Contact the Federation E-mai: pfstaff@pf.pofed.org Te: Fax: Chairman s foreword By John Hughes, chairman of Leicestershire Poice Federation It has been a busy few weeks in Poice Federation circes with the pubication of the report into the Poice Federation of Engand and Waes bringing the organisation under intense scrutiny and the Home Secretary putting compusory severance on the back burner for the time being at east. Both of these issues aong with deveopments around the way officers on restricted duties wi be managed - are covered in detai in this edition of Upbeat, but I just wanted to make a few comments on them, and aso to reaffirm my commitment to ensuring that Leicestershire Poice Federation strives to continuay improve the way it operates so that it is efficient, effective and, above a, abe to best serve members interests. Deaing firsty with compusory severance, I think we have to keep sight of the fact that this is sti very much on the Home Secretary s agenda. However, I beieve we shoud ony ever enter into discussions on this with a view to having another members baot on a campaign for fu industria rights. The introduction of compusory severance has the potentia to criticay damage the office of constabe and, as such, ater the unique status we have in society. If that is not preserved, then I, for one, woud find it difficut to understand what sets us apart from other workers and woud want to consider if officers ought to have the same rights and protections as a other empoyees. Tom Winsor s recommendations on the way officers on restricted duties are handed have aso made their way through negotiations, the Poice Arbitration Tribuna and the Home Secretary so wi start to be introduced ater this year. But, as with so many of the other recommendations from the Winsor review, further negotiation is now needed before the fu detais of the impementation can be confirmed. Simiary, we are aso now seeing much deiberation around the contents of the independent review team s report. Leicestershire Poice Federation beieves it is imperative that we press ahead, make the changes recommended and truy transform the Federation. We have written to Leicestershire s MPs to ask to meet them to discuss our views on the review and how the Federation can improve and move forward. We have fuy supported the review process and, indeed, have aready worked cosey with the Force not just to improve the way we work but aso to try to hep the chief officer team make cost-savings. For exampe, we have changed the way we do business and reduced the number of Federation meetings thus reducing Fed reps abstractions from their duties. At the start of March, we wi be moving out of Force Headquarters and into an office in Whetstone that is being eased from the Leicestershire Poice Federation Medica Scheme and the Group Insurance Scheme with whom we wi share the premises. We fee the time is right for the Federation to make this move which wi, of course, free up vauabe office space at Force Headquarters and we are aso using this opportunity to improve the services we offer to members. Our members services awyers, Straw and Pearce, wi aso take office space at the new buiding making it even easier for members to access the ega support services the Loughborough based soicitors offers. The new office is at Suite B, Lancaster House, Grange Business Park, Whetstone, Leicestershire LE8 6EP and we make the move during week commencing 10 March so pease ca in to see us.

3 Home Secretary ratifies PAT ruing Home Secretary Theresa May has ratified the Poice Arbitration Tribuna (PAT) ruing rejecting the introduction of compusory severance for poice officers. But she has said it is a reform that the Government and the poice service shoud continue to consider. The proposa was one of the most controversia eements of the Winsor report and was referred to the PAT when agreement coud not be reached at the Poice Negotiating Board. The PAT ruing, which aso covered a number of other reated recommendations as we as three reating to officers on restricted duties which were accepted by the pane, was announced days before Christmas. But it then had to be referred to the Home Secretary, who is not bound by the arbitration decision. However, Ms May announced on Thursday 13 February that she accepted the PAT ruing. Having considered the tribuna s report thoroughy, I have decided to accept its recommendation on restricted duties and wi impement the reforms it has put forward. I have decided to accept the tribuna s recommendation not to impement measures to introduce compusory severance at this time, her statement expains. However, this remains a reform that I beieve Government and the poice shoud continue to consider. I have written to the Poice Negotiating Board to expain my decision in further detai. The Home Secretary says the reforms buid on changes introduced foowing the Winsor reports as part of a programme to Home Secretary Theresa May. modernise poice pay and conditions so they are fair to both officers and other taxpayers. We remain committed to the review s principes and objectives, in particuar inking pay and skis, and modernising management practices, the statement continues, These