August 29, 2014 Via to The Honorable Tom Harkin Chairman Health, Education, Labor and Pensions Committee 428 Dirksen Senate Office Building Washington, DC Dear Chairman Harkin: The Education Trust, which promotes high academic achievement for all students from early childhood through college and works to close the achievement gaps at all levels of education for low-income students and students of color, appreciates the opportunity to offer input during the reauthorization of the Higher Education Act (HEA). This letter provides comments, as requested, to the discussion draft of the Higher Education Affordability Act (HEAA). This bill addresses many important issues, including providing more useful public information for college students and their families. We would, however, recommend that it offer stronger accountability measures to curb current and escalating college costs and help ensure student retention and success. We urge the Committee to continue working on this proposed legislation with a heightened focus on these issues. Here, we summarize our thinking on four main areas of interest from the discussion draft then offer additional recommendations for your consideration. We look forward to discussing these ideas at your convenience. College Scorecard We commend the Committee for proposing the College Scorecard. Such clear, easy-tounderstand, Web-based data on affordability and value by individual college is long overdue as informed decision-making relies on increased transparency and public data. 2 While The Education Trust supports the College Scorecard as an essential resource, we recommend additional steps beyond just public reporting on certain outcome measures. The responsibility for matching, financing, academic success, and completion should be shared among students, their families, and postsecondary institutions. We strongly support measures to ensure colleges participating in federal student aid programs are held accountable for prioritizing and aggressively improving student learning and success. It is in our country s best interest to make sure there is a high return on the dollars we invest to support higher education, especially for students from low- and moderate-income families. In our report Tough Love: Bottom-Line Quality Standards for Colleges, we propose minimum performance and accountability standards for four-year institutions of higher education, a timeframe to reach those standards, and sanctions if those standards are not met. We have included a link to the report in this and would recommend its elements, described below, be included in the bill as the legislative process continues. In addition, we have attached legislative language in an appendix to execute the inclusion of these concepts. In this report, we propose establishing performance measures that target the bottom 5 percent of four-year colleges based on six-year completion rates, student loan default rates, and the percentage of freshmen receiving Pell Grants. In order to maintain participation in the Title IV financial aid programs and continue receiving tax benefits and institutional grant aid, colleges would have to meet the following minimum criteria: Percentage of full-time, first-time freshmen receiving Pell Grants should be at least 17 percent. Six-year graduation rates for full-time, first-time freshmen should be at least 15 percent. Three-year cohort default rates should not exceed 28 percent. We propose that colleges be given technical assistance and financial support to help meet these benchmarks. However, institutions unable or unwilling to meet these benchmarks in a reasonable, predetermined timeframe would be held accountable through real sanctions as follows: Highly selective colleges that do not enroll enough Pell-receiving, full-time freshmen would lose institutional grant and tax benefits for charitable deductions. 1 Colleges with low-graduation and low loan repayment rates would be subject to losing institutional grant and tax benefits as well as all eligibility to receive federal student aid, including grant, loan, and student tax benefits. Better public reporting will help, but transparency and accountability are not equivalent. Without clear goals for improvement, help for institutions that are struggling, and clear consequences for inaction, students will continue to be poorly served by too many of the colleges participating in federal student loan programs and precious taxpayer dollars will continue to be wasted. 1 Examples include the Supplemental Opportunity Education Grant, TRIO, and any future competitive federal-state partnership grants.

3 Year-Round/Summer Pell The Pell Grant remains the most reliable and accessible source of federal financial aid for lowincome, Pell-eligible students. The Education Trust supports restoring year-round Pell Grant authority as was in law prior to This restoration is critical as a means of increasing college persistence and completion for disadvantaged students. Teacher Preparation Standards and Programs The Education Trust supports the reporting provisions in the HEAA draft regarding educator preparation programs. The reporting requirements and measures are relevant to ensuring the public, prospective students, and hiring districts all know which institutions produce graduates who excel in the classroom. We especially support the metrics on the employment of the program s graduates and on teacher performance on the job. We would recommend going further to ask that states not just report these data but act on them. States should reward their high performers and shrink or close any low performers that don t improve in a reasonable time. The problems in teacher preparation are simply too profound and too pervasive to only go as far as simply mandating reporting. Unfortunately, the proposed structure of the Education Preparation Program Reform Grants would not require all states to address these issues. Instead of requiring all states to act on the data, this program would provide only a handful of states with an incentive to develop measureable plans that would reward high-performing programs and impose consequences on low-performing programs. While this structure would require those states receiving grants to undertake these efforts, states that chose not to apply for and receive competitive grant funding would not be required to meet these higher standards. In addition, they would not have to develop strong partnerships with high-need local educational agencies. We recommend a program that holds all states and educator preparation programs to high standards. We have provided for your consideration draft language that addresses these issues. State Grant Programs Addressing College Affordability, Student Persistence, and Program Completion We support the demonstration program for early awareness of college aid. The problem it addresses is so widespread that the program should be available for all interested states, rather than capped at 15. Currently, sufficient and necessary information about financial aid options is not available to many students before they apply to or select a college. This contributes to several undesirable outcomes, including undermatching, which is where students and their families choose less selective colleges based solely on their perception of affordability, often stemming from sticker shock over an institution s published cost of attendance. The proposed early awareness program could help students and their families perceive a broader set of options in choosing and affording a college.

