DASDrive Ultimate offers you the comprehensive legal protection, specialist support and expert advice you need as a motorist, all packaged up into one neat, affordable product. DASDrive Ultimate Legal Protection is designed to help if you: suffer injury or incur losses which are not covered under your motor insurance policy, or need a replacement hire vehicle, following a motor accident that was not your fault, your vehicle is stolen or cannot be driven following theft, attempted theft, fire, vandalism or accidental damage you are responsible for, have been prosecuted for a motoring offence, have a contract dispute regarding the buying or selling of your vehicle, just need general legal advice.

4 4 IN THE EVENT OF AN ACCIDENT If you are involved in a road traffic accident which was found not to be your fault, you are entitled under law to be put back into the position you would have been had the accident not taken place. With DASDrive Ultimate Legal Protection, we will endeavour to recover losses not covered by your underlying motor insurance policy, this includes: Compensation for bodily injury or death of any person travelling in or on your vehicle, and medical and rehabilitation expenses Your policy excess under your comprehensive motor insurance policy. If we can recover your losses in full, your no-claims bonus should not be affected Accident repair costs if you do not have comprehensive insurance cover Compensation for damage to personal property belonging to any person travelling in or on your vehicle. Often, our fully trained and experienced motor claims handlers can negotiate full recovery of your claim outside the courts. If this is not possible, or where bodily injury is involved, we refer your case to a lawyer for further action. We pay all costs up to 100,000 for each claim, including solicitors and barristers fees, court costs and expenses for expert witnesses.

5 5 VEHICLE HIRE If the accident was entirely the other person s fault, and your vehicle cannot be driven, we can arrange to supply you with a replacement hire vehicle. We can also supply you with a replacement hire vehicle for up to 21 days if your car is stolen or cannot be driven following theft, attempted theft, fire, vandalism or accidental damage you are responsible for. EUROPEAN COVER Our legal protection cover applies to the United Kingdom and most other European countries. So, when you drive your car in Europe you have the peace of mind of knowing you have the benefit of DASDrive Ultimate Legal Protection and our legal advice helpline. UNINSURED LOSS RECOVERY SCENARIO A motorist failed to apply the brakes and drove into the back of our insured s car. Our insured claimed on their motor legal expenses policy. DAS supplied a hire car and recovered the insured s policy excess from the party at fault.

6 6 IF YOU RE FACING A MOTOR PROSECUTION If you are facing a motoring prosecution, we can help provide legal protection to support you in court. Many of us rely on our driving licence for our day-to-day lives and losing it can have serious consequences. Every driver should be entitled to access good advice and be in a position to defend themselves should the worst happen. DASDrive Ultimate includes Motor Prosecution Defence cover which provides up to 100,000 in legal defence costs should you face a motoring prosecution. Our legal advisors will provide you with guidance on your offence, and should you face a prosecution, legal representation to defend your legal rights. Cover applies to all prosecutions, except parking or obstruction offences, insurance offences and challenging a fixed penalty notice. You must call us within 10 days of receiving the Notice of Intended Prosecution. MOTOR PROSECUTION DEFENCE SCENARIO Our insured was caught speeding and faced the possibility of being disqualified through totting up. The insured already had 7 points on their licence and with this new offence carrying a further 6 penalty points, the insured would most likely have been banned. Representatives acting for the insured were able to negotiate a reduction in the fine and number of penalty points imposed meaning the insured did not suffer a driving suspension. The legal costs involved in this case when defending the insured were paid by DAS.

7 7 IF YOU HAVE A CONTRACT DISPUTE RELATING TO YOUR VEHICLE The Sale of Goods Act 1979 states that goods must be of satisfactory quality and fit for purpose. Purchasing a car can have a large impact on your finances and should the car have problems which prevent it being used as intended, you want to be assured your legal rights are protected. If you find yourself in a motor contract dispute regarding an amount of 250 or more, we can help settle that dispute and make sure you don t end up out of pocket. MOTOR CONTRACT DISPUTE SCENARIO Our insured purchased a vehicle which almost immediately showed problems. The insured therefore contacted us seeking a solution to this problem. Our solicitors arranged for the vehicle to be independently inspected which concluded the vehicle was not of satisfactory quality when supplied to the insured. A claim was intimated to the seller and following negotiations with their solicitors, it was agreed that the seller would purchase back the vehicle for a percentage of the market value agreed by our insured. The costs involved in pursuing the claim were covered by DAS.

Our experienced counsellors are available to discuss any issue and offer completely confidential support and advice at a convenient time. Some of the concerns they deal with include stress, anxiety, depression, health related issues, relationship breakdown and bereavement. They are also able to provide all kinds of information and can offer referral to relevant professional or voluntary bodies which offer help and support. The insured is responsible for paying any costs for using those services to which DAS refers them.

