1 Arlington Bank eservices Agreement Personal Account The Arlington Bank is pleased to offer internet banking, mobile banking, electronic statements, electronic alerts and telephone banking (herein referred to as eservices) access to customer accounts by acceptance of this agreement. The purpose of the agreement is to identify, describe, and state the general terms and conditions that will apply to the electronic/phone based banking services offered by The Arlington Bank. While this agreement covers all eservices, enrollment is not automatic to all services. The terms you and your will identify and refer to each person who applies for and is approved for eservices access to any account or service offered by The Arlington Bank. Upon acceptance of this agreement, a valid and binding contract between you and The Arlington Bank exists. You understand that The Arlington Bank will act upon instructions received with respect to any eservices via your username, password, security image and challenge questions without further inquiry into the identity of the person using the password. Except as otherwise provided by law with respect to unauthorized electronic fund transfers, you will be liable for all transactions authorized with the use of your username and/or password. You can change your challenge questions in the Options section online or contact The Arlington Bank for assistance. If you give your password or PIN to someone, you have failed to protect its secrecy. You do so at your own risk and liability. You are informed that anyone with your password or PIN will have access to all of your accounts. If you believe that your password or PIN has been compromised, contact the bank immediately and/or change your credentials. It is important to note that where possible, eservices will mask or nickname accounts for your protection, but statements and check images will have your complete account information. We cannot accept notification of lost or stolen usernames, passwords or PINs via . You agree under no circumstances to disclose your username, password or PIN to anyone whom you have not authorized to access your accounts, including anyone claiming to represent The Arlington Bank. An Arlington Bank employee will never ask for your password or send you an asking for your username, password and/or PIN. For internet banking, you will have the ability to set up subaccount users to have access to the accounts that you select and you can also select the security levels for these accounts. The subaccounts are your responsibility to oversee, you will be liable for any activity conducted by a subaccount user and it is your responsibility to communicate the security requirements for the subaccount usernames and passwords that are created. Subaccounts should never be set up for children under 13 years of age. The Arlington Bank will establish eservices for you using an assigned username and password (or PIN). The username request is subject to approval. If the username you request is not approved, you will be asked to select a different username. You will be required to change your initial password at first login. The password must be 8 to 17 characters in length and contain all of the following: an uppercase letter, a lowercase letter, a number and a special character. You will also be asked to select security questions and a security image and phrase. To better protect your security, we recommend that you select questions where the answers are not easily obtained through social media sites to which you may belong. We recommend that you change your password frequently. All passwords will be prompted to be changed every 180 days. Passwords can be changed online at anytime. After three (3) failed attempts to enter your password, you will be locked out of eservices. You can try again after the lockout period or you can call The Arlington Bank to be unlocked. Please see our online Educational Department at arlingtonbank.com for recommended reading on keeping your online identity safe. Usernames and passwords must be kept active to continue use of eservices. Logging into the service will keep your account active. Usernames and passwords will be disabled after 180 days of inactivity for Internet Banking and 90 days for Mobile Banking. You will need to contact the bank to be reinstated. For joint account holders, each person will have a separate username and password. Each account holder on joint accounts will be responsible for all transactions that are made on that account by all other joint holders of the account. By directing The Arlington Bank to transfer funds or make a payment of any kind through the use of any eservices initiated with your username and password, you authorize The Arlington Bank to withdraw or transfer the funds necessary to complete the designated transaction. Requests for new accounts or changes of addresses cannot be handled through online services. To the extent permitted by law, you agree to fully indemnify and release The Arlington Bank from any and all liability, and agree not to make any claim against The Arlington Bank or bring any action against The Arlington Bank, relating to its honoring and allowing Page 1 of 7
2 any action or transactions that are conducted under your username and password and/or a subaccount username or password. The Arlington Bank eservices business days are Monday through Friday, except for bank holidays. The Arlington Bank processes transactions on business days only. You may initiate a transaction through Arlington Bank Online 24 hours a day, 7 days a week, except during maintenance periods. Any transactions initiated after business hours will be handled on the next business day. For a transaction to be posted on a current business day transactions must be conducted by 4:30 pm (EST). Any transaction conducted after this time will post on the next business day. The Arlington Bank agrees to make a reasonable effort to complete all fund transfers as requested. The Arlington Bank will be responsible for acting only on those instructions actually received by The Arlington Bank and cannot assume responsibility for malfunctions in communications, facilities, or acts of others not under our control that may affect the accuracy or timeliness of transactions you conduct. The Arlington Bank will refund any fee that you may incur on your account as a result of an error that is The Arlington Bank s