2 AGENDA July 16, 2013 Page 2 of 2 The City Council meets the first and third Tuesday of each month beginning at 7:00 p.m. Meetings are held in City Hall at 321 Walnut Street and audio recordings of the meetings are posted on the City's website at The City may take action on any matter during this meeting, including items that are not set forth within this agenda. Minutes of the City Council meetings can be obtained from the City Clerk's ohice. The minutes are recorded, bul are not transcribed verbatim. Persons requiring a verbatim transcript may make arrangements with the City Clerk to duplicate the recordings, or arrange to have a court reporter present at the meeting. The cost of duplication and(at court reporter will be at the expense of the requesting party. 3 CITY OF GREEN COVE SPRINGS, FLORIDA STAFF REPORT FOR SPECIAL SHADE MEETING OF JULY 16,2013 SUB.meT: The City Council is holdjng a special shade meeting at 6:30 p. m. on July 16, The purpose of the meeting is stated on the agenda. The Council has received backup information on this issue, which indicates that an attorney for one defendant in the City v. Tillinghast condemnation suit is seeking very large attorney fees and costs from the City. Our special condemnation attoj11cy, Fred Isaac, wi ll attend this meeting to discuss our strategy regarding this topic and will be able to answer questions from Council Members..BACKGROUND: The City has condemned and now owns real propcl1y presently used for a retention pond at the northwest corner of Gum Street and Cypress Avenue. The City has already negotiated and paid for the property and Attorney Ad Litem fees. Addi tional issues to resolve include attorney fees and costs being sought by one of the defendant's attorneys. A hearing is set before the Honorable John H. Skinner, Circuit Jud ge, on August 1,2013, to resolve this matter. Our special condemnation attorney wishes to full y inform the Council and to seek direction from jt. FISCAL IMPACT I FUNDING SOURCE: Unknown, but total exposure of the City is shown 0 11 the backup documents previously sent to the Council. STAFF RECOMMENDATION: Council may deem appropriate.
