3 Platinum Rewards Credit Card Agreement Dear Cardholder: Your new Card has been ordered. The Terms governing the use of this account are printed within this form. These Terms may be amended or supplemented by separate notices to you, including notices you have previously received from us. The Disclosures required by federal law are set forth below. Keep these forms so you can refer to them if you have any questions regarding your account. DISCLOSURES REQUIRED BY FEDERAL LAW 1. FINANCE CHARGES A. The minimum payment required is the New Balance shown on your statement if the amount is equal to or less than $ B. If the New Balance exceeds $25.00 the minimum payment is 1.50% of that portion of the New Balance which does not exceed your credit limit (rounded up to the nearest dollar), or $5.00, whichever is greater, plus the entire portion of the New Balance in excess of your credit limit, plus any amount past due. 4. LATE CHARGES If the minimum required payment is not received within 10 days after the due date, a late charge of up to $35.00 will be incurred. 5. DOCUMENTARY STAMP TAXES Documentary stamp taxes as may be required by law shall be imposed on each Cash Advance at the time the loan is made. 6. COLLATERAL Platinum Rewards If you have other loans or credit extensions from Penn State Federal, or take out other loans or credit extensions with Penn State Federal in the future, collateral securing those loans or credit extensions will also secure your obligations under this agreement. However, unless you expressly agree otherwise your household goods and dwellings will not secure your obligations under this agreement even if Penn State Federal has, or later acquires, a security interest in the household goods or a mortgage on the dwelling. If you have executed a written agreement granting a security interest in any deposit accounts (checking, savings, or share accounts) or other funds held by Penn State Federal to secure your obligations under this credit card plan, such accounts and/or funds are additional security for your obligations to Penn State Federal arising from the use of your Card. Share Secured Platinum Rewards A Share Secured Visa credit card looks and functions just like a standard Visa credit card. Members must have on deposit, in a savings account, an amount equal to or greater than the credit card limit, to serve as security for the card. The money on deposit earns interest, but must remain in the account while you have the card. Home Equity Platinum Rewards A Home Equity Line of Credit is a form of revolving credit, in which your home serves as collateral. A credit limit will be established which means the maximum amount you can borrow at any one time while you have the credit card. 7. CHANGES IN TERMS The Credit Union can change the terms of this Agreement, including the Annual percentage Rate, by giving you written notice 45 days prior to the effective date of the change. If you do not want the changes to apply to your credit card account, you must notify us by phone or mail by the date of the change stating your nonacceptance of the terms and indicating your name, address and account number. Mail it to Penn State Federal, 1937 N. Atherton St., State College, PA If you notify us, your credit card will be cancelled, but you will continue to pay off the balance under the old terms. If you do not notify us or if you continue to use your card, the new terms, or new Annual Percentage Rate (APR) will apply to the balance of your loan. Your notice of termination will not affect any unprocessed transactions that occurred prior to your written notice of termination, for which you will be obligated. You grant us a security interest in all individual and joint share and/or deposit accounts you have with us now and in the future to secure your credit card account (with the exception of an authorized user). When you are in default, you authorize us to apply the balance in these accounts to any amounts due. Shares and deposits in an Individual Retirement Account, and any other account that would lose special tax treatment under state and federal law if given as security are not subject to the security interest you have given in your shares and deposits. 8. PERIODIC FINANCE CHARGE CALCULATION METHOD ATM Finance Charge. A transaction fee may be imposed by an ATM operator, not holding your account, or by any national, regional or local network used to complete a Cash Advance transaction. Finance Charges on Cash Advances: The finance charge on your cash advances are computed by applying the periodic rate to the average daily balance of your cash advances. To get the average daily balance, we take the beginning cash advance balance each day (not including any unpaid finance charges), add any new advances made that day, and subtract any payments or credits received that day. This gives us the daily balance. Then, we add up all the daily balances for the billing cycle and divide the total by the number of days in the billing cycle. This gives us the average daily balance. Finance charges begin to accrue on cash advances on the day of the advance. Finance Charges on Credit Purchases: The finance charge on your credit purchases are computed by applying the periodic rate to the average daily balance of credit purchases. To get the average daily balance, we take the beginning credit purchase balance each day (not including any unpaid finance charges), add any new credit purchases posted that day, and subtract any payments or credits