Introduction 1.1 Background At the 1st Steering Committee meeting of 9 September 2010, the representatives of the RENA countries explained that they are already highly involved in the planning process and they need assistance on EU accession negotiation. One of the Copenhagen criteria for accession is the ability to take on the obligations of membership, including adherence to the aims of political, economic and monetary union. To meet this criterion, a candidate country must be in full compliance with EU legislation. After receiving candidate status, negotiations with the EU may be opened. The negotiations on Chapter 27 may take several years. The speed of the negotiation process will be determined by the country capacity to present its position and to make justified requests for transition periods backed by well elaborated evidence Environment is considered a sector which will pose particular problems for the candidate countries in this regard because of the extent of the EU environmental requirements and the need for significant investment in environmental infrastructure in order to achieve compliance The workshop on EU Accession Negotiation Process was developed in close collaboration with the DG Environment. It was also based upon the results of the recently organized sub-regional training on developing National Environmental Approximation Strategies. The lectures have been provided by the selected team of experts and former negotiators from the new Member States ( Romania and Lithuania and representatives of the Ministry of Environmental Protection, Physical Planning and Construction from Croatia who recently closed their negotiation process. Training workshop methodology The main feature of the training was to provide hands on experience and lessons learned from former negotiators on Chapter 27. Main characteristics of this training workshop were : - Well defined modules in line with the countries priorities and overall project design - Interaction between the modules - Customized training programme, aimed to achieve the overall activity objective - Provided materials, guidance and facilitation - Enabled exchange of experiences and best practices - Contacts with EC DG env. Desk Officers Objectives of the Training Workshop: To provide an overview of the EU Accession Negotiation process and strengthen the capacities of the RENA candidate counties and potential candidates. To provide forum for exchange of experience and best practices on the EU accession negotiation process. The training agenda provided: 1

4 - an overview of the training objectives; - main target group of the training ; - expected outcome of the training; - training methods used: PPP presentations, learning materials, references and provision of best practices. 1.2 EU Accession Negotiations According to the EC, the accession negotiations are conducted according to a Negotiating Framework that sets out the method and the guiding principles of the negotiations, in line with the December 2004 European Council conclusions. The substance of negotiations will be conducted in an Intergovernmental Conference with the participation of all Member States on the one hand and the candidate State on the other. In order to ensure progress in the negotiations, the candidate countries will also need to make progress on the ground in meeting the requirements for membership, most importantly the Copenhagen criteria: the stability of institutions guaranteeing democracy, the rule of law, human rights and respect for and protection of minorities; the existence of a functioning market economy and the capacity to cope with competitive pressure and market forces within the Union; the ability to take on the obligations of membership, including adherence to the aims of political, economic and monetary union and the administrative capacity to effectively apply and implement the acquis. Analytical examination (screening) of the acquis forms the first step in the negotiations process. The Commission launches the analytical examination, commonly called screening forms the first phase of accession negotiations. This process which takes around a year allows candidate countries to familiarise themselves with the acquis and the Commission and the Member States to evaluate the degree of preparedness of candidate countries prior to negotiations. Screening is conducted through meetings. There are two kinds of meetings for each chapter: first explanatory meetings with all candidate countries together and then bilateral meetings with each of the countries separately. In the explanatory sessions the Commission explains the acquis to the candidate countries. Approximately one month after the explanatory meeting, a bilateral meeting (country session) is held with each country individually. During that session, it is the candidate country who explains its degree of preparedness and its plans with regard to the chapter in question. The information gathered in these meetings serves as a basis for MS to decide on the opening of accession negotiations on individual chapters. For the purposes of screening and the subsequent negotiations, the acquis is broken down into a number of chapters, each covering a specific policy area. Chapter 27 : ENVIRONMENT EU environment policy aims to promote sustainable development and protect the environment for present and future generations. It is based on preventive action, the polluter pays principle, fighting environmental damage at source, shared responsibility and the integration of environmental protection into other EU policies. The acquis comprises over 200 major legal acts. Compliance with the acquis requires significant investment. A strong and well-equipped administration at national and local level is imperative for the application and enforcement of the environment acqui 2

