1 Annex D 1 Sophie Black UK Food & Wine, 262 Brixton Hill licensing review Date: 04 August :34:15 To whom it may concern, I live in I have lived here and for most if not all of that time, a group of men have congregated outside this shop drinking, smoking (and selling) weed. The guy who sells vegetables outside the premises sells weed (I have seen him pass it to people and take cash - this isn't just an assumption it's a fact!) and I can't imagine that this is without the knowledge of UK Food & Wine. The men outside (who I believe frequent the betting shop next door too) would regularly catcall and make gross and degrading comments about my appearance - after several years this has now stopped, due to the great hostility on my part, but I know they still do this to other women in the block and people who visit. I once opened the front door to find one of them inside my front hall. They are a generally irritating and intimidating presence - there are regularly so many of them you have to push past them to get to your front door which, as a woman on her own, is intimidating and unpleasant. I don't know if revoking their alcohol license would make these men leave, and it feels harsh to punish the premises (given they have, at best, just turned a blind eye) but, in my opinion, renewing it would be craziness and would be very disheartening for our community. best wishes Sophie Black

I have been in New Park Court, for and shop regularly in this store, primarily for alcohol. I would not necessarily want to see UK Food & Wine s alcohol licence revoked, the owners of this shop have battled on despite the Sainsbury s competition, and I think sadly that losing their alcohol licence will kill their business. I don t think they deserve that. However I totally agree that the anti-social behaviour and harassment of women by the many men who linger outside is completely unacceptable. But I am not sure that UK Food & Wine losing their licence would change much. The reason these men gather is the bookies, and the fact there is a conveniently empty shop unit in between the bookies and UK Food & Wine to loiter outside of without a proprietor complaining/attempting to move them on. I imagine that if UK Food & Wine lost their licence these men would just pop up or down the road 100 yards or so for their alcohol, return to the same spot and carry on regardless It feels like we re targeting the wrong element by challenging UK Food & Wine s alcohol licence what is to stop these men buying their alcohol in Sainsbury s instead? Is Sainsbury s alcohol license under review? Proper enforcement of proper responsible behaviour on the street is essential and the real challenge in my mind. But I fear punishing UK Food & Wine will have little or no impact on that. That is also down to and the responsibility of the bookmakers, where all of these men are regular customers is their gambling licence to be revoked? In fact I ll wager that if we shut the bookmakers this problem would largely go away. That is where the real problem lies, not in a small shop business that struggles on through recession. 3 3 Conmy,Bernard Cc: UK Food & Wine, 262 Brixton Hill SW2 Date: 07 August :17:19 Dear Mr Conmy Further to your review application with regard to the above premises I have visited the licence holder and discussed the issues you have raised and am now writing to respond to your comments. 1-4) With regard to the sale of alcohol to a 17 year old volunteer this was made by Mr Javaid. As a result of this purchase Mr Javaid was fired and no longer works at the shop. 5) The two bottles of counterfeit Bollinger which were found at the premises in April 2010 had been brought in by a customer who had asked them to exchange them for some spirits as they did not drink Champagne. Mr Nadeem was unaware that these had not been genuinely purchased from a cash & carry outlet and that they were counterfeit. He now only allows alcohol on the premises that has been bought by either him or a member of his staff at a reputable cash and carry outlet. 6-7) Mr Nadeem admits that he made a mistake selling the cigar wraps to someone under age and should not have made the sale. 8) There is no condition on the premises licence that a refusals register must be used. A tobacco notice is now displayed advising that customers must be 18+ to buy it. 9-11) We note that an inspection on 16th April 2013 raised no concerns regarding the stocks of alcohol. There is no condition on the licence that high strength beers & ciders cannot be sold at the premises. 12) The open bottles of alcohol in the storeroom were for friends of the licence holder who had visited him and who had been given some drinks after the shop had closed. the condition on the licence that states alcohol shall not be sold in an open container or be consumed in the licensed premises to mean not to be sold to paying customers, not given to friends after the shop has been closed. I am sure that the majority of people would interpret it that way as well. 13) After receiving the refusals register from Trading Standards it was put to use straight away. Mr Nadeem has received 3 letters from Trading Standards in March and November 2014 and March 2015 confirming that test purchases had been made at the premises and on all three occasions they had passed the test and not sold alcohol to anyone under age.
4 14-19) Mr Nadeem admits that on one occasion he had bought counterfeit alcohol from a man in a white van and had not received any receipts for it. The man had told him that he had bought it all from cash & carry and showed him duty paid stickers on the bottles which Mr Nadeem thought were genuine. He confirms that he will never buy any alcohol from anywhere other than genuine cash & carry outlets again. As already pointed out there is no condition on the premises licence not to sell high strength beers etc. Mr Nadeem signed a voluntary agreement in April 2013 not to sell single cans or high strength beers and complied with this condition rigidly until someone came back into the shop 6 months later to say that these conditions were no longer required, so he reverted back to selling these products ) None of the alcohol from the half empty bottles had been sold to customers in open containers, only given to friends after the shop had shut. Mr Nadeem no longer opens bottles on the premises, or allows his staff to do so, or keep plastic cups and bottle openers in the shop ) There is no requirement on the premises licence for a list to be made of staff authorised to sell alcohol, and there is no requirement for written training records or a refusals register. Since my visit Mr Nadeem has trained all his staff on how to use the refusals book and given them alcohol licensing tests, which he keeps in a folder, to ensure that they know and understand the law. All open cigarette packets have now been removed from the shop and staff told not to smoke anywhere in the shop at any time. Mr Aslam no longer works at the shop so we have made an application to the Council to change the DPS into Mr Nadeem s name. When the new licence is issued with his name as DPS he will keep all pages of the premises licence together so that it can be shown to any authorised officers. As previously mentioned there are no bottle openers now kept at the shop. 30) Mr Nadeem is aware of the problems of people loitering outside the shop. He has rung the Police on several occasions to complain about this and he and his staff regularly go out to tell them to move away. Often they do leave but sometime they just become aggressive. Signs have been put up both sides of the shop outside advising customers to report bad behaviour but Mr Nadeem has also now put up signs asking people not to loiter outside. 31) As already stated Mr Nadeem has now applied to be the DPS of the premises. From now on Mr Nadeem agrees to stop selling single cans of high strength beers etc over 7% once current stocks of these beers have sold out. There are a number of specialist beers purchased by regular customers which are % so he does not want to stop selling these and lost his regular customers. Having been through all the points raised by you and your department with Mr Nadeem I am confident that he has now put everything in place to ensure that the problems
