1 NZLS HAWKE S BAY BRANCH NEWSLETTER BREAKING NEWS: Russell Fairbrother appointed as Queens Counsel We are delighted to congratulate Russell Fairbrother on his appointment as QC. To those of us who have known and worked alongside Russell over many years this comes as no surprise. Russell enjoys a well earned reputation for working tirelessly in his clients interests and importantly for unfailing fairness and scrupulous honesty. FROM THE PRESIDENT: It is heartening to learn anecdotally that despite the general economic downturn most if not all legal practices in Hawke s Bay appear to be busy and in good heart. As a profession locally we were very disappointed at the Ministry of Justice announcements concerning Court restructuring. A number of our very senior and much loved Court registrars and staff have lost their jobs or have elected to take early retirement in face of the changes. Elsewhere in this newsletter is an update on staff changes at the Ministry of Justice in Napier and Hastings. On a happier note we have welcomed two new District Court Judges to Hawke s Bay in the last few months. Judge Skellern and Judge Down were appointed late in 2012 to be based in the Hastings District Court. A somewhat belated function to fit in with their busy out of town schedules was held on 24 April in Hastings and was well supported and enjoyed by all in attendance. The branch has continued to support continuing legal education in our area. A seminar to up-skill practitioners and support staff in the use of Excel spreadsheets was held recently with 17 people attending. Although very commonly used the ability to use the program effectively and easily escapes many of us. The seminar was presented by Philip Strang, an NZLS Inspector, and costs were kept low through the generous support of Napier Boys High School who made one of their computer rooms available for the workshop. A presentation has also been arranged for property lawyers and legal executives and is being cohosted by the branch and the Property Law Section of the Society and will combine both a learning opportunity and social occasion. A bar dinner is planned for the middle of the year to honour c o l l e c tivel y the j u d i c i al appointments from our area in the last few years. Judges Courtney, Matheson and Collins have been invited to attend as guests of honour. It is likely that the bar dinner will be either Friday 2 August or Friday 9 August. We think it is important to extend collegiality outside of our profession. To that end we have discussed for some time the possibility of holding a medico legal ball. It is more than Issue 42, May years since the last medico legal ball and it seems time that we had another one. After a false start last year we are hoping that a ball can be arranged for the spring. Early discussions are being had with members of the medical profession. More detail to come. Finally can I remind practitioners of the Annual General Meeting to be held at the River Bar in Clive on Thursday 30 May at 4.00 pm. That will mark the end of my two year stint as President of the Branch. Nominations for all Council positions have now closed and new officers will be elected on that day - see reminder notice attached for nominations received. 2 Arnold Robert (known as Bob) Wallis Hawke s Bay practitioners may or may not be aware that one of their senior colleagues completed 50 years of legal practice on 21 February Bob spent his early days in Masterton and was educated at Wairarapa College [ ] and Victoria University of Wellington, graduating LLB in May He was admitted as a Barrister and Solicitor on 21 February 1963 by Mr Justice Leicester at Wellington on the motion of his then employer Frank O Flynn who later entered parliament and became Minister of Defence in the 1984 Labour Government. Frank employed Bob until December While so employed Frank used Bob as a junior in a murder trial. In January 1965 Bob moved to Wanganui. Since 1 April 1966 Bob was a Partner in the firm that became known as Jack Riddet Tripe, Lawyers, Wanganui. Since 20 January 2003 Bob has been employed by Holderness Mansfield, Lawyers, Hastings as a Consultant. He ceased full time work on 2 December 2010 and continues with the firm on a part time basis. Bob s areas of practice covered urban and rural Conveyancing, estate administration, trusts, Maori Land Law, commercial, preparation of Rules and Constitutions for non-profit organisations. Bob was Secretary ( ) and President ( ) of the Wanganui District Law Society, delegate to New Zealand Law Society ( ). He served on the New Zealand Council with now Justices Lester Chisholm and Judith Potter. He also revised the Wanganui District Law Society Rules, adopted 13 September Former partners of Bob have been Don Rennie and Robert Lyons Barclay Spear [who became Magistrate/District Court Judges], and Sir Roy Jack [who became Speaker of the House and Minister of Justice]. Sir Roy Jack s father was JB Jack who had previously been a Maori Land Court Judge before resigning from the bench to practise law with George Currie that lasted approximately 50 years. The firm had a large Maori client base and that was how Bob became proficient with Maori Land Law. Bob has two sons and one daughter. Son Roger Wallis, is a partner in Chapman Tripp in Auckland. Bob and wife Shirley live in Taradale. Bob is an active member of the Taradale Rotary Club The Council congratulates Bob on attaining this milestone and so joining the other members of the Branch who have reached this important milestone. 