2 Presentation For the first time in the three year long ministerial level negotiations on the successor to the current Kyoto Protocol that is up for renewal in 2013, in Cancún in December 2010, all countries have just agreed to reduce Green House Gas (GHG), to comply with external checks on their emissions, and to continue multilateral negotiations under the auspices of the UN. The worst has been avoided, but few concrete decisions have been taken and there is much to be negotiated at the forthcoming G 20 and Climate ministerials. The sheer magnitude of the task still ahead justifies the fears that trade and climate change objectives may be on a collision course. Firms fear that mitigation policies will affect their competitiveness while environmentalists fear that trade ( leakage ) will undercut domestic policies to reduce GHGs emissions. Progress on designing successful mitigation policies hinges on a well functioning World Trading System (WTS). This conference is to inform on how the interaction of trade and climate policies in the WTS will help or hinder the adoption of successful mitigation policies. The format of the one day conference seeks to elicit a lively debate on the steps needed to avoid a collision course between trade policies and the operation of the WTS on the one side, and climate change policies, on the other. Each invited speaker will prepare and present a paper to be discussed at the conference. Main Themes 1. The dual criteria of fairness and efficiency will have to be met in any successful mitigation strategy to reduce Greenhouse Gas Emissions. The possibility that a global carbon credit trading system could be part of the architecture of forthcoming climate agreement is subject to controversies. Even in the case it plays a central role, how can international trade contribute to these objectives in a world where countries are reluctant to acquiesce to subsidiarity on tax matters? 2. Trade has entered successfully in the architecture of the successful Montreal Protocol with trade sanctions playing the role of a participation mechanism. Can this system apply to the broader problem of climate change? Would sectorial Treaties with trade sanctions (transport, energy intensive manufacturing sectors) ease the collective action problem? 3. The pressure to address the leakage problem via border tax adjustments will be great as the price of energy will follow different paths and the gaps in energy prices will remain. Trade wars are a real possibility as the parties involved are major players in international trade (EU, US, China). How can this be avoided? What changes within the current WTO system would help handle the conflict between trade and climate policies at the WTO? 4. A subset of WTO members could form a new international agreement with new principles that could be drawn up for a climate change treaty rather than relying on the current complicated rules governing the use of border adjustment measures to address competitiveness effects. Is this a viable path ahead? The invited speakers will produce a paper to be presented at the conference in which one or several of these (and other trade related) themes will be addressed. These themes will be addressed in the wake of COP 17 taking as a starting point that the outcome of negotiations confirmed that the next climate change accord will be more bottom up than top down. This change of emphasis starting at COP 16 might favor sectorial rather than global approaches (e.g. agreement on halting deforestation) in the design of the architecture for the succession to the current Kyoto Protocol. Logistics and Dissemination The papers will be posted on the conference site and the conveners will write an introduction to the proceedings that will be posted as an e book shortly thereafter. 2/11

3 Présentation Climate Change Policies and the World Trading System: The Challenges Ahead Pour la première fois après trois années de négociations au niveau ministériel sur la succession du Protocole de Kyoto qui doit être renouvelé en 2013, tous les pays se sont mis d accord, à Cancún en décembre 2010, pour réduire les gaz à effet de serre, pour se conformer aux contrôles externes de leurs émissions, et pour poursuivre les négociations multilatérales sous les auspices des Nations unies. Le pire a été évité, mais peu de décisions concrètes ont été prises et beaucoup d éléments restent sur la table des négociations pour les prochaines conférences ministérielles de la Convention Climat ou le G20. L ampleur de la tâche qui les attend est telle qu elle justifie les craintes que les objectifs liés au commerce et au changement climatique n entrent en collision. Les entreprises ont peur que les politiques d atténuation n affectent leur compétitivité alors que les environnementalistes craignent que les échanges commerciaux internationaux ne permettent des «fuites» de carbone et ne freinent ainsi les politiques nationales de réduction des émissions de gaz à effet de serre. Les progrès menant à l élaboration de politiques d atténuation réussies nécessitent une certaine performance du