10 POLICY SUMMARY This policy summary provides key information about DASDrive Ultimate Legal Protection, which you should read. It does not contain full terms and conditions of the policy, which you can find in the DASDrive Ultimate Legal Protection policy document. Unless otherwise agreed with the person who sells you this insurance, your cover will be valid for one year. DASDrive Ultimate Legal Protection is a legal expenses insurance contract which helps you to recover uninsured losses and costs from the person responsible following a motor accident, defends you against motoring prosecutions and assists you in contract disputes related to your vehicle. DAS Legal Expenses Insurance Company Limited ( DAS ) is the underwriter and provides the legal protection insurance under your policy. The legal advice service is provided by DAS Law Limited and/or a preferred law firm on behalf of DAS. The handling of your claim, via the Motor Claims Centre is provided by DAS Law Limited on behalf of DAS. Features and benefits Significant exclusions or limitations Policy section 10 We will resolve an insured legal problem, either ourselves or through external lawyers and other experts that we will appoint. We will appoint our preferred choice of law firm to deal with your claim and will pay their costs and expenses, which include opponents costs. Reasonable prospects (other than in respect of insured incident 2 Motor prosecution defence) exist for the duration of the claim. The most we will pay for all claims resulting from one or more events arising at the same time or from the same originating cause is 100,000. The most we will pay in costs and expenses is no more than the amount we would have paid to a preferred law firm. The amount we will pay a law firm (where acting as an appointed representative) is currently 100 per hour. This amount may vary from time to time. Costs incurred before we have accepted a claim. Unless we agree to start legal proceedings or there is a conflict of interest, we are free to choose the representative who will help you. 11 11 Features and benefits Significant exclusions or limitations Policy section 1 UNINSURED LOSS RECOVERY AND PERSONAL INJURY Costs and expenses incurred to recover uninsured losses after an event which causes: The prospects that an insured person will recover losses or damages must be at least 51%. Page 9, LEGAL PROTECTION: OUR AGREEMENT 1 (a) (b) damage to the insured vehicle or to any property belonging to an insured person in or on the vehicle; and/or death or bodily injury to an insured person whilst travelling in or on the insured vehicle. Anyone claiming must be in or on your vehicle with your permission when the damage and/or injury is caused. The insured vehicle being used by anyone, with your permission, who does not have valid motor insurance. The insured person must notify us within 10 days of receiving a written Notice of Intended Prosecution, or as soon as reasonably possible if the insured person is notified of a prosecution any other way. Parking or obstruction offences, insurance offences or challenging a fixed penalty notice. The settlement payable under an insurance policy (we will cover a dispute if your insurer refuses your claim, but not for a dispute over the amount of the claim). Page 10, INSURED INCIDENTS: 3 MOTOR CONTRACT DISPUTES: WHAT IS NOT COVERED 4a REPLACEMENT HIRE VEHICLE (following a non fault accident) We will make the arrangements for vehicle hire for you within the countries covered and we will pay your vehicle hire costs following an accident involving the insured vehicle and another vehicle. If this is not possible we will still seek to recover your uninsured losses for the loss of use of your vehicle. Replacement vehicle hire costs are payable only if the accident was entirely the other person s fault and your vehicle cannot be driven. We will choose the vehicle hire company and the type of vehicle to be hired. We will decide how long a vehicle can be hired for. You must tell us as soon as the insured vehicle becomes available for you to drive again. A replacement hire vehicle will only be provided if you meet the age and licensing rules of the vehicle hire company we choose and you must follow any terms and conditions of hire. If a replacement vehicle is unavailable we will seek to recover your uninsured losses for the loss of use of your vehicle. We will only pay vehicle hire costs for up to 21 days, or until your vehicle can be driven again if this is sooner. Your vehicle must be undriveable. If a crime has been committed it must have been reported to the police. We will choose the vehicle hire company and the type of vehicle to be hired. A replacement hire vehicle will only be provided if you meet the age and licensing rules of the vehicle hire company we choose and you must follow any terms and conditions of hire. 15 15 CANCELLATION RIGHTS We hope you are happy with the cover DASDrive Ultimate Legal Protection provides. However, you can cancel the policy without notice within 14 days of taking it out. After this you can cancel it at any time by telling the person who sells you the policy, but you must give 14 days notice of cancellation. We can cancel this policy at any time as long as we give you at least 14 days notice. You can ask the person who sells you this insurance about getting a refund of premium if you cancel the policy.
