1 REQUEST FOR QUALIFICATIONS (RFQ) FOR CONSTRUCTION MANAGEMENT SERVICES (Construction Manager At-Risk) FOR PROJECTS IN THE CENTER UNIFIED SCHOOL DISTRICT April 7, 2005 The ( District ) is seeking Statements of Qualifications from professionals experienced in the construction of public school facilities in California to provide Construction Manager At-Risk services to the District. 3 REQUEST FOR QUALIFICATIONS This Request for Qualifications (RFQ) is for Construction Management Services, At-Risk ( AT-RISK ), for new construction and modernization Project(s) for the Center Unified School District. I. INTRODUCTION/BACKGROUND 1. The ( District ) is seeking proposals from qualified construction management firms to provide construction management services on an AT-RISK basis to achieve completion of the following Projects ( Project(s) ): District s New Rex Fortune Elementary School, Dudley Elementary School Modernization, Spinelli Elementary School Modernization, McClellan High School Modernization, Antelope View Charter School Modernization Project(s), and additional Project(s) to be determined by the District at a later date. It is the desire of the District to select a construction management firm that meets or exceeds the minimum credential and experience requirements set forth in this Request for Qualifications ( RFQ ), and that can and will deliver the Project(s) in a manner that meets or exceeds the minimum design, construction schedule, educational program and technical performance specifications at the lowest possible cost with the highest possible quality. The District has prepared this RFQ to obtain detailed information so that a construction management firm(s) may be interviewed, evaluated, and selected for the District s Project(s). Assignment of a construction management firm will be made on a project by project basis. The District is currently in the preliminary stage of the design phase for the Project(s). Project Architects will be assigned within the next two months. The District s Program Manager is Capital Program Management, Inc. This Request for Qualifications is issued pursuant to California Government Code sections 4525 et seq., Public Contract Code section 6106 and applicable authorities. The District intends that upon completion of the competitive, public bid process for each trade package assembled by the Construction Manager, the District will then enter into a contract with the lowest responsive, responsible bidder for each trade package. After award and complete execution of each trade contract, the District will then assign each trade contract to the Construction Manager. The Construction Manager will accept the assignment of each trade contract, submit Performance and Payment Bonds to the District, issued by a California admitted Surety acceptable to District, in the amount of the cumulative sum of all trade contracts, plus Construction Manager s fee, general conditions, project contingency and approved costs and expenses. The Construction Manager will guarantee completion of the Project(s) for the cumulative sum of all trade contracts, together with the Construction Manager's approved compensation, including fees and general conditions and approved costs and expenses. The Construction Manager's compensation, including fees, general conditions, project contingency, allowable costs and expenses will be negotiated with the District following the District's identification of the most qualified Construction Management firm, pursuant to Public Contract Code section 6106(d). PROJECT CONSTRUCTION COSTS The Project(s) are filed with the State as a Financial Hardship and are financed 100% by the State. The Project(s) budgets (2005) are as follows: 2. New Rex Fortune School Growth eligibility for 25 classrooms. 3. Dudley Elementary Modernization Construction cost estimate of $2,116, Spinelli Elementary Modernization Construction cost estimate of $912, McClellan High Modernization Construction cost estimate of $435, Antelope View Charter Modernization- Construction cost estimate of $298, Additional Project(s) to be Determined. IV. ANTICIPATED SCOPE OF SERVICES FOR EACH PROJECT The following list outlines the types of services that the district expects the Construction Management firm to provide, AT-RISK (as outlined below and in the District s contract), and these services are all applicable to both New Construction and Modernization Project(s). The list is not intended to be exhaustive and the services described in the final form of the Construction Management At-Risk Services Contract will be more explicit. The purpose of the following list is to provide the Construction Management firm a general idea of the nature of the scope of services required, and guidance in responding to the District s RFQ. 1. Preconstruction Services Contract Document Coordination Review: Provide plan coordination review and comprehensive constructability review(s) with an emphasis on omissions, interdisciplinary coordination, and coordination between the project plans and specifications. 5 Preliminary Master Construction Schedule: Produce a Preliminary Master Construction Schedule, subject to acceptance by the District. It shall contain key milestones to be accomplished by the Trade/Multiple-Prime Contractors including identification of the Project critical path, and be incorporated into the bid documents and subsequent contracts with the successful bidders. Cost and Budget Review: Prepare a detailed construction estimate showing the values of all major components of the Project. Bidding Strategies: Propose to the District and its consultants bidding strategies with an emphasis upon timing, marketing/outreach to the contracting community, and if necessary, the development of alternates. Construction Management firm s philosophy regarding the quantity/breakdown of bid packages between the trades to best suit these Project(s). Trade/Multiple-Prime Bid Package Document Preparation: The Construction Management firm shall assume responsibility for the separation of the Project specifications and drawings into separate bid packages for all appropriate