Introduction 1.1 Summary The Office of the Regulator of the National Lottery (The Regulator) invites tenders for the provision of the following service: To provide bespoke website design and a content management system for the Office of the Regulator of the National Lottery. 1.2 History and Background to the Regulator On 27 February 2014, the Minister for Public Expenditure and Reform granted a licence to operate the National Lottery to Premier Lotteries Ireland. The award of the 20 year licence followed a competition which took place between May and October The licence was granted in accordance with the terms of the National Lottery Act Premier Lotteries Ireland took over the operation of the National Lottery on 30 November The National Lottery Act 2013 established the post of Regulator of the National Lottery and the first Regulator took up the position on 17 November The establishment of an independent regulatory office is one of the key components of the revised model for the National Lottery provided for in the Act. Under the Act, the Regulator may appoint staff and the Office currently has sanction for 10 members of staff. The role and functions of the Regulator of the National Lottery are set out in the National Lottery Act The Act provides that the principal function of the Regulator shall be to procure the holding of the National Lottery. The Act also requires the Regulator to ensure: (a) That the National Lottery is run with all due propriety (b) That the interests of participants in the National Lottery are protected (c) That the long term sustainability of the National Lottery is safeguarded and (d) That, subject to the above, revenues raised by the National Lottery for good causes are as great as possible, subject to any terms in this regard contained in the licence. The Regulator is also responsible for managing and controlling the National Lottery Fund. Page 4 of 25

5 2. Nature of Services Required 2.1 Service Required Provision of bespoke website design and a content management system for the Office of the Regulator of the National Lottery. Functionality on the website should include, but is not limited to; Bilingual Website Provision (Gaeilge and English) Accessibility Options Social Media Integration Downloadable files (PDF, Word, etc.) Multi-Platform Capability (mobile devices etc.) Multi-Browser compatibility. Visitor Statistics Search Engine Optimization. Good user experience with simple uncluttered graphical layout that is easy to navigate. Sitemaps. Functionality on the Content Management System should include, but is not limited to; CMS Specification (Name, Platform, Open-Source or Proprietary etc.) Creation, Deletion, Editing and Organising Pages. Restrictions on changing design and colour scheme. Accessibility and Usability for people with visual impairments. Roles and Permissions for different users Ability to revert to previous version of page. Provision of training to ORNL Staff on CMS. Prevailing web design standards adhered to. The Office of the Regulator of the National Lottery reserves the right to amend this Invitation to Tender. Any amendments will be ed to all tenderers. The tenderer must acknowledge receipt of all amendments issued. 2.2 Contract Timeframe Without prejudice, the Regulator will endeavour to appoint a suitable tenderer by 16 October 2015 and must be in a position to take on the contract form 2 November Also without prejudice, the Regulator would intend to retender for these services after 3 year. However, the Regulator reserves the right to terminate any agreement with the successful service provider(s) and / or to retender for the services at any time. Page 5 of 25

6 2.3 Escalation Procedures The successful tenderer(s) will be required to provide details of their escalation procedures, including contact names and telephone numbers in the event of faults or problems not being resolved satisfactorily and/or within the timescales agreed in 2.6 below. 2.4 Maintenance of Website The successful tenderer will be required to maintain the website and ensure the Office of the Regulator of the National Lottery can update the content on the website. The maintenance should be billed at an hourly rate with a detailed breakdown given for both office hours and out-of-office hours. The contractor will also be expected to keep the configurations of software under active review with the objective of increasing resilience, improving fault tolerance and reducing the risk of system degradation or failure. A defined procedure for software configuration changes must also be put in place. This will include full documentation of software changes. Details of how the tenderer plans to implement rigorous testing of any changes that would affect the user s experience or the reliability or functionality of the website must also be documented and included in the tender. 2.5 Security Requirement The safe, secure and reliable functioning of the Regulator s website is vital to the day to day conduct of the Regulator s business. The successful service provider(s) will work with the Regulator and its ICT Service Providers to maintain the security of the website, server, network, PC s and laptops. The Regulator aims to be ISO compliant and the successful service provider(s) will ensure that all areas under their control are compliant with the security standard. All diskettes, CD s, USB or other storage devices brought into the Regulator s office must be checked for viruses, malware, etc. before use. A defined procedure for software update, version or configuration changes must also be put in place. This will include full documentation of software update, version and configuration changes. It will be the responsibility of the successful service provider to ensure effective version management systems are in place. Page 6 of 25

