3 General Administrative Guidelines for Extern and Clinical Courses at Elon Law This information packet is for students interested in participating in the clinical and extern courses offered at the Elon University School of Law. While registration for extern and clinical courses is administered in the same manner as other courses, extern and clinical courses differ substantially from other upper-level law electives as these courses allow students to participate in the representation of live clients under the supervision of an attorney. Since the student s learning experiences in these courses involve live clients, the parameters for participating in the courses differ than what may be the norm for other upper-level elective courses. Students interested in extern and clinical courses should note the following administrative guidelines: 1. Registration and the No-Drop Policy Students register for clinical and extern courses through the normal course registration process. There is no advance registration and registration cannot be accomplished by agreement with the course faculty or program Directors. As in all other courses, students must register online and seats in the courses will be allotted on a first come, first served basis. When the number of students registered exceeds the cap set by the program Director, students attempting to register will be placed on a wait list, which is administered by the Registrar s office. The Registrar s office will then contact the Program Director and inquire whether the cap for enrollment should be raised. Raising the enrollment cap is in the discretion of the Program Directors, subject to external concerns such as physical space and ABA supervision guidelines for extern and clinical courses. If the enrollment cap is raised, the Registrar will notify the students on the wait list, enrolling students based on their priority on the waitlist (the first student on the wait list will get the first opportunity for an open spot in the course, and so on). Because extern and clinical courses rely on actual live client representation under the supervision of practicing lawyers and clinical faculty, resource and planning decisions are made far in advance of the course s first class meeting. For example, the Clinical Director uses student enrollment to determine the appropriate caseload for the clinic in a given semester. Therefore, law students must commit to the courses at the time of registration. After enrollment, students are not allowed to drop an extern or clinical course without the permission of the Program Director. The regular drop/add period allowed for course changes in each semester does not apply to extern and clinical courses. 2. Role of the Program Directors All extern courses are part of the Elon Law extern program and supervised by the Externship Program Director. The Externship Program Director plans the extern program and works with other faculty regarding the supervision of student externs. The Externship Program Director must approve all student placements before commencement of the extern courses. Students interested in an extern course should contact the Externship Program Director to discuss Page 3

4 possible placements and timelines for settling placements. The Externship Program Director may set advance deadlines for placement confirmation and may decline certain placements if they fail to meet the ABA guidelines for extern courses or Elon Law s internal guidelines regarding course credit. The Externship Director has authority to withdraw a student from an extern course for failure to meet the course guidelines or for poor performance. All clinical courses at Elon Law involve supervised live-client representation in an established clinical setting. A clinic acts as an operating law office wherein licensed attorneys represent clients whose needs meet the stated focus of the clinic. Each clinic is supervised by a full-time faculty member who acts as the Clinical Director. The Clinical Director supervises all aspects of the clinic, including the supervision of lawyers and staff working in the clinic and the supervision of students. As the Clinical Director must assure the clinical courses meet ABA and Elon Law guidelines, the Director maintains authority over the academic programs in the clinic. Therefore, the Clinical Director may set internal policies, such as training requirements and professional responsibility standards, which all students participating in the clinical courses must follow. The Clinical Director can withdraw a student from a clinical course for failure to meet the course requirements. The Clinical Director also has authority to withdraw a student from a clinical course for poor performance. Page 4

5 General Externship 3 Credits (Summer Session); 3 Credits (Spring or Fall) The General Externship Course is a component of the Law School s Externship Program, which is designed to provide opportunities for students to gain practical legal experience while working under the supervision of attorneys and judges. The General Externship Course is an upper-level elective which consists of a combination of supervised work hours and periodic sessions with a faculty advisor. The course requires a minimum of 140 hours of work (during Fall and/or Spring semesters) or 180 hours of work (during Summer session) under the supervision of a state or federal government attorney, a judicial officer serving in a state and/or federal court, or an attorney employed by a non-profit public service organization. As part of supervised Externship work, students may observe client conferences, staff attorney meetings, negotiations, plea bargains, motion arguments, appellate arguments, trials, conferences, and other aspects of the legal process while under the supervision of an attorney or judicial officer. In addition, the student may research legal and procedural matters and perform such other tasks to support the legal functions, as the supervising attorney or judicial officer may require. In addition to the minimum hours of supervised work, the Externship