014, an extraordinary amount was accomplished during her term. Highlights include: the creation of three new task forces Housing, Redesigning Education, and Sheepherders Rights; an amicus brief was filed in the Colorado Supreme Court in a case that led to the protection of voters rights in Center, Colorado; a draft complaint was prepared challenging the constitutionality of a recent education funding formula that has cut almost $4 billion from public school financing; 260 homeless people received legal information and referrals at Project Homeless Connect; and 23 volunteers were trained to help individuals appeal denials of Medicaid benefits or Affordable Care Act subsidies. 15 NOMINEE FOR INDIVIDUAL OF THE YEAR Aaron A. Boschee (Patton Boggs LLP) Photo Courtesy of Hartmannphoto, LLC Aaron Boschee joined the Taylor Ranch Litigation team in 2010 and was active from the start, donating an average of 117 hours per year in his first three years. In 2013, Aaron took over as Chair and spent more than 278 hours leading the Lawyers Committee s oldest project. Originally filed in 1981, Lobato v. Taylor involves the right of thousands of property owners to exercise their traditional use rights to graze livestock and collect wood and timber on the property known as La Sierra or the Taylor Ranch, a 77,500 acre parcel of land in the San Luis Valley. The dispute dates to the mid-1800s when Mexican settlers on the Sangre de Cristo Land Grant were promised access to the mountainous regions near their homes for uses necessary to their survival. In 1960, Jack Taylor purchased and fenced off the land, causing enormous disruption to the economic and social fabric of the local communities that had depended on it for over 100 years. The Colorado Lawyers Committee became involved in 1996 and has seen the case through federal court review, two trials and both appeals. In an historic opinion in 2003, the Colorado Supreme Court ruled in favor of the property owners and remanded the case to the Costilla County District Court to identify the landowners with rights to use the property. Since then, approximately 7,500 parcels entitled to access and use La Sierra have been identified. Aaron has demonstrated a remarkable commitment to the rights of the landowners in the San Luis Valley and has skillfully and seamlessly assumed a significant leadership role in this important project, not only representing plaintiff landowners but also coordinating assignments to 35 attorneys from 8 different law firms. 13

17 NOMINEE FOR INDIVIDUAL OF THE YEAR Susan C. Cole (Arnold & Porter LLP) Photo Courtesy of Hartmannphoto, LLC For almost a decade, Susan Cole, a paralegal at Arnold & Porter LLP, has been an essential part and coordinator and administrator extraordinaire of three Colorado Lawyers Committee clinics: two Denver Legal Night clinics and Project Homeless Connect. She has donated an average of 170 hours per year of her time to these clinics. Denver Legal Night began in 2006 as a monthly clinic at Mi Casa Resource Center to provide legal information and referrals to individuals who could not otherwise afford legal services. A year later, the high demand for the clinic led to its expansion to a second location at Centro San Juan Diego. In 2013, 265 volunteers from 90 different organizations assisted 2,168 clients at these clinics; since 2006, more than 18,130 individuals have been served. In addition to this work, Susan has been a significant part of the leadership team of the Project Homeless Connect Task Force since This Task Force coordinates the legal component for Project Homeless Connect, a one-day event sponsored by the City of Denver that typically links over 1,000 homeless individuals in Denver to a variety of services, including public benefits, housing, jobs, and medical care. Task Force volunteers staff a legal triage area, where homeless individuals receive legal information and referrals, as well as a Homeless Court, where outstanding warrants for municipal violations can be resolved before a Denver County Court Judge. Last year alone, 69 volunteers assisted 260 people in the legal triage area and handled 214 cases in Homeless Court. The monumental success of Denver Legal Night and Project Homeless Connect is due in large part to Susan s tireless efforts, contagious enthusiasm, and skilled coordination. 15

19 NOMINEE FOR INDIVIDUAL OF THE YEAR Peter H. Schwartz (Davis Graham & Stubbs LLP) Photo Courtesy of Hartmannphoto, LLC For the last five years, Peter Schwartz has led two important transactional projects for the Lawyers Committee. Peter has chaired the Nonprofit Working Group since its creation in The Task Force operates in partnership with the Colorado Nonprofit Association to provide transactional-type pro bono legal services and representation to small nonprofits whose operating budgets do not permit them to retain legal counsel. Peter evaluates and approves all applications for assistance and communicates with more than 125 volunteer attorneys to match nonprofits with pro bono lawyers. Last year, Peter matched 43 attorneys with 32 nonprofits. In the last five years, more than 200 nonprofits in Colorado have been served no small feat. In addition to this on-going work, Peter is an essential member of the Steering Committee for the annual Clinic in a Box, a one-day event that connects teams of transactional attorneys with small nonprofits to evaluate their legal health. This project is offered in partnership with the Association of Corporation Counsel (Colorado Chapter) and the Pro Bono Institute at Georgetown University Law Center. First offered in 2006, the event has more than doubled in size from 20 to 49 participating lawyers. Last year, more than 20 small nonprofits received legal audits as part of this program. Peter s skillful leadership of the Nonprofit Working Group and his role in coordinating the legal audit program have been essential to the tremendous success of these important efforts. Peter also serves on the Steering Committee of the Project Homeless Connect Task Force and on the Colorado Lawyers Committee Board of Directors and Executive Committee. 17

21 NOMINEE FOR INDIVIDUAL OF THE YEAR Cole A. Wist (Holland & Hart LLP) Photo Courtesy of Hartmannphoto, LLC Cole Wist has participated in three important Colorado Lawyers Committee projects in health care and education. He skillfully led the Medicaid HCBS/SLS Task Force from 2011 to 2013, a team that was created to address the improper reductions and terminations in Medicaid benefits for adults with disabilities participating in the Home and Community Based Services-Supported Living Services waiver program. Under Cole s leadership, the Task Force explored several legal challenges to the State s actions, ultimately drafting a complaint in the matter. Using the leverage of a potential lawsuit, Cole led meetings with State representatives to advocate for the legal rights of these individuals. These combined efforts resulted in several state agencies promulgating new regulations to protect adults with disabilities who receive Medicaid benefits; the State also created an advisory committee to address any lingering issues. Cole s second leadership role has been in education. A member of the Education Task Force since 2007, Cole became a Co-Chair in August Cole was instrumental in the Task Force s early efforts to explore a challenge to the State s education financing: for each of the last four years, the State has cut $1 billion from K-12 schools; the Task Force believes these cuts violate Amendment 23 of the Colorado Constitution which requires annual increases in K-12 funding. Cole serves on the leadership team of the Redesigning Schools Task Force, which is providing legal assistance to the Donnell-Kay Foundation s efforts to design a new public education system. Cole s wisdom and enthusiastic leadership have been important to the success of these Colorado Lawyers Committee efforts. Cole also serves on the Colorado Lawyers Committee Board of Directors and Executive Committee. 19
