Lab equipment needed to conduct future forensic analyses is in the process of being purchased using capital funds. Fiscal Impact of the Proposed Legislation The District s FY 2011 through FY 2014 budget and financial plan includes $7.6 million in total funds that could be used to support DFS. Under the provisions of the proposed legislation, it is estimated that the District would need to allocate $11.9 million to support DFS and its functions. The estimate excludes new funds for an Agency Fiscal Officer OCFO

2 would absorb this cost and for laboratory equipment related to the provisions of new forensic services capital funds could be used to pay for the costs. Given the timeline for implementation, no new funds are required in FY The District must allocate an additional $76,705 in FY 2012, and $4.3 million in the FY 2011 through FY 2014 financial plan period. Of this amount, $1.5 million in personnel and non-personnel costs is associated with providing forensic services currently provided by the federal government. The legislation requires the provision of these services be subject to appropriations. 4 March 14, 2011 The Honorable Phil Mendelson Chairman, Committee on Public Safety and the Judiciary 1350 Pennsylvania Avenue, NW Washington, DC Dear Councilmember Mendelson: The following is in response to your second round of advance questions for the Committee on Public Safety and the Judiciary s oversight hearing on the Consolidated Forensic Laboratory scheduled for March 18, MPD DNA and Trace Unit just received $393,960 to expend over the next two years. We (FVO) are not applying for any other grants currently. See attachment: all staff at our Lorton VA facility (DNA and Trace Evidence) are required to use administrative leave when off site at training, even when local, paid by grant money or free. Also, there was a recent District wide snow day. a) Yes. Two vehicles, neither is a take home vehicle. b) n/a Currently we are on schedule and within budget. Completion expected in May Occupancy will be phased after commissioning of each floor: OCME in first, Public Health Lab second and MPD Crime Lab and Forensic Science Services Division in last. We are planning for complete occupancy by October, 2012.

5 It has not been completed. Completion is expected in Spring DRES is preparing the move plan for a detailed and organized move of each stakeholder. OCME moves in first, PHL second and MPD Crime Lab last. Wings and Southland had no problems at the CFL site. The complaints were generated from workers at other non-dc government sites. Wings and Southland have completed their work on the CFL and are demobilizing. There are change orders from both OCME and MPD which are limited to the office side of the project. The approval of these and their cost is still being evaluated by DRES. See attachment for Crime Lab, OCME has 68 FTE and anticipates 90 at full service, Public Health lab has 26 and needs to double eventually to full service capability. MPD Forensic Biology (DNA / Trace Evidence Unit) is accredited by American Society of Crime laboratory Directors/Laboratory Accreditation Board (ASCLD/LAB) since November 2008 under International standards: ISO MPD Firearms and Latent Fingerprint and are not currently accredited. We are working to gain accreditation for both units within one year of the move in date. OCME has provisional accreditation by National Association of Medical Examiners (NAME).

6 PHL is licensed (or certified) under three sets of requirements: Federal Clinical Laboratory Improvement Amendment of 1988 (CLIA). The Legal Citations are as follows: Public Law & 42 CFR Part 493 Laboratory Requirements. ( Operating License) District of Columbia Rules on Communicable Disease Testing, Title 22 DCMR Chapter 2 (Operating License) CDC Select Agent Program ( Certification required for possession or use of Select Agents): 42 CFR Part 73 Select Agents and Toxins Under Security, there are several specific design and programmatic requirements. Under Biosafety, two additional references are made to documents for guidance or compliance. CDC/NIH publication: Biosafety in Microbiological and Biomedical Laboratories ( BMBL 5 th edition). Occupational Health & Safety Administration (OSHA) 29 CFR and Under Incident Response, there are specific response procedures required of the entity such as protocols for security breaches, workplace violence, bomb threats and emergencies such as severe weather, fire, or power failure.