and required categories of work, and assist the District and its consultants with the public bid opening process, including evaluation and recommendation of the lowest responsive/responsible bidder for each bid package. Bid Package Scoping: The Construction Management firm shall develop Trade/Multiple-Prime bid packages to ensure appropriate and complete coverage between bid packages for all work necessary to complete the Project, and avoid duplication of any scope or portion thereof or gaps between scopes that would leave work undone. Certify to District before bid that recommended bid packages include the full scope of work required by the Contract Documents and necessary to complete the Project. The Construction Management firm will be required to guarantee completeness and coordination of the scopes of work between all bid packages, as the Construction Management firm will not be permitted to use the District s contingency funds to cover lapses in coverage between the bid packages. 2. Bid/Award Phase Services Advertisements: Assist District staff with the placement of both the Project legal advertisements and any other pre-bid advertisements, and the bid-award-start timeline. Pre-bid Conferences: In association with the District and its consultants, conduct prebid conferences and site visit meetings with potential bidders. Bid Evaluation and Review: Review and evaluate all bids for responsiveness and certify the bid results to District. If the bids exceed the Project budget and the District authorizes re-bidding of all or portions of the Project, Construction Management firm shall cooperate in revising the scope of work with the Architect, as required to reduce the construction costs for the Project. 6 Post-Bid Document Coordination: Issue Notice of Intent to Award letters, review and acceptance of all post-bid document submittals including but not limited to: all applicable bonds and insurance certificates, contracts, and issuance of Notice to Proceed letters. 3. Construction Phase Services Master Construction Schedule: Develop a Critical Path Method (CPM) Construction Master Schedule based upon the milestones established in the Preliminary Construction Master Schedule and input received from Trade/Multiple-Prime Contractors. Maintain and update the Master Construction Schedule on a monthly basis for acceptance by the District, prepare bi-weekly short interval schedules, and distribute to the appropriate parties during the weekly construction progress meetings. Pre-Construction Conference: Conduct pre-construction conferences for the benefit of the Trade/Multiple-Prime Contractors. Provide information with regard to the schedule, supervision, contract administration, Labor Compliance Program coordination, reporting procedures and site rules and regulations to be adhered to during construction. Storm Water Pollution Prevention Plan: Ensure that Storm Water Pollution Prevention Plan is initiated, is in accordance with all regulations, local ordinances, and is maintained throughout duration of the Project. Supervision: Manage, supervise and coordinate all construction activities in accordance with the Construction Documents and Master Construction Schedule. Provide full-time on-site supervision and management of the Project(s), including weekly construction progress meetings with the District and its consultants. Maintain on a daily basis an onsite Project activity log. Contract Administration (CA): Assist the District and its consultants with CA activities and document control for the Project(s). Set up, track, and maintain a computerized CA database to track CA related functions, including but not limited to: establish submittal priority matrix, coordination of the RFI process, and assist with the change order and payment application process. Labor Compliance Program: The Construction Management firm and the Trade/Multiple-Prime Contractors will be required to participate and comply with the District s Labor Compliance Program, which will be in effect for the Project. Safety Programs: Develop Project safety programs and monitor their implementation along with any necessary safety meetings. The Construction Management firm shall be the controlling employer on the Project. Agency Interface/Compliance: Provide local and state agency interface during the Preconstruction, Construction and Close-out phases of the Project, and comply with all applicable State and Local Agency requirements as described in the Contract Documents. 7 Utilities/Permits: Assist the architect and District in obtaining all necessary local agency utility and encroachment permits for the Project. This task may also encompass accompanying governmental officials (Fire Marshal, DSA, Health Department, local building department and fire authority, etc.) during inspections, assisting in preparing and submitting proper documentation to the appropriate approving agencies, assisting in final testing and other necessary and reasonable activities. Schedule of Values/Progress Payment Procedures: Prepare, review and reconcile each Trade/Multiple-Prime Contractor s schedule of values, which shall be correlated and tied to the activities included in the Master Construction Schedule. Prepare monthly payment applications based on percentages of work completed by trade, and review and obtain Architect s and Owner s Representative s approvals. Forward approved payment applications to the District. Project Record Documents: Coordinate and expedite all activities in connection with preparation of as-built record documents, and the furnishing of all Operation and Maintenance manuals and warranties. Ensure that all as-builts are incorporated into a single set of Project Record Documents and that required training has been provided to District personnel. Submittals: Conduct preliminary submittal reviews and monitor the approval status of product data, shop drawings, manufacturers installation instructions, samples, mock-ups if required, and related correspondence. Change Order Review: Assist the District and its consultants with reviewing potential changes in the work. Establish and implement