Système Commercial International (SCM). Cette conférence vise à apporter un éclairage sur la façon dont les interactions entre commerce et politiques climatiques dans le SCM vont favoriser ou freiner l adoption de politiques d atténuation efficaces. Dans son format d une journée, cette conférence cherche à générer un débat sur les étapes nécessaires pour éviter la «collision» entre les politiques commerciales et le fonctionnement du SCM d une part, et les politiques climatiques d autre part. Chaque conférencier préparera et présentera un article débattu lors de la conférence. Thèmes principaux 1. Le double critère de justice et d efficience devra être respecté afin que les stratégies d atténuation des émissions de gaz à effet de serre portent leurs fruits. L inclusion d un système global d échanges de créditscarbone dans l architecture d un prochain accord est soumise à controverse. Même dans le cas où un tel système jouerait un rôle central, la question reste de savoir comment le commerce international peutl contribuer à l atteinte de ces objectifs dans un monde où les pays sont réticents à accepter la subsidiarité en matière de taxes et d impôts. 2. Le commerce s est introduit avec succès dans l architecture du Protocole de Montréal, souvent célébré comme une réussite. Les sanctions commerciales y ont joué le rôle de mécanisme d incitation à l adhésion au protocole. Ce système peut il s appliquer au problème plus large du changement climatique? Des traités sectoriels (transport, secteur des industries intensives en énergie) accompagnés de sanctions commerciales faciliteraient ils l action collective? 3. L incitation à traiter le problème des fuites de carbone au moyen de taxes aux frontières risque d être forte, d autant que les prix de l énergie connaîtront des évolutions différenciées selon les différents pays, ce qui devrait faire persister des différentiels importants dans les coûts énergétiques. Les guerres commerciales sont une éventualité à ne pas négliger, puisque les parties impliquées sont des acteurs majeurs du commerce mondial (Union européenne, États Unis, Chine). Comment les éviter? Quels changements au sein du système actuel de l OMC pourraient aider à gérer le conflit entre politiques commerciales et climatiques? 4. Un sous groupe de membres de l OMC pourrait établir un nouvel accord international dont les principes seraient définis pour prendre effet au service d un traité du changement climatique plutôt que basés sur les actuelles règles complexes qui gouvernent les mesures d ajustement aux frontières pour faire face aux problèmes de compétitivité. Est ce un chemin viable pour l avenir? Les conférenciers invités prépareront un article qui sera présenté à la conférence, pendant laquelle seront abordés un ou plusieurs de ces thèmes (ou d autres qui leur sont rattachés). Ces thèmes seront débattus à la veille de la COP 17 en partant du constat que les résultats des négociations ont confirmé l approche bottom up plutôt que top down du prochain accord sur le changement climatique. Cette nouvelle orientation initiée lors de la COP 16 pourrait favoriser une approche plus sectorielle que globale (par exemple, un accord pour mettre fin à la déforestation) dans l élaboration de l architecture d un accord pouvant succéder au Protocole de Kyoto. 6 Speakers Biographies Organizer and Conference co ordinator/ Organisateur et Coordinateur de la conférence Patrick Guillaumont, Président of the Fondation pour les études et recherches sur le développement international (Ferdi), is Professeur émérite at the Université d'auvergne, member of Cerdi (Centre d'études et de recherches sur le développement international), which he founded in 1976, and director of the Revue d'économie du Développement. He is also a member of the European Development Network (EUDN) and Fellow of the Oxford Center for Studies on African Economies (CSAE). Patrick Guillaumont for many years has been a member of the Committee of Development Policy at the United Nations (CDP) where he has chaired from 1997 to 2009 various expert groups on the identification criteria of the LDCs (Least Developed countries). He has also been a member of many advisory international committees and has worked for various international institutions and foreign governments. Patrick Guillaumont has published many books and nearly two hundred papers, mainly on development, in a wide set of economic journals. His recent work is mainly about public development assistance, economic vulnerability and the Least Developed Countries, with his last book Caught in a Trap, Identifying the least developed countries, Present research is focused on aid allocation criteria and the effectiveness of special measures for the LDCs (book in preparation Out of the trap. Supporting the least developed countries). He has been awarded in 1992 the Prix El Fasi de la recherche francophone. Jaime de Melo teaches at the University of Geneva. He is a CEPR fellow, an Associate of CERDI, University of Auvergne, and a senior Fellow at the FERDI. He worked at USAID from 1972 to 1976, taught at Georgetown University