responsibility. Federal regulations require The Arlington Bank to limit certain types of transactions from money market and savings accounts. Under these regulations each account is limited to six (6) preauthorized electronic funds transfers including telephone transfers, Arlington Bank Internet Banking, Mobile Banking and TelBank transfers or bill payments, checks, ACH, and point-of-sale transactions. Each fund transfer or payment through Arlington Bank Internet Banking, Mobile Banking and TelBank from your money market or savings account is counted as one of the six limited transfers you are permitted each month. Payments to your loan accounts held at The Arlington Bank are not counted toward this limit. The Arlington Bank will not be responsible for failure to provide access or for interruptions in access to Arlington Bank eservices due to a system failure or other unforeseen acts or circumstances. Arlington Bank Online will allow you to view all deposit and loan account activity and information. You also will have the ability to transfer funds between accounts and pay your Arlington Bank loan with your Arlington Bank checking account. The Arlington Bank offers an online bill payment service. This service maintains a separate enrollment and approval process. Enrollment is online through Arlington Bank eservices. You must be enrolled in the internet banking service in order to request the bill payment service. Arlington Bank eservices and bill payment (a separate service agreement and enrollment from Arlington Bank eservices) are free services but The Arlington Bank reserves the right to charge for either of these services in the future. You will be notified in writing if a charge will be assessed and given the ability to cancel service. See The Arlington Bank s privacy disclosure for information regarding our privacy policies. A person must be 18 years old to enroll in Arlington Bank eservices and bill payment. We do not knowingly collect information at our web site from children under the age of 18 years old. Do not create subaccount users for children under 13 years of age. The bank will not provide assistance in setting up these accounts. The Arlington Bank, in its sole discretion, may refuse access to Arlington Bank eservices to any new or existing customer. You authorize The Arlington Bank to obtain and verify credit reports and other credit information from third parties to verify your suitability for Arlington Bank eservices. The Arlington Bank has the right to terminate this agreement at any time. The agreement will automatically be terminated when you no longer have any accounts or a loan relationship with The Arlington Bank. You may also terminate this agreement at any time by notifying us in writing or by calling our bank office at 614/ or Any such termination by you applies only to Arlington Bank eservices and not your Arlington Bank checking account or other accounts. The Arlington Bank is not responsible for the hardware or software required for the use of Arlington Bank eservices. You are responsible for providing your own internet service provider (ISP) and any charges assessed by the ISP. You will be provided with the minimum system requirements needed for the use of Arlington Bank eservices and bill payment services. The Arlington Bank s liability to you is limited to the extent stated in any other account and/or loan agreements, notices and disclosures that are separately provided to you when you open your account and from time to time regarding your Arlington Bank accounts and/or this agreement. Applicable provisions of the agreement explain the extent of The Arlington Bank s liability to you Page 2 of 7
3 that has not already been separately disclosed to you by any of these agreements, notices or disclosures. Neither The Arlington Bank, nor any of its directors, employees, or agents make any representations or warranties of any kind regarding the performance or quality of Arlington Bank or the results that may be obtained from using The Arlington Bank eservices. The Arlington Bank eservices specifically disclaims any express or implied warranties, including, without limitation, warranties of fitness for a particular purpose, warranties of merchantability or warranties against infringement. Except as otherwise provided by applicable law, The Arlington Bank, nor its directors, employees or agents shall be liable for any damages or losses, including, without limitation, direct, indirect, consequential, special incidental or punitive damages, resulting from or caused by the use, or attempted use, of Arlington Bank eservices, or its content, including, without limitation, losses related to your use, or your inability to use, Arlington Bank eservices. Any errors, omissions or defects in any content, interruptions or delays in transmission to Arlington Bank eservices, or computer viruses received by you as a result of your use of Arlington Bank eservices are not the fault of The Arlington Bank. In any event, any liability of The Arlington Bank, its employees, agents, content providers and licensors shall not exceed those amounts specifically provided for in this agreement. ELECTRONIC FUND TRANSFERS YOUR RIGHTS AND RESPONSIBILITIES Indicated below are types of Electronic Fund Transfers we are capable of handling, some of which may not apply to your account. Please read this disclosure carefully because it tells you your rights and obligations for the transactions listed. You should keep this notice for future reference. Electronic Funds Transfers Initiated By Third Parties. You may authorize a third party to initiate electronic funds transfers between your account and the third party s account. These transfers to make or receive payment may be one-time occurrences or may recur as directed by you. These transfers may use the Automated Clearinghouse (ACH) or other payments network. Your authorization to the third party to make these transfers can occur in a number of ways. For example, your authorization to convert a check to an electronic fund transfer or to electronically pay a returned check charge can occur when a merchant provides you with notice and you go forward with the transaction (typically, at the point of purchase, a merchant will post a sign and print the notice on a receipt). In all cases, the transaction will require you to provide the third party with your account number and bank information. This information