1 CHAPTER 9: BIBLIOGRAPHY OF SELECTED CALIFORNIA MATERIALS The following list highlights basic California legal materials. Included are large sets of books that require considerable shelf space and are costly to purchase and maintain and thus are appropriate for larger libraries. Also included are several books directed primarily at the layperson. These sources are indicated with an asterisk(*). STATUTES Codes are collections of current statutes, arranged by subject. Two complete sets of annotated codes are available from commercial publishers, LEXIS Law Publishing and West Group. Both sets include the full text of the codes, the California Constitution, and Rules of Court. California Statutes and Amendments to the Codes, Annual. This is an official publication of all laws enacted by the legislature in a given year, with tables and indexes. ANNOTATED CODES Annotated codes provide the text of the statute as well as references to court decisions and secondary sources. 3 JURY INSTRUCTIONS During a trial a judge may give specific instructions to a jury. BAJI and CALJIC contain jury instructions drafted by the Committee on Standard Jury Instructions, as well as notes explaining their use, history, or relevant cases. COURT REPORTS (UNOFFICIAL) Court decisions are reprinted in their entirety by West Group, the Daily Journal Corp., and the Recorder Publishing Co. West reporters use the key number system to categorize cases by subject, as do West s digests for subject access to case reports. When a relevant case is found in a West Reporter, the key numbers listed before the text of the case may be used to locate similar cases in West digests. 9-3

This series contains decisions of the Supreme Court, Courts of Appeal and Appellate Departments of the California Superior Courts. Pacific Reporter, v ( ) and Pacific Reporter, 2nd, v. 1- (1991-present) with advance sheets. St. Paul, MN: West Group. This series contains appellate decisions from fifteen western states, including California. It ceased publication of California Courts of Appeal decisions in 1960, but continues to publish California Supreme Court opinions. Daily Appellate Report (D.A.R.) is an insert in the Los Angeles Daily Journal and the San Francisco Daily Journal, both published by the Daily Journal Corp. This publication contains the full text of both Supreme Court and Court of Appeal decisions within a few days of the decision. It also includes full text of decisions from the U.S. Ninth Circuit Court of Appeals, the Ninth Circuit Bankruptcy Appellate Panel, the U.S. Supreme Court, and the California Attorney General. California Daily Opinion Service (CDOS) is an insert in The Recorder, a daily legal newspaper for San Francisco. It provides the same coverage as the Daily Journal Publications listed above. INTERNET SOURCES FOR CALIFORNIA CASE LAW: Judicial Branch of California: Decisions from the California Supreme Court and the California Courts of Appeal in the last 100 days are posted here in full text. Supreme Court opinions are posted immediately after filing. Court of Appeal opinions are posted within hours of filing. Callaw: Callaw is a subscription based web site for California opinions. Use of the database is free if you subscribe to the Recorder. Findlaw: Findlaw provides the full text of California Supreme Court opinions dating back to October, Owned by West Group. DIGESTS A digest is a subject index to reported court decisions. Digests are useful only if the library subscribes to the sets of published decisions listed above in Court Reports. If a digest is purchased, it should be from the same publisher as the court reports, e.g. West digest and West reporters, or McKinney s digest and official reports. This is because the 9-4

5 subject headings, or headnotes, are assigned to a case by the publisher, and correspond to the subject headings in that publisher s digest. 8 TREATISES, HANDBOOKS The California Continuing Education of the Bar (CEB) publishes several excellent handbooks, some of which are listed below. In addition, the CEB publishes Action Guides, which are pamphlet sized, inexpensive publications containing basic how-to instructions for a variety of legal situations.