from and, between 1980 and 1993, held various positions in the research Department at the World Bank before joining the faculty at the University of Geneva in He has held several editorial positions and was editor in chief of the World Bank Economic Review, His areas of interest include Trade Policies, Migration, the Environment, and Regionalism. Speakers/ Orateurs principaux: Scott Barrett is the Lenfest Earth Institute Professor of Natural Resource Economics at Columbia University. He is also a research fellow with the Beijer Institute (Stockholm), CESifo (Munich), and the Institute of World Economics (Kiel). He was previously a professor at the Johns Hopkins University School of Advanced International Studies in Washington, DC, an associate professor at the London Business School, and a visiting scholar at Yale. His research focuses on institutional remedies to global collective action failures ranging from climate change to polio eradication. He is the author of Environment and Statecraft: The Strategy of Environmental Treaty Making (2003; paperback, 2005) and Why Cooperate? The Incentive to Supply Global Public Goods (2007; paperback, 2010), both published by Oxford University Press. He was awarded the Erik Kempe Prize and the Resources for the Future Dissertation Prize, and received his PhD in economics from the London School of Economics. 6/11

7 Henrik Horn, Professor of International Economics, joined the Institute for International Economic Studies (IIES), Stock holm University, in He became Doctor of Economics at Stockholm School of Economics 1983, Associate Professor at the IIES 1986, and was Full Professor at the IIES from 1994 until his resignation He was Deputy Director at the IIES between 2000 and Since 2006 his main affiliation is with the Research Institute of Industrial Economics (formerly IUI) in Stockholm, where he is Senior Research Fellow. Horn is also Non Resident Senior Fellow at Bruegel, a Brussels based think tank, Chief Reporter (jointly with Petros C. Mavroidis) for the American Law Institute project Legal and Economic Legal and Economic Principles of World Trade Law. Horn is Research Fellow in the International Trade and Industrial Organization Programmes of the Centre for Economic Policy Research, London, and an Editorial Board member of the World Trade Review and Journal of World Trade. Horn has done research in a variety of areas, including International Economics, Industrial Organization, Labor Economics and Economics of Sports. For the last 15 years, Horn's research has focused mainly on issues at the intersection between Economics and Law, and in particular economic and legal aspects of international integration agreements, such as the WTO and the EU, and competition and regulation issues. He is also working in a long term project on the relation between nationally defined environmental policies and the WTO Agreement. Petros C. Mavroidis is Edwin B. Parker professor of law at Columbia Law School and Chris reporter for the American Law Institute project "Principles of international trade: The WTO" Patrick Messerlin is professor of economics at the Institut d'études Politiques de Paris, known as Sciences Po, and the director of the Groupe d'économie Mondiale de Sciences Po (GEM) since its creation in GEM is an independent research unit seeking to improve the performance of French and European public policies in a global world. He has specialized in international trade and trade policy. His current research deals with: (i) WTO issues (from the Doha Round to trade and climate change); (ii) liberalization in services and the associated regulatory reforms; and (iii) EC commercial and enlargement policies. In , he was a special advisor to Mike Moore, WTO Director General. He also served as a member of the Preparatory Conference to the G7 G8 Summits (a group of independent persons gathered by the Peterson Institute for International Economics and the Tokyo Foundation). Since June 2008, he is serving as co chair, with Ernest Zedillo, Director of the Yale Center for the Study of Globalization, of the joint World Bank & UK Department for International Development Task Force on Global Finance and Trade Architecture. He is a member of the Global Trade Council of the World Economic Forum (2009 ) and he is chairman of the steering committee of the European Centre for International Political Economy (ECIPE). After having been a visiting professor at the University of Houston (Texas) and at Simon Fraser University (British Columbia), he has been, from 1986 to 1990, a Senior Economist at the Research Department of the World Bank, and since then, a consultant to various international organizations, governments and firms. 7/11

