CORPORATE PRIORITIES AND POLICY CONSIDERATIONS 2.1 The Corporate Plan provides that We will continue to drive costs out of the council through transforming our internal organisation, reducing the costs of providing services and giving better value for money. To meet the Council s corporate priority of Better services with less money there is a strategic goal to maximise improvements and savings in back office functions. 3. RISK MANAGEMENT ISSUES 3.1 As part of the review and remedial activities process in 2008, Information Systems (IS), in conjunction with Adult Social Services, conducted a review of the current SWIFT Oracle managed service. This service provides Oracle support for both the Children s Service and Adult Social Services SWIFT systems. From the findings, it was apparent that procurement of support on an ad-hoc basis carried risks for both services, as there were no formal agreements in place with the supplier. In order to reduce the risk and formalise these arrangements I.S. worked with the Children s Service and Adult Social Services to establish support requirements. 4. EQUALITIES AND DIVERSITY ISSUES 4.1 Under the Equality Act 2010, the council and all other organisations exercising public functions on its behalf must have due regard to the need to: eliminate discrimination, harassment, victimisation and any other conduct that is prohibited by or under the Act; advance equality of opportunity between those with a protected characteristic and those without;

4 promote good relations between those with a protected characteristic and those without. The protected characteristics referred to are: age; disability; gender reassignment; pregnancy and maternity; race; religion or belief; sex and sexual orientation. It also covers marriage and civil partnership with regard to eliminating discrimination. 4.2 Formalising arrangements with e-dba, supports equality and diversity as the SWIFT system holds information on people in care. The Council can extract analysis reports from Swift based on a number of criteria, for example, age, gender, ethnicity, location, to name just a few demographic options available to report on. SWIFT is the main care package that is used by the Council to support the vulnerable people in the community. 4.3 e-dba s Equal Opportunity Policy states It is the policy of e-dba Limited to treat all employees and applicants fairly and equally regardless of their sex, sexual orientation, marital status, race, colour, nationality, ethnic or national origin, religion, age, disability or union membership status. Based on this statement I am satisfied that they would comply with the Equalities Act USE OF RESOURCES IMPLICATIONS (Finance, Procurement, Performance & Value for Money, Staffing, IT, Property, Sustainability) 5.1 To comply with the council s Contract Procedure Rules two alternative quotes from different suppliers were requested and obtained. These were 33,000 from Supplier A and 38,000 from Supplier B. 5.2 The service will be procured from Supplier A, e-dba, who will carry out the management and monitoring of the SWIFT Oracle systems, improving support for the Swift databases. 5.3 The cost of the contract with e-dba is 33, LEGAL ISSUES 6.1 The council s public sector duty, pursuant to the Equalities Act 2010 is set out in paragraph 4.1, above. 6.2 The contract value is below the, relevant, European threshold and, consequently, the requirements of the Public Contracts Regulations 2006 do not apply to this contract award. 6.3 A formal written contract, between the Council and e-dba will be prepared and executed on behalf of both parties.

CONSTITUTIONAL POWERS 7.1 Council Constitution, Part 3, Responsibility for Functions - paragraph 6.1 provides that Chief Officers may take decisions without consultation with the Cabinet Member concerned where it is a decision authorised to be taken by the Chief Officer under the Contract Procedure Rules. 7.2 Council Constitution, Contract Procedure Rules - Rule 6 and Table 6-1 of the council s Contract Procedure Rules require a minimum of 2 written competitive quotations to be obtained before a contract with a value of 25,000 up to 74,999 may be awarded. 7.3 Council Constitution, Contract Procedure Rules - Section 5 (Authorisation & Acceptance Procedures). Table 5-1 sets out authorisation and acceptance thresholds for works, supplies and services and provides that Directors/Head of Service can accept tenders/quotations up to a value of 173,933 where: a) it is the lowest; or b) represents value for money and is the best available option for the Council. 8. BACKGROUND INFORMATION 8.1 The provision of the Swift Oracle Managed Service by e-dba will be 33,000 for a period of six months. 8.2 The recommendation made by IS is to award this contract to e-dba for the Swift application to support the system for the duration of six months from 10 th December 2012 until 10 th June 2013 with a provision to extend the contract for further six months if required. 9.