received that day. This gives us the daily balance. Then, we add up all the daily balances for the billing cycle and divide the total by the number of days in the billing cycle. This gives us the average daily balance. Finance charges begin to accrue on the day a credit purchase is posted to your account, unless you take advantage of the grace period mentioned next. Grace Period for Full Payment: If you pay the entire purchase balance from your last cycle s statement on or before the payment due date, then, during the billing cycle of full payment, no finance charge will accrue on the credit purchase balance from the previous cycle nor on any new credit purchases in the current cycle. Cash Advance Average Daily Balance Method (including current transactions). To avoid incurring an additional Finance Charge on the beginning balance of cash advances reflected on your monthly statement, you must pay the Beginning Balance shown on your monthly statement on or before the Payment Due Date. No grace period is provided for current cycle transactions. The Finance Charges for a billing cycle are computed by applying the monthly Periodic Rate to the average daily balance of cash advances. To get the average daily balance, we take the beginning balance of your account each day, add any new purchases or cash advances, and subtract any payments, credits, non-accruing fees, and unpaid finance charges. This gives us the daily balance. Then we add up all the daily balances for the billing cycle and divide the total by the number of days in the billing cycle. Credit Purchases of Goods and Services Average Daily Balance (including current transactions). To avoid incurring an additional Finance Charges on the balance of the purchases reflected on your monthly statement and on any new purchases appearing on your next monthly statement, you must pay the New Balance, shown on your monthly statement, on or before the Payment Due Date. The grace period for the New Balance of purchases extends to the Payment Due Date. The Finance Charges for a billing cycle are computed by applying the monthly Periodic Rate to the average daily balance of purchases. To get the average daily balance, we take the beginning balance of your account each day, add any new purchases or cash advances, and subtract any payments, credits, non-accruing fees, and unpaid finance charges. This gives us the daily balance. Then we add up all the daily balances for the billing cycle and divide the total by the number of days in the billing cycle. 9. TERMS GOVERNING THE USE OF YOUR CARD The person (Cardholder) whose name is embossed on the face of the VISA (Card) to be delivered and each Cardholder agrees with Penn State Federal Credit Union as follows: A. Goods and services, (Credit Purchases) may be purchases or leased by means of such card by Cardholder from any retail Business establishment (seller) who honors same upon the execution of a sales slip evidencing such Credit Purchases and bearing the account number of Cardholder embossed on the face of such Card. Additionally, Visa Cash Advances (loans) may be obtained through use of such Card (a) upon execution of a written request of Cardholder in a form furnished to Cardholder from any financial institution that is a member, alone or in association with others, of VISA U.S.A. Inc. and (b) upon execution of a written separate agreement with issuer for a VISA overdraft financing agreement if offered by issuer. B. Cardholder shall be liable and agrees to pay Penn State Federal for Credit Purchases made by, or for Loans extended to Cardholder or anyone else using such card unless use of such Card is by a person other than the Cardholder (a) who does not have actual, implied or apparent authority for such use, and (b) from which Cardholder receives no benefit. Additionally, Cardholder shall be jointly severally liable and agrees to pay for all Credit Purchases and Loans obtained through use of any other Card bearing Cardholders account number that has been issued to another person by reason of such person being a member of Cardholder s family, or otherwise issued upon Cardholder s request (all such cards bearing the Visa account number here and after collectively called (Related Cards). C. Each Card is the property of Penn State Federal, is not transferable and must be surrendered upon demand. It can be canceled as well as repossessed by Penn State Federal or designee, and the privileges thereof revoked, at any time without prior notice. D. Cardholder shall not use the Card or permit the use of Related Cards to obtain Credit Purchases or Loans, which will increase Cardholder s indebtedness to Penn State Federal to any amount in excess of a limit established by Penn State Federal. E. All Credit Purchases and Loans are effected at the option of the Seller and Cash Advancing Financial Institution respectively, and Penn State Federal shall not be responsible for refusal by any Seller or Cash Advancing Financial Institution to honor the Card or any Related Card. Any refund, adjustment or credit allowed by Seller shall not be cash but rather by a credit advice to Penn State Federal which shall be shown as a Credit on Cardholders account statement with Penn State Federal. F. Penn State Federal will send to Cardholder, at monthly intervals determined by Penn State Federal, a statement reflecting for the prior monthly period all Visa Card and Related Card transactions. Such statements shall be deemed correct and accepted by Cardholder and all