If an organiser of casino games also operates slot-machines inside the casino, they are obliged to constitute the guarantee fund by adding up their obligations under the provisions of paragraph (a) and (b) above.

7 LEGISLATION Overview of the policy situation The National Gambling Office is a newly created institution, subordinated on Romanian Government that seeks authorization local gambling operators and provides technical support for their monitoring. By establishing the National Gambling Office by GEO appearance no.20/2013, in April 2013, the Romanian government passed a European principle that enables the uniform management of gambling activities in our country, the first time the authorization, supervision and monitoring of gambling are made by a single institution. Decision on the organization and functioning of the National Gambling Office no.298/2013 and Government Decision no.870/2009 approving the Methodological Norms for the application of Government Emergency Ordinance no.77/2009 on the organization and operation of gambling, allowing institution to operate in accordance with the principles of the gambling community. The new legislative provisions removes bureaucratic barriers and established the possibility as documents games organizers being taken for licensing and authorization electronically with digital signature. Also established general criteria for monitoring the activity of online gambling and the main rules Operation Rules Oversight Committee - deliberative and decision-making structure in the field of gambling. For proper organization and functioning of the Office, and to improve the work of the Committee has been established an Advisory Council of businessmen from gambling, which will be able to inform the authority of the aspects of the domain. TAXATION 16% - profit tax for slot-machines We have to mention that actually, thanks to the new gambling settlement, all the taxes license fee, authorization fee and profit tax must to be paid only to the Finance Ministry. Additionally, the Romanian government modified the taxation system for the gambling sector. Back in June 2010, the government applied a gambling tax of 25% to players income above EUR 135. There is therefore concern that such a tax policy will result only in a loss of customers for operators in Romania, with no possibility to be applied for slot-machines and casinos. This tax only can be applied for Bingo, Betting and Lotto. A.O.P.J.N.R. and ROMSLOT proposed to be maintained the system which impose only the Jack-pot and tombola wins.

8 In December 2010 by Government Emergency Ordinance no.117 was introduced an entrance fee for players in casino and slot-machine sites. For Casino sites EUR 4.50/player For Slot-machine sites EUR 1.12/player At the end of 2010, A.O.P.J.N.R. and ROMSLOT had successfully reached an agreement that would have leave out the mentioned winning tax and introduce instead an entrance fee, unfortunately the Government finally decided to preserve the winning tax and additionally introduce also the entrance fee for players. INDUSTRY NEWS Romanian Gambling Conference Bucharest, February 13 to 14, The event debated on the phenomenon of gambling under all aspects, including those regarding the generated collateral services. The conference aimed to create a collaboration bridge between the various associations in the domain in view of presenting a shared opinion as a start for dialogue between operators, the press and authorities. Furthermore, the event aimed to create a correct image of industry, including in the perception of the public opinion. Objectives contained in ROMANIAN GAMBLING CONFERENCE RESOLUTION still remain valid. ROMANIAN GAMBLING CONFERENCE RESOLUTION Given the obvious tendency to reduce the gambling industry in our country in general and to reduce the sustainability of a profitable activity in the industry, representatives of the professional associations and independent operators, meeting at the Romanian Gambling Conference - Bucharest February 9 to 10, 2012, want to report a minimal set of measures that can revitalize business, create a fair legal, stable, consistent and enforceable framework for gambling. This set of measures will enhance the collection of taxes, reduce tax evasion, piracy, and reduce tax provisions ambiguities that could lead to disproportionate measures of the control authorities. The minimal set of measures include the following: 1. Authorities enact real and powerful measures to clear the "black market" by: Placing plaques at the entrance of spaces where gambling takes place in order to indicate the activity in that place is legal regulated and the consequences of participation in illegal game spaces. Notification of moving game equipment from one location to another, followed by cross-checks, to control the effective cancellation from the old location. Illegal rooms player accountability on the legal model specific to online gaming. 2. Provisions change relating to the 25% income tax from gambling to their practical applicability. By applying exclusive tax income for prizes from Jackpot and raffle, is

