2 POLICY STATEMENT DUI Education Centers is a voluntary alternative to the Workhouse or jail for offenders convicted of all vehicle related offenses including but not limited to DUI, Reckless Endangerment, and Reckless Driving. This program is a private alternative to a correctional facility. At DUI Education Centers, we offer an environment in which clients are able to serve their time without being exposed to the criminal element that exists in correctional facilities. In turn, our program helps to alleviate the overcrowding of jails and saves tax payers money. We provide a safe place for clients to serve their time associated with all vehicle related offenses including but not limited to DUI, Reckless Endangerment, and Reckless Driving where they are also able to receive education and think about the mistake they have made. In the eighteen years of the Swaim Center s (now DUI Education Centers) existence, there has never been a violent act. We are fortunate to have Dr. Swaim, the original founder of the Swaim Center (now DUI Education Centers), on staff at our facility for the next three years. Everyone who participates in the programs offered at DUI Education Centers must follow all rules and regulations. Failure to do so will result in the person immediately being asked to leave. The individual s judge and probation officer will be notified of his/her failure to complete the program. No person is admitted to our facility while under the influence of alcohol or any illegal drug or while overly medicated on mood altering prescription drugs. DUI Education Centers provides no medical care and is not responsible for medical bills resulting from injury, illness, or other sickness while any individual is serving time or participating in DUI Education Centers programs. Any medical expenses are the sole and individual responsibility of the client. Every effort will be made by the staff of DUI Education Centers to see that clients receive all necessary emergency treatment in a timely and responsible way. First aid and CPR 2

3 will be administered for those who have need or want it. Emergency Services will be notified of any serious or life threatening condition. DUI Education Centers provides a bed and allows the client the opportunity to complete the DUI School and Victim Impact Panel while at our facility. We offer this twelve hour DUI class every Saturday. Further, clients attend a daily DUI class based upon the principles of Jim Rohn. In addition, each student attending the DUI School will receive a professional alcohol and drug assessment. Also, we host meetings every day at 8:00 a.m. to discuss daily thoughts and have evening round table discussions. We offer a tranquil setting to encourage client s self reflection. DUI Education Centers is not a Workhouse, correctional facility, or substance abuse center. Our programs are educational. Guest time spent here is voluntary. Should a guest choose to leave, he or she may do so at any time. The client s probation officer and/or judge will be notified of such an occurrence. Mission Statement To provide a safe, rewarding sentencing alternative that offers state of the art DUI education cirriculum in order to empower residents to make positive life choices that lead to a more productive, healthier lifestyle. 3

4 1. Check-in process CLIENT CONDUCT DUI EDUCATION CENTER RULES a. Upon informing staff client has arrived, client will empty his/her bags into the provided plastic containers. b. After client s belongings have been inspected, client will be escorted to residential area, and will be instructed on facility s procedures. c. Any client attempting to check in who is under the influence of alcohol, drugs, or who is overly medicated on prescription medication will be asked to leave, and may not be permitted to return. 2. No short shorts or halter tops. Shirts must touch top of pants. Jeans, sweatpants, and dresses are acceptable. 3. Smoking is permitted outside in designated areas only. Clients who smoke inside will be asked to leave. Judge/Probation Officer will be notified. 4. Cigarette butts are to be put in the smoker s outpost. 5. Clients must dress appropriately when outside. Shirt and shoes are to be worn at all times. 6. Absolutely no communication between men and women will be permitted while staying at the facility, except during the DUI class. 4

5 7. All clients must be inside for the night by 10:00 p.m. The only exception to this is an emergency situation, in which case the office must be notified as soon as possible. Any resident caught outside in a non-emergency situation will be asked to permanently leave. 8. Clients must remain inside until 7:00 a.m. 9. All clients must turn off all lights and televisions by 11:00 p.m. 10. Clients who snore are encouraged to use Breathe Right strips, or another device for the prevention of snoring. 11. Bathrooms, personal, and common areas are to be kept clean. Daily inspections will be performed. 12. Visitation is on Sunday only, from 1pm to 3pm. Absolutely NO visitation will be permitted outside these hours. 13. Clients may walk outside in designated areas. 14. Clients are to bring all prescribed medications in the prescribed bottles with client s name and dosage. This will be turned in and dispensed per the doctor s orders. ANY drugs not turned in will be considered as contraband. This applies to over the counter medication as well. Failure to do so will result in client being asked to leave the facility permanently. Spot checks of luggage, personal belongings, and room searches are performed at random. 15. Any person bringing alcohol and/or illegal substances onto the premises will be transported immediately to the Rutherford County Jail. 16. If client is asked to leave for failure to comply with the conduct policy set herein, no refunds will be made, and the appropriate authorities will be notified. 5

