7 ALL ARRANGEMENTS WITH BIMINI BOATYARD BAR & GRILL ARE SUBJECT TO THE RULES AND REGULATIONS OF THE RESTAURANT AND THE FOLLOWING CONDITIONS: Payment shall be made according to the terms and conditions of the restaurant management. If the terms and conditions of payment are not fulfilled, the restaurant management shall have the option of cancelling the contract upon 24 hours notice to the person who signed the agreement or any officers of the group and organization. DEPOSIT: A non-refundable deposit of $ is due at the time of booking by credit card or check. The selection of the location for the Patron s function is based on the Patron s requirements at the time of booking such facilities. In the event that such requirements change, the Management reserves the right to transfer the function to the appropriate location. **Alcohol is served on a per drink basis. There is no bar package available. (Approximately $5 to $10 per beverage.) NO OUTSIDE FOOD/ALCOHOL IS TO BE BROUGHT INTO THE RESTAURANT. Bimini Boatyard is not responsible for damage or loss to any articles brought in by Patron or Guests. Patron is responsible for any damage done to Bimini Boatyard during the period of time that the facilities are being used by Patron or the use of any independent contractor hired by the Patron. SALES TAX: 6% will be added to all food and beverage charges. SERVICE CHARGE: 20% will be added to all food and beverage charges. Checks are not accepted for functions. We accept the following Credit Cards (AMEX, VISA, MASTER CARD AND DISCOVER). Direct billing is not available. INITIALS

8 SEATING: Please be advised of your requirements for all seating arrangements. Daytime functions and Monday through Thursday evening functions require a minimum of 30 persons to occupy the BAHAMA ROOM, and a minimum of 45 persons for Friday Night, Saturday Night and Sunday. Smaller function rooms are also available. GUARANTEE: When arranging a private function, the number of guests attending must be submitted to the Banquet Manager no later than 48 hours prior to the function. This number will be considered the guarantee not subject to reduction. If no guarantee is received, Bimini Boatyard will use the number of guests estimated on the original contract at the time of booking. There are no exceptions concerning this guarantee. MENU SELECTION: Your guest will have a choice of Soup or Salad, choice between three (3) entrees, and one (1) dessert. Bimini Boatyard will make a special printed menu for your function. To ensure printing of the menu, all items must be confirmed two weeks in advance. SET-UP (SHOWERS, BIRTHDAYS, ETC): All decorations such as flowers, balloons, etc. are responsibility of customer. The use of restaurant personnel is not permitted to assist with decorating or set-up. All parties are subject to a clean-up fee if customer does not leave the room clean. Cleaning fee does not cover damage done to property or persons. HOLD HARMLESS: Quay Restaurant, LLC (doing business as Bimini Boatyard) shall not be held liable for injuries or property damage/loss to others during this function, including, but not limited to: death, personal injury, property damage, or any other incidents that may occur to any person(s) by use of the building or premises during the term of the event.