holders of Related Cards unless Penn State Federal is notified to the contrary in writing within 60 days of mailing of such statement. Cardholder will pay such statement by remitting to Penn State Federal within 25 days of the closing date reflected on the statement either the full amount billed or, at Cardholders option, an installment equal to at least the required minimum payment stated in Section 3. G. Interest on Loans and Credit Purchases will be charged in accordance with the finance charge calculation method referred to in Section 1 of the disclosure. The rate of interest shall be established by Penn State Federal from time to time, but shall never exceed the maximum rate permitted by law. The current interest rate per annum is the Annual Percentage Rate set forth in Section 1 of the Disclosures. H. If the Card is canceled or surrender is demanded by Penn State Federal, or if

4 Cardholder defaults in any payment due, or is deceased, bankrupt or insolvent, or any attachment or garnishment proceedings are initiated against Cardholder or his property, Penn State Federal may elect to declare all amounts then owed to Penn State Federal to be immediately due and payable without notice or demand any kind. Cardholder agrees to pay all costs incurred by Penn State Federal in collecting Cardholder s indebtedness or in enforcing this agreement, including reasonable attorney s fees and also those costs, expenses and attorney s fees incurred in appellate, bankruptcy and post-judgments proceedings, except to the extent such costs, fees or expenses are prohibited by law. I. This agreement may be amended from time to time by Penn State Federal by written notice mailed to Cardholder at Cardholder s last known address. J. Except to the extent that Federal Law is applicable, the validity, construction and enforcement of this agreement in all matters arising out of the issuance and use of the Card shall be governed by the laws of Pennsylvania, where the principal office of Penn State Federal is located. K. Additional charges, plus applicable taxes, may also be accessed if you pay us with a check not-honored by your financial institution, request a copy of a document, request a replacement card or use your card for a transaction at an automated teller machine, if such charges are not prohibited by law or regulation. No Finance Charge will be assessed on such additional charges. L. Cardholder may be liable for the unauthorized use of the Card or Related Cards as provided in this paragraph. The Cardholder will not be liable for any unauthorized use that occurs after the Penn State Federal is notified, orally or in writing at: CASH BACK REWARDS TIER on Purchases: $0.00 to $5,000.25% cash back $5, to $10,000.50% cash back $10, and Above 1.00% cash back Cash Back Rewards will be posted automatically to the open share account on December 31. The Platinum Visa Rewards Credit Card must be in good standing to receive Cash Back Rewards. Good standing means the account is not past due, over limit, fraudulent, restricted or in a bankruptcy settlement. Atherton St. Fax: (814) State College, PA If Cardholder has a consumer account or a business account for which less than 10 cards have been issued, Cardholder s liability for unauthorized use of a Card will not exceed $ If 10 or more cards are issued to employees of a single business or other organization, there is no limit to Cardholder s liability for any unauthorized use that occurs before Cardholder notifies Penn State Federal provided herein: the business organization may only impose liability on its employees for unauthorized use of a Card as authorized by federal law and regulation. M. Cardholder agrees that Penn State Federal, its agent or service companies may monitor and/or record telephone communications with Cardholder. N. Payments must be made to Penn State Federal in U.S. dollars drawn on a U.S. Financial Institution. If Cardholder incurs charges in any other currency, the charges will be converted into U.S. dollars. The conversion may occur after the transaction date and the conversion rate may differ from the rate of exchange in effect at the time of the transaction. Cardholder agrees to pay the converted amount to Penn State Federal in U.S. dollars, plus any charge for conversion or processing that may be imposed. O. Penn State Federal shall have sole discretion in how payments are applied to Cardholder s Account. Penn State Federal may accept checks marked Payment in Full or with words of similar effect without losing any of Penn State Federal s rights to collect the full balance of Cardholder s account. P. Penn State Federal can reinvestigate and reevaluate any information Cardholder provided on Cardholder s application at any time, and in the course of doing so, Penn State Federal may ask Cardholder for additional information, request credit bureau reports, and or otherwise verify Cardholder s current standing. Q. Cardholder agrees that Penn State Federal may release information to others, such as credit bureaus, regarding the status and history of Cardholder s account. However, Penn State Federal is not obligated to release any such information to anyone unless Penn State Federal is required by law to do so. R. Cardholder agrees that Cardholder s account shall be subject to all applicable rules and regulation of VISA USA Inc., as applicable, as well as all applicable laws. If there is any conflict between the provisions of this agreement and the rules and regulations of VISA USA Inc. the rules and regulations of VISA USA Inc. shall control. 