wi be important considerations in further discussions in the Poice Negotiating Board and in the reated work that is being taken forward by the Coege of Poicing. The PAT decision Pans to introduce compusory severance for poice officers were rejected by the Poice Arbitration Tribuna (PAT) in a ruing issued days before Christmas. The proposa reated to officers with ess than fu pensionabe service. When agreement was not reached at the Poice Negotiating Board (PNB), the issue was referred to the PAT which met in November and announced its ruing on 20 December Expaining its decision, the tribuna said: In principe, the case for the introduction of such a fundamenta measure, whether used or not, needed to be compeing. In the tribuna s view, this was not the case. The pane continued: Officers were required to accept a number of sacrifices and restrictions in their persona ives and, on occasion, put themseves in harm s way. The knowedge that despite Ian Rennie, genera secretary of the Poice Federation of Engand and Waes. making these sacrifices, an officer coud sti then be subject to compusory severance as part of workforce panning was, in the tribuna s view, detrimenta to the mutuaity of commitment between officers and forces. Ian Rennie, genera secretary of the Poice Federation of Engand and Waes, said: This woud have changed the whoe dynamic of poicing and woud have damaged the independence of British poicing. Of the three Winsor recommendations reating to restricted duties, the two sides of PNB - Staff Side and Officia Side - ony differed in their views on one, Recommendation 39. The view put forward by the Officia Side on the meaning of restricted duty was accepted by the PAT, so now the definition and potentia pay reduction appies to officers unabe to undertake the fu range of duties of a poice officer. Staff Side remains concerned that this coud ead to discrimination for disabed officers. Upbeat March

4 Officers on restricted duties The Home Secretary has made it cear that she wants to see forces change the way they manage officers on restricted duties as soon as possibe. But, as seen with other reforms introduced as a resut of the Winsor review, work wi now need to go into how the changes are impemented. Under Recommendation 38, which has now been accepted, the Poice Reguations 2003 wi need to be amended so they specify the circumstances in which an officer can be paced on restricted duty, the way that the Chief Constabe manages those officers and how they shoud be paid. Meanwhie the part of Recommendation 39 referred to the PAT, now aso accepted, wi see restricted officers ose around 2,900 in their annua saary but to be more precise the ower of eight per cent or 2,922 if after a year on restricted duties their condition is reviewed and they are deemed not to be depoyabe or not capabe of work which requires the office of constabe. The recommendation states that this shoud come into effect from September this year. Under the approved Recommendation 71, what is termed the depoyment component of the poice officer X-factor is set at eight per cent of basic pay for constabes. With other ranks, this is expressed in cash terms, benchmarked at eight per cent of the maximum constabes pay. Under the ruing, restricted now appears to have been defined as the inabiity to be depoyed to front-ine operationa duties. The Officia Side of the Poice Negotiating Board (PNB) assured the PAT that each case woud be deat with on its own merits. A process woud be put in pace to aow an appea to the chief officer though they may deegate authority on this. But it s ess cear who woud consider the merits of each individua case, any possibe reduction in pay and then the review of that reduction. Restrictions caused by an injury sustained whie carrying out duties woud, it appears, be treated differenty. There are severa different views on whether the pay cut coud be considered to be a breach of the Equaity Act 2010 in respect of disabiity. However, the PAT s view seems to be egisation aows a chaenge to be made over any aeged discrimination. The second feature of Recommendation 39 is where officers have been restricted for a tota of two years. This eement was not considered by the PAT and negotiations are continuing. The recommendation says: After a further year, appropriate proceedings shoud be initiated to dismiss or retire these officers from the poice service on the grounds of incapabiity or poor attendance. But it aso states: Those who are not permanenty disabed shoud be given the opportunity to resign as poice officers and immediatey take up a poice staff job on poice staff terms and conditions. But it s not cear whether restricted officers subject to UPP woud be aowed to fufi poice staff roes. And there are aso questions around another section of the recommendation which says: Officers who are permanenty disabed from working as poice officers shoud be i heath retired. There is a difference between permanenty disabed and restricted. Permanenty disabed is a Mac Mis, secretary of Leicestershire Poice Federation ega term so procedures in this area are covered by the reguations in the od and new pension reguations. But restricted is a more temporary state. Since the Winsor report was pubished and the subsequent changes accepted, Leicestershire Poice Federation has been working with the Force on how these changes wi be impemented. We have a good working group in pace currenty which is working on how best we can bring these in whie taking into consideration the potentia chaenges under the Equaity Act, says Mac Mis, secretary of Leicestershire Poice Federation, These rues are very serious indeed and coud affect many of our members in restricted posts. 