can be found on your check as well as on a deposit or withdrawal slip. Thus, you should only provide your bank and account information (whether over the phone, the Internet, or via some other method) to trusted third parties whom you have authorized to initiate these electronic funds transfers. Examples of these transfers include, but are not limited to: Preauthorized credits. You may make arrangements for certain direct deposits to be accepted into your checking or money market account(s). Preauthorized payments. You may make arrangements to pay certain recurring bills from your checking or money market account(s). Electronic check conversion. You may authorize a merchant or other payee to make a one-time electronic payment from your checking account using information from your check to pay for purchases or pay bills. Electronic returned check charge. You may authorize a merchant or other payee to initiate an electronic funds transfer to collect a charge in the event a check is returned for insufficient funds. Please also see Limitations on frequency of transfers section regarding limitations that apply to savings accounts. ATM Transfers types of transfers and dollar limitations You may access your account(s) by ATM using your Debit MasterCard and personal identification number, to: make deposits to checking account(s) with a debit card get cash withdrawals from checking or money market account(s) with a debit card - you may withdraw no more than $ per day - there is a charge of $1.00 per withdrawal at non STAR ATMs or non-moneypass network ATMs transfer funds from money market to checking account(s) with a debit card - there is a charge of $1.00 per transfer at non STAR ATMs or non-moneypass network ATMs transfer funds from checking to money market account(s) with a debit card - there is a charge of $1.00 per transfer at non STAR ATMs or non-moneypass network ATMs get information about: - the account balance of your checking or savings account(s) there is a charge of $1.00 per inquiry at non STAR ATMs or non-moneypass network ATMs Some of these services may not be available at all terminals. 4 Types of Debit MasterCard Point-of-Sale Transactions You may access your checking or money market account(s) to purchase goods (in person, online or by phone), pay for services (in person, online or by phone), get cash from a merchant, if the merchant permits, or from a participating financial institution, and do anything that a participating merchant will accept. Point-of-Sale Transactions dollar limitations Using your card: You may not exceed $ in transactions per day. Please also see Limitations on frequency of transfers section regarding limitations that apply to debit card transactions. Currency Conversion and Cross-Border Transaction Fees. If you effect a transaction with your Debit MasterCard in a currency other than US Dollars, MasterCard will convert the charge into a US Dollar amount. The MasterCard currency conversion procedure includes use of either a government-mandated exchange rate, or a wholesale exchange rate selected by MasterCard. The exchange rate MasterCard uses will be a rate in effect on the day the transaction is processed. This rate may differ from the rate in effect on the date of purchase or the date the transaction was posted to your account. MasterCard charges us a Currency Conversion Assessment of 20 basis points (.2% of the transaction) for performing the currency conversion. In addition, MasterCard charges us an Issuer Cross-Border Assessment of 80 basis points (.8% of the transaction) on all cross-border transactions regardless of whether there is a currency conversion. As a result, we charge you a Currency Conversion fee of.2% and a Cross-Border Transaction fee of.8%. The Cross-Border Transaction fee is charged on all cross-border transactions regardless of whether there is a currency conversion. A crossborder transaction is a transaction processed through the Global Clearing Management System or the MasterCard Debit Switch in which the country of the merchant is different than the country of the cardholder. Advisory Against Illegal Use. You agree not to use your card(s) for illegal gambling or other illegal purpose. Display of a payment card logo by, for example, an online merchant does not necessarily mean that transactions are lawful in all jurisdictions in which the cardholder may be located. Arlington Bank Online Computer Transfers types of transfers You may access your account(s) by computer at and use your user identification and password, to: transfer funds from checking to checking transfer funds from checking to savings transfer funds from savings to checking transfer funds from savings to savings transfer funds from line of credit to checking transfer funds from line of credit to savings make payments from checking to loan account(s) with us make payments from checking to third parties with Bill Payment - you need to be approved in order to have Bill Payment make payments from savings to loan account(s) with us make payments from savings to third parties with Bill Payment - you need to be approved in order to have Bill Payment get information about: - the account balance of checking account(s) - the last 30 days deposits to checking accounts - the last 30 days withdrawals from checking accounts - the account balance of savings account(s) - the last 30 days deposits to savings accounts - the last 30 days withdrawals from savings accounts All of the above (except the references to Bill Payment) can also be performed using The Arlington Bank Mobile Banking. Please also see Limitations on frequency of transfers section regarding limitations that apply to computer/mobile device transfers. Limitations on frequency of transfers. In addition to those limitations on transfers elsewhere described, if any, the following limitations apply: Transfers from a Money Market or savings account to another account or to third parties by preauthorized, automatic, telephone, or internet (including Mobile Banking) transfer, or check, draft, debit card, or similar order are limited to six per month. Transfers from a savings account to another account or to third parties by pre-authorized, automatic, telephone, computer or mobile device transfers are limited to six per month. FEES We do not charge for direct deposits to any type of account We will charge you $5.00 to replace a lost debit card Except as indicated elsewhere, we do not charge for these electronic fund transfers. ATM Operator/Network Fees. When you use an ATM not owned by us, you may be charged a fee by the ATM operator or any network used (and you may be charged a fee for a balance inquiry even if you do not complete a fund transfer). DOCUMENTATION Terminal transfers. You can get a receipt at the time you make a transfer to or from your account using an automated teller machine or pointof-sale terminal. However, you may not get a receipt if the amount of the transfer is $15 or less. Preauthorized credits. If you have arranged to have direct deposits made to your account at least once every 60 days from the same person or company, you can call us at to find out whether or not the deposit has been made. Periodic statements. You will get a monthly account statement from us for your checking accounts. You will get a monthly account statement from us for your money market accounts. Page 4 of 7
