As County Philip oversees the provision of legal services to a wide range of public sector organisations and is head of the profession. He is also Monitoring Officer and Clerk to Essex Fire Authority and Returning Officer to Essex County Council. 5 PEOPLE DEPARTMENT Welcome to the People Department: The strategic manager is Alex Hallam, Assistant County, Dorothy Simon is Head of People. Education The department gives advice to schools about all aspects of education law including parental responsibility, access to pupil records and disability discrimination. 9 ADULT SOCIAL CARE Welcome to Adult Social Care. The strategic manager is Shirley Jarlett, Assistant County ; Derek Jones, Ciaran O Hart and Julia Crow are Section Leaders. Adult Social Care: The work consists of all aspects of adult social care for Essex County Council and both North and South Essex Mental Health Foundation Trusts. The department has expertise in dealing with judicial review for adults and children matters, Court of Protection work including advising the deputy office within the Council, transition of service users from children s to adult services, safeguarding of vulnerable adults, give legal advice on drafting of policy and evidence of all aspects of adult social care including the personalisation of the service and protection of vulnerable adults guidance. Mental Health: The department also advises on all aspects of mental capacity and mental health including displacement of nearest relatives, advising AMHPs on all aspects of work, implementation of the amendments to the MHA and MCA, advising on DOLs, conflict of interests, policy, protocols and guidance. The department advise on legal aspects of residential care funding and immigration including dealing with litigation in respect of age assessments. 10 DISPUTE RESOLUTION ADVOCACY/ENFORCEMENT Welcome to the Dispute Resolution Department. The strategic manager is Shirley Jarlett, Assistant County, the Head of Dispute Resolution is Chris Dyton and the Section Leader is Natasha Taylor. We deal with Advocacy/Enforcement/Childcare Crime : this work consists of prosecuting trading standards breaches, education matters (non-attendance and exclusions), probation breaches and environmental & highway breaches. Work is carried out on behalf of Trading Standards, Essex Probation, Essex Schools and District Councils. The Department has particular expertise in dealing with probation breaches and manage up to 2,000 prosecutions a year. Public Interest Immunity Law is applied to criminal court orders for disclosure. The work consists of complying with criminal court orders relating to the disclosure of sensitive County Council files to assist both the prosecution and defence in a criminal trial. This involves ensuring that the information disclosed complies with the order and that information that should not be disclosed is redacted. The Department has particular expertise in dealing with Local Authority law matters and work well with the police and the local criminal courts to ensure that proper disclosure is made and that the criminal trials are not hampered. Childcare: The Childcare Advocates within this team specialise in lengthy complex and contentious childcare proceedings on behalf of social services. The department s work consists of defending claims in the Employment Tribunals with a focus on proactive interventions to prevent claims. This includes providing advice at the earliest stages, giving input into the development of client HR policies, producing and delivering training and advising on new case law and legislation. The department also provides general employment advice on TUPE as well as advice on compromise agreements, the new disciplinary and grievance procedures, service level agreements and pensions. Our clients include Essex Fire & Rescue Service, Essex Probation, Essex Police and London Probation. The department has particular expertise in dealing with Local Authority law matters with a unique practical experience of TUPE (both incoming and outgoing). The team deals with the Commons Registration Authority functions (including searches, new application for registration and applications to vary rights) and modifications of the Definitive Map under Schedule 14 Wildlife and Countryside Act Our lawyers have expertise across diverse areas of work including:- access land issues, commons and village greens non statutory public inquiries, Commons and village greens search replies and processing of statutory applications in relation to register, Advice on common land and village greens and applications to vary register, Land drainage and coast protection and Country parks.
