1 The University of Cincinnati reviews drug, alcohol policies Elizabeth DePompei Anchor Every two years, public universities are required to notify students about their drug and alcohol policies. At the University of Cincinnati, those policies are pretty straight forward: don t use illegal drugs, don t drink alcohol if you re underage, and abide by state and federal laws. Students who violate the university s policies set out in the Student Code of Conduct risk facing consequences. But determining those consequences which range from reflection papers to expulsion isn t so cut and dry. This is Elizabeth DePompei reporting from the University of Cincinnati TAPE Estimated time: 7:00 [Bring up TUC ambience] As an urban campus populated with more than 43,000 students, it s no surprise that drugs and alcohol are factors in UC s campus-culture equation. According to a 2013 report conducted by UC s Wellness Center and based on an American College Health Association survey, 76 percent of approximately 800 UC students reported drinking alcohol in the past 30 days. Nearly 29 percent reported using marijuana and more than 23 percent reported using other drugs including cocaine, opiates and smokeless tobacco. [Fade out TUC ambience]
2 UC Wellness Center director Regan Johnson says that information, along with the required biennial review released in January, helps her office assess UC s needs. JOHNSON: The purpose of it is really to see if we have a comprehensive initiative on our campus, so it should always include multiple entities on campus. So, you know, it included things like violations from judicial affairs as well as talking with the university police department, in the residence halls violations, but then also programming is done all around campus. So we do a lot of programming in our office around alcohol but they re doing it in the residence halls, they re doing it in Greek life, you know, so really putting all of that information together and seeing where our gaps are and where we can be doing a better job as well as looking at our policies. You know, being able to complete that report every two years really gives us an opportunity to evaluate where we are as an institution and make some changes based on that. Some of the 14 programs listed in UC s biennial review include online alcohol screenings, residence hall programming, Greek life initiatives and educational workshops. But Johnson says more needs to be done, pointing out that UC s rates of drug and alcohol use are higher than the national average. According to data from the 2013 ACHA reference report a survey that looks at more than 120,000 students at 153 universities UC s rates are roughly 10 percent higher than other colleges.
3 JOHNSON: I would say that some of that is because of the lack of resources that we put into addressing those issues. So, you know, on a lot of campuses there is one person that their role is addressing alcohol and drug issues on campus. We don t necessarily have that. That s one of my roles on campus amongst some other roles. So really putting some more resources and some more effort into addressing those issues I think is important. Johnson adds that, beyond programming, the university needs to enforce its current policies. Daniel Cummins is the assistant dean of students and director of UC s Judicial Affairs. Any time there s an incident involving a student accused of violating the university s drug and alcohol policy, his office receives notice from UC s police department CUMMINS: The reports that come from the police department are critical to the student code of conduct being implemented because that is the first source of information about what had happened. Sometimes it will complement a report that I may get from a residence adviser if it happens on campus. If it happens off campus then that sometimes is the independent report and only report that ill get on a particular incident. So it comes through on a daily basis. During the academic year, Judicial Affairs
4 reported 195 cases involving students illegally using drugs or alcohol. Of those cases, 182 students received probation and educational sanctions things like workshops and parental notification and 12 students were found not responsible. Other possible sanctions include reprimand, suspension and dismissal from the university. But when a student breaks Ohio law a clear violation of the student code of conduct the incident can end with an arrest. CUMMINS: The student code of conduct makes it clear that the process with the university is totally separate and independent of the municipal process. And the reason being is the municipal process; their jurisdiction is talking to the person as a citizen. The university process is talking to the person as a student. So the municipal process can t suspend a student from the University of Cincinnati. The university process can t incarcerate a student. According to UCPD crime logs, arrests for drug and alcohol violations are rare. Between January 1 st and February 11 th, more than 20 cases of drug use or underage drinking on or near campus were reported. Four of those resulted in arrests. UCPD Captain Rodney Chatman says that s because each incident warrants different responses, depending on the circumstances and the responding officer. CHATMAN: Police officers do have some degree of discretion. And I think I can t speak for what each individual incident was but I think an officer who comes across you with a beer is much different than me coming across you with a 12 pack, your behavior s disorderly and you drew attention
5 to us by some other things. The officers are given some degree of discretion with that. Still, we document what s going on and we send it to Dan Cummins so there isn t the free ride so to speak. It s just the egregiousness of what we re dealing with affects the officer s discretion. Zef Vesel is the president of UC s chapter of Students for Sensible Drug Policy. Vesel questions whether sanctions or arrests have any positive effect on a student s behavior. Instead, he says, education, support and harm reduction are most important. VESEL: What I think should happen is that anybody that s caught using illegal substances or underage drinking, that just means that they need support and they need measures taken, education given, understanding of that person and their circumstance. And I think with support there s going to be a lot more harm reduced and their education is going to be benefited, the university is going to be benefitted, the community is going to be benefitted and that arrest does nothing but tarnish their record and probably create resentment towards the university and law enforcement. Vesel adds that UC should adopt a medical amnesty policy, something also suggested in the biennial review. The policy would protect individuals who need to report a medical emergency like alcohol poisoning, even if the person reporting is in violation of the student code of conduct. Other suggestions outlined in the review include developing