5 2. The Workshop 2.1 Overview On November, 2011 a regional RENA training workshop on Chapter 27 negotiations was organized at the EC DG Environment, Brussels, Belgium. The training workshop was organised to cover the following three thematic areas, further divided into sub modules: - The enlargement process: main steps and challenges - Negotiations for Chapter 27 - Exchange of experience with Romania, Lithuania and Croatia. Mr. Francois Delcueillerie, provided most comprehensive presentation on the main features of the enlargement process, highlighting the Political criteria, where the applicant country must have achieved stability of its institutions, guaranteeing democracy, the rule of law, human rights and respect for and protection of minorities. Economic criteria: functioning market economy, as well as the capacity to cope with competitive pressure and market forces within the EU. Criteria of the adoption of the acquis : ability to take on the obligations related to the membership (known as the acquis communautaire which consists of 35 chapters), including adherence to the aims of political, economic and monetary union. 3

6 Stabilisation and Association Process (SAP) conditionality:the Western Balkan countries need inter alia to enhance regional cooperation and fully cooperate with the ICTY. The participants have also been informed on the Enlargement Strategy, highlighting the following: - Thessaloniki Agenda ( 2003) o Stated that the future of the WB is in the EU. o SAP will be the main framework of the overall course of the WB towards the EU. o European/Accession Partnerships. o Opening Community programmes to SAP countries. o Enhancing regional cooperation in various sectors. o Perspective of liberalisation of visa regime - Renewed consensus of December 2006 o commitments maintained o conditionality o communication on enlargement o EU s ability to integrate new members - The European perspective confirmed by the EU-Western Balkans high-level meeting in Sarajevo (2 June 2010), General Affairs Council of December 2010 Specific emphasis was put on the benefits of compliance with EU environmental acquis. Ensuring compliance with the acquis requires significant investment, but also brings significant benefits. A strong and well-equipped administration at national and local level is imperative for the application and enforcement of the acquis. - For Chapter 27: o Significant improvement of quality of life o Environment has become a factor of economic growth, employment o Benefits of early action outweigh the costs of implementation of the EU directives Mr.Delcueillerie provided detailed overview of the Negotiations on Chapter 27. With 35 chapters, the accession process is very challenging. The negotiations are the critical phase of the accession process while the environmental acquis are very complex, requiring legal, institutional and financial challenges. Participants have been informed on process of opening negotiations, namely: - Screening report presented to the Council - Action plan in response to the opening benchmark(s) - Benchmark assessment report presented to the Council - Submission of Negotiating position by the country - EU Draft Common Position (including closing benchmarks) - Opening of Chapter for negotiations Negotiators process is based on country negotiating position and the implementation plans. All documents will need to be of good quality providing detailed technical and financial information Request for transition periods are exceptional, limited in time and scope while all potentially problematic issues need to be addressed. The sectoral approach was elaborated: - Horizontal legislation o Cross-cutting dimension o Needs to be fully implemented at the date of accession o Eg: EIA, SEA, access to information o Importance of involvement of stakeholders in the negotiation process 4

7 - Air quality o A few heavy-investment directives: o 94/63/EC (VOC petrol station) o 1999/32/EC (sulfur content of liquid fuels) - Waste management: o Landfill directive 1999/31/EC - Water - WFD (2000/60/EC): RBMP need to be in place at the date of accession - UWWT (91/271/EC) - Drinking water directive:98/83/ec - Industrial emissions o IED directive 2010/75/EU - Nature protection o Natura 2000 network needs to be in place at the date of accession The closing chapter for negotiations will be once an agreement has been reached with the Commission and when all closing benchmarks have been met with assurance that the level of alignment is close to completion. The EU draft closing DCP submitted to the Council followed by provisional closure of the Chapter. Mr. Puskas provided the participants with information on the general context of the negotiations. As former Chief Negotiator for