Pelham, S.E. and Peter J. Sandlin, S.E. of Barrish Pelham & Associates, Inc. They provided a very comprehensive presentation regarding claims issues including the recent fire at the Roseville Galleria, as well as covering numerous other key structural questions. Ron tells us that his first introduction to the claims process was in 1969 as an all lines adjuster with Auto Club of Southern Calif in Redlands, CA. He had recently returned from serving in the Navy in Viet Nam when he was introduced to ACSC members at a Junior Chamber of Commerce meeting. His hobby of auto mechanics and rebuilding was the kind of touch the company was seeking in an all lines adjuster. 7 joined and participated in the local Sacramento Claims Association while in that position. The lure of self-employment took Ron to pursue and obtain a Calif Private Investigator s License. For the next four years, he operated this business while going to Lincoln University Law School at night. Through the years, he has kept that license current while practicing law. He is one of the few lawyers who earned a LLB rather than a JD as his undergraduate degree was just an AA degree. Ron opted to immediately open a solo plaintiff s personal injury practice. He has maintained that independent business approach even as he has moved into the less stressful life of Alternative Dispute Resolution. The focus in his law practice was automobile injury law, but he was also involved in a wide array of issues, including: insurance coverage; products liability; premises liability; medical negligence; and property and construction damage actions. Having learned the art of evaluation and negotiation from his experience as an adjuster, going to trial was an infrequent event. He believes that going to trial results from failure in communication. The ADR process done properly creates the communication that results in settlements. Ron is a volunteer Pro Tem judge in Sacramento and Placer Counties, an ADR panel member of Sacramento, Placer, El Dorado, Yolo, Sutter and San Joaquin Counties. Some of these panel memberships exceed 10 years. In 2009, he earned a certificate from the Pepperdine School of Law, Straus Institute of Dispute Resolution. The Sacramento Valley, from Modesto to Redding, is the venue for his services. 9 Come Hear From The California DOI Deputy Commissioner at May 12 SCA Geoffrey F. Margolis, Deputy Commissioner & Special Counsel to address Sacramento Claims Association There s a new administration in town over at the Department of Insurance. With the election of CDI Commissioner Dave Jones comes a new staff, as well. Longtime counsel to Commissioner Jones - his appointed Deputy Commissioner and Special Counsel to the California DOI - Geoffrey F. Margolis, is scheduled to speak before the May 12, 2011 luncheon gathering of the Sacramento Claims Association. Geoffrey F. Margolis We are honored to have such a high ranking officer from the CDI agree to come speak with our organization, said SCA Board Member Bob Battezzato, of Cleanrite Buildrite. Newly added to the SCA Speakers Committee, Mr. Battezzato clearly scored a coup with this one. In his role as the Deputy Commissioner & Special Counsel for the California Department of Insurance under Insurance Commissioner Dave Jones, Mr. Margolis provides the Commissioner with legal advice concerning highly sensitive and complex legal issues, independent advice on adjudicative hearings and rulemaking proceedings, legal counsel regarding issues arising from the National Association of Insurance Commissioners (NAIC), and serves as a member of the Commissioner s Executive Staff. Prior to his current position, Margolis served on the legislative staff of then Assemblymember Dave Jones, where he handled all aspects of legislation including: developing, researching, analyzing, drafting, amending, negotiating and presenting bills. (May 2009 Jan. 2011). Margolis previously served as a Senior Attorney for the California Department of Insurance and the State Controller s Office, where he performed highly sensitive and very complex legal work including litigation and legal analysis. (May 1997 May 2009). Prior to his more than a decade of work as a government lawyer, Margolis was the managing partner of a civil law practice, which emphasized: Business Law, Entertainment & Sports Law, Legislative Law, Mediation, and Public Relations. (July 1992 May 1997). Additional Legal Service - Mr. Margolis is a Judge Pro-Tem (Small Claims and Traffic Court) for Sacramento Superior Court. He is also a Mediator in the California Court of Appeal, Third District; and works as an Arbitrator for the Better Business Bureau (Business and Lemon Law disputes). In addition, Margolis holds memberships in the following organizations: California State Bar (#157796), Business Law, Intellectual Property Law, and Public Law Sections; Sacramento County Bar Association, Public Law, Administrative Law and Alternative Dispute Resolution Sections; American Bar Association, Forum on Entertainment and Sports Law; Sports Lawyers Association. He is Phi Delta Phi - International Legal Fraternity, and earned his Juris Doctorate from McGeorge School of Law (1991), following a Bachelor of Arts degree from UCLA (1987). 10 Association News Network Personality Profile: Laura O Rourke Living life by example, open-minded and with passion for what matters Laura O Rourke has a lilting Irish name that easily rolls off the tongue. I m not even Irish. She exclaims, I married the name and share it with my 16 year old daughter, Kylie. Laura s mention of her offspring softens her face with pride. She is a really good kid, she has a 4.4 GPA (I know!) and is in the band at school and on the Band Council. Since she just started driving it makes it a little less worrisome that she is such a great girl and so responsible. After graduation from Ohio State University near her birthplace in Toledo, Ohio, Laura landed a position with Erie Insurance as a comprehensive claims facilitator for first party claims; but only for a year, as adventure came calling and the neophyte claims adjuster quit her job to take a position in the Sequoia National Park for the summer. She worked as a restaurant manager in that idyllic setting and lived in a rustic cabin in a setting far different from her home state. Laura had worked in restaurants while attending college so the work wasn t unfamiliar, but the terrain surely was. The experiences of that summer stayed with her and shaped her future. She went to work for Infinity Insurance as an auto adjuster and married, gaining the lilting name and a new address; this time Utah. Laura worked for six years for Liberty Mutual as an inside adjuster I ve heard adjusters say that the meetings can feel like a shark tank, but my experience is that most service providers just want to introduce themselves. and then GuideOne for three years in the same position before transferring to California. In fact, he stated, they started letting people back in the mall just seven days after the fire. One month later 40 stores