course requires students to participate in sessions with a faculty advisor and submit reflective written work and time records. Students are eligible for the General Externship Course after completing two or three semesters at the law school, depending on the particular externship placement requirements. While students may register for the General Externship Course through the regular course registration process, the Externship Director must approve any Externship before classes begin, based on a deadline for placement approval specified by the Director. The General Externship Course is available for judicial, non-profit or governmental placements only. Students may not receive any compensation for their work in the Externship course. Professional Responsibility is a prerequisite if placement requires the Extern to be certified under the North Carolina State Bar Limited Practice Certificate Program. Elon Law Externship Requirements: To receive credit hours in the Externship Program students must: 1. Obtain an externship placement and have it approved by the professor 2. Work 10 hours per week for a total of 140 hours at their externship, during the fall or spring semesters, or 180 hours during the summer session 3. Complete the Learning Goals and Plan for the semester 4. Attend three individualized tutorials 5. Participate in discussion forums, meetings or panel presentations as assigned 6. Submit weekly journal entries and timesheets 7. Be evaluated mid-term by their supervisor 8. Submit a student evaluation of the externship 9. Be evaluated at the end of the semester by their supervisor Page 5

Students register for the Externship course, get their proposed externship work approved by the Externship Director and fulfill the externship course requirements, working the required number of hours, documenting the hours worked with weekly timesheets and reporting and reflecting on the type of work done through submission of weekly journal entries. How do externs know what they will be doing during their externship? Externs should research the office where they plan to work before beginning work there. At the beginning of their work in the office, externs set goals for their time in the externship and work with their supervising attorney to make a plan for achieving those goals. Are externs graded on their work? Externs work performance is assessed by their on-site supervising attorney with a Mid- Term Evaluation and a Final Evaluation, allowing externs feedback for professional growth. The Externship course is graded Pass/Fail. Can Externs work in for-profit law firms or corporations? No. Elon Law externs can only work in non-profit, government, judicial or other public sector offices. Can Externs receive stipends or other compensation for their work at their placement? No. Under ABA Standards, Externs cannot be compensated and still receive academic credit. How do students find out about available externship opportunities? Students learn about opportunities through Career Services, the Extern Director or personal contacts. All students are expected to meet with the Extern Director shortly after registering for the course. 12 Semester in Practice Externship Course 13 Credit Hours - Fall The Semester in Practice Externship Program is designed for qualified third-year law students who wish to work full-time in an approved governmental, judicial or non-profit externship, under the supervision of a lawyer, with the support of a faculty member who serves as teacher, coach and mentor. This competitive, off-campus program will support students who obtain full-time externships in government, judicial or non-profit organizations. Students will work 40 hours per week at their externship and participate in a concurrent academic component, which will include a faculty directed orientation session prior to the beginning of the semester in practice, written reflective assignments, telephonic conferences and tutorials and at least one site visit meeting with the student, supervising site attorney or judge and professor. Students will keep weekly timesheets. Supervising attorneys evaluate students in writing mid-term and at the end of the semester. Students will receive 13 credit hours, graded pass/fail. (11 hours are earned through field work, 2 credit hours are earned through participation in the concurrent academic seminar portion of the course.) Students accepted into the program will pay all standard tuition and fees required by their enrollment at the Elon University School of Law and are eligible for financial aid through the law school. Students are responsible for their own housing and transportation. Registration for the semester in practice externship is by approval of the Associate Dean for Academic Affairs. In assessing a student s application to register for the Program, the Associate Dean for Academic Affairs will consider various factors indicating whether taking a semester away from the law school could comprise the student s academic development or ability to succeed on the licensure examination. Interested applicants must be third-year law students during their proposed semester in practice and must have been accepted into an externship. Students may only participate in the Semester in Practice program during one semester of law school. Successful applicants will demonstrate strong character and fitness for practice, independent judgment and professional and personal organizational skills. Applicants will include faculty and employer references as a part of their applications. Students who previously participated in the Washington Center Externship Program are not eligible to participate in the Semester in Practice Externship. 