DUI and the Bishop Cook s Case

1 Page 1 of 7 Her name is Heather, and she is an alcoholic. She is also an Episcopal priest, and the recently elected suffragan bishop of the Diocese of Maryland. On Thursday, January 16, Heather Cook was released on bail from the Baltimore Women s Detention Center where she had been held on a $2.5 million bond since being charged with manslaughter and drunken driving in the December 27, 2014 crash that killed Thomas Palermo, a 41-year-old cycling enthusiast and father of two young children. When Cook was tested after the crash her blood alcohol content was.22, almost three times the legal limit of.08 in Maryland. She was allegedly also texting while driving, and she left the scene of the crash, failing to return for half an hour. Cook is reportedly now in an inpatient treatment facility. She is scheduled to appear in court on February 6. This horrible and needless tragedy has elicited some thoughtful and serious commentary on the bishop search process, the prevalence of alcohol in the culture of the Episcopal Church, and the role of clergy in recovery in the leadership of the church. I am going to address each of these issues. The national church has a set of guidelines to be used by dioceses in the bishop search process. The Diocese of Maryland followed those guidelines in the search process that resulted in the September election of Heather Cook to suffragan bishop. Among the guidelines is that all candidates for bishop are to be referred to a psychiatrist for evaluation. This was done with all five candidates in the process in
2 Page 2 of 7 the Diocese of Maryland. Cook was deemed fit to continue in the process. The exact details of her discussion with the psychiatrist are protected under HIPAA regulations. 1 According to one priest in the Diocese of Maryland who was present for a briefing on the Cook incident by the Bishop of Maryland, the search committee and standing committee were told a candidate has a DUI in her past. Both committees were asked if this would disqualify the candidate. Both responded, no. Additional details of Cook s arrest were not disclosed, including how long ago it was (2010), her blood alcohol content at the time of the arrest (.27 over three times the legal limit, indicating severe intoxication), and the presence of drug paraphernalia and marijuana in the car (this charge was dropped). The release of minimal information about the 2010 arrest is in keeping with the national church guidelines on handling sensitive information in the search process. Also in accordance with national guidelines the information about Cook s previous DUI was not disclosed to the electing convention. There are some holes in the national guidelines for bishop selection that need plugging. A priest in the Diocese of Maryland wrote in a Pastoral Letter to her parish that, our guidelines are woefully inadequate and naïve in addressing the complex problems of substance abuse and addiction. Questions regarding how one is managing and treating a chronic condition like addiction, or any other chronic condition which could impact a clergy s ability to serve as a church leader, are questions which need to be addressed as part of the search process. 2
3 Page 3 of 7 Many people in the Diocese of Maryland are angry because the details of Cook s 2010 DUI arrest were not made public to the delegates who were charged with voting for bishop. Cook was reportedly encouraged to disclose information about the incident during the walkabout meetings but she chose not to do so. Hindsight is 20-20, of course. But Cook s lack of candor in disclosing the prior DUI arrest raises serious question about whether or not she was addressing her alcoholism. Revising the process for more transparency in disclosing to search committees and stand committees, reflects a priest in the diocese, would likely have resulted in Heather s candidacy for bishop ending before her name was put forward for election. 3 Bishop Cook s case is extreme, of course. Her level of intoxication in both the 2010 and 2014 incidents is hard to fathom. As a result, it is easy to dismiss what happened in Baltimore two days after Christmas as an aberration. However, some in the church have used the Maryland incident to address the pervasive presence of alcohol in the Episcopal Church. The Rev. William A. (Bill) Doubleday notes in an essay reprinted on the Episcopal Café website that, I have long been troubled by the number of Episcopalians clergy, seminarians, and laity who regularly or occasionally drink to serious levels of excess. I expect most readers of this article can recollect Bishops, Priests, Deacons, Professors, Lay Leaders, Congregants, Family Members, and others whose lives were marred and probably shortened by the excess use or abuse of