were reopened, which happened to also be Black Friday - the day after Thanksgiving. Category three - unsalvageable - is what we saw. He went on to explain that sometimes even places that don t look damaged need to be tested. Beyond this particular fire, the team took the time to broaden the subject matter to general testing - Assessment & Reconstruction - discussing physical effects on various building materials. Peter Sandlin, SE, took the lead on this portion of the program. When a roof structure needs to be removed/replaced, all walls must first be stabilized, he explained. Mr. Sandlin also discussed the need for compression testing on the foundation of a burned building to determine to what extent it may or may not be salvageable. Sandlin went on to cover a wide array of engineering tools and various processes used in a variety of applications. While she was okay with working at an inside desk, she likes the experience of getting face to face with the claimants and loves working for GuideOne. I have a varied mix of claims on my desk she explains so it is never boring. When I was working with Workers Comp. files, some cases were older than I was and were never going to end until the person expired. Now the customer s expectations are much higher than in the past, but there is instant gratification in helping people which keep me going. I love the family atmosphere of the company. The CEO comes by to say hello and knows everyone s name and there are regular conference calls with the employees. Laura loves to travel and often the destination revolves around music - her avowed passion. She loves the music of G. Love and Special Sauce - a blues-alternative hip-hop band - but appreciates all kinds of music and from all eras. I ve started taking my daughter to concerts so that she can get a sense of the variety and history of music available here. We ve gone to The Fillmore Auditorium and Hardly Strictly Bluegrass in San Francisco, among others, so we have a basis for sharing all types of music. She attends the Sacramento Claims Association luncheons whenever possible I feel it is a great way to connect with people in the insurance industry, she says. It affords a broader knowledge of services available so I have a sense of whom I can turn to if I encounter a situation I ve not had to deal with previously. I ve heard adjusters say that the meetings can feel like a shark tank, but my experience is that most service providers just want to introduce themselves. I don t think that an adjuster is doing their policyholders a favor by sitting in their office without knowing what is available to assist them. I cannot always attend but I appreciate the connection when it is possible. It s the same thing with the Claims Conference of Northern California. I am shocked that so many adjusters are unaware of the conference and the training it provides which, most of the time, is lacking in their workplace. We are fortunate to have this resource and more adjusters should be taking advantage of it. 17 News from the DOI Insurance Commissioner Jones Applauds Passage of AB 52 by Assembly Health Committee Bill would give Commissioner authority to reject excessive health care premiums Insurance Commissioner Dave Jones announced April 27, 2011 that the Assembly Health Committee has passed AB 52, authored by Assembly Member Mike Feuer (D-Los Angeles), by a vote of 12 to 7. The bill would protect consumers and businesses by giving the Insurance Commissioner the power to reject excessive health insurance rate increases. On a regular basis, health insurers announce significant premium increases that far surpass the rate of medical inflation. It has become commonplace for policyholders to experience multiple rate increases over the course of a given year, Commissioner Jones said. Since I took office, Californians have made it exceedingly clear that they want me to reject excessive rate increases, but I do not have this authority as Insurance Commissioner - AB 52 can change this. That is why I have partnered with Assembly Member Feuer to do all that we can to ensure AB 52 becomes law. As a member of the Assembly, I introduced this legislation three times and the need for it has only grown, as health insurance continues to become unaffordable for more and more Californians. Today the Assembly Health Committee recognized that Californians should not have to depend on the whim of an insurance company to halt a major rate increase, said the bill s author, Assembly Member Feuer. This was a crucial first step toward getting AB 52 signed into law, but until that happens, California families will continue to live in fear that they are just one rate hike away from no longer being able to afford health insurance. Jones Announces Sentencing of Insurance Agent for Fraud Agent misappropriated $400,000 in premiums for personal use Insurance Commissioner Jones May 2, 2011 announced that Albert Ricardo Prince, 54, of Bakersfield was sentenced to one year in jail for each of three felony counts of fraud he was charged with in Kern County Superior Court. Prince was immediately remanded to the Kern County Sheriff where his sentence has begun, and where his remaining time will be served concurrently in the Kern County Jail. Prince was also sentenced to three years felony probation and ordered to make restitution to 21 of his victims in an amount to be determined by the probation department. This agent s egregious behavior put his clients at great financial risk, said Commissioner Jones. His deceit and disregard for his policyholders could have led to tragic results. Prince s conviction and sentencing resulted from an investigation conducted by the California Department of Insurance (CDI), Investigation Division, Valencia Regional Office. CCNC ANNOUNCES OPENING OF ONLINE STORE FOR SEPTEMBER CONFERENCE PURCHASES Preparations are well under-way for the 18th annual Claims Conference of Northern California, being held September 8-9, 2011 back at the Hyatt Regency Downtown Sacramento. The popular two-day conference and tradeshow will feature continuing education credits from both the California Department of Insurance for adjusters and agents, as well as from Texas for the first time this year. Also a first for CCNC is a new high-tech advancement with the organization s web site. CCNC Exhibitor Committee Co-Chair (and EBCA rep), Lisa Winn, explains the motivation for upgrading the web site. We wanted to give our exhibitors the opportunity to actually choose their booth space for the tradeshow this year, she says. Deciding where each exhibitor will be each year is an arduous task, at best. The new upgraded site allows each exhibiting company the ability to choose which booth space they want from a floorplan map of the exhibit hall on the site. As each booth is purchased, the name of the exhibiting company dynamically appears in their booth spot in real-time. Not only are our exhibitors able to choose their spot, but they also are able to see who else has already purchased their booths, and where they are.