Romania, Mr. Puskas provided well structured information on what is negotiation and negotiation strategies. The EU negotiations are highly institutionalized, permanent, linked and continuous. The character of the negotiating parties, and by extension their roles, are distinctive. The formal negotiation process is closely linked to a prevalence of informal negotiations. EU negotiations are characterized by linkages not only between levels and sectors internally, but also between en internal and external negotiations. Mr. Kondrotas: Lithuania: Negotiations as the stage in the process Lithuanian formal negotiations for chapter Environment took less than 1 year But we are speaking about the time period, which was only 1/8 of the process. Even 1/14, if to consider transitional periods. Preparatory process is very important stage, which will influence negotiations. As well as period after negotiations when implementing your promises Accession Negotiation Process in Romania EU accession negotiations are both multilateral and bilateral negotiations, between the Member States on the one part, and the applicant countries on the other. The accession negotiations are dealing with the adjustment to values, institutional, legal, economic system of EU. Negotiation process has three dimensions: - Political dimension :selection of the strategic objectives and setting the political priorities of the government in the negotiation process; communication of these to the public opinion and to the EU; 5

8 - Policies dimension: special institutions were established such as the Ministry of European Integration and the National Delegation for Negotiating Romania s Accession to the EU (2001), the Executive Committee for European Integration, chaired by the Prime Minister (2002). - Technical dimension: strengthening the administrative capacity in order to implement the acquis. Mr. Puskas:The negotiation system of the EU is unique: EU negotiations are highly institutionalized. EU negotiations are permanent, linked and continuous. The character of the negotiating parties, and by extension their roles, are distinctive. The formal negotiation process is closely linked to a prevalence of informal negotiations. EU negotiations are characterized by linkages not only between levels and sectors internally, but also between internal and external negotiations Both Mr. Kundrotas and Mr. Puskas provided presentations on the institutional challenges for the candidate countries. Information has been provided to the participants on the : - National mechanisms for preparing the negotiations - Institutional aspects - National coordination - Obstacles to the process - Aspects related to staff management The both presentations have provided experiences from Lithuania and Romania, providing useful recommendations for the candidate countries. The following requirements for benchmarking have been highlighted: - Legal transposition should be completed at the latest by accession with the priority given to the framework legislation - Adequate strengthening of the administrative capacity and overall coordination - Directive-specific implementation plans with timetables and milestones need to be prepared, including financing strategies and plans for securing public and private investments into infrastructure and technology - Transitional periods must be accompanied by a plan which clearly defines stages for application of the acquis, and which is based on a resource mobilisation and financing plan indicating the sources of financing and on an overall institutional development plan The presentations provided information on the overall responsibility for Chapter 27, while considering responsibility for each piece of legislation ( i) the MoE is solely responsible for all acquis under Chapter 27 or it provides leadership but other institutions are also involved. In Lithuania, during accession process, two main structures were present in various institutions: - Special EU departments, responsible for all EU related activities. Usually rather big and growing - One or several persons usually placed in the EU, Foreign relations or Policy departments as EU unit, coordinating all EU activities. Real work on transposition and implementation planning was performed by sectoral departments Check LIst General Transposition Administrative structures Transitional period Implementation plans, including costs assessment and financing plan Directive specific Agglomerations Sensitive waters Industrial discharges Lithuanian Ministry of Environment was using second model. 6