I suspect we are all acquainted [with] those who struggle with being Adult Children of Alcoholics or with serious Co-dependency Issues. 4 On the blog, Angels in the Alley, the Rev. Dr. Hilary Smith posted the following: I never felt peer pressure to drink until I joined the Episcopal Church. Let me give you a few examples of what I mean. So many times at church events, when I am offered a glass of wine or a beer, and I decline... immediately the person follows up with, it s ok, you can have a drink. I usually have to refuse the drink two or three times before the person will let it go. During an interview process for a position in a church, I was offered a drink by a vestry member during the social time before dinner. When I stated that I was good with the water I was drinking, this vestry member stated, We like to drink with our priest. I didn t get the job. There is a culture in the Episcopal Church of drinking and being proud of it. 5 Dean Mike Kinman of Christ Church Cathedral in Missouri writes, I know that my own Diocese of Missouri had an active alcoholic bishop when I first arrived here as a college student in I know there was an intervention done at the end of his tenure and that he lives now in courageous long-term recovery but that our diocese has never truly addressed his alcoholism or the systems of dysfunction that led us to call him, sustained him and did not magically disappear when he left office. 6 Thousands of dioceses and parishes including this one mirror the situations cited by Dr. Smith and Dean Kinman. All of us need to take a hard look at the role alcohol plays in our faith communities at every level of the church. We
5 Page 5 of 7 might find, as one commentator has noted, a significant cultural practice that is often at odds with our stated values. 7 While we Episcopalians really like our alcohol we do not make it easy or safe for impaired clergy to acknowledge their substance abuse. Such an admission can be a career-ender. Perhaps that was why Heather Cook chose not to disclose a DUI arrest in her past. One response to the tragedy is Maryland is to declare that the church should not ordain alcoholics. That would be like throwing the baby out with the bathwater. What we should be doing is asking the hard questions when a person is in the ordination process. If we believe a substance abuse problem exists or we know of acting out behavior we need to engage in tough love at that point rather than ignoring the problem and allowing it to get worse with the passage of time. Many clergy in the Episcopal Church are alcoholics in recovery. They have been sober for years and they are actively engaged in programs to maintain their sobriety. As a result of these programs, clergy in recovery welcome ways to be held accountable for their sobriety. Most clergy in recovery have no problem disclosing their alcoholism when it is appropriate or when it might be helpful to another alcoholic. These clergy are also often involved in education programs around addiction. The incident in Baltimore on December 27 has weighed heavily on my heart since I first read about it. And, frankly, it has made me angry.
6 Page 6 of 7 Thomas Palermo did not have to die. In an instant, two young children were deprived of their father. In an instant, a wife became a widow. Thomas Palermo was riding his bicycle in Baltimore, as he had done so many times, adhering to the rules of the road. Thomas Palermo was killed because a motorist did not adhere to the rules of the road. That motorist drove while intoxicated; that motorist was allegedly texting while driving; that motorist left the scene of the crash. That motorist was an Episcopal priest who clearly did not have a handle on her alcoholism but who, in spite of that, successfully maneuvered her way through a process that resulted in her election as bishop. That motorist chose not to treat her alcoholism and she chose not to disclose a past DUI arrest. That motorist will have to live for the rest of her life knowing that her negligence resulted in the death of another human being, and that she may go to prison as a result. The Rev. Anjel Scarborough, Rector of Grace Church in Brunswick, Maryland, closed a Pastoral Letter to her congregation with these words: As the Church, we set [Heather Cook] up to fail by confusing forgiveness with accountability. We did not hold her accountable to a program of sobriety and we failed to ask the tough love questions which needed to be asked. In so doing, we offered cheap grace and that is enabling. 8 This tragic incident provides us the opportunity for serious reflection and discussion. May God give us the courage to wrestle with the role alcohol plays in the culture of the Episcopal Church. May God give us the strength to speak the truth in a
7 Page 7 of 7 spirit of love and ask the tough questions when it is necessary even if those questions are of ourselves. May God s love and comfort be with the family and friends of Thomas Palermo as they learn to adjust to life without him. May God bless their laughter and their tears. May God s healing power envelope Heather Cook as she engages in treatment for her alcoholism. May God give her the blessing of insight into her life. May God s will that all things be made new motivate us to fix what is broken so that a senseless tragedy like that which took place on the streets of Baltimore on December 27 never happens again. 1 Pastoral Letter from The Rev.