9 redefined therefore players income from slot machine gambling as being unique. Domain-specific clear and enforceable accounting regulations, which reflect the real work according to adopted international standards from the notion of "business income" (branded as Gross Gaming Revenue). The effective regulations display Romania as an uncompetitive country as tourist destination for gambling and discourage investment in the gaming sector. 3. Removing the entry ticket or at least transferring purchase responsibility to the player. 4. Including in legislation the right of the organizers to pay fees for permits and licenses from the date of issue of those documents throughout the period of validity. 5. Developing a legal framework to control gambling entrepreneurs (including the origin of share capital) prior to authorization as a means of preventing the organized crime to enter this industry. 6. Gambling commercials are accompanied by messages promoting responsible gaming. 7. Establishing a Regulating Authority for slots, similar to the model from online gaming legislation, authority including representatives of NATA, Financial Guard, Ministry of Finance etc. 8. Stopping the misinterpretation and misuse of NAFA territorial representatives regarding the concepts of "revenue-income" and "awards-cost", which resulted in bankruptcy of the slot-machine operators and whose proliferation would endanger the work of all licensed companies in this sector. 9. Changing the minimum number of slot machine that can be exploited in a dedicated game room to 10 machines in the province and keep the minimum of 15 machines in Bucharest. 10. Changing provisions related to coverage areas of the game locations with up to 5 slot machines, and the admission of a minimal street commercial for this category too. 11. Clearing legal provisions favoring CN Romanian Lottery on the competitive gaming market creates illegal state aid cases and establishes discrimination in this area. 12. Transferring players gambling receipts through banking system, can turn Romania into a more attractive destination for the gambling- tourism. 13. Clearing determination of the state agencies that control the gambling industry and define the limits of their competence. Given the very important contribution of the gaming industry to the state budget, we require more attention from authorities for the problems of gambling organizers and

10 more concern for their proposals. Minimal set of measures above will lead to a rapid revitalization of the work in the gambling industry in our country, to eliminate redundancies in this industry and increase the state budget income and a better cooperation between operators from the gambling area and authorities, all these benefits have positive effects on long term for all the involved parties. Gambling magazines: CASINO INSIDE CASINO LIFE & BUSINESS MAGAZINE ONLINE GAMBLING MARKET Overview of the policy situation Online providers must have a certain involvment in land- based operation required for applying for licence -Belgian model- such as min. 500 slots-machine or 20 live table or 100 betting shops. From the taxation point of view, the licence fee value and authorization fee (1,5% from income for all types except betting with 5%) are moderate in comparation with other jurisdictions demands. The authorization of monitoring, technical control and reporting operator for online organizers.

11 The requirement of registered seat of gambling operators in Romania. Comprehensive reglementation regarding the payment method, identification and tracking of players, players addiction and self exclusions, blocking the websites which offer access or for the unlicensed providers, blocking the bank payments in such cases, fines for publicity of the unlicensed operators, etc. In accordance with the Romanian law, the definition of online gambling contains: bingo games organized via Internet communication systems, landline or mobile telephone systems, online bets, lottery games, online gambling games which takes place otherwise than in the physical presence of players, organized and transmitted through the communication systems mentioned above. As a conclusion the Romanian definition cover the means of remote gambling. National rules and practices relating to customer verification In the case of online games the players can register: directly by accessing the website of the gambling organiser, in which case the player must also supply to the gambling organizer a copy of their legal identity document, namely: 1. for citizens who do not belong to any of the Member States of the European Union: passport, diplomatic or consular identity card, temporary permit; 2. for Romanian citizens or citizens of a Member State of the European Union: identity book/card or other documents issued by the police authorities, which bear a photo and the signature of the holder. At any of the premises where a gambling organizer who holds a license and authorization for online gambling games in which case the player must present to the gambling organizer one of the legal identity documents mentioned in point above, in original form. The player shall provide details of the valid address and personal bank account to be used for any transfers to/from the game account opened with the respective gambling organizer. Preventive measures and treatment of problem gambling/addiction at the national level Regarding to the law we have the following provisions: An organizer of the online gambling games must provide the player with an application that would enable them to set daily, weekly, and monthly deposit limits. The gambling organizer must provide the player with an application that would enable them to request to be temporarily or permanently excluded from the game. Any request for exclusion issued by the player must be implemented immediately.