7 All software used will be maintained up-to-date at n or n-1. This includes the implementation of the most up to date security patches, service packs etc. issued by manufacturers. Reconfiguration work undertaken by the contractor must not compromise the security of the configurations. The successful service provider(s) will conduct annual audits of any additions or modifications they made to the Regulator s IT equipment, network, etc. to ensure compliance with the ISO security standard and report on such. The successful service provider(s) will be required to conduct these services in a confidential manner as outlined in section 5.10 of this tender document. 2.6 Level of Service A one hour or less response to telephone or queries from ORNL staff available during office hours. Four hour or less on-site response during the aforementioned office hours. Details of how the tenderer plans to deliver a 24/7 support package in case of a systems failure that does not self-recover. Costs pertaining to this service should be listed separately. Remote Support: In those circumstances where remote access is required, either to diagnose or resolve a reported problem/issue, such access is normally provided by the service provider through a secure application. The tenderer must indicate whether this is adequate for their needs or otherwise detail how they would implement remote support. An annual disaster recovery test (dates and duration to be agreed between the Regulator and the service provider) will be conducted with the retrieval of a backup, full installation and testing of the recovered system and reporting on the test. Estimated time for this procedure should be included in the tender. A dedicated technician with appropriate experience, support, holiday and illness cover will be required to carry out these services. The successful tenderer(s) will be required to assist and liaise with our internal, external and other auditors in relation to any information technology issues that may arise. Page 7 of 25

Required Format of Tender Tenders must include the following information and be presented in the following format and order as set out in sections 3.1 to 3.8 below: 3.1 General Information The following information must be supplied: (a) The name, address, telephone, fax number and address of tenderer. (b) The name of the person within the company dealing with the tender. (c) Confirmation of acceptance by the tenderer and any third parties of the conditions of tender described in Section 5 of this document. 3.2 Firm Profile The following information must be supplied: (a) A brief history of the tendering firm. (b) A list of the principal contracts (in particular similar work) undertaken in the last 3 years, with dates and recipients, public or private, of the service provided. (c) Any other relevant information. 3.3 Management of Project and Technical Personnel Assigned The following information is required: (a) The name and position of the person within the company nominated to be responsible overall for the contract. (b) The name of the Project Manager responsible for the delivery of the website. (c) The names of the proposed personnel who would be responsible for ongoing delivery of the service including cover arrangements. Page 8 of 25

9 3.4 Organisation Profile Regarding Technical Capability The following information must be supplied: (a) Provide a summary of the organisation s technical approach to website development and maintenance including any design methodologies and quality assurance standards that the organisation uses. Include details of the CMS and any other programming languages (java, html, CSS, SQL, JavaScript etc.) that you propose to use. (b) Outline the technical experience/expertise of the project management and technical personnel you propose to assign to this project for the duration of the contract and also outline how you will warrant that any employees, contractors, 3 rd party agents etc., have the necessary skills and business maturity to supply/support our website with due care, skill and diligence. (c) Contingency plans in case a key member of staff leaves your company and how any replacement can be assured to have the skills required so as not to negatively impact the project. 3.5 Delivery of Service Including Ongoing Maintenance The tender must specify the arrangements envisaged for the project management and delivery of the website and how they plan to keep the Regulator informed of project progress. The tender must also outline their strategy for the ongoing maintenance and development of the website over the course of the contract. The tenders should also provide information about the provision of 24/7 emergency support in the event of a systems failure and our website not recovering automatically. 3.6 Costs The tender must specify a cost for the delivery of the services specified in section 2.1. These costs must be broken down into: 1. Development costs. 2. Maintenance costs. 3. Any ongoing licensing costs for tools used such as a proprietary CMS. 4. Training for four ORNL staff. 5. Emergency cover charges/costs. Page 9 of 25

10 Any restrictions or qualifications in respect of the quoted prices must be specified in the tender. Prices should be expressed exclusive of VAT. Details of how the costs would vary over the duration of the contract must be specified. The cost of the tender must be your best and final offer. 3.7 References Tenderers should outline their relevant experience of providing services similar to this project. Tenderers are required to demonstrate that they have an acceptable level of experience in delivering previous similar contracts over the past 3 years. The Office of the Regulator of the National Lottery reserves the right to contact the referees provided. Three contract examples should be provided in the following tables. Page 10 of 25

Evaluation of Tenders and Award Criteria 4.1 Pre-Screening Qualification Tenderers to whom any of the circumstances listed in Article 45 of EU Council Directive 2004/18/EC, (Coordinating procedures for the award of public works contracts, public supply contracts and public service contracts) apply, will be excluded from this competition. Tenderers not so excluded will then be initially evaluated by reference to the following qualification criteria: (a) Completeness of tender documentation as specified in this document, (b) Completed tender declaration form (Appendix A,B, C & D), (c) Demonstrated ability of tenderer(s) to meet the requirements specified in this document, (d) Technical capacity as evidenced by the information requested in the tender documents and, (e) Possible conflicts of interest. 4.2 Evaluation of Tenders and Award Criteria The contract will be awarded to the tenderer who is judged to have submitted the most economically advantageous tender having regard to the following award criteria: Award Criteria Weighting Delivery, Maintenance & Development Methodology 20% Technical Capability & Quality Assurance 14% Example 1 10% Previous Experience Example 2 10% Example 3 10% Initial Website Development 15% Costs Ongoing Maintenance 13% Training costs & ongoing license costs 8% TOTAL 100% Page 14 of 25

