1 C A LIF ORNI A IMMIGR A NT POLICY CY CENTER Making the Affordable Care Act Work for Immigrants in California The California Immigrant Policy Center advances inclusive policies that build a prosperous future for all Californians using policy analysis, advocacy and capacity-building to unlock the power of immigrants in California. 1
2 Making the Affordable Care Act Work for Immigrants in California In 2014, as a result of the federal Affordable Care Act of 2010, 4.7 million Californians will gain access to quality health care through expansions in the Medi-Cal program and through purchasing health plans through the California Health Benefit Exchange (the Exchange)1. Although many more of California s immigrants and their families stand to benefit from these reforms, which will provide them with access to quality health care coverage, over one million unauthorized immigrants are explicitly excluded from buying affordable health insurance in the Exchange, and may have less options for affordable health care 2. For this reason, it is critical that state policymakers address the needs of immigrant families under health care reform in a way that reflects the reality in which these families and communities live. In this report we will examine the following aspects of health reform affecting immigrants: Affordability of Health Care For Lawfully Present Immigrants Addressing Complex Issues Facing Mixed Status Families Preserving Access to Health Care for Undocumented Immigrants v LAWFULLY PRESENT IMMIGRANTS AND THE AFFORDABLE CARE ACT (ACA) Although immigrants who are lawfully present in the United States will have access to the Exchange, there is a question of whether or not coverage will be affordable. For federal Medicaid, only a certain group of lawfully present immigrants are eligible and they remain subject to a five-year wait before they may enroll3. Fortunately, California s Medi-Cal program provides coverage for lawfully present immigrants with no five-year waiting period. 1 Cabezas, Livier and Lavarreda, Shana. 3 Policymakers must determine how to ensure that low-income, lawfully present immigrants who are currently eligible for Medi-Cal will be able to continue to afford health care. While many of these lawfully present immigrants will be eligible for the Exchange and related tax credits, they may find purchasing health insurance unaffordable because they have incomes below 133% FPL. It may be in California s best interest to ensure these immigrants remain in the Medi-Cal program after The ACA provides California with an option to enroll individuals with incomes between 133% and 250% FPL into a basic health plan rather than having them buy health insurance through the Exchange. The concern here is that individuals in this income range may remain uninsured if they cannot afford to purchase health insurance on their own, even with tax credits. The Basic Health Plan (BHP) is an alternative under the ACA that California can choose in order to make sure that health care is affordable for everyone. Under the Basic Health Plan, citizens and lawfully present immigrants in California who are below 250% FPL would be eligible for coverage. Policymakers should determine whether establishing a Basic Health Plan in California would allow more working Californians access to affordable health coverage. MIXED STATUS FAMILIES: U.S. CITIZEN CHILDREN LIVING WITH UNAUTHORIZED PARENTS Special efforts will need to be made to ensure that all eligible members of immigrant families are able to successfully enroll into the Exchange or Medi-Cal on January 1, For example, starting in 2012, policymakers will be charged with designing on-line portals so that individuals and families can search for, purchase, and enroll into health plans. In addition, the ACA requires that individuals have multiple pathways to be able to enroll so that there is no wrong door for getting health coverage. Every application and enrollment system created for Californians must address the needs of mixed status families given the composition of the state s immigrant families. Specifically, it will be imperative for policy makers to ensure that beta testing is done with immigrant families to ensure that the system can adequately manage the complexities of enrolling eligible members of mixed status families. It will also be important to ensure that the IT system within the Exchange is designed to ask questions only of those applying for coverage, discloses the use of the information to be provided, and strongly adheres to privacy protections so that eligible members of immigrant families will feel secure and confident about using these new enrollment systems. The Affordable Care Act encourages horizontal integration, which would allow the system to integrate and connect a family s enrollment in health care coverage under the Exchange with other health and human service programs that a family may be eligible for, such as CalFresh or child care services. After 2014, horizontal integration may even be able to connect low-income immigrant families to programs and resources for which they are eligible at the same time they are applying for health care. Because of the diversity of California s population, policymakers must prioritize outreach and education and especially develop plans to reach vulnerable populations such as immigrant communities. California should 3
4 hold multilingual focus groups in partnership with community based organizations and legal services agencies that work closely with immigrants and limited English proficient (LEP) communities to ensure that California s diverse population s needs are met. More eligible families are likely to enroll after 2014 if California builds on the success of the promotora 4 and other health outreach models that have helped to connect families in California to health care that they can afford. UNDOCUMENTED IMMIGRANTS As the state of California implements the Affordable Care Act, policymakers will need to take into account a host of issues affecting access to care for immigrants. The Affordable Care Act explicitly excludes unauthorized immigrants from the federally funded Exchange. Unauthorized immigrants also remain ineligible for federal health programs such as Medicaid, CHIP, and Medicare. They will remain eligible for Emergency Medi-Cal, community health centers, and public health services after Unfortunately, this exclusion of unauthorized immigrants from buying insurance within the Exchange, even at full price, contradicts the vision/mission that the California Health Benefit Exchange has which states: The vision of the California Health Benefit Exchange is to improve the health of all Californians by assuring their access to affordable, high quality care5. 4 Promotoras and Community Health Workers (CHW s) play a critical role in promoting community-based health education and prevention, particularly in communities that have been historically underserved by the U.S. health care system. Promotoras and CHW s represent a rich spectrum of characteristics that makes them the bridge between health care institutions, professional providers and community residents in need of health care services. 5 So, while many Californians will have more affordable health insurance options, more than a million Californians will remain left out of the exchange and be forced to remain uninsured. Given the large immigrant population in California which includes many families with mixed immigration statuses, state policymakers must consider workable options for addressing affordable access to health care for those who will remain uninsured after Protecting and strengthening access to community clinics and rural health centers for non-emergency care as well as developing innovative ways to provide care to the uninsured will be critical for meeting the overall goal of building a healthy California. A recent report from the Immigration Policy Center showed that California s immigrants pay $2.7 billion in sales, income, and property taxes 6. California should consider providing a state tax credit to assist those who will struggle to purchase insurance so that they will continue to have access to quality affordable care. From Access for Infants and Mothers (AIM) to Child Health Disability Prevention (CHDP) to Regional Centers, there are a number of health programs available to Californians regardless of immigration status. California has invested in these programs over many decades to make sure access to critical health care services for vulnerable populations such as children or persons with disabilities is available regardless of their insurance status. As we approach 2014, it will be extremely important for policymakers to ensure that the needs of the populations served by these critical programs are adequately met and to protect access until that time. 6 Immigration Policy Center.
