Formatted: Font: Cambria AN ORDINANCE AMENDING CHAPTER 169 OF THE NORTH LIBERTY CODE OF ORDINANCES BY AMENDING SECTION TO ESTABLISH NEW SCREENING AND OPEN STORAGE REGULATIONS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH LIBERTY, IOWA: SECTION 1. AMENDMENT. That Section , "Other Design Standards," of the North Liberty Code of Ordinances be and the same is hereby amended by deleting subsection (5) and adopting in lieu thereof Sections (5) and (6) to read as follows: 5. Screening of Commercial Nonresidential Uses and Storage. A green belt planting strip consisting of evergreen shrubs and trees shall be used to screen any commercial nonresidential use, or the permitted open storage of any materials or equipment, from adjoining residential districts or residential uses. Such planting strip shall be of sufficient width and density, as determined by City staff, to provide an effective and aesthetically pleasing screen with shrubs and trees not less than five feet in height when planted. In lieu of planting strips, a six-foot tall solid vertical fence of masonry or heavy wood construction, or other similar material approved by the Building OfficialCity, may be used as a screen, provided that decorative plantings are established on the residential side of the fence. Both a green belt planting strip and a six-foot tall fence may be required at the discretion of the CouncilCity staff. 6. Open storage of Materials and Equipment. Outside storage of materials and equipment is permitted in certain commercial and industrial districts subject to City staff approval of a site plan showing details of the site and the storage area. In those cases, a green belt planting strip consisting of evergreen shrubs and trees shall be used to screen the storage from view from all public ways and all neighboring properties. Such planting strip shall be of sufficient width and density as determined by City staff to provide an effective and aesthetically pleasing screen with trees and shrubs not less than five feet in height when planted. In lieu of planting strips, a six-foot tall solid vertical fence or masonry, heavy wood construction, or other similar material approved by the Building Official may be used as a screen. All such open storage shall be allowed only on hard-surface areas paved to parking lot specifications with asphalt or concrete. Change Outdoor Storage from a conditional use to a permitted use in the following districts: C-1-B; C-2-B; C-2-A; C-1-B; and I-1. Add as a permitted use in I-2. Add the following text to each:, requires City permit. SECTION 2. REPEALER. All Ordinances and parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed.

3 SECTION 3. SEVERABILITY. If any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