5 We have got to change says chairman wecoming independent review report The Poice Federation is in need of fundamenta reform to enabe it to improve significanty, according to the findings of the independent review. The 84-page report, pubished on Monday 20 January, makes 36 recommendations for reform set around three key themes: trust, professionaism and unity. The recommendations wi be discussed at May s Poice Federation conference in Bournemouth. The review team s recommendations cover 11 key areas incuding trust and pubic accountabiity, openness and reporting, better communications to members, diversity and equaity and professionaism and standards. More specificay, they incude: The Federation shoud adopt immediatey a revised core purpose which refects the Poice Federation s commitment to act in the pubic interest, with pubic accountabiity, aongside its accountabiity to its members A new Nationa Board shoud repace the Joint Centra Committee A director of equaity and diversity shoud be appointed A new performance and standards agreement wi be drafted, consuted upon, and signed by a reps Rank committees ocay and nationay shoud be removed from the governance and decision-making structure A new professiona means of seecting the genera secretary. The chair wi be eected by the membership Nationa conference to be simmed down in time and numbers There shoud be a 25 per cent reduction in subscription eves for one year in 2015 financed by the reserves of the rank centra commit tees. An extension of this shoud be reviewed for subsequent years. The Federation s nationa chairman Steve Wiiams admitted the report makes uncomfortabe reading and identifies the need for deep cutura change. He says: It shows that the organisation is currenty faiing to perform its roe effectivey and efficienty, is ineffective and uninfuentia, has ost the confidence of its members, and is in need of urgent reform. Its recommendations are far reaching and set out a roadmap of reform. There is no doubt that root and branch change is required. The Federation needs to embrace this chaenge however difficut that may be. Its findings wi be seen by some as controversia and that they undermine the fabric of our organisation. However, I have no doubt that if the Federation fais to deiver the change required, others wi do it to us. The Poice Federation pays a vita roe and it is essentia that we are an effective voice representing front-ine poice officers. But we need to do that with the highest standards and the greatest of integrity. The independent review gives us the opportunity to buid the Federation of the future. An organisation that we can be justy proud of, that has cear purpose and direction, is accountabe and transparent. Ony by achieving this can we once again become the trusted voice for front-ine officers. To read the fu report and our own summary document, visit the Leicestershire Poice Federation website Fed urged to impement review recommendations The chairman of Leicestershire Poice Federation (LPF) has written to the nationa Federation asking for the review recommendations to be taken on board in fu. John Hughes wrote to Steve Wiiams, chair of the Poice Federation of Engand and Waes, to say the Leicestershire Joint Branch Board wanted the recommendations from the independent review to be impemented as soon as possibe. At the end of January, John attended a nationa chairs and secretaries meeting where discussions were dominated by the review. Another meeting date was set for two weeks ater but neither John or LPF secretary Mac Mis were abe to attend. In his etter, which was read out at the meeting, John said: Our Board view is that the independent review shoud be adopted in fu and in accordance with the timeine and ony when the new structure is in pace and up and running can or shoud any amendments to the recommendations be considered, debated and impemented. The review was aunched by the Poice Federation of Engand and Waes in December 2012 and was ed by Sir David Normington. 