6 PROGRAM CONTRACT (continued) DEFINITIONS ACCIDENTAL INJURY means an occurrence that is unforeseen, unexpected, involuntary and due to an external cause. ADMINISTRATOR means CUNA Mutual Insurance Agency, Inc., 5910 Mineral Point Road, Madison, Wisconsin ADVANCE means each extension of credit we provide to you under a loan. BORROWER means a person who is obligated to repay the advance to us, either principally or jointly and severally. It does not include guarantors. DAILY PAYMENT means the protected periodic payment converted to an equivalent amount per day. EFFECTIVE DATE OF PROTECTION means the later of the date you enrolled in a program option, the date your protection under the program is reinstated, or the date of the advance. FULL TIME EMPLOYMENT or EMPLOYED FULL TIME means actively working for income 25 hours or more per week. LOAN means a loan identified on this contract as a covered loan. NON-PROTECTED ADVANCE means any advance not protected according to the Non-Protected Events section of this contract. PROTECTED BALANCE means the pay-off amount owed under the loan on the first day of a protected event less any non-protected advances. PROTECTED PERIODIC PAYMENT means the minimum payment amount, including principal, interest, and the program fee, due on the protected balance. It does not include any other fee or insurance amount not included in the protected balance, scheduled balloon payment, escrow amounts, the amount of any minimum payment that represents past due payments, or amounts that exceed any credit limit for the loan. For balloon loans, the protected periodic payment will be determined using the minimum payment amount due for the period immediately preceding the scheduled balloon payment. For variable rate and/or variable payment loans, the protected periodic payment will remain equal to the protected periodic payment as of the first day of the protected event. WE, US, OUR means the Lender named on the loan and this contract. GENERAL PROVISIONS PROOF OF A PROTECTED EVENT. You must notify us or our administrator when a protected event occurs. Claim forms and written evidence may be required periodically to show that conditions of the program are satisfied. If you do not report a claim or provide initial or continued proof within one year of the date requested, we will not accept (or continue to accept) your claim. PAST EVENTS. The program does not protect you from events that occurred before your enrollment in the program. If you enroll in the program as a single borrower and add a joint borrower at a later date, the joint borrower will be considered to have enrolled in the program on the date of becoming a joint borrower. TAX IMPLICATIONS. You may be subject to federal, state, and local taxes on the amount of a canceled or postponed debt. You should consult your tax advisor. Neither we, nor our administrator, are able to provide you with tax guidance. PROGRAM FEE. The program fee is the amount you pay for protection under the program. The rate used to determine the program fee is subject to change. You will receive notice before any increase goes into effect. The program fee will be added to the outstanding balance each month. CHANGING THE TERMS OF THIS CONTRACT. We have the right to change (including the addition or deletion of) the terms of this contract and apply those changes to the outstanding balance. You will receive notice before any change goes into effect. Your continued payment of the program fee will constitute your acceptance of the change in terms. You have the right to cancel this contract at any time. CHANGING BETWEEN OPTIONS. If you change from one program option (the "prior program option") to a different program option (the "current program option"), and an event occurs that does not qualify for protection under the current program option because of the new effective date of protection, we will recognize the continuous time protected for a specific event under both program options. However, the level of protection available will be the lesser of: the protection that would be provided under the current program option if the effective date of protection was adjusted to be the same as the effective date of protection under the prior program option; or the protection that would have been provided under the prior program option if it had remained in effect. TERMINATION OF THE PROGRAM. You may terminate this program contract at any time by providing us with written notice at least 5 business days prior to the requested termination date. If you do so within 30 days of enrolling in the program, we will credit the outstanding balance for any fees charged for the program. Your protection under the program will automatically terminate: when any portion of any payment of the loan is past due for 90 days or more. If you bring your loan current, your protection under the program will be reinstated automatically. when you fail to pay the program fee. for any other reason if we give you written notice at least 30 days in advance of the termination (or as required by law). Termination will not affect benefits for a protected event that occurred prior to the termination date as long as an outstanding balance remains on the loan. ERRORS AND ADJUSTMENTS. If we cancel or postpone more or less than we should have according to the terms of this contract, we will adjust the balance when the error is discovered. If we issued protection under the program due to