3 CENTRALISATION OF PROBATES FROM 4 JUNE 2013 NOTICE TO ALL PRACTITIONERS, LEGAL EXECUTIVES, LAW CLERKS From Tuesday 4 June 2013 the following changes relating to all applications filed under Part 27 of the High Court Rules come into effect: All applications for probate, letters of administration with will annexed and letters of administration on intestacy can only be filed in the registry of the High Court at WELLINGTON. Other registries of the Court throughout the country will not be accepting these types of proceedings after Friday 31 May Therefore, do not send new applications through the mail that will not be received at a court by Friday 31 May. An amendment to Rule of the High Court Rules comes into effect on this date. Forms PR1 to PR9 are also amended by deleting paragraph 4 that relates to the nearest court to where the deceased resided, and in the orders, the place where the Registrar granted the application. A dedicated unit is being set up at the High Court Wellington to deal with this work. Caveats Must be filed in the registry at Wellington. Intitulment on documents The intituling for all new applications will be IN THE HIGH COURT OF NEW ZEALAND WELLINGTON REGISTRY Existing proceedings Applications already filed in registries will remain a file of that court and any further documents that need to be filed as a result of a minute for non-grant are to be filed in that registry. Those files will be dealt with in accordance with existing procedures. Contested proceedings Must be filed in the registry at Wellington. The venue for the hearing of any such proceedings will be determined in the course of case management. 5 Hawke s Bay Lawyers Standards Committee The Hawke s Bay Lawyers Standards Committee continues to meet monthly to consider complaints it receives under the Lawyers and Conveyancers Act For lawyers, subject to any discourse that may have occurred between their client (if indeed that is the complainant) and themselves previously, the first indication they will have that a complaint is made, is when they receive either a telephone call from an officer from the Early Resolution Service (ERS) or a letter from the Legal Standards Officer (Shonagh Matheson) advising them of the complaint. The ERS is an option which consumers can choose when complaining about a lawyer or law firm, instead of going through the more formal complaints process. If a complaint is not accepted by the ERS or a party elects to proceed through the formal process the lawyer will be invited to provide their response in 14 days. If the practitioner is an employee, that letter is required to be copied to the partnership (as is the outcome). The first decision that the Standards Committee has to make is whether or not to inquire into the complaint. This threshold decision takes place at the first meeting after the lawyer s response is received. Once an inquiry is commenced, it is a matter of obtaining the relevant information, and determining how best to progress the complaint. The complaint can be dismissed at that stage (or at any stage) if the circumstances warrant it. Ultimately however, the matter may proceed to a hearing which is almost always on the papers at which stage the complaint will either be upheld (and tariffs imposed), dismissed or referred to the Disciplinary Tribunal. It is possible for a party to seek a review of a standards committee decision by the Legal Complaints Review Officer. Currently, the delays with those decisions being determined are approximately two years. To avoid the risk of further disciplinary consequences, we encourage practitioners to engage with the Standards Committee, and provide information requested in a timely manner. Ingrid Squire Ministry of Justice Publications On 1 April 2013, the Ministry of Justice is moving publication storage providers from Wickliffe Ltd (you may know them as Stocklink) to Marketing Impact. This move is subject to final contract sign-off. The MoJ expects this change to drive innovation and efficiency in the publications service they deliver. How will you be affected? There is no change. 6 Admission Ceremony for Stacey Wood and Nicole Shaw Napier High Court 7 May 2013 Left to Right - Carol Hall, Nicole Shaw, Stacey Wood and Pamela Fairbrother (Stacey s proud mother) Changes to Waipukurau District Court Central Hawke s Bay practitioners will be aware that the services provided by the Ministry of Justice at the Waipukurau District Court have changed to a hearing only Court. This means the Court will only be opened on days when it is needed for hearings. The work of the Court s registry office has been transferred to the Hastings District Court. The Branch Council asks practitioners who have dealings with the Waipukurau Court to let us know if the Court is not being used as promised. If there are examples of the Waipukurau Court not being used for hearing matters involving people living in Waipukurau areas please let Council member Claire Enticott know so that the situation can be monitored to ensure the continuation of Court services in Waipukurau. 