6 EXCLUSION CRITERIA The following are conditions under which an individual may not be admitted to this facility: 1. Any person who is obviously intoxicated or under the influence of alcohol or any drug, including, but not limited to, overuse of prescription medication. 2. Persons with certain severe, life-threatening medical conditions. 3. Persons with certain mental/emotional disorders DISRUPTIVE BEHAVIOR MANAGEMENT If a client becomes disruptive or unruly, the following methods may be employed, depending on the severity of the situation: 1. Talk to the client 2. Contact the Director 3. Ask client to leave premises 4. Call 911 MEDICAL A. Each client will undergo a preliminary background screening by staff during intake. B. Medical history will be taken and data recorded on medical information sheets. The completed sheet will be placed in the client s file. C. No client will be admitted to the Center while under the influence of drugs or alcohol. A person with any serious injury or illness must be seen at a physician s office or the emergency room and receive a letter of clearance before entering the Center. D. Basic first aid supplies are in the file room. E. Staff person on duty will accept and note complaints of minor nature. These complaints will be reviewed by the Director to ensure appropriate medical attention is provided. F. If a medical condition arises after admission to the Center and a client requires a medical doctor, follow procedures below: a. If a serious emergency, call 911 and request an ambulance 6

7 b. If not a serious emergency (for example, person is mildly sick) call responsible person to transport individual to medical facility. c. Notify next of kin and the Director. G. All medication and medical supplies will be placed in proper envelopes and stored in a locked cabinet to minimize the abuse of medications. H. If the individual refuses to take prescribed medication, it will be noted on the medical sheet and initialed by staff. I. Any of the following symptoms will be considered an emergency and require calling 911. At the same time, notify next of kin. Conditions are: a. Severe bleeding b. Unconsciousness c. Serious breathing difficulties d. Head injuries e. Severe burns f. Severe pain g. Suicide attempts Rutherford County Crisis Response Team will be notified. (Guidance Center) J. Mental and Emotional Any individual suspected of being mentally ill or of being a potential suicide risk must be closely observed. Following are indicators which may require individual to see a physician: a. Hallucinations Hearing voices, seeing visions; b. Illusions Misperceiving, thinking they are someone else; c. Delusions Strange ideas or beliefs, cannot control thoughts; d. Hyperactivity Constant moving, talking, cannot sleep; e. Withdrawal Very little activity, refusal to eat or sleep; f. Obsessions Persistent thoughts, unable to control; g. Compulsion Repeated actions such as washing hands constantly; h. Phobia Unrealistic fear, hyperventilation; i. Catatonia Unusual, rigid posture; j. Flight of ideas Strange speech No order in speech. 7

8 Exhibition of some of the above can also be related to withdrawal symptoms from alcohol/drugs. If any of the above are manifested, contact the Director immediately. VISITING HOURS Client visitation will be on Sundays only, from 1:00 p.m. to 3:00 p.m. No other visitation will be allowed at any other time. BATHING AND DRESS CODE Showers are available in shower room areas. Any person staying twenty-four (24) hours or more will be encouraged to shower at least once for each 24-hour period. Clients are not to wear short shorts or halter tops. Shirts must cover entire abdominal region, and are to be worn when outside. Shoes must be worn at all times while outside. Flip flops or sandals are acceptable. 8

9 DORMITORIES Each client will be provided the following: (1) A clean, serviceable, fire retardant mattresses; (2) A bed storage area; (3) A desk and chair; (4) All bedding materials. 9