15 4.2.1 Quality of Service Offered (Weighting 64 marks split between the three parts) This will include an appraisal of: (a) The tenderer s overall approach to the delivery and management of the services requested in this document including the industry acceptance of the CMS used. (b) The level of experience and expertise of the proposed team members relevant to the contract & Quality assurance procedures used by the tenderer(s). (c) Previous Experience During the evaluation period clarification may be sought in writing from Tenderers. Responses to requests for clarification may not materially change any of the elements of the tenders submitted. No unsolicited communication from Tenderers will be entertained during the evaluation period. A number of the most competitive Tenderers may be invited to make presentations on their proposals for the purpose of elaboration, clarification and/or aiding mutual understanding. Any proposed subcontractors may be required to participate in the presentation Cost (Weighting 36 marks) In issuing this Request For Tender (RFT), there is no obligation, implied or otherwise, made by the Regulator to accept the lowest cost or any proposal submitted. Training for four ORNL staff in the use of the CMS used needs to be factored into the costs. Any ongoing costs associated with the licensing of software needs to be included for the three years of the contract. Page 15 of 25

16 5. General Conditions of Tender Detailed contractual arrangements are not within the scope of this document. However, the following conditions should be noted: 5.1 Article 45 of EU Council Directive 2004/18/EC Tenderers to whom any of the circumstances listed in Article 45 of EU Council Directive 2004/18/EC apply shall be excluded from this competition. 5.2 Conflict of Interest Any conflict of interest or potential conflict of interest on the part of a tenderer or individual employees or corporate or individual service providers of a tenderer, must be fully disclosed to the Regulator. All references hereafter to conflicts of interest shall include conflicts of interest or potential conflicts of interest arising either for the tenderer, individual employees or corporate or individual service providers relating to the tender. Tenderers should confirm in the course of their tender response that, prior to responding to this RFT, comprehensive searches to identify any conflict of interest have been carried out. Tenderers are expected to exercise all reasonable care in ensuring that they are aware of any conflicts of interest which exist or may arise at any stage of the process. Should any such association or conflict of interest emerge at any time subsequent to the submission of a response to this RFT, it should be immediately disclosed to the Regulator and confirmed in writing by registered post. Notwithstanding any other provisions which may apply in law, the discovery or emergence of a conflict of interest on the part of a successful tenderer(s) after the award of the contract, may, at the sole discretion of the Regulator, void the contract. In such an eventuality, the Regulator shall not be liable for any costs or loss incurred by the successful tenderer(s) or other party up to the time of the voiding of the contract. Any registerable interest involving the service provider, members or staff of the Regulator must be fully disclosed in the response to this RFT, or should be communicated to the Regulator immediately upon such information becoming known to the service provider, in the event of this information only coming to their notice after the submission of a bid and prior to the award of the contract. 17 The terms 'registerable interest' shall be interpreted as per Section 2 of the Ethics in Public Office Act, Tax Clearance The selected service provider (and agent, where appropriate) will be required to promptly produce a Tax Clearance Certificate from the Irish Revenue Commissioners before appointment. Before any contracts are awarded, the selected service provider (and agent, where appropriate) will be required to comply with the prevailing tax clearance procedures viz: (a) A selected service provider resident in Ireland will be required to promptly produce a Tax Clearance Certificate from the Irish Revenue Commissioners. (b) A non-resident service provider or sub-contractor will be required to produce a statement (in lieu of a Tax Clearance Certificate) from the Irish Revenue Commissioners confirming suitability on tax grounds to be awarded the contract. Where a certificate or statement expires during the course of the contract, the Regulator will require a renewed certificate or statement. All payments under the contract will be conditional on service providers being in possession of valid certificates at all times. 5.4 Health and Safety Compliance In accordance with Section 20(6) of the Safety, Health and Welfare at Work Act, 2005, the selected service provider must be in a position to provide an up-to-date safety statement showing how the safety, health and welfare of his/her employees shall be secured and managed. 5.5 Other National and EU Legislation The selected service provider will be required to comply with all relevant prevailing National and EU legislation. In this regard, the tenderers attention is specifically drawn to the fact that there is a body of national legislation in such areas as Official Secrets, Data Protection, Freedom of Information, Health and Safety, Employment and Equality Law, the relevant provisions of which the selected service provider will be required to comply with. 18 Tenderers must have regard to statutory terms relating to minimum pay and to legally binding industrial and or sectoral agreements in preparing tenders. 5.6 Requirements Tenderers should form their own conclusions about the methods and resources needed to meet the requirements of the tender. The Regulator will not accept responsibility for the tenderers' assessment of the requirements. 5.7 Contract Award Information supplied by tenderers will be treated as contractually binding. Without prejudice, the Regulator will endeavour to appoint the successful tenderer by 16 October The contract will not be awarded unless the tenderer can prove adherence to the various criteria outlined in this document such as tax clearance, health & safety compliance etc. 5.8 Non-collusion and Canvassing Canvassing by a tenderer may result in automatic disqualification. Where a tenderer has an existing relationship with the Regulator or its employees, the tenderer is advised that any discussions, correspondence, or other influences on the tender process may be treated as canvassing and dealt with accordingly. Tenderers particular attention is drawn to the application of the Competition Act The Act makes it a criminal offence for tenderers to collude on prices or terms in a public tendering procedure. Should the Regulator become aware of direct or indirect communications through trade associations or otherwise between tenderers relating to the proposals or which might facilitate price collusion, it shall be the policy of the Regulator to disqualify such proposals or tenderer(s) and to notify the matter to the Competition Authority with the recommendation that action be taken against such tenderer(s). Tenderers are required to complete the declaration attached in Appendix A and include this as part of their proposals. Page 18 of 25

