1 SCOPE OF WORK The Occupational Health and Counselling Services has been Accredited by the Faculty of Occupational Medicine Safe Effective Quality Accredited Occupational Health Service Coventry City Council Traded Services for schools 2013/14 Occupational Health Provision of a medical and nursing advisory service. Advice and support will be available on work and health issues for head teachers, governors and staff. Specific advice and guidance will be given where particular groups such as pregnant women, nursing mothers, disabled employees, young people and those nearing retirement are concerned. Health related advice to inform strategic planning: anticipating changes to the working environment and the possible impact on health. Health assessments and medical examinations. These are undertaken both preemployment and where the health of an employee becomes a matter of concern, usually as a result of prolonged sick leave or frequent but relatively short periods of sickness absence. These examinations allow the occupational health practitioner to assess health issues in relation to work requirements and advise head teachers, governors and staff on reasonable adjustments and ability to undertake the activities required in the post. Health assessments/medical examinations in relation to redeployment or retirement due to ill health Pre-employment: Questionnaires will be reviewed within two working days and an offer of an appointment made where required. A report will be sent to the employer within 2 working days of a health assessment. Employee health assessments: Following both health and workplace assessments a report will be sent to the employer covering such issues as, likely return to work, underlying health problems, on-going attendance, disability considerations, modifications and reasonable adjustments. Case conferences can be undertaken where further advice/discussion is required to successfully manage an employee's sickness absence. Workplace assessments in relation to the prevention of work related ill health. Visits to the workplace and familiarisation with processes, materials and equipment used, together with an awareness of protective measures, will enable the occupational health practitioner to identify and assess hazards and risks that may affect health. An awareness of the physical and psychological problems inherent in certain jobs such as repetitive work and stress plays an important part in these assessments.
2 Health surveillance and statutory medical examinations in line with legislative requirements and guidelines. Vision screening and musculoskeletal advice for employees working at DSE workstations and associated equipment. Head teachers are responsible for reporting ill health conditions under the Reporting of Injury, Diseases and Dangerous Occurrences Regulations (RIDDOR). The Occupational Health and Counselling Service will provide advice and support in liaising with the Health and Safety Executive and maintain statutory records relating to work related ill health. Biological risk audits and advise on health protection measures for schools/academy's Coventry City Council Traded Services for schools 2013/14 Advice on the legal provision for first aid in the workplace. Counselling Service The Counselling Service is equipped to provide a comprehensive range of strategies to support, advise and guide head teachers, governors and staff on emotional and psychological issues impacting on the individual and the workplace. The core services offered include: Confidential one to one counselling will be provided, for employees facing problems or crisis that could affect their work. This will enable an individual to examine the issues causing distress, develop coping strategies and find a way forward, helping to minimise the mental and physical impact of such events and the sickness absence that may result. In supporting employees, various therapy models can be used, including person centred counselling, cognitive behavioural therapy, transactional analysis and relationship counselling. Advice to head teachers and governors on wellbeing practice, enabling them to support employees experiencing problems. Advice, guidance and support to head teachers and governors on avoiding stress in the workplace. Stress can have a major impact on health, motivation and productivity. The Service will provide advice, guidance and support to head teachers and governors on managing stress in the workplace. Training and Audit are additional tools that can be accessed through the service to effectively address such issues. Liaison with head teachers and governors to ensure that appropriate staff support is provided at times of change and/or crisis. Informing head teachers and governors of situations and issues that affect their responsibilities for people or services. Counselling for victims of assault and violence.
3 Debrief counselling and focus groups. The Service will provide group or individual debriefing, where a traumatic incident such as the suicide of a student/colleague has impacted on individuals at work Group, on-line, telephone and support, including on-line Cognitive Behavioural Therapy and group relaxation for panic attacks and anxiety. Advice and guidance on retirement issues. PERFORMANCE TRACKING & REPORTING QUALITY & PERFORMANCE The Occupational Health & Counselling Service has a service policy of constant review and development in order to improve the quality and the cost effectiveness of its current services, as well as offering new or extended facilities to provide better value to its customers. The quality and performance of the service will be assessed in accordance with the standards laid down in the Service Specific Protocols & Procedures and Business Process Maps, and are regularly monitored by our quality auditor for timeliness, accuracy and adherence to specification. Feedback will be sought regularly from customers on the quality & performance of the service and suggestions for improvement will be welcomed. Coventry City Council Traded Services for schools 2013/14 The Occupational Health & Counselling Service will ensure that it keeps abreast of clinical developments, market place service and system developments. PERFORMANCE MEASURES The Occupational Health & Counselling Service monitors aspects of its performance quantitatively. These measures are based on the following targets: Communication with Customers Acknowledge all customer correspondence within 3 working days Respond to/resolve all written enquiries or complaints within 10 working days For health assessments, an offer of an appointment will be made within 5 working days of receipt of the referral form. A report will be sent to the employer within 3 working days. Where specialist reports are required the Service will make it clear to the specialist that a response is required within 4 weeks of making the request and will pursue any non-response on the employer's behalf, keeping the employer informed of progress. Quality of Service Process all data input that is received in the Occupational Health & Counselling Service by the input deadlines