8 John Whalley is Professor and a Distinguished Fellow at the Centre for International Governance Innovation (CIGI), Waterloo, Ontario. He is also a research associate of NBER (Cambridge, US), joint coordinator of the global economy area for CESifo (Germany) and Professor of Economics at the University of Western Ontario, Canada. He is as well a Fellow of the Econometric Society, a Fellow of the Royal Society of Canada, and a Foreign Fellow of the Russian Academy of Natural Sciences. He is internationally known for his work in several diverse areas of economics. He was a founder of applied general equilibrium analysis in the 1970 s building on his Yale thesis work, and became an expert on WTO issues, development strategies and tax policy. His recent work focuses on China, Russia, and climate change. On a personal level, he is committed to the position that wit and humour lighten life s path. Chairs and Discussants / Présidents de session et Commentateurs: Mireille Chiroleu Assouline is Professor of Economics at Paris School of Economics and the University of Paris 1 Panthéon Sorbonne (Centre d Économie de la Sorbonne). Her current research includes various topics related to Environmental Economics, like environmental regulation and tax policies, corporate environmentalism and product differentiation, green awareness, cooperation between environmental NGOs and firms, mechanism design to induce carbon sequestration by agricultural practices or to reduce deforestation and preserve biodiversity. She has published several papers about the potential double dividend allowed by the recycling of the revenues of the environmental taxes as well as papers dealing with the distributive properties of such taxes. She is the co head of a pluri disciplinary master degree in sustainable development at Paris 1. Pascale Combes Motel is Professor at the Centre d Études et de Recherches sur le Développement International (Cerdi, Center for Studies and Researches on International Development), CERDI CNRS, Clermont Université, at Clermont Ferrand, France. Her research fields relate to agricultural risks economics, macro dynamic modeling, sustainable development, natural resources and environmental economics. She is the co head of a master degree in international development specialized in sustainable development developing and transition economies. Before joining Cerdi, Prof. Combes Motel was Professor at the Université de Grenoble 2 and Maître de Conférences at the Université de Caen Basse Normandie. Doaa Abdel Motaal is Counsellor in the Office of the Director General of the WTO, where she is responsible for a number of subjects, including Doha Round agricultural and environmental negotiations. Prior to joining the Director General's Office, she has worked in the WTO's Trade and Environment Division for 8 years. She was Secretary of the negotiating group on environment that was established in the Doha Round. Ms. Abdel Motaal has a PhD in Development Studies from the University of Geneva, a Master of Philosophy degree in environment and development studies from the University of Cambridge and a Bachelor of Arts degree in economics from Swarthmore College in Pennsylvania. Her doctoral dissertation was the The Role of Science and Risk Assessment in WTO Rules. 8/11

9 Dominique Bureau is currently deputy director of the Economic Council for Sustainable Development, at the Ministry of Ecology, Sustainable Development, Transport and Housing. He is also member of the French Office for Railways Regulation (ARAF), and professor at École Polytechnique, responsible of its chair for Sustainable Development. He had previously been: Economist or head of the economic departments of different ministries; and co author of numerous reports for the government, about carbon taxes, environmental policies, fiscal reforms, agriculture and trade policies; utilities liberalisation Emmanuel Guérin is the coordinator of the energy and climate programme at the French Institute for Sustainable Development and International Relations (IDDRI). The programme covers the international and domestic dimensions of energy and climate policies. It focuses on energy and climate economic modelling and back casting; on the implementation and the interaction of public policy instruments in Europe and big emerging countries; on the support for low carbon technology innovation and diffusion; and on the links between mitigation and trade policies. Emmanuel Guérin leads, on behalf of Climate Strategies, an international network of economists working on climate, a European project gathering several leading research institutions on the strengthening of the European Climate and Energy Package (EU CEP). He is a visiting research fellow at the Grantham Institute of the London School of Economics. His research deals with the international dimension of green growth and focuses on the links between mitigation policies, global imbalances, and public debt. And he teaches the politics and the economics of the environment at Sciences Po Paris. Emmanuel was policy advisor to the Chair of the United Nations Framework Convention on Climate Change (UNFCCC) negotiations for two years, between Bali and Copenhagen. He was therefore personally involved in the international politics of the global deal on climate. He has written a number of publications on the links between mitigation and trade policies, including Chinese renewable energy and technology policies: Legal compatibility with