9 Mr. Kundrotas and Mr. Puskas exchanged experiences and provided recommendations on how to best prepare for the negotiations for Chapter 27. The presentations covered the following topics: - How to prepare for the accession negotiations - How to negotiate the transitional periods - How to prepare the implementation plans - Involvement of the civil society Transposition is a straightforward process with long tradition in monitoring using Tables of Concordance. Transposition of some Directives is also allowed after negotiations until the date of accession. Screening process will look into all details. Lithuania developed detailed legal gap analysis for all the acquis. It was evaluated that Lithuania will have completed transposition in environmental sector with development and adoption of 29 (44) laws and 192 (312) Governmental and ministerial level decisions. It took 6 years of very intensive drafting, coordination and approval process, until majority of EU requirements, which had to be in place before the accession, became part of Lithuania s national legislation. The MoE had very intensive support for sectoral units with external and local experts while legal department was mainly checking consistency with national law and correspondence to EU law, but not drafting. Transitional Periods It is very important to early identify the transitional periods while detailed planning is mandatory. While negotiating transitional period, it is important to be sure that those are really needed and that there are no means to avoid asking transitional period. There are good guidance from previous enlargements on what kind of information will be required, in particular costs assessment and financing plans. Most of the transitional periods are required because of high implementation costs. IN Lithuania, in nature protection sector it meant very intensive work on the establishment of the required protected areas: when implementing EU requirements on nature protection, there were foreseen to establish 332 areas according to Habitats directive and 87 areas according to Birds directive. Positions can be reformulated after Lithuania Examples for calculating transitional periods Sources of finance: % EU ISPA and bilateral donor grants 10-20% Government grants 0-30% Loans from International financial institutions or private investors 70% of investment funds for water sector projects and 30% for waste management projects additional information received from the EC during negotiations as well as after the Government decision about increase of financing. Ms. Nursen Numanoglu, Deputy Permanent Delegate, Permanent Delegation of Turkey in the EU, presented the experience of Turkey in negotiating chapter 27. In her presentation, she highlighted the challenges of the process and information on the opening benchmarks. Turkey presented to the Commission its comprehensive strategy for the gradual, well coordinated transposition, implementation and enforcement of the acquis in this chapter, including plans for building up the necessary administrative capacity at national, regional and local level and required financial resources with an indication of milestones and timetables. According to Ms. Numanoglu, the negotiating paper need to have strong country ownership. IN Turkey, 26 public institutions actively took part in the preparation of the negotiating paper which has been approved by 13 members of the Cabinet Suggestions while recommendations of all relevant sectoral organisations & NGOs were considered. 7

10 The following main challenges of the negotiating framework have been highlighted: Significant number of legislation to be transposed Priority of alignment of horizontal and framework directives (particularly Customs Union related legislation) Very detailed and related with each other Ratification of international conventions to which the EC is a party Determination of fields for which transition periods are required Impact assessment Implementation plan Only for parameters/plants Significant investment requirement for effective implementation Heavy cost Need for effective financial resource management Strengthening of administrative capacity At the central and local level Particular attention to inspection 2.3 Training workshop modules 24 November,, 2011 The second day of training started with the topics on practical aspects of the accession negotiations including preparation of position paper and implementation plans. The sessions provided hands on experience from Lithuania, Romania and Croatia. Candidate Countries are required to prepare Directive Specific Implementation and Financing Plans for all directives for which they are seeking transition periods in their accession negotiations. Where supporting a transition bid, the plan will need to present a defensible case for the additional time period for implementation Candidate Countries will develop their own structures for Directive Specific Implementation and Financing Plans Lithuania First National Negotiation Position for environment was relatively short 17 pages.after the EU opinion was presented in the Common Position, Lithuania submitted addendum to the Negotiation Position more than 500 pages After technical consultations Lithuania submitted additional information 36 pages Lithuania: Detailed implementation gap analysis was done for all acquis.during the pre-accession period there were 18 programmes developed, including: Strategy for Approximation of Lithuania s Legislation in the Environmental Sector with EU Requirements Report on Approximation Costs National Programme for the Adoption of the Acquis Outline of the National Waste Management Strategy and the Action Plan National Hazardous Waste Management Programme and the Action Plan Programme for Approximation and Implementation of the EU Water Quality Legislation in Lithuania Municipal Waste Recycling Strategy Plan Strategic Plan for the Future Network of Landfills In Lithuania, most of transitional periods were required because of high implementation costs.in nature protection sector it meant very intensive work on the establishment of the required protected areas: when implementing EU requirements on nature protection, there were foreseen to establish 332 areas according to Habitats directive and 87 areas according to Birds directive. 