4 Implement Audit recommendations to agreed deadlines. Performance monitoring and review meetings will be held between the Occupational Health & Counselling Service and the academy. If there are any causes for concern by either party regarding compliance with this agreement this will be subject to immediate discussion with a view to reach a solution acceptable to both parties. STAFFING Qualifications of Key Personnel Occupational Health The Occupational Health Service is staffed by a team of qualified, professional nurses, physiotherapists and medical officers, who are members of their respective professional bodies, i.e. the Nursing and Midwifery Council and the General Medical Council. 6 The cost of providing an occupational health and counselling service as outlined, will be 29 per fte per annum. It includes the time spent by both Medical Officers and Occupational Health Advisors. If there is any reason to challenge an invoice, the academy is requested to advise the Occupational Health & Counselling Service Manager of the reasons in writing within one week of the invoice date to enable early resolution. ADDITIONAL CHARGES Specific training courses will incur separate costs. A full range of specialist training courses are available. Prices are based on location and type of training, together with the total numbers involved. You can request a full list of available training, including Emotional Resilience, First Aid at Work and First Aid for Visit Leaders. Some Courses Currently Available Stress Management and the Supervisory Role The Human Element in Conflict and Aggression Creating Self Esteem Developing a Team - A psychological approach to overcoming problems The Psychology of Mediation First Aid at Work Training Infectious Diseases Alcohol Awareness Managing Mental Health in the Workplace Health Education Training Well being days and one to one healthy lifestyle screening for staff, which includes screening measures such as blood pressure, cholesterol, blood sugar checks and urinalysis. Wellbeing events are bespoke and the cost varies depending on therapies and workshops required. Wellbeing (Stress) Audits and bespoke post assessment support programmes, which meets HSE requirements. Mediation and Team building - the Service will provide team building and mediation services to support head teachers and governors in ensuring that appropriate support is given at times of change and/or crisis. Payments to external providers will incur separate costs, including reports from General Practitioners and Consultants, vaccinations and blood tests. Below is a table summarising the Occupational Health & Counselling s charges for work undertaken that is not covered by the basic charge.

The contract can be provided over a 12 month or longer period. A Service Level Agreement is drawn up once the contract has been agreed. Contract charges are reviewed annually. Any additional charges will be raised separately.
8 DATA PROTECTION Coventry City Council is registered with the Information Commissioner s Office. Occupational Health & Counselling shall ensure that its employees, agency workers engaged in its services, or sub contractors shall process the data controller s information in line with the associated Data Processing Agreement appended to this agreement. MEDICAL CONFIDENTIALITY Medical and counselling records will be held securely within the Unit and will be stored in line with Data Protection and medical legal requirements. All employee information shall be treated as confidential by both (company) and the Occupational Health and Counselling Service MEDICAL LIABILITY INSURANCE COVER The Occupational Health and Counselling Service is covered under the terms of Coventry City Council's Public Liability Policy against third party claims for personal injury or physical damage to property arising from negligence of the Council, its employees, servants or agents. In addition, the Occupational Health and Counselling Service holds professional negligence insurance specifically to cover third party claims arising from negligent acts or omissions from the sale or delivery of the professional services to outside organisations. OTHER STANDARDS The Occupational Health & Counselling Service is and will continue to be registered with the Data Protection Registrar for the duration of the agreement under the appropriate categories for Data Protection and shall comply with all obligations under the Data Protection Act 1988 insofar as performance of the Service gives rise to obligations. Should the Occupational Health & Counselling Service become aware of or suspect any irregularity in regard to any transaction involving the academy this information shall be immediately notified to the academy. Any attempt at bribery, corruption or improper conduct which comes to the notice of the Occupational Health & Counselling Service shall be immediately notified in writing to the academy and shall reimburse the Council for any expenses incurred in co-operating with, and providing statements or other evidence to its internal and/or external auditor's police or any other competent authority responsible for investigating any possible irregularities. The Occupational Health & Counselling Service shall maintain records of all work carried out for and on behalf of the academy and shall keep them in a secure and confidential manner. INTELLECTUAL PROPERTY The Occupational Health & Counselling Service shall (except as may be provided in this agreement or by law or by the consent of an employee) ensure that its employees do not divulge to any third party any information which comes into their possession in the course of providing the Service. SUBJECT ACCESS REQUESTS Should a Subject Access Request be made by an employee/former employee of the academy to see personal information that the Occupational Health & Counselling Service holds about them, the Occupational Health & Counselling Service will be required to forward the request immediately to the academy. The Data Processor must not deal with this request on behalf of the Data Controller.
9 DURATION OF AGREEMENT The agreement may be terminated by either party giving to the other 6 months notice in writing of such termination Without prejudice to any other pre-existing rights or remedies the agreement may be terminated immediately in writing by either party if the other party is in fundamental breach of the agreement and fails to remedy such breach within 28 days of the receipt of notice The Occupational Health & Counselling Service are not responsible for any failure to perform or for delay in performance or any obligation in this agreement if such delay is caused by Act of God, War, Strikes, lockouts, trade disputes, accidents or other cause beyond its reasonable control and which materially affects the performance of such party. Coventry City Council will indemnify the academy in respect of loss and damage arising from any breach of Employment Services obligations under this agreement. Should this agreement be terminated, the Occupational Health & Counselling Service will hand over to the academy's Occupational Health Provider, medical records relating to employees and former employees following the provision of consent as outlined in the Access to Medical Reports Act Where this involves the extracting of electronic data the Occupational Health & Counselling Service reserves the right to pass on any costs involved. Computer and other access to information will be limited to those that need to have access to it to carry out actions and services described in this Agreement The Occupational Health & Counselling Service will meet as requested with external statutory agencies and if appropriate internal/external auditors providing services to or with the academy. CUSTOMER DUTIES AND RESPONSIBILITIES The academy will be responsible for the following: Ensuring that information provided to the Occupational Health & Counselling Service is accurate and up to date.