WTO rules & Economic interactions with other countries climate and industrial policies Idées pour le débat N 02/2011. IDDRI, Daniel Gros has been Director of the Centre for European Policy Studies (CEPS) since 2000, President and Vice President of Eurizon Capital Asset Management since 2005, and member of the Supervisory Board of the Central Bank of Iceland since October He holds a Ph.D. in economics from the University of Chicago. In the past Daniel Gros worked at the IMF, collaborated with the European Commission as economic adviser to the Delors Committee that developed plans for the EMU and taught at several universities. He has been member of advisory bodies to the French and Belgian governments and was appointed by the latter to the Lamfalussy Committee on the new global financial architecture. He also provided one to one advice to numerous governments and central banks in Central and Eastern Europe. He is currently adviser to the European Parliament, member of the Stakeholder Group of the European Banking Authority (EBA), member of the Euro 50 Group of eminent economists, as well as editor of Économie Internationale and International Finance. He is the author of several books and numerous articles for scientific journals and newspapers. Vesile Kulaçoglu is Director of the Trade and Environment Division of the World Trade Organization, a position she has held since The Division s main areas of work include the trade and environment negotiations under the Doha Round, the regular work of the WTO Committees on Trade and Environment, and Technical Barriers to Trade. Recently she led the preparation of the forthcoming WTO UNEP report on trade and climate change. Prior to her current responsibilities, Vesile Kulaçoglu worked on a range of WTO subjects including in the capacity as Secretary to several WTO Committees. She has a Masters degree in International Affairs from Columbia University and an Economics degree from the University of Geneva. 9/11

10 Sylvie Lemmet has been appointed in January 2007 Director of the UNEP Division of Technology, Industry and Economics (DTIE), based in Paris. Ms. Lemmet is a graduate of the French École Nationale d Administration and holds a Master s Degree in Public Administration from Harvard University as well as a Master s Degree in Business Administration from l École des Hautes Études Commerciales. She brings to UNEP a wealth of managerial and technical expertise, spanning many years working with the private sector, NGOs, including Médecins Sans Frontières. She brings more than 10 years of expertise in the field of environment, implementing major sustainable development projects in the World Bank and evaluating environmental policies as a Senior Auditor with the French Cour des Comptes. During her tenure, she participated in the audit of the UN. Thierry Mayer is currently professor of economics at Sciences Po. He also is a scientific advisor in CEPII, and a research fellow in the International Trade/Regional Economics programme at CEPR. His research is primarily focused on economic geography, trade theory and empirics as well as on foreign direct investment determinants. His recent publications include research on the impact of globalization on armed conflicts, as well as papers looking at the diffusion of cultural patterns across space. He also published theoretical and empirical analysis of locations choices by multinational firms, studying in particular the extent and determinants of agglomeration patterns. His most frequently cited research includes empirical studies on the level and causes of market fragmentation in the European Union. His research was rewarded by a number of distinctions in France, including the bronze medal of the CNRS. Axel Michaelowa is senior founding partner of the consultancy Perspectives and researcher on international climate policy at the University of Zurich. He has been working on climate policy instruments for the last 17 years and participated in UNFCCC negotiations since COP 1. He is a member of the CDM Executive Board's Registration and Issuance Team and has contributed to the development of six approved CDM baseline methodologies. As expert on national CDM institutions, Axel has supported building of Designated National Authorities in places as diverse as Algeria, Indonesia, Saudi Arabia, Vietnam and Yemen. Axel is a lead author in both the 5th and 4th Assessment Report of the Intergovernmental Panel on Climate Change; he has published over 100 articles, studies and book contributions on the Kyoto Mechanisms. Julia Reinaud (PhD) is Policy and Programs Director at the Institute for Industrial Productivity (IIP, IIP is a non profit organization established by the ClimateWorks Foundation in 2010 to focus on energy efficiency for industries. IIP s role is to give business leaders and policymakers access to effective practices, technologies and tools to advance industrial productivity. IIP serves as a hub for information on global best practices as well as source for direct assistance in key countries such as China and India. Julia was previously an energy and climate policy analyst at the International Energy Agency (IEA), working on climate and energy policy issues in the Energy Efficiency and Climate Change Division. She received her PhD with distinction in Economics and Industrial Organisation at University Paris Dauphine in December /11