our own error, and we recognize our error before a protected event occurs, our obligation to you is limited to return of any program fee you paid. If we recognize our error after a protected event occurs, we will provide benefits for the protected event that occurred, and we will terminate the program for any future events as of the date we recognize our error. However, if you misstated a material fact when enrolling for the program that caused us to issue protection under the program when we otherwise wouldn t have, we will return any program fee you paid when we discover this, and we will not provide any benefits even if an otherwise protected event has already occurred. WAIVER OF PROVISIONS. We reserve the right to waive any of the requirements described in this contract, at our sole discretion. If we do so, we will not be obligated to waive the same requirements in any other situation and our waiver will not constitute a waiver of any other requirements. CONTINUED EFFECTIVENESS. If any part of this contract is determined to be unenforceable, the rest will remain in effect. PROTECTED EVENTS A loan is protected according to the terms of this contract if you are enrolled for the specified program protection and you have paid the applicable program fee. LOSS OF LIFE (Included with Life Disability & Unemployment and Life) If you die: before the end of the month during which you reach age 70, we will cancel 100% of your protected balance as of the date of death, up to a maximum of $100,000. after the end of the month during which you reach age 70, we will cancel 25% of your protected balance as of the date of death, up to a maximum of $25,000. DISABILITY (Included with Life Disability & Unemployment) Disability means that you are: DCM00A (08/2012)

7 PROGRAM CONTRACT (continued) unable to engage in the significant duties of your occupation for at least 14 consecutive days; and under the regular care and treatment of a physician; and not working at any job, or combination of jobs, paying you an income equal to or exceeding 80% of the wages you were earning from your full time employment immediately preceding the date you became disabled. After you have been disabled for 12 months, the definition of Disability changes and means that you are: unable to engage in the significant duties of any occupation for which you are reasonably qualified by training, education, and experience; and under the regular care and treatment of a physician. If you are employed full time when you become disabled, we will cancel the daily payment for each day that you are disabled: beginning with the 1st day of Disability; and for the next 36 months or until the entire protected balance is canceled, but not more than $36,000 per period of Disability. INVOLUNTARY UNEMPLOYMENT (Included with Life Disability & Unemployment) Involuntary Unemployment means that for at least 14 consecutive days you are not working at any job, or any combination of jobs for 25 hours or more per week and that you are actively seeking full time employment. Involuntary Unemployment includes honorable discharge from active duty service by the United States Armed Forces. Involuntary Unemployment does not include any annual, regularly scheduled, or seasonal layoff or any period of unemployment that occurs while you are a temporary employee, independent contractor, self-employed, or employed by a joint borrower. It also does not include any retirement, vacation, strike, unionized labor dispute, lockout, sabbatical, family leave, disability, termination due to your willful or criminal misconduct, resignation by agreement with your employer, voluntary furlough, voluntary unemployment or voluntary loss of wages. If you are employed full time when you become Involuntarily Unemployed, we will cancel the daily payment for each day that you are Involuntarily Unemployed: beginning with the 1st day of Involuntary Unemployment or the first day after any severance pay has ceased, whichever comes later; and for the next 6 months or until the entire protected balance has been canceled, but not more than $3,000 per period of Involuntary Unemployment. For Involuntary Unemployment, we will initially require proof that you have received federal, state, or railroad unemployment benefits for the period of unemployment to determine if you meet the definition of Involuntarily Unemployed. You must provide evidence of your continued Involuntary Unemployment each month by demonstrating your continued registration with a state unemployment office or a recognized employment agency. NON-PROTECTED EVENTS An advance is not protected by the program if the event: is due to the commission of a felony. is caused by or results from an atomic explosion or any other release of nuclear energy (except when used solely for medical treatment). Additional non-protected events are specified below. An advance is not protected by Loss of Life protection if the event: occurs within the 6 months immediately following the effective date of protection for the advance and is related to a pre-existing condition for which you received advice, diagnosis, or treatment (including medication) within the 6 months immediately preceding the effective date of protection for the advance. is the result of a suicide or an intentionally self-inflicted injury that occurs within the 12 months immediately following the effective date of protection for the advance. An advance is not protected by Disability protection if the event: occurs within the 6 