a change order processing system that provides review of scope, and analysis of changes in Contract Sum and/or Contract Time. Scope Interface Contingency and Provisional Allowances: Within the Construction Management firm s Contract Sum, the District and its consultants shall maintain and control the Scope Interface Contingency and Provisional Allowances. Prior to District authorization, change orders shall be classified in the following categories: design errors, design omissions, unforeseen site conditions, agency related changes/requirements, and owner initiated changes. At the conclusion of the Project, all unused portions of the Scope Interface Contingency and Provisional Allowances shall be returned to the District via deductive change order. Trade/Multiple-Prime Contractor Claims: Evaluate and mitigate all claims for additional cost or time due to any alleged cause, including certification that any claim brought forward by the Construction Manager to the District meets the requirements of the California False Claims Act, Government Code Sections 12650, et seq. Verified Reports: Process and forward all verified reports and required Project closeout documentation to the Architect for submission to DSA. Risk RFQ 2005 Page 5 of 12

Post Construction and Project Close-Out Phase Services Project Close Out: Review Contract Documents and prepare a checklist of items that must be submitted to District, Architect, or governmental agencies for proper contract and agency close-out. Monitor and ensure compliance by Trade/Multiple-Prime Contractors and advise District concerning compliance. Verify requirements in the Contract Documents and assist the District with the final payment application process. Punch List/Warranty: Participate in developing and distributing punch list(s) with the Architect, and cause all punch list and warranty items to be timely completed. Create a punchlist schedule for completion, and verify completion of all punchlist items. The Construction Management firm is responsible for all warranty items for the life of the warranty period. Move In/Staff Training/Commissioning: Coordinate the arrival and installation of all District furnished materials, furniture and equipment items. Coordinate staff training for all mechanical, electrical, and low voltage systems, and assist the District s Maintenance & Operations department with equipment and system commissioning that may be specified. V. GENERAL INFORMATION 1. Submittal of Statement of Qualifications Submittals should be verified before submission. Adjustments will not be permitted after submission to the District. The District will not be held responsible for errors or omissions on the part of the firm in the preparation of the submittal. The District reserves the right to reject any and all submittals, or to waive any irregularities or informalities in the submittal process. Disqualified Statements Any submittal received by the after 4:00 p.m. on April 21, 2005, shall be refused and returned. Risk RFQ 2005 Page 6 of 12

9 4. Withdrawal of Submittal Organizations may withdraw their submittal, either personally or by written request, at any time prior to the closing time for the receipt of submittals. 5. Copies of Submittal Each organization making a submittal must include an unbound original and six (6) copies. 6. Contact Organizations interested in making a submittal are directed not to make personal contact with members of the District s Governing Board. Any contact will constitute grounds for disqualification of consideration. Fees The District will negotiate contract fees for the services to be provided from the bestqualified organizations. 9. Contract Upon selection, the Construction Management firm will be required to enter into a Construction Management At-Risk Services Agreement, which includes the following indemnity clause: Indemnity by Construction Management Firm: To the fullest extent permitted by law, Construction Manager agrees to indemnify, defend and hold DISTRICT entirely harmless from all liability arising out of: Risk RFQ 2005 Page 7 of 12

Any and all claims under workers' compensation acts and other employee benefit acts with respect to Construction Manager's employees or Construction Manager's trade contractor s/subcontractor's employees arising out of the Project and Construction Manager's work under this Agreement; b. Liability for damages for (1) death or bodily injury to person; (2) injury to, loss or theft of property; (3) any failure or alleged failure to comply with any provision of law, or (4) any other loss, damage or expense arising under either (1), (2), or (3) above, sustained by the Construction Manager or any person, firm or corporation employed by the Construction Manager upon or in connection with the Project, except for liability resulting from the sole or active negligence, or willful misconduct of the District, its officers, employees, agents or independent contractors who are directly employed by the District; and c. Any loss, injury to, death of persons or damage to property caused by any act, neglect, default or omission of the Construction Manager, or any person, firm or corporation employed by the Construction Manager, either directly or by independent contract, including all damages due to loss or theft, sustained by any person, firm or corporation including the District, arising out of, or in any way connected with the Project, including injury or damage either on or off District property; but not for any loss, injury, death or damages caused by the sole and active negligence of the District. The Construction Manager, at Construction Manager's own expense, cost, and risk, shall defend any and all claims, actions, suits, or other proceedings that may be brought or instituted against the District, its officers, agents or employees, on any such claim or liability, and shall pay or satisfy any judgment that may be rendered against the District, its officers, agents or employees in any action, suit or other proceedings as a result thereof. VI. CONTENTS OF PROPOSAL All submittals shall address the following items. Each response to this RFQ should appear in the order in which the information is requested by the RFQ. Submittals must be limited to thirty (30) pages in total length. 1. Cover Letter 2. Description of Firm Include name of the firm, address, telephone number, fax number, type of firm (e.g., corporation), California contractor s license number and name of principal contact. Provide a brief history of the firm, including: (1) Number of years in business (2) Senior member(s) and length of association (3) Whether the organization has gone by a different name while under substantially the same management. (4) Location of office where project team members will complete their work and manage the Project(s). Risk RFQ 2005 Page 8 of 12