7 Overview of the review The review was set up by the Poice Federation of Engand and Waes in spring Six peope sat on the independent pane. Their terms of reference asked them to consider Whether any changes are required to any aspect of the Poice Federation s operation or structure in order to ensure that it continues to promote the pubic good as we as meeting its statutory obigation to represent the interests and wefare of its members and the efficiency of the poice service. In particuar, they were asked to ook at how the Federation: acts as a credibe voice for rank and fie poice officers genuiney serves the pubic good as we as its members interests is abe to infuence pubic poicy on crime and poicing in a constructive manner is an exampe of organisationa democracy and effective decision-making at its best aowing genuine ownership of the organisation by poice officers and effective communication between members and the Federation at a eves is recognised as a word cass eader in empoyee voice. In making their recommendations, the pane members were to have regard to: vaue for money, the unique position and responsibiities of the Office of Constabe, the importance of enhancing pubic confidence in poicing, equaity and diversity, and transparency of decision-making and the subsequent action. Change needed for Fed to have a credibe voice The effectiveness of the Federation was questioned widey by both those inside the Federation and out. Reform now or ose contro The Poice Federation woud risk osing contro of its future if it faied to take immediate action to reform, warns the independent review pane. Any deay woud eave the fied open to Pariament, the Government and chief poice officers to take the ead instead. The pane s report aso warns that the process of reform wi require exceptiona eadership and commitment, and makes the appointment of an experienced project director and an impementation team a key recommendation. Review chair Sir David Normington says: We woud ike to see the Federation setting the pace and eading the reform. By doing so it woud show there is a new spirit within the Federation and a commitment to work together to make the Federation fit for the future. The Poice Federation shoud be an essentia body within Engish and Wesh poicing. This reform package wi go a ong way to re-estabishing it as a trusted, professiona and united voice; the trusted voice of front-ine officers. That is something worth striving for. It is what the members most want. It is now for their representatives to work together to deiver it. The pane has proposed a four-phase impe mentation pan to enabe a the main recommendations to be impemented by May Many can be impemented without immediate reguatory change, however, there wi need to be agreement with the Home Office about a timetabe where reguatory change is required. The pane determined that in order for it to have a credibe voice change was urgenty needed. The reason for the Federation is not questioned, with the report stating: It is in the nature of their work, which by definition may invove fine, spit-second judgments, that poice officers get compained about more than most, often unjusty, sometimes not. Poice officers need and greaty vaue an organisation that represents them in individua cases of investigation or discipine; and can give them and their famiies wider support when they are under stress. This absoutey necessary protection means that it is desirabe for membership to be universa given the widespread risks that individua officers face. That is why membership of the Federation is automatic upon enroment. 10 PNB agreement on revised payscaes The Poice Negotiating Board (PNB) has agreed a revised payscae foowing on from the Winsor report recommendations. Detais have been finaised for a revised constabes payscae, a revised sergeants payscae, pay progression, pubic order aowance and casua over-time for speciaist protection officers. Approva is now needed from the Home Secretary, Theresa May. The foowing agreements reached by the PNB have been submitted to Mrs May. Constabes payscae (Recommendation 55) Pay Points 6, 7 and 9 shoud be removed from the existing constabes payscae in Apri 2014, 2015 and 2016 respectivey. This wi aow constabes to move to the maximum more quicky and ensure that the current and new constabes payscaes merge in To prevent eapfrogging, whereby an officer with shorter service is paced on a pay point that coud resut in them reaching the top of the scae before an officer with onger service, impementation wi invove some adjustment to incrementa dates. PNB has agreed the foowing assimiation procedure: Constabes payscae assimiation procedure 1. The constabes payscae of 11 points wi be reduced by three points over three years from Apri When a pay point is removed officers wi not automaticay move to the next highest pay point but wi move instead in ine with their incrementa date. 2. With effect from 1 Apri 2014 Pay Point 6 wi be removed to create a new 10-point payscae. 3. With effect from 1 Apri 2015 Pay Point 7 wi be removed to create a new nine-point scae. 4. With effect from 1 Apri 2016 Pay Point 9 wi be removed to create a new eight-point pay scae, the top point of which wi be reached in seven years. 5. Anomaies wi arise with these changes, whereby some officers wi be overtaken in the pay scaes by other officers recruited up to a year ater, due to the inter-reationship between individuas incrementa dates, the effective dates of pay point remova and the method adopted of accruing reckonabe service from Apri 2014 at the end of the suspension of incrementa progression. 6. To counteract these anomaies, changes to certain officers incrementa dates were agreed, a of which, for ease of reference, are reproduced beow. Officers that continued to progress to Pay Point 3 during the suspension of incrementa progression wi move to Pay Point 4 at 1 Apri Sergeants payscae (Recommendation 56) Pay Point 0 of the current sergeants payscae shoud be removed from Apri 2014 to ensure that sergeants are aways paid more than constabes, consistent with the greater responsibiities of the job. Pay progression (Recommendation 84) PNB has agreed that, (subject to some caveats), pay progression for officers in the Federated ranks shoud be subject to a satisfactory box marking in the annua appraisa. Those officers who receive a box marking of satisfactory contribution or above shoud advance by one pay increment; those who receive an unsatisfactory contribution box marking shoud remain on the same point for a further year. This shoud be introduced for sergeants, inspectors and chief inspectors in 2014/15 and for constabes in 2015/ LPF Medica Scheme