months immediately following the effective date of protection for the advance and is related to a pre-existing condition for which you received advice, diagnosis, or treatment (including medication) within the 6 months immediately preceding the effective date of protection for the advance. is related to a normal pregnancy. is due to an intentionally self-inflicted injury. An advance is not protected by Involuntary Unemployment protection if the event: occurs within the 3 months immediately following the effective date of protection for the advance. is due to an intentionally self-inflicted injury. CONCURRENT PROTECTED EVENTS If we are canceling the daily payment for one protected event and another protected event occurs: the amount canceled will be applied to the dollar limitation for the first protected event. we will not cancel more than the daily payment for any one day. If two protected borrowers die at the same time, we will cancel the lesser of the protected balance or the Loss of Life amount for each protected borrower for Life Disability & Unemployment and Life. RECURRENT EVENTS If you incur a claim for the same type of protected event again within one year after you have recovered or returned to work, we will consider this a continuation of the prior event. For disability, however, this only applies if you are disabled due to the same condition. Any remaining time period available from the earlier protected event will continue beginning with the date of the recurrence. If you incur a claim for the same type of protected event more than one year after recovering or returning to work, we will consider it a new protected event. This provision applies whether you return to work with the same or a different employer. STATUS OF THE LOAN AFTER A PROTECTED EVENT During the time it takes to process your claim, you remain responsible for making at least the minimum payment due on the loan by the payment due date. You are responsible for any difference between the minimum payment due on the loan and the amount canceled or postponed. If you have a valid claim, we will refund the portion of your payment(s) that should have been canceled or postponed according to the terms of this contract. Your Visa Card Guide to Benefit Auto Rental Collision Damage Waiver Effective 3/1/06 What is this benefit? When certain terms and conditions are met, the Visa Auto Rental Collision Damage Waiver benefit ( Auto Rental CDW ) provides at no additional charge reimbursement for damage due to collision or theft up to the actual cash value of most rental vehicles. In your country of residence, this benefit is supplemental to, and excess of, any valid and collectible insurance from any other source. Here are answers to some commonly asked questions about the benefit. Who is eligible? You are eligible only if you are a valid cardholder whose name is embossed on an eligible U.S.-issued Visa card. Only you as the primary renter of the vehicle and any additional drivers permitted by the auto rental agreement are covered. What is covered? Subject to the terms and conditions in this Guide to Benefit, Visa Auto Rental CDW reimburses you for covered damage or theft to a rental vehicle while it is your responsibility as well as valid administrative and loss-of-use charges imposed by the auto rental company and reasonable towing charges. Only vehicle rental periods that neither exceed nor are intended to exceed fifteen (15) consecutive days within your country of residence or thirty-one (31) consecutive days outside your country of residence are covered. The benefit provides reimbursement up to the actual cash value of the vehicle as it was originally manufactured. Most private passenger automobiles, minivans, and sport utility vehicles are eligible, but some restrictions may apply. Please contact the Benefit Administrator to inquire about a specific vehicle. Within your country of residence, this benefit supplements, and applies excess of, any valid and collectible insurance or reimbursement from any source. This means that, subject to the terms and conditions of this Guide to Benefit, Visa Auto Rental CDW applies to losses or expenses that are not covered by insurance or reimbursement. Covered losses are: Physical damage and/or theft of the covered rental vehicle. Valid loss-of-use charges imposed and substantiated by the auto rental company through a fleet utilization log. Reasonable and customary towing charges, due to a covered loss, to the nearest qualified repair facility. How do I activate this benefit? For the benefit to be in effect, you must: Initiate and complete the entire rental transaction with your eligible Visa card, and Decline the auto rental company s collision damage waiver (CDW/LDW) option, or similar provision, if offered by the auto rental company. Helpful hints: Check the rental vehicle for prior damage before leaving the rental lot. Review the auto rental agreement carefully to make sure you are declining CDW/LDW and also to familiarize yourself with the terms and conditions of the auto rental agreement. What do I do if I have an accident or the rental vehicle is stolen? Immediately call the Benefit Administrator at VISA- 911 to report the theft or damage regardless of whether your liability has been established. If you are outside the United States, call collect at The Benefit Administrator will answer any questions you or the rental agency may have and will then send you a claim form. All incidents must be reported immediately following