13 Elder Law Clinic 4 Credit Hours The Elon University Elder Law Clinic was new in fall The U.S. Census Bureau estimates that one in five Guilford County residents will be over age 60 by the year As the number of elder residents grows, the need for expanded legal services will grow. The Elder Law Clinic was established as a general civil clinic to serve the legal needs of low income senior citizens in the Guilford County area and to expose young lawyers to a growing practice area. Clients: Guilford County residents over the age of 60 with monthly income of less than $1700. Services Provided: Working under the supervision of clinical faculty, students conduct research and provide legal services to clients, handling issues including but not limited to: Durable Power of Attorney Advance Directives for Health Care Medicaid eligibility Long Term Care planning Will Drafting / Estate Planning Consumer rights Real Estate Financial Exploitation Grandparent Rights Divorce Housing Insurance Issues Public Benefit Appeals / Administrative Hearings Course Format: Students are expected to spend an average 12 hours per week on clinic matters. There are three regularly scheduled clinic events each week: 1) seminars 2) case rounds and 3) case status meetings. Seminars Students are assigned readings and/or a research project that will be discussed in class during the weekly seminar. The seminars are designed to expose students to the techniques and theories for developing good lawyering skills, address the ethical issues that arise in an Elder Law practice, and provide some background on substantive elder law issues. The seminar also may expose students to other issues often overlooked in traditional law school settings, such as cross-cultural lawyering, balancing professional and personal lives, and social justice lawyering. Case Rounds Case Rounds are an opportunity for students to present information about cases and projects to the class, and to solicit feedback about issues confronting them in their work. Students should be prepared to present on their cases, providing background materials and a brief synopsis of the issues with which they are grappling. Everyone is expected to actively participate in case rounds, both sharing information about their cases and providing feedback to peers. Case Status Meetings Students are assigned a partner to work with on cases throughout the semester. For each case, one student is designated the lead attorney, although your partner is expected to be familiar with all aspects of the case, review and provide feedback on all documents, and participate in discussions of all cases. Each student team will meet with a Page 13

14 supervising attorney on a weekly basis to discuss their cases and projects. We will establish a standing weekly meeting time early in the semester based upon our collective schedules. Outside of the scheduled time described above, students have additional responsibilities each week. Each student s primary responsibility is to provide quality legal service to their clients. Students are responsible for handling all of the casework for their assigned clients, which includes: communicating with clients about their legal concerns, researching legal issues, gathering factual information, conducting interviews, counseling clients on options, etc. However, students also participate in mock client exercises, prepare presentations for the class, create informational pamphlets, and/or speak to the community at large on laws affecting older adults. Prerequisites: Professional Responsibility, Eligible for NC State Bar Limited Practice License Faculty and Staff: Prof. Margaret Kantlehner and Prof. Hannah Vaughan are responsible for supervising the student attorneys throughout their clinical experience. Candy Albrecht supports the clinic as a legal assistant. Assessment: There is no final examination for this course. 15 Humanitarian Law Immigration Clinic 4 Credit Hours The Humanitarian Immigration Law Clinic is a law office which operates year round to provide immigration related legal services to refugees, asylees, and others who have faced human rights violations. The Immigration Services provided: There are a variety of immigration related benefits that are handled by student attorneys in the clinic. The principal types of immigration cases that student attorneys will have the opportunity to handle are: Green Card Applications Naturalization Applications Petitions for Family Reunification Applications for Asylum Humanitarian Parole Applications Travel Authorization Replacement Greencards The opportunity also exists for any student who is interested to attend and represent clients in administrative hearings before officers of the United States Citizenship and Immigration Services, as well as attend other events including outreach with local populations and local refugee organizations and family reunifications. The Clients: The client base consists primarily of refugees, asylees or asylum seekers who have suffered persecution because of their race, religion, nationality, political opinion or social group and who have been given protection by, or are seeking the protection of, the United States Government. In addition our clients may include other persons seeking humanitarian legal assistance including Cuban Paroles, Human Trafficking Victims, and persons seeking temporary protected status due to conflict or natural disaster in their home countries. HILC clients are from populations that come from many and varied places around the globe including Afghanistan, Bhutan, Burma, Congo, Cuba, Iran, Iraq, Liberia, Somalia, Sudan, Togo, Vietnam and Zimbabwe, among others. Prerequisites: Students must have completed all of the first-year requirements and have undertaken Professional Responsibility. Students are not required to apply for NC State Bar Limited Practice Certification. How is the Course Conducted? As this is a clinical course undertaken in a law office, the structure of the course is not that typically experienced by law students in a doctrinal course. The following is intended to provide an overview to students as to how the course will be take place this procedure operates in most, though not all cases. The Course will involve 3 hours of formal class time each week. These three hours per week include class lectures in which students will gain knowldege of relevant immigration law, Page 15