11 Ms.Mira Medic, Director for EU in the Croatian Ministry for Environment, Construction and Physical Planning, presented the recent Croatian experience in Chapter 27 Negotiations. The Croatian overall negotiation structure consisted of : State Delegation of the Republic of Croatia (Foreign Minister, Chief Negotiator, their deputies, Head of Cro Mission to EU, Secretary of Negotiating Team) Coordinating Committee on Accession (Head of State Delegation, Chief Negotiator, other ministers..) Negotiating Team for the Accession (Chief Negotiator, deputies, members of the NT in charge of individual chapters, Head of Mission, Secretary of NT) Working Groups for the Preparation of Negotiations (WG Negotiator, Head of WG, heads of sub-groups, members) Office of the Chief Negotiator Secretariat of the Negotiating Team Ms. Medic, informed the participants on the scope of the Technical consultations in the period (5 meetings for Chapter 27, additional 3 for Air quality, 2 for Water quality and 1 for Nature protection). Peer missions organised in 2009( 6-8 May for EIA, SEA, Water and Nature protection and June for Waste sector, Climate change and Air quality ).Reporting was done through the SAA framework (SAA Council, Subcommittee on Environment, etc.). The working group Initially ( ) had 35 members while at end (2010) 108 member consisted of Line Ministries, State administrative organizations, Institutes, Agencies, Croatian Economy (Chamber of Commerce), NGOs and various experts. The Ministry of Environment, Construction and Physical Planning was officially designated as the Chapter Coordinator while the Department for EU had main coordinating role for the entire Chapter. Ms. Medic presented the content and structure of the documents and opening benchmarks : Non Paper and Screening lists (for screening) Action Plan for setting up necessary admin capacities at national, regional and local level and required financial resources for implementing the environmental acquis (opening benchmark) Negotiating position, Addendum to NP Report on fulfilment of obligations Implementations plans (for transitional periods) Croatia : Implementation Plans/Transitonal Perionds Directive 2008/1/EC IPPC Directive 1999/31/EC Landfill of Waste Directives 91/271/EEC and 98/83/EC Water Directive 1999/13/EC VOC solvents Directives 98/70/EC amending Directive 93/12/EEC and 2003/17/EC FUELS Directive 2001/80/EC LCP Directive 94/63/EC VOC terminals Closing benchmarks for Croatia were: adoption of legislation aimed at transposing the acquis in the field of water quality, (new Water Act and the new Water Management Financing Act, implementing legislation) adoption of legislation aimed at transposing the acquis in the field of industrial pollution control and risk management alignment with the acquis in the remaining sectors capacity building at all levels, improve coordination of work 9

12 Croatia: Lessons Lernt/Recommendations Knowing and understanding the acquis is fundamental (it takes time ) Information on the environment sector in your own country make sure you have it Well substantiated arguments, especially financial ones, are most important Make use of the EC and its services to get clarifications, including through TAIEX Strong internal coordinating mechanism is necessary. 2.4 Workshop conclusions The participants gained knowledge on the elements of the EU Accession Negotiation Process /Chapter 27- Environment.. The training enabled the participants to have greater understanding and knowledge on : The key legal issues related to the EU Accession Negotiation Process. The EU and national accession negotiation structure. The tasks needed to be fulfilled by the candidate countries and how to plan when full compliance with EU environmental acquis can be achieved. Implementation Plans and Transitional periods as one of the key elements of the negotiation process. The workshop concluded that the next trainings should be focusing on Simulating Negotiations, to be organized in the week 4 th June, Evaluation of the meeting The evaluation is based on the analysis of the evaluation forms filled out by the training participants. Evaluation forms were supplied to participants to evaluate scope and quality of lectures, workshops, and site visits, as well as to assess the overall organization and logistics of the course. All participants at the workshop provided evaluation forms, thus presenting highly reliable results. Participants were asked to evaluate each lectures/workshops according to the following four categories: Overall quality of the lecture Relevance of the topic Teaching ability Usefulness of the lecture/workshop Each of these categories was rated in a scale from 1 to 10 and it is to be understood as follows: 10 = Excellent/Ideal, 5 = Satisfactory, 1 = Poor/Very Low Moreover, the participants had the possibility to answer an open question suggesting whether the lecture/workshop should be repeated in the future and/or comments on what did not work and can be improved. 10