11 Francesco Sindico (PhD) started on April 18, 2011 in his new position as Lecturer in International Law with CEPMLP. He brings to the Graduate School of Natural Resources Law, Policy and Management a combined expertise on international climate change and energy law and policy, on the one hand, and on international groundwater law, on the other. Both areas are analysed through the lens of Public International Law. Previously a Lecturer at the School of Law of the University of Surrey, UK, where he also acted as Deputy Director of the Environmental Regulatory Research Group, Francesco holds a PhD in Law from the Universitat Jaume I in Castellon de la Plana, Spain, and an LLM in International Law and International Relations from the Universidad Autonoma of Madrid. His doctoral research focused on the interplay between international climate measures and the law of the World Trade Organisation. Francesco Sindico has also worked on the links between climate change and security and is currently interested in exploring how climate change per se, and the development of the international climate change regime in particular, may pose challenges to the foundations of Public International Law. Francesco Sindico s other main research interest lies in international groundwater law. From 2009 to 2011 he led an EPRSC KT fellowship project in which he focused on the impact of the UN International Law Commission Draft Articles on the law of transboundary aquifers on the management of the Guarani Aquifer System in Latin America. Linked to this project Francesco Sindico has organised two seminars on this topic. The second one will take place in September 2011 in Sao Paulo, Brazil, and is titled The Management of the Guarani Aquifer System: An Example of Cooperation. Both events contribute to the UNESCO ISARM (Internationally Shared Aquifers Resource Management) Initiative. Laurence Tubiana is founder of the Institute for Sustainable Development and International Relations (IDDRI) in Paris. She follows and participates in the international negotiations on climate change, in which IDDRI is highly involved. She is also professor and director of the Sustainable Development Center at Sciences Po Paris. From May 2009 to May 2010, Laurence Tubiana was asked to set up the new direction of Global Publics Goods of the French Ministry of Foreign and European Affairs. She is member of several scientific boards of main research institutions such as the French Agricultural Research Centre for International Development (CIRAD), the India Council for Sustainable Development and the China Council for International Cooperation on Environment and Development. From 1997 to 2002, Laurence Tubiana served as senior advisor to the French Prime Minister, Lionel Jospin, on environmental issues and conducted a number of international negotiations on this subject. She was also member of the French Council of Economic Analysis and research director for the French National Institute for Agricultural Research (INRA). She has been a representative of the European NGOs at the World Bank and directed the French based NGO Solagral. Founder of the journal Le Courrier de la Planète, she published a number of articles and books on environment, development and international issues. Since 2007, she has co directed the publication of the annual review Sustainable Development in Action A Planet for Life. Laurence Tubiana studied at the Institut d Études Politiques de Paris and holds a PhD in economics. Désiré Vencatachellum is director of the Development Research Department at the African Development Bank. Formerly Professor of economics at HEC Montréal, he holds a Ph.D. in Economics (Queen s University, Canada) and a Magistère Ingénieur Économiste (Université d Aix Marseille II, France). He has overseen the production of some of the Bank s flagship publications such as the African Economic Outlook, the African Development Report and Africa Competitiveness Report. More recently, Désiré has led the ex ante assessment of all private sector operations in which the Bank has been approached to participate in. Dimitri Zenghelis is Senior Economic Advisor to Cisco's long term innovation group. Previously, he headed the Stern Review Team at the Office of Climate Change, London, and was a senior economist working with Lord Stern on the Stern Review on Economics of Climate Change, commissioned by the then Chancellor Gordon Brown. He continues to act as an advisor to the UK Government and Lord Stern at the LSE where he is a Senior Visiting Fellow at the Grantham Research Institute. He is an Associate Fellow at the Royal Institute of International Affairs (Chatham House). Dimitri Zenghelis was Head of Economic Forecasting and Head of Macroeconomic Analysis and Projects at HM Treasury from 1999 to /11