11 The caveats are: In reaching agreement PNB notes that Recommendation 81 of the Winsor fina report deas with the training of ine managers in the efficient and effective use of the PDR system. This recommendation is a matter for the Coege of Poicing. However, the provision of this training, in advance of the introduction of the changes to the pay progression arrangements, wi be critica to the successfu impementation of the new arrangements; Recommendation 82 of the Winsor fina report concerns the use of forced distribution and has been referred to the Coege of Poicing to decide whether it shoud be used within the PDR system. PNB reached agreement on Recommendation 84 on the basis that, shoud forced distribution be introduced to the PDR system, pacing an officer in the bottom 10 per cent of the distribution woud not resut in the automatic denia of incrementa progression; Impementation of the changes to the pay progression arrangements wi be based on a nationa PDR mode deveoped by the Coege of Poicing; that the system operates on an assumption of competence uness there is evidence to the contrary; and that, in the absence of a PDR, progression wi be automatic. The atter point is to ensure that an officer is not penaised as a resut of a faiure by their ine manager to conduct the required PDR; and Any denia of progression wi be based on unsatisfactory performance in reation to the standards required for the roe. Denia of progression wi ony occur if an officer is subject to forma unsatisfactory performance procedures (UPPs) at the time of their appraisa. This is to ensure that a consistent approach and consistent standards are appied to unsatisfactory performance in respect to both UPPs and incrementa progression. Pubic order aowance (Recommendation 101) PNB agreed that Recommendation 101, which concerned the creation of a pubic order aowance when the EPPA was removed, shoud not be introduced. Foowing the Home Secretary s decision to accept the Poice Arbitration Tribuna s recommendation that the EPPA shoud not be impemented, the Board agreed that a arge part of the rationae for the proposed aowance had been removed. Casua over-time speciaist protection officers (Recommendation 103) PNB agreed to reject Recommendation 103. PNB notes that discussions are continuing within the Metropoitan Poice Service and that a timetabe for these discussions has been agreed together with a mechanism for escaating the matter to PNB in the event that oca agreement cannot be reached. Fed concern over job osses Leicestershire Poice Federation chairman John Hughes has expressed concerns at pans to ose another 300 officers and staff over the next three years. The Force has aready ost 260 poice officers and 230 staff over recent years but needs to save around 20 miion by 2016/2017. More than 80 per cent of Force spending is on wages so it s cear that as the chief officer team and the PCC work together to try to manage what seems to be an ever-decreasing budget that they are going to have to reduce that wage bi, says John. They have aready had to work hard to make savings whie attempting not to compromise front-ine poicing but there s ony so far you can go without that being affected. The Force has saved money by seing buidings, reducing the number of poice vehices and through other efficiency measures but it sti has to try to reduce costs further. At the moment we are not sure how many of the 300 jobs that are going to be cut wi be poice officers and how many wi be poice staff. 13 What the Federation does for you About us Leicestershire Poice Federation (LPF) Joint Branch Board is a part of the Poice Federation of Engand and Waes, which is the representative body for constabes, sergeants and the inspecting ranks. The Federation was estabished by the Poice Act 1919 to provide the poice with a means of bringing their views on wefare and the efficiency of the service to the notice of Government and other authorities. It has remained argey unchanged since 1919 athough it is now set for reform foowing the independent review of the Poice Federation carried out in How the Federation is organised There are 43 poice forces in Engand and Waes. Each has a branch of the nationa Poice Federation which negotiates directy with the Chief Constabe and the Poice and Crime Commissioner. A Federation officias, oca and nationa, are currenty eected for three-year terms and are eigibe for re-eection when a term expires