7 END OF YEAR FUNCTION 2012 On Friday 7 December 2012 eighty practitioners and their partners attended the New Zealand Law Society -Hawke s Bay Branch End of Year Function at the Hawke s Bay Club. The evening began with a welcome glass of bubbles in the Club foyer. Revellers took this opportunity to catch up with colleagues and friends and the atmosphere was buzzing with conversation and laughter. While a barbeque was advertised for the night, the chef decided on the day to serve a buffet instead. Chef is always right and the buffet food was fabulous! Those who expected a barbeque were not disappointed with the ample buffet and many choices of delicious meal options. Another unexpected and last minute change was with the music. The band became a one-woman singer. On reflection and in light of the welcome comments from attendees who later responded via the evaluation forms, live music is likely something that can be omitted from this year s event. Nevertheless, some of the party-goers did notably visit the dance floor during the evening! Mostly, the night became a very relaxing time to eat, drink, talk and laugh with fellow lawyers and their partners in a very collegial setting. There was much table-swapping as the evening wore on, the wine poured and stories flowed! Council is constantly striving to deliver to members the kinds of social events that members would enjoy. Feedback for this function indicated that it was a good fit for most and that everyone favoured the significant price reduction from End of Year Functions in the past. We continue to welcome your comments and ideas for social activities that would appeal, so please do let us know what you would like to see happen socially with the Law Society in And THANK YOU to the members who made last year s party such a fun night! 8 Staff Changes at MOJ in Napier, Hastings & Waipukurau As a consequence of recent restructuring by the Ministry of Justice there have been a number of staff changes, which are outlined below. Jon Muston, the previous Satellite Court Manager for Hastings resigned from that position in Feb/March Mr Chris Greaney, the Local Courts Manager for Hawkes Bay is now a Service Delivery Manager based out of the Christchurch District Court, holding responsibility for the Ashburton District Court. Messrs Les Silson & Batt O'Rourke, previous Hawkes Bay Case Flow Managers based in Napier have both retired, as at 19th April Mr Mark Summers, Satellite Court Manager Waipukurau is now a Court Registry Officer based in the Hastings District Court, following the closure of the Waipukurau Court and it now being a hearing centre. Mrs Trish Caldwell, previously a Court Reporter with the Hastings office also retired on the 19th April 2013 and Glennis Jamieson of Waipukurau, Court Registry Officer, did not seek any position following the closure of the Waipukurau office. Mr Mick Lander has been appointed, as at 22 April 2013, Service Delivery Manager for the East Coast Hawkes Bay region, looking after the Courts of Gisborne, Napier & Hastings, as well as the hearing Centres of Waipukurau & Ruatoria. Mr Brett Mudgway has been appointed Court Services Manager Criminal & High Court for Napier. There is a vacancy in the Napier office for a further Court Services Manager, Civil & Family, there is hopefully an appointment for this position in the very immediate future. Mr Hau Te Maipi, previously Courts Manager from the Waihi District Court has been acting in this role on a fixed term contract till mid June Mr Ron Garrick has been appointed Court Services Manager Hastings for Civil & Family. Ron was previously a Team Leader at that Court. Mr Greg Millard, ex Courts Manager for the Upper Hutt District Court has taken the role of Court Services Manager Hastings for Criminal. Mr Steve Ebbett, previously a Team Leader for Family Court at Hastings has been appointed in a role as a Court Registry Officer, still in Hastings with the Family team, working with Ron Garrick. Brett Mudgway Court Services Manager High District Court, Napier DDI (06) EBBETT CUP GOLF TOURNAMENT Last year s Ebbett Cup was held on 26 November 2012 at the Hastings Golf Club. There was an even distribution between lawyers and bankers. However, the overall number of 34 continues to disappoint and discussions will need to be held this year about whether another profession is invited to boost numbers and ensure the survival of the tournament. Suggestions on the profession are welcome. The Bridge Pa course was, as always, in lovely condition. The only small complaint would be that the fairways were often not in the correct place and it would have been useful if the greens had more than one hole option. The weather was very hot but that was only a problem if you were silly enough to play from the middle of the fairway. The competition involved teams of 4 with the best 3 stableford scores counting on each hole. As can be seen from the results (in particular second place), this competition is not necessarily about how well you play but rather how well you choose your team. 10 Family Violence Is Everyone s Business Did you know that: Approximately half of all homicides and violent crime in NZ is Family Violence. On average, Police attend around 200 Family Violence incidents every day in NZ - that s 1 every 7 minutes. Napier Police attend 5 Family Violence incidents each day. Police estimate only 18% of Family Violence incidents are reported. The cost of Family Violence to New Zealand was estimated at between $1.2 and $5.8 billion in Businesses were estimated to have lost $2.9 million in lost working days and productivity alone. In today s figures that means family violence costs us all up to $8 billion a year. For employers this cost is evidenced in terms of: Absenteeism Presenteeism Lost productivity Poor morale Higher staff turnover This $ cost does not necessarily acknowledge the other very significant social, familial, emotional, psychological and relationship costs. Employers can play an important part in raising understanding of Family Violence and providing support for employees affected by Family Violence. Positive and informed responses to Family Violence by employers and employees provides significant influence in reducing the costs outlined above. They are designed to help employers and employees understand Family Violence and learn how they can respond effectively to anyone who needs help.