11 (5) List of basic services provided by firm. (6) List of additional services provided by firm. (7) Provide a detailed explanation of any litigation related to school construction Project(s) in which the organization has been involved, as well as a discussion of how the litigation was resolved. (8) Description of the firm s team members proposed for the Project, the firm s a. organizational and management approach, and the role of each team member, b. proposed consultants and technical assistants. 3. Experience Relative to District Needs Discuss the firm s knowledge of and experience with providing AT-RISK Construction Management services for new and modernization Project(s). Provide a minimum of three references from school districts or other institutional clients where the firm performed construction management services AT-RISK. Provide a list of Project(s) where the team members provided construction management services AT- RISK, and the role each team member played on the specific project. Discuss the extent of the risk that the firm will accept in relation to the Project(s) in relation to the coordination and completion of the plans and specifications, any overlap in the scope of work between separate contractors, and any gap left between the scopes of work of different contractors, and the firm s willingness to accept responsibility to ensure completion of the Project(s). Provide the total number of school Project(s) in progress in your local office at this time and phase status, grade level and current dollar value. 4. Qualifications Of Construction Management Firm s Personnel Identify the personnel who will be assigned to the Project. Provide detailed resumes emphasizing California K-12 public school experience. Describe specific skills as they relate to the management of Project(s) of this specific type. 5. Experience with State Regulatory Agencies Describe experience with OPSC and DSA procedures. 6. Project(s) Plan and Methodology Discuss specific firm procedures for addressing the following: (1) Plan and construction document coordination (2) Performance of constructability reviews and value engineering analysis. (3) Packaging of complete and separate trade contracts to avoid any overlap or gaps between scopes of work in the trade contracts, and to ensure all necessary work is performed to deliver a complete Project Risk RFQ 2005 Page 9 of 12

12 (4) Establishing an accurate construction budget for the Project and any savings that may be obtained through value engineering (5) Disputes and claims involving contractors and subcontractors (6) Communication and coordination with consultants (7) Provision of preliminary schedules, construction budgets, and estimates of change order items (8) Proceeding with construction through a construction change directive process 7. Fees Provide proposed fees on a percentage basis for construction management services described herein for the Project(s), and hourly rates, based on a Direct Personnel Expense (DPE) model for individual personnel to be assigned to the Project(s). Please specify if the Construction Manager s proposed fee is different for new vs. modernization projects. 8. Bonding and Insurance Provide the following: (1) Name of professional liability, commercial general liability insurance, workers compensation, and builders risk carriers (2) Designate whether each policy of insurance is on an occurrence or claims made basis (3) Policy limits (4) Deductible on each policy of insurance (5) Number of years with each carrier (6) Claims made on any policy of insurance held by the firm within the last three years, including: a) A detailed explanation of the nature and type of claim b) Whether the claim has been resolved c) The terms of the resolution (7) Experience modification factor for workers compensation insurance (8) Bonding capacity (9) Name of surety for payment and performance bonds 9. Qualification Certification (Exhibit A) 10. Additional Requirements The following may be submitted as a separate attachment: (1) Proposed timeframe for completion of the Project (2) Proposed general conditions costs for the Project (3) Description of any additional services not covered above which in your judgment might be necessary (4) A copy of a constructability review prepared by your firm for a school project Risk RFQ 2005 Page 10 of 12

13 VII. SELECTION & EVALUATION CRITERIA The following criteria will be adhered to in evaluating each construction management firm s Proposal: 1. Firm organization, history, longevity, and stability 2. Financial strength including bonding capacity 3. Insurance capacity and history 4. Claims and litigation history and experience 5. Demonstrated evidence that the construction management team has the experience and ability to initiate and manage a multi-trade bidding process, avoiding any overlap or gaps in scopes of work between all trade contracts, thereby ensuring all work necessary to achieve completion of the Project(s) is provided for in the documents released for bid by the trade contractors. 6. Successful firm experience in managing CM At-Risk school construction Project(s). 7. Experience of proposed project team 8. Satisfactory references from school districts 9. Acceptable fees and DPE rate schedule 10. Demonstrated ability to perform complete, detailed constructability reviews 11. Demonstrated ability to perform accurate cost estimating 12.