5 For passbook accounts, if the only possible electronic transfers to or from your account are preauthorized credits, we do not send periodic statements. You may bring your passbook to us and we will record any electronic deposits that were made since the last time you brought in your passbook. In any case, you will receive a statement at least quarterly. PREAUTHORIZED PAYMENTS Right to stop payment and procedure for doing so. If you have told us in advance to make regular payments out of your account, you can stop any of these payments. Here is how: Call or write us at the telephone number or address listed in this brochure in time for us to receive your request 3 business days or more before the payment is scheduled to be made. If you call, we may also require you to put your request in writing and get it to us within 14 days after you call. Please refer to our separate fee schedule for the amount we will charge you for each stop-payment order you give. Notice of varying amounts. If these regular payments may vary in amount, the person you are going to pay will tell you, 10 days before each payment, when it will be made and how much it will be. (You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment, or when the amount would fall outside certain limits that you set.) Liability for failure to stop payment of preauthorized transfer. If you order us to stop one of these payments 3 business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages. Financial Institution s Liability Liability for failure to make transfers. If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance: (1) If, through no fault of ours, you do not have enough money in your account to make the transfer. (2) If you have an overdraft line and the transfer would go over the credit limit. (3) If the automated teller machine where you are making the transfer does not have enough cash. (4) If the terminal or system was not working properly and you knew about the breakdown when you started the transfer. (5) If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken. (6) There may be other exceptions stated in our agreement with you. CONFIDENTIALITY We will disclose information to third parties about your account or the transfers you make: (1) where it is necessary for completing transfers; or (2) in order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant; or (3) in order to comply with government agency or court orders; or (4) as explained in our separate Privacy Disclosure. UNAUTHORIZED TRANSFERS (a) Consumer liability. Generally, Tell us AT ONCE if you believe your card and/or code has been lost or stolen or if you believe that an electronic fund transfer has been made without your permission using information from your check. Telephoning is the best way of keeping your possible losses down. You could lose all the money in your account (plus your maximum overdraft line of credit). If you tell us within 2 business days after you learn of the lost or theft of your card and/or code, you can lose no more than $50 if someone used your card and/or code without your permission. If you do NOT tell us within 2 business days after you learn of the loss or theft of your card and/or code, and we can prove we could have stopped someone from using your card and/or code without your permission if you had told us, you could lose as much as $500. Also, if your statement shows transfers that you did not make, including those made by card, code or other means, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods. MasterCard Debit Card. Additional Limits on Liability. You will not be liable for any unauthorized transactions using your MasterCard debit card if: (i) you can demonstrate that you have exercised reasonable care in safeguarding your card from the risk of loss of theft, and (ii) upon becoming aware of a loss or theft, you promptly report the loss or theft to us. MasterCard is a registered trademark of MasterCard International Incorporated. (b) Contact in event of unauthorized transfer. If you believe your card and/or code has been lost or stolen or that someone has transferred or may transfer money using the information from your check without your permission, call or write us at the telephone number or address listed in this brochure. ERROR RESOLUTION NOTICE In Case of Errors or Questions About Your Electronic Transfers, Call or Write us at the telephone number or address listed in this brochure, as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared. (1) Tell us your name and account number (if any). (2) Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information. (3) Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days. We will determine whether an error occurred within 10 business days (20 business days if the transfer involved a new account) after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days (90 days if the transfer involved a new account, a point-of-sale transaction, or a foreign-initiated transfer) to investigate your complaint or question. If we decide to do this, we will credit your account Page 5 of 7
6 within 10 business days (20 business days if the transfer involved a new account) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account. Your account is considered a new account for the first 30 days after the first deposit is made, unless each of you already has an established account with us before this account is opened. We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.