16 but in addition to this will also involve Partner s Meetings during which student attorneys discuss the cases that they are handling; caseload review with their supervising attorney to ensure that the student attorney has a suitable and not overburdensome workload; and other exercises relevant to gaining additional practice skills including interviewing, office management and professionalism. In addition to the 3 hours of formal class time, students will commit themselves to two additional hours during which the student will conduct elegibility screenings with new clients (meet with the client and determine whether the client is legally entitled to the immigration benefit he or she is seeking). These two one hour blocks are chosen by students to suit their schedule and will remain constant for the duration of the semester. After the client is found to be eligible for legal services, the student will schedule a follow up interview (referred to as a benefits interview ). These interview sessions can last between 2-4 hours. Students are able to schedule the benefits interview once again at a time that is convenient to their schedule. The only limit on scheduling is that the interviews must be scheduled within regular office hours (9:00am-5:00pm), to ensure that a supervising faculty member is in the clinic while the interview is being conducted. Eligibility screenings and interviews are conducted by students after receiving instruction from supervising faculty and having the opportunity to observe an interview/screening. Students are given great autonomy in the conduct of their cases and have primary responsibility for their caseload. Students should be assured however that at all times a supervising faculty member will be on hand to discuss, assist and review the students work at each and every stage. Upon completion of a client s benefits interview the student attorney will finalize all relevant documentation for review by their supervising faculty member. After review by the supervising faculty member, the client s application will be forwarded to the United States Citizenship and Immigration Services for assessment. Clinic Access: Although client interviews are to be conducted within regular office hours, students are welcome to work on their files in the clinic outside of these times, including nights and weekends. Clinical Hours: Students must complete 150 hours of clinical work as part of the requirements for satisfactory completion of the clinic. On average this means that student attorneys are expected to work approximately 12 hours per week on clinic work to meet the minimum requirement of 150 hours during the semester (based on a week semester). The hourly requirement includes, but is not limited to: Class preparation Classroom time Case supervision Casework Meetings, telephone calls, correspondence, etc. Page 16

17 Community work Administrative duties such as file maintenance, telephone duties and logging information into the clinic s computer system Meetings with supervising faculty concerning the course/assigned case/s Meetings with case partners Attending benefits hearings and interviews (if applicable) Partner Meetings Research Assessment: Grades will be allocated on a Pass/Fail basis. To earn a passing grade students must: complete the 150 hours of clinic work; at all times conduct themselves within the code of professional conduct; work proficiently and to a high standard on assigned cases (this includes conducting professional relationships with clients, exhibiting exemplary lawyering skills, undertaking proficiently research and writing skills, adhering to office management requirements, being punctual for all meetings, interviews, classes, meeting of any deadlines and completion of cases (as required) prior to the end of semester; attend class; and actively participate in class discussion, Partner s Meetings and any other required exercises. There is no examination for this subject. 18 Small Business and Entrepreneurship Clinic 3 credit hours The Small Business and Entrepreneurship Clinic ( SBEC ) is a law office which provides business-related legal services to entrepreneurs and small business owners who would not otherwise be able to afford legal representation. Students learn by acting in role - in this case, in the role of a practicing attorney. The primary purposes of the course are to help students develop the skills they will need to represent clients successfully and ethically once they enter the practice of law. As such, the SBEC is designed to provide interested law students with an opportunity to develop a number of practice skills related to: (1) general legal counseling, (2) choice of entity advising, (3) organizational document drafting and review, (4) N.C. Secretary of State compliance, (5) contract review and drafting, (6) employment and H.R. advising, (7) regulatory compliance, (8) financing documentation, and (9) dealing with issues of professional responsibility which arise in the course of solving clients' problems. Prerequisites: Professional Responsibility and Business Associations. Business Drafting, though not required, is strongly encouraged. Clinic Hours: Students are expected to complete 130 hours of clinic work during the semester which time includes class meetings, firm meetings, client meetings, drafting, administrative office work, and other tasks assigned by the professor. Grades: Graded course; no examination component. Student-Lawyer grades will be based on the following: Client Service, ethical representation of live clients and simulated clients, including interviews of clients, research on behalf of clients, communications with clients, documents drafted for clients, support of colleagues in their representation of clients, document signing ceremonies, adherence to office protocol, etc. Participation in firm meetings, class attendance, and participation in firm management. Students will keep a portfolio or notebook with copies of their work and journal entries, or other evidence of and reflection on their work efforts, for submission and final review at the end of the semester.