the theft or damage, but in no event later than forty-five (45) days* following the date of the theft or damage. We therefore advise you to notify us immediately after any loss. You must make every reasonable effort to protect the rental vehicle from damage or theft. What is not covered? Any obligation you assume under any agreement (other than the deductible under your personal auto policy). Any violation of the auto rental agreement or this benefit. Injury of anyone or damage to anything inside or outside the rental vehicle. Loss or theft of personal belongings. Personal liability. Expenses assumed, waived, or paid by the rental agency or its insurer. Cost of any insurance or collision damage waiver offered by or purchased through the auto rental company. Depreciation of the rental vehicle caused by loss or damage including, but not limited to diminished value. Expenses reimbursable by your insurer, employer, or employer s insurance. Loss due to intentional acts, or due to the driver(s) being under the influence of alcohol, intoxicants, or drugs, or due to contraband or illegal activities. Wear and tear, gradual deterioration, or mechanical breakdown. Items not installed by the original manufacturer. Loss due to off-road operation of the rental vehicle. Loss due to hostility of any kind (including, but not limited to, war, invasion, rebellion, or insurrection). Confiscation by authorities. Vehicles that do not meet the definition of covered vehicles. Rental periods that either exceed or are intended to exceed fifteen (15) consecutive days within your country of residence or thirty-one (31) consecutive days outside your country of residence. Leases and mini leases. Loss or damage as a result of the cardholder s lack of reasonable care in protecting the rental vehicle before and after damage occurs (for example, leaving the vehicle running and unattended). Losses reported more than forty-five (45) days* from the date of loss. Losses for which a claim form has not been received within ninety (90) days* from the date of loss. Losses for which all required documentation has not been received within 365 days from the date of loss. Losses from rental transactions which originated in Israel, Jamaica, the Republic of Ireland, or Northern Ireland. What if the auto rental company insists that I purchase the auto rental company s auto insurance or collision damage waiver? Call the Benefit Administrator at VISA-911 for help. If you are outside the United States, call collect at When and where do I have this benefit? This benefit is available on a 24-hour basis, in the United States and most foreign countries. No benefit is provided for motor vehicles rented in Israel, Jamaica, the Republic of Ireland, or Northern Ireland. Additionally, this benefit is not available where precluded by law or in violation of the territory terms of the auto rental agreement or prohibited by individual merchants. Because regulations vary outside the United States, we recommend you check with your auto rental company and the Benefit Administrator before you travel to make sure Visa Auto Rental CDW will apply. This benefit is in effect while the rental vehicle remains in your control or in the control of a person permitted to operate the rental vehicle in accordance with the rental agreement between you and the auto rental company. This benefit terminates when the auto rental company re-assumes control of the rental vehicle.

9 Auto Rental Collision Damage Waiver (Cont.) How does this benefit apply? Within your country of residence, Visa Auto Rental CDW supplements, and applies excess of, any valid and collectible insurance or reimbursement from any source. It does not duplicate insurance provided by or purchased through the auto rental company; it will not pay for losses reimbursed by your own insurer, employer, employer s insurance, or any other valid and collectible insurance; however, it will pay for the outstanding deductible portion or other charges, including valid administration and loss-of-use charges not covered by your applicable automobile insurance policy. Outside your country of residence or if you do not have automobile insurance, this benefit is primary in those countries where it is available, and in that case, you do not have to claim payment from any other source of insurance before receiving the benefits. What types of rental vehicles are not covered? Excluded worldwide are: expensive, exotic, and antique automobiles; certain vans; vehicles that have an open cargo bed; trucks; motorcycles, mopeds, and motorbikes; limousines; and recreational vehicles. Examples of excluded expensive or exotic automobiles are the Aston Martin, Bentley, Bricklin, Daimler, DeLorean, Excalibur, Ferrari, Jensen, Lamborghini, Lotus, Maserati, Porsche, and Rolls Royce. However, selected models of BMW, Mercedes-Benz, Cadillac, and Lincoln are covered. An antique automobile is defined as any vehicle over twenty (20) years old or any vehicle that has not been manufactured for ten (10) years or more. This benefit is provided for only those vans manufactured and designed to transport a maximum of eight (8) people and which is used exclusively to transport people. If you are outside the United States, call collect at What do I need from the auto rental company in order to file a Visa Auto Rental CDW claim? At the time of the damage or theft, or when you return the rental vehicle, immediately ask the auto rental company for: A copy of the Accident Report Form and claim