19 5.9 Costs The Regulator will accept no responsibility for any costs incurred in formulating or presenting proposals. (a) Prices and rates quoted should be expressed exclusive of VAT. The VAT rate(s) applicable should be indicated separately. (b) The selected service provider shall be responsible for the delivery of all services provided for within the contract on the basis of costs set at the beginning of the contract. (c) Additional costs will be a matter for the service providers themselves. (d) Prices quoted in the tender cannot be increased during the currency of the contract. Similarly, terms and conditions cannot be altered. (e) Payment for all services covered by this invitation to tender will be on foot of appropriate invoices Confidentiality The Regulator undertakes to use its best endeavours to hold confidential any information provided in proposals submitted, subject to the Regulator s obligations under law. This includes the Data Protection Act, 1988 as amended and the Freedom of Information Act, 1997 as amended which place obligations on the Regulator to disclose information in response to queries from the public. If those making proposals wish that any information supplied in the proposal should not be disclosed because of its sensitivity, then this should be clearly stated, with the reasons for its sensitivity. The Regulator will then consult with firms that submit proposals about such sensitive information before making a decision on any Freedom of Information request received. Subject to law, all information provided by tenderers will be regarded as having been submitted on a confidential basis. Similarly, the Regulator requires that all information provided pursuant to this invitation to tender will be treated in strict confidence by the tenderer(s) Intellectual Property The Regulator will remain the sole owner of all materials, data and other information produced while providing these services. 20 5.12 Payment Method The successful tenderer must accept payment by the ORNL will be made by Electronic Funds Transfer (EFT) only Publicity No publicity regarding this public procurement competition, the award of a contract or the execution of any contract is permitted unless and until the ORNL has given its prior written consent to the relevant communication Submission of Tenders (a) Tenders must be completed in accordance with the format specified in Section 3. (b) Applicants to tender are requested to make their own arrangements to obtain proof of delivery of the tender, at the time and date specified below. (c) When submitting the tender by hard copy four copies of the tender proposals are required, in a sealed envelope, marked "Tender for provision of Website Design and Maintenance for the Office of the Regulator of the National Lottery and addressed to: Mr. John O Donoghue Office of the Regulator of the National Lottery Block D, Garden Level Irish Life Centre Lower Abbey Street Dublin 1 Tender proposals should also include the name and address of the tendering company on the outside of the envelope. (d) Tenders submitted by are acceptable, on the proviso that the tenderer can provide evidence of successfully ing the full tender proposal, not later than 5 p.m. on 25 September ed tenders can be forwarded to procurement@rnl.ie. (e) Tender proposals must be received by the office of the Regulator, at the above address not later than 5 P.M. on 25 September Tender proposals delivered after this time will not be accepted. 21 (f) (g) Please note any queries regarding this tender must be made no later than 5 p.m. on 21 September Any queries submitted after this date will not be entertained. The tenderer may submit an amended tender before the closing date but such resubmissions must be a complete replacement for the previous submission and clearly identified as such. The Office of the Regulator of the National Lottery will not merge new content with previous submissions. Any errors in the new submission is the responsibility of the tenderer and no corrections or re-submissions after the closing date will be accepted. Page 21 of 25