4 We also strongly support the concept and intention of the State/Federal College Affordability Partnership and the State Competitive Grant Program for Reforms to Improve Persistence and Completion. States are critical actors in keeping colleges, especially public colleges, affordable. Without engaging states in a new partnership, the federal government will be unable to reign in the growth of college costs or improve college success rates. We would recommend going further to ensure a true partnership with the states. In our report, Doing Away With Debt: Using Existing Resources to Ensure College Affordability for Low and Middle-Income Families, The Education Trust shows how without spending a nickel more than it currently spends on student aid Congress could create a powerful new partnership with exactly the size and scope necessary to get the job done. We have included a link to the report in this . We recommend that more than $20 billion annually, drawn from existing federal resources (outside of the Pell Grant) and from modifying the tax code related to higher education to benefit families in need, go directly to states that address four key policy commitments: 1) College and career readiness for all. High schools would provide a college- and career-ready course of study for all students. 2) Stabilize support for higher education. States would be required to maintain their level of state higher education spending. Ensuring steady and reliable funding streams enables institutions to curb rising tuition. 3) Develop credit transfer agreements. Public institutions of higher education, and private institutions that choose to participate, would be required to ensure that credits transfer from institution to institution. 4) Cap debt and interest for low- and moderate-income students. States would guarantee that costs for low-income students be capped at a small percentage of discretionary family income, and that moderate-income students could borrow interest free. Unlike the smaller program outlined in the draft framework, the Education Trust s recommended state grant program provides a more comprehensive solution to the many issues students face related to college affordability, persistence, and degree completion. For your consideration, we have included legislative language for this proposal. Other Provisions We also support a number of provisions in HEAA, including the following: Return to 85/15 and the Inclusion of Additional Federal Funding Streams: The Education Trust supports the return to 85/15 from 90/10 regarding the percentage of non-federal funds that proprietary schools must generate. Current law requires proprietary institutions of higher education to derive no more than 90 percent of their revenue from Title IV. We support the bill s aim to cap federal funds (not just Title IV aid) at 85 percent, with the balance of revenue coming from outside sources.

5 Notification of Pell Grant Eligibility and Expanded Loan Counseling Requirements: The Education Trust supports the bill s requirements for colleges to regularly notify students of remaining Pell Grant eligibility and for upgraded loan counseling requirements. The recent addition of more stringent lifetime limits on Pell eligibility and the ever-increasing costs of college make these added notification and counseling requirements invaluable for students making decisions on which college to attend and about whether they can afford to continue their schooling. New Loan Repayment Metrics: We support the inclusion of the bill s new provisions on Loan Repayment Rate and Speed-Based Repayment Rate. These two new metrics will provide valuable and much-improved information on whether students are able to repay their loans. These provisions are increasingly important as the cost of college continues to rise and existing cohort default rates do not sufficiently measure loan repayment by institution. Ability to Benefit (ATB): We support the bill s partial restoration of this means of qualifying for student financial aid when coupled with enrollment in a career pathway program. The linkage of the career pathway requirement in the bill will ensure that students without a high school diploma or high school equivalency are on a track to succeed. Under prior ATB authority, students who qualified for aid were not required to be on a career pathway. Changes to Incentive Compensation: The Education Trust supports the tougher incentive compensation standards and the requirement that institutions of higher education affirmatively acknowledge that incentive compensation is a prohibited activity. System of Civil Penalties: We support the inclusion of a system of civil penalties for substantial misrepresentation, other serious violations, or an institution s student default risk as calculated under HEAA. Greater Transparency on Accreditation: We support the bill s requirements to publicly post accreditation documents related to academic and institutional quality as a means of bringing greater understanding and acceptance to the accreditation process. Thank you for your leadership in taking steps to reauthorize the Higher Education Act to ensure all students, especially low- and moderate-income students, students of color, and students with disabilities, are able to access, afford, and complete a high-quality postsecondary education.