12 If a player excluded themselves from participation in a game organized by the gambling organizer, the latter must inform the player about their options of receiving counseling and treatment for pathological addiction to gambling, in a treatment centre. The gambling organizer shall keep a register with the players who request permanent or temporary exclusion. Gambling organisers are prohibited from sending any advertising material to players who excluded themselves, temporarily or permanently, from participation in online gambling games. The information that must appear on the online gambling organizer s website: Information about responsible gambling and the possible harmful effects of gambling. This information must be drawn up in collaboration with a treatment centre;access to a self-test regarding addiction to gambling; Information about and a contact address for a helpline which gives recommendations relating to gambling addiction issues and the treatment centers in Romania or other Member States of the European Union; A clock must also be displayed on the gambling organizer s website, to enable the player to keep track of the time spent on the gaming page. The clock shall indicate the current date and time and must be visible to the player at all times. The gambling organizer must provide the player with an application that would enable them to request to be temporarily or permanently excluded from the game. Any request for exclusion issued by the player must be implemented immediately. The commercial communications for online gambling services are permitted in all mass media types only for operators licensed in Romania. The holder of a license and authorization for the online gambling games shall not provide sports betting services to teenagers under 18 years of age. New/forthcoming national legislation on online gambling Despite those detailed regulations there are no applications for online licenses in Romania. For making attractive the online sector is necessary to modify some regulations like: the removal of the 25% wining tax (on the players wining) the sites effective blocking of the online organizers that are not licensed in Romania the inforcement against the unauthorized online operators regarding the illegal advertisement in Romania. the urgent authorization of monitoring, technical control and reporting operator for on- line organizers.

13 RESPONSIBLE GAMBLING The Responsible Gambling project was started in November 2010, at the Expo Arena Entertainment. The program was taken over by Romslot Slot Organizer s Association and was extended to a larger number of slot-machines locations of all Romslot members. In 2013 the Responsible Gambling project was further developed in partnership with Romanian Bookmakers. Both Romslot in partnership with Romanian Bookmakers and A.O.P.J.N.R. promote by their separately programs a responsible behaviour for the slot players in order to fully benefit of this means of entertainment and fun, the slot games being a captivating form of entertainment and relaxation. Romslot Play Responsible program: This program, ensure the players with the possibility to verify one s addiction degree, through the questionaires presented on the project s website and have free access to treatment in a specialized psychotherapy clinic. The project s dedicated prospectus-questionare is avalable in a large number of slot arcades and betting halls (over 4000 locations) and it is not only a project information instrument, but also a means of recognition or screening of a patholigical gambler with the help ofthe self-testing method presented in the prospectus. Trough the free HELPLINE dedicated to the project, all players with gambling addictions or their family members have the possibility to contact the clinic by phone, to be explained about gambling addiction symptoms and to benefit free psychotherapy sessions. A.O.P.J.N.R. Responsible Player program: A.O.P.J.N.R. as representative of a large number of gambling organizers and as a member of EUROMAT, understood the necessity of the implementation of European principles on combating addiction to gambling and promoting the responsible consumer gambling. In this context the program run by A.O.P.J.N.R. starting in 2013 and named Responsible Player aimed at consumer information on issues related to gambling addiction and its treatment and determination of all the gambling organizers work together to widespread application in daily practice of the principles of responsible approach to gambling. The program is achieved through two components: - display in over 1600 gambling locations posters promoting responsible gambling practice through various slogans and address of a website containing information on this phenomenon; - a site, which offers to the players the opportunity of an accurate information on the phenomenon of addiction, methods of control and its treatment in specialized clinics.

14 Romslot and A.O.P.J.N.R. will further collaborate during next years, in order to exted the Responsible Gambling project throughout the entire slot-machines gambling industry. - // -
