1 REPAIR OF WATER LEAKS OR SEWER LINE LEAKS ON PRIVATE PROPERTY Many times we get calls from town residents telling us that y have a water line leak or a sewer line leak and caller expects City of Petersburg to fix ir problem. While City recognizes that average homeowner does not have capability to repair ir sewer or water leaks City is not in business of performing plumbing repairs and does not repair plumbing leaks on private property or that are responsibility of homeowner. The homeowner is responsible for any water leak from point where homeowner's water line connects to water meter and n proceeds to residence. The City is responsible or any leak in meter itself or in water line that goes from water meter to City's main water line. The Citv is also responsible for any leak in main water distribution line. For sewer line problems City is responsible for main sewer line and homeowner is responsible for all parts of homeowner's sewer line including where it connects to City's main line. In past City has made repairs to sections of lines that homeowner was responsible for and homeowner n failed to pay City for repairs. Therefore, City has changed its policy and now requires homeowner to sign attached Water/Sewer Repair Agreement before City will dig up connection near water meter or dig up where sewer line connects to City's main trunk line to ascertain problem. The attached Agreement requires homeowner to make a $ deposit before City will dig up area and homeowner also agrees by signing Agreement that y will pay for any repair if leak is on that section of line that is homeowners responsibility. If City digs up water meter or sewer connection and problem is on City's side of water meter or if problem is on City's main sewer line n City will make repairs and homeowner will not be charged for repairs and homeowner's deposit will be refunded in its entirety.

2 Keep in mind that just because a plumber tells you that City is responsible for repair this usually is not case. Your plumber, like us, rarely can tell what problem is until we dig up connection point of sewer or point of water leak. If leak or problem is on homeowner's lot we will not take any action and homeowner will have to call a plumber or contractor to repair problem. The City will only dig around water meter or sewer line connection point to determine problem. If problem is at connection point City may make repairs or ask that homeowner get ir plumber io make repairs. As stated previously, if result is that issue is responsibility of homeowner, n homeowner is responsible for cost of digging,rp th. area and making repairs. If homeowner digs up area mselves, y must first call dig test at g11 to have utility lines in area marked prior to digging. If homeowner digs up area and damages any utility lines n homeowner will be responsiute foi cost of repairs. Before City will dig in any area City also calls to have utilities marked. This can take up to a couple of days for utilities to be marked and checked out by City. The City responds to customer requests on a first come first serve basis and in order of priority of items City needs to take care of first. Therefore, if you are experiencing a problem we encourage you to first call your plumber to see if y can solve your problem. If you need to call us n call andask for Public Works Director. If he is not available please leave a message with City Secretary and message will be forwarded to Public Works Director.

3 WATER/SEWER REPAIR AGREEMENT This Water/Sewer Repair Agreement ("Agreement") is entered into this day of 20l-by and between City of petersb*g 6City"; and ("Customer") concerning property located at Petersburg, Texas. Name: Address: CUSTOMER INFORMATION (REOUTREp) Mailing Address if different than physical address: Driver's License Number Social Security Number State of Issuance Date of Birth Customer has requested that City of Petersburg investigate cause of a water/sewer problem and by execution of this Agreement agrees to pay all costs associated with investigation and repair of problem specified below by Customer: Initial: Customer agrees to make a $ deposit before work will begin by City and to pay any remaining charges beyond deposit amount upon receipt of an invoice from City. Customer also agrees to pay alate charge of 3Yoper month for any unpaid amounts starting 30 days after date of invoice generated after completion of repairs or investigation. Page I of 3

4 Customer agrees that city is under no obligation to make investigation repairs or and is doing so only as a convenience to th. Customer. Customer acknowledges that he/she has right to employ a licensed plumber to make repairs/investigation that is requested. By execution of this Agreement Customer is agreeing to forever waive any and claims all of any nature, including attorney fees, Igainst City of petersburg, Texas, its officers, elected offltcials, employee.,ld/o, agents or designees relating to identification, investigation, and iepair or non-."pui, of any water/sewer problem set forth above and it is Customer's intent that this waiver of claims 9f any kind' origin, or nature be intemrpted to be as all encompassing as possible including, without limitation, waivei of any claims for darnage to above described property and structures or improvements reon, or.rid.. property, that may or may not have been observed during investigation or repair of above described problem. Customer also agrees and understands that any repairs made by City do not contain any warranties or guarantees of workmanship or quality and are being done by City only as a courtesy to Customer and in consideration of payments to be made hereunder. Customer also agrees and understands that after investigation of problems specified above, City may decline to enter into repairs and Customer will be billed for all work and labor incurred to said point in time that City refuses to go furr. Customer acknowledges receipt of Labor and Equipment Rates which are attached hereto. Customer agrees that materials will be billed at cost. Customer furr agrees that he/she are not relying on any representations of any City employee as to cause or responsibility foi probl"* set forth above and agrees that no City employee has made any cost estimate of total amount it will cost to resolve problems set forth above. By execution of this Agreement Customer acknowledges that he/she understands that maintenance and repairs to individual sewer lines are responsibility of Customer and that City is only responsible for repairs and maintenance of Page2 of 3

5 main sewer line' Therefore, Customer is responsible for every part of main line sewer from line to customel's building or residen... in regards lines to water customer acknowledges that he/she inderstands that customer responsible is for repairs and maintenance of it's water line from meter Customer's into property and residence or building.