10 FOOD AREA We have a kitchen in each dorm in which clients may store food should they wish. OTHER SIGNIFICANT DATA 1. If the need arises and a request is made, religious services or counseling is available by volunteer ministers. 2. Since the facility may be considered a home for a night, normal home security procedures apply. To prevent unauthorized entry, outer doors are to be locked. These doors can be unlocked from the inside. 3. All construction materials and bedding materials meet fire safety standards. Copies of the rules will be given to each person at the time they enter the Center. 4. Keys to every locked door in the center are located in the KEY LOCK BOX, which is in the Director s office. 5. In the event that the use of force becomes necessary, only that amount of force needed to restore order will be used. 10

11 EMPLOYMENT/PERSONNEL Part-time staff is hired through normal processes, that is, completion of an application for employment and interview, and completion of the required training. Standards of employment are: High School graduate or GED; No adult felony convictions; At least twenty-one (21) years of age; Free of all apparent mental and physical disabilities; Be of good, moral character; and All employees must pass an extensive background check. TERMS AND CONDITIONS OF EMPLOYMENT 1. Starting salary will be based upon the Center s established pay scale at the time of employment. 2. All employees may be terminated for any cause at any time. 3. All employees must be able to manage the people who are participating in the program. This is VERY IMPORTANT. 4. All employees must be able to complete the intake and release of guests as required by these rules and appropriate forms. 5. Dress code will be casual but appropriate. No jeans, except on 3 rd shift. EMPLOYEE RESPONSIBILITIES A safe working environment can only be achieved if all employees strive to create and maintain such an atmosphere. It shall be the responsibility of each employee to: 1. Make safety the first consideration in every employment situation. 2. Accept the responsibility for his/her own safety and for the safety of those employees under their supervision. 3. Abide by all safety procedures as prescribed in this booklet. 4. Report unsafe practices or work conditions promptly to immediate supervisor. 5. Use only tools that are in good, safe working condition. 11

12 6. Remain on the job to which assigned and do not distract other employees. Safety Work Rules 1. Personal protective equipment such as safety glasses, mask, safety shoes, gloves, hard hats, back belts, aprons, and other safety items shall be worn in any job position requiring their use, and in accordance with rules and regulations or manufacturer s recommendations. 2. When using paints, solvents, or any other hazardous materials, use the proper personal protective equipment. Follow all warnings on labels and keep personal equipment clean. 3. No employee will climb a ladder without a second employee standing at the ladder s base to keep it steady. DRUG FREE WORKPLACE DUI Education Centers is a drug-free workplace. All employees shall be made aware of the Center s policy regarding drugs in the workplace, and will be given documentation detailing such policy. Substance abusing employees will be referred to appropriate treatment providers. 12

13 EMERGENCY PROCEDURES A. Source of power. The Center operates of the same power as the main building, located at 135 Capital Way. B. Emergency Lights. Activate automatically when power is interrupted, and are located in each room. These are tested quarterly by the Director. C. Sprinklers. The facility is equipped with sprinklers which will activate in the event of a fire. D. Immediate Backup Help. Available by staff calling 911, the Director, or another staff member. E. The Center is equipped with smoke detectors. In case of a fire, all persons are to be evacuated, following the posted emergency exit signs, are to assemble in a safe place away from the fire, and 911 is to be called. Portable heaters are not permitted in the Center. Fire extinguishers are located in each room of the Center. F. Escape. Escapes are to be reported immediately to the Director by staff person on duty. G. Disturbances. In the event of a disturbance, immediate action will be taken to quell the disturbance. Range of action, from minimum up, will include: a. Talk to the individual(s). b. Call 911. c. Notify Director. DEATH In the event of a death from any cause, seal off the area and notify the Sheriff s Department emergency operators at 911, and the Director. WEAPONS No staff will bring any weapon into the Center. 13

14 ADMINISTRATIVE NOTES All client information is strictly confidential. Staff members will not release information to anyone regarding clients without the approval of the Director. No individual (former employees included) will be given information about any client. DUI Education Centers is committed to protecting and improving the environment by recycling commonly used materials such as cardboard, glass, et cetera. 14