document, which should indicate the costs you are responsible for and any amounts that have been paid toward the claim. A copy of the initial and final auto rental agreement(s). A copy of the repair estimate or itemized repair bill. Two (2) photographs of the damaged vehicle, if available. A police report, if obtainable. How do I file a claim? You, the cardholder, are responsible for reporting your claim to the Benefit Administrator immediately, but in no event later than forty-five (45) days* from the date of theft or damage, or your claim will be denied. Notice to any other party will not suffice. Furthermore, we reserve the right to deny any claim that contains charges that would not have been included had the Benefit Administrator been notified before those expenses were incurred. We therefore advise you to notify us immediately after any theft or damage. Mail the following documentation to the Benefit Administrator: The completed and signed Visa Auto Rental CDW Claim Form. Your completed claim form must be postmarked within ninety (90) days* of the date of the damage or theft, even if all other required documentation is not yet available, or your claim will be denied. A copy of your receipt or monthly billing statement as proof that the entire vehicle rental was charged and paid for with your eligible Visa card. A statement from your insurance carrier (and/or your employer or employer s insurance carrier, if applicable) or other reimbursement showing the costs for which you are responsible and any amounts that have been paid toward the claim. Or, if you have no applicable insurance or reimbursement, please provide a notarized statement to that effect. A copy of the declaration page from your automobile insurance carrier. Enclose all the documents you received from the auto rental company: A copy of the Accident Report Form. A copy of the entire auto rental agreement(s). A copy of the repair estimate or itemized repair bill. Two (2) photographs of the damaged vehicle, if available. A police report, if obtainable. Any other documentation deemed necessary by the Benefit Administrator to substantiate the claim. For faster filing, submit your claim online. It s easy, convenient, and available at no extra cost to eligible Visa cardholders. To submit your claim and learn more about Visa Auto Rental CDW go to the Visa Auto Rental CDW Claim Center at If you experience difficulty in obtaining all the required documents within ninety (90) days* of the date of theft or damage, just submit the claim form and any documentation you already have available. NOTE: All remaining documents must be postmarked within 365 days of the date of theft or damage. Do I have to do anything else? Usually not. Under normal circumstances, the claim will be paid within fifteen (15) days after the Visa Auto Rental CDW Benefit Administrator has received all documentation necessary to fully substantiate your claim. However, after the Benefit Administrator has paid your claim, all your rights and remedies against any party in respect of this theft or damage will be transferred to the Provider to the extent of the cost of the Provider s payment to you. The Provider shall then be entitled at its own expense to sue in your name. Should this occur, you must give the Provider all assistance as the Provider may reasonably require to secure its rights and remedies including the execution of all documents necessary to enable the Provider to bring suit in your name. *Not applicable to residents of certain states. Additional Provisions for Auto Rental CDW: You must make every effort that would be made by a reasonable and prudent person to protect the Rental Vehicle from damage or theft. This provision will not be applied unreasonably to avoid claims. If you make any claim knowing it to be false or fraudulent in any respect including, but not limited to, the cost of repair services, no coverage shall exist for such claim and your benefits may be canceled. The Provider relies on the truth of the statements of each cardholder. Each cardholder agrees that such representations are accurate and complete. Any and all relevant provisions shall be void in any case of fraud, intentional concealment, or misrepresentation of material fact by the cardholder. Once you report an occurrence, a claim file will be opened and shall remain open for six (6) months from the date of the damage or theft. No payment will be made on a claim that is not completely substantiated in the manner required by the Benefit Administrator within twelve (12) months of the date of damage or theft. No legal action for a claim may be brought against us until sixty (60) days after we receive Proof of Loss. After the expiration of two (2) years from the time written Proof of Loss was to be provided, no action shall be brought to recover on this benefit. Further, no legal action may be brought against us unless all the terms of this Guide to Benefit and policy have been complied with fully. Visa Auto Rental CDW is a benefit provided to eligible Visa cardholders in accordance with the policy underwritten by Indemnity Insurance Company of North America ( Provider ). The benefit is subject to the terms and conditions outlined and includes certain restrictions, limitations, and exclusions. This Guide to Benefit is not a policy of insurance. In the event of any conflict between the description of the benefit in this Guide to Benefit and the policy, the policy will govern. The policy is on file at the offices of Visa U.S.A.
