Once upon a time, the Governor of California passed a Workers Compensation Reform Act and called it SB863. This happened because unscrupulous attorneys were taking advantage of the system by alleging bad faith psych, sex, and/or sleep claims. For DOI on/after 1/01/2013, SB863 says goodbye to WPI increases for Add-Ons of Sleep Dysfunction, Sexual Dysfunction, Psychiatric Disorder or any combination thereof that arises out of a compensable physical injury. As a result of these changes, all waste, fraud, and abuse were eliminated from the Workers Compensation System one can understand curtailing practice of alleging psych sleep/sex, and psyche on every application, for example, but problems arise when injured workers have unquestionable, disabling sleep/sex/psyche conditions as a result of their industrial injury and they lived happily ever after.but then, we have jumped ahead. A. HISTORY OF PSYCHIATRIC INJURIES IN CA: PROGRESSIVE CHANGE 1) 1982: Albertson s Decision: Causation: Worker s Subjective Perception of stress is sufficient to establish that the stress resulted from employment Employment must have played an Active Role in causing the mental injury (1%) Industry takes the employee as it finds him/eggshell Plaintiff-no apportionment to preexisting pathology or even preexisting Disability 2) 1989 Reform: (b): Increases threshold for Causation of Psychiatric Injuries: Actual events of employment must constitute at least 10% of the causation for a compensable psychiatric injury
17 RE: SB863 Page 2 Worker s injury claim must be established by a preponderance of the evidence 1990/1991: (a) Increases threshold for Causation of psychiatric injuries Must have a recognized diagnosis Must have worked for the employer for at least six months 3) 1993 Reform: AB 119 Increases threshold for Causation of Psychiatric Injuries: It is the intent of the Legislature is enacting this section to establish a new and higher threshold of compensability for psychiatric injury under this division. Actual events of employment must be the predominant cause of the injury Violent acts must be a substantial cause of the injury Limits on post-termination claims No comp for psychiatric injuries substantially caused by good faith personnel actions 4) 2004 Reform: SB899/Labor Code 4663/Escobedo: Limits on PD for all psychiatric injuries Apportionment of PD to Causation, excluding compensation for prior injuries, prior awards, prior disability, and preexisting pathology 5) 2013 Reform: SB863: Effective 1/01/2013, exclusion of additional PD for Physical-Mental claims as of 12/31/2012. PD for add-on psych injuries will be limited to catastrophic physical injury or where IW was a victim of, or a witness to a violent crime but can still comment on need for treatment for any of those conditions. B. SB863: LABOR CODE ) Statutory Language: Elimination of Sex, Sleep, Psych WPI for Compensable Claims
18 RE: SB863 Page 3 LC (c)(1) Except as provided in paragraph, there shall be no increases in impairment ratings for sleep dysfunction, sexual dysfunction, or psychiatric disorder, or any combination thereof, arising out of a compensable physical injury. Nothing in this section shall limit the ability of an injured employee to obtain treatment for sleep disorder, sexual dysfunction, or psychiatric disorder, if any, that are a consequence of an industrial injury. LC (c)(2) Exception: An increased impairment rating for psychiatric disorder shall not be subject to paragraph (1) if the compensable psychiatric injury resulted from either of the following: Being a victim of a violent act or direct exposure to a significant violent act within the meaning of Section A catastrophic injury, including but not limited to, loss of a limb, paralysis, severe burn, or severe head injury 2) Statute Application LC (c) only applies to: Specific injuries 1/01/2013 and after CT injuries ending 1/01/2013 and after 3) Legislative Intent SB863 Section I(b): The Legislature intends to eliminate questionable claims of disability when alleged to be caused by a disabling physical injury arising out of and in the course of employment while guaranteeing medical treatment as required by Division 4 (commencing with Section 3200) of the Labor Code. 4) Is there an Inherent Incongruence of LC (c) PD to be based on the AMA Guides: For AMA impairments, doctors are supposed to take into consideration Activities of Daily Living (ADLs), which include sexual function and sleep In SB863 Section I, the Legislature explicitly indicates there is no intent to overrule Guzman that allows a doctor to consider any table/chart for accurate impairment.
19 RE: SB863 Page 4 So one question is, does LC (c) disregard the ADLs of sexual function and sleep and disallow the use of certain AMA tables for disabled workers injuries? C. WHAT WE KNOW: WHAT HAS NOT CHANGED? 1) Treatment/Future Medical Care: LC (c) explicitly allows for treatment of sleep dysfunction, sexual dysfunction, and psychiatric disorder for any compensable injury 2) TTD Benefits: SB 863 SectionI(b) discusses PD and LC (c) references impairment ratings Since the statute and legislative intent are both silent regarding TTD benefits, it appears TTD benefits are available for sexual dysfunction, sleep dysfunction, and/or psychiatric disorder for any compensable industrial injury 3) Mental-Mental PD: Example: IW suffers harassment on the job and the good faith personnel action defense doesn t apply. IW receives compensable psychiatric impairment based on the GAF Scale for depression and anxiety But Psyche PD in mental-mental case isn t an increase in WPI it is the rating 4) Physical Injuries: Query: What is a physical injury: The most reasonable interpretation of the statute would be physical injuries do not include mental injuries But does physical only mean orthopedic injuries? What about internal, GI, or rheumatologic injuries or injuries rooted in neurologic problems that cause sleep dysfunction, sexual dysfunction and/or psychiatric PD?
20 RE: SB863 Page 5 Example: IW suffers from CRPS, which causes sleep problems and depression. Are the sleep and psych problems compensable? 5) Violent Acts: Psych PD for Violent Act or Catastrophic Injury 6) Physical Problems due to Psyche: PD for Physical manifestations of psych claim in form of sleep and/or sexual dysfunction Example: IW suffers from depression, second robbery victim and has PTSD. IW spends an increasing time lying in bed. As a result, IW gains weight and suffers from sleep apnea Would sleep dysfunction be due to the mental-mental injury and not a physical injury, so should sleep impairment be compensable? 7) Arise Out of Physical Injury: When does an impairment arise out of a physical injury? Primary injury and direct cause vs. compensable consequence mechanism of injury vs. result 8) For Labor Code 4662 Cases: Sleep, sexual dysfunction, and psychiatric disorder conditions could possibly still be relevant in assessing total permanent disability for LC 4662 cases Sleep/sex/psyche impairment(s) are not providing increases in ratings the only rating is permanent disability based on all the facts of the case D. SPECIAL ISSUES 1) Combination Cases: For example, cases of posttraumatic stress disorder and physical disorder or physical disorders plus work stress predominant causal threshold?