A nationa conference is hed each year, usuay in May A branch boards and committees have a reserved seat for a femae officer The chairman, deputy chair, secretary, deputy secretary, treasurer and deputy treasurer of the Joint Branch Board are eected to office by its members. How we serve our members The Federation raises vountary contributions from its members. The funds of the Federation are used mainy to provide services to members. Subject to the discretion of the nationa Joint Centra Committee, free ega and medica advice is provided to enabe members to pursue civi caims for damages for such things as injuries sustained in traffic and other accidents and defamation arising from poice duty and crimina assauts. The funds can aso be used to support officers who are invoved in equa opportunities cases. The Federation provides ega advice to members who are charged with certain crimina offences, arising whoy from the course of their duties. It aso pays for ega support to members facing serious discipinary aegations. It is the member who takes ega action. The Federation simpy provides the financia backing, within the rues of the funds (which are approved by the annua conferences). It is therefore wrong to say that the Federation is suing in an individua case. Nor does the provision of ega assistance from the funds impy that the Federation is backing a member facing a crimina or discipinary charge. A members are treated equay, and the Federation does not take a prior view on the merits of a case, where this is a matter for the courts or the discipinary authority. What does LPF do for you? There have been at east two occasions where officers who were represented by the Federation had ega bis in excess of 30,000. Had they not been in the Federation they woud of had to fund this themseves or coud have potentiay ost their job. In 2013, 44 peope used the divorce surgery provided through LPF for a free initia consutation. 27 peope used the mortgage surgeries provided through LPF during Group Insurance Scheme The Group Insurance Scheme (GIS) provides motor, trave and ife insurance as we as critica iness cover for Leicestershire Poice officers and staff. 15 Fed supports appea for Stew Leicestershire Poice Federation is backing a fund-raising campaign to support PS Stew Sparing. Stew is suffering from Motor Neurone Disease (MND), a degenerative musce wasting condition, and the campaign is aiming to raise the 21,000 needed to adapt his home to make it more suitabe to his needs and those of his famiy. We are working in partnership with the Chief Constabe and the Force to promote this fund-raising effort so that Stew s famiy home can be atered and made as comfortabe as possibe, says Mac Mis, secretary of Leicestershire Poice Federation. Under the current taxation of pensions regime, the annua aowance (AA) currenty stands at 50,000, but from 6 Apri wi be reduced to 40,000. There is no imit on the amount of money that can be saved in a pension scheme, but there is a imit on the amount which receives tax reief each year. The AA is the maximum amount of pension savings an individua can accrue each year that receives tax reief. The ifetime aowance wi aso reduce from 1.5m to 1.25m. The Poice Federation of Engand and Waes is warning that as the annua aowance is being reduced more poice officers wi be iabe for a tax charge. It said: However, we do not consider that arge numbers of the Federated ranks wi be affected by the tax impications of the reduced AA. It is ikey that affected Federated ranks members wi be those who are promoted or experience a simiar significant increase in pensionabe pay, and aso have ong pensionabe service (and therefore have higher pension accrua rates eg, Poice Pension Scheme 1987 members who are doube accruing). In addition, members who are at risk of breaching the AA are abe to ro forward up to three years of unused AA aowance to cover the shortfa. This is a hepfu source of mitigating the AA charge, particuary when it is caused by a one-off event such as a promotion. The statement continued: We woud suggest that members who are promoted or experience a simiar significant increase in pensionabe pay and have ong pensionabe service shoud check their position as they may be iabe for a tax charge. It is anticipated that coeagues in the superintending and chief officer ranks wi be more immediatey affected by the changes to the AA. New guide for pregnant officers The Poice Federation of Engand and Waes has issued a new maternity guide. Femae poice officers do not have exacty the same rights at work as other women empoyees so it is important they get the right information about their entitements. The booket provides genera information on their baby s deveopment, their heath care needs and their rights as a working poice officer. It covers heath and safety issues, maternity eave, maternity pay and returning to work. The maternity guide is avaiabe on our website. Give us your views on pay and morae Poice Federation members are being encouraged to take part in a survey to give their views on pay and morae. The resuts wi be used to as evidence by nationa Federation officias when trying to negotiate with those that make pay decisions.
