1 SCHEME OF WORK A-LEVEL LAW LAW02 The Concept of Liability For use in exams from 2015 Copyright 2014 AQA and its licensors. All rights reserved

2 This Scheme of Work is for guidance only: it is a suggestion from a current teacher of how the LAW02 course might be structured. It assumes that 14 weeks teaching will be available for this unit and a similar period for LAW01, and that students will sit exams in both LAW01 and LAW02 at the end of the AS course. It also assumes that students arrive with little or no prior knowledge. A short period of time will be required for induction activities to introduce the subject, to include: showing the difference between civil and criminal laws and cases discussing where laws come from considering who is involved in the civil and criminal justice systems. There is also the possibility of considering progression and careers with a qualification in Law. Visits from professional lawyers and past students will help to show students what can be done with a Law qualification. Any unused time after completion of study material can be used for exam revision. The LAW02 paper requires students to answer all questions on criminal liability and either tort or contract. Each year, it obvious from the exam papers that many students disadvantage themselves as they do not finish answering all the required questions on the paper. You should therefore build in some time to practise answering questions within the time allocated, throughout this paper. 2 of 10

3 Unit 2: Crime: general principles Suggested teaching period: 3 weeks Introduction to crime; actus reus acts, omissions, state of affairs and result crimes Causation Mens rea Coincidence; transferred malice Strict liability offences and reasons for strict liability Case studies of actus reus cases; Case studies of mens rea cases; Case studies of relevant cases; Case studies of strict liability cases; teacher input into reasons for existence of strict liability. 6 Unit Two: Tort of negligence Suggested teaching period: 3 weeks Introduction to tort and duty of care Breach of duty Loss and damage Res ipsa loquitor Case studies of duty cases; write and answer. Case studies of breach cases; write and answer. Case studies of damage cases; write and answer. This topic can follow on from induction and/or can be integrated with civil courts and ADR topic from LAW01. There is a choice of tort or contract topics most students will follow tort topic. However, if it is planned to study contract in unit 3, consideration may be given to the study of contract in this unit. Need to cover each of Caparo 3- stage tests.
