1 Effective Date: June 2003 Page No. 1 of 12 GENERAL PURPOSE: This policy is intended to provide a process and procedure that will increase awareness of campus safety and security issues and to communicate to all those visiting the campus on procedures to follow when safety and security issues arise. It is also the purpose of this policy to meet the Office of Postsecondary Education of the U.S. Department of Education (OPE) requirement that by October 1st of each year, any school that is Title IV eligible publish and distribute an annual campus security report to all current students and employees. This requirement was authorized by Congress with the 1998 amendment to the Higher Education Act of 1965 (HEA) to help potential college students and their parents research criminal offenses on college campuses. The OPE and covered schools such as MJI are committed to providing students with a safe environment in which to learn and to keep parents, students, those with business on campus and other concerned parties well informed about campus security. This congressional act is known as the federal Student Right to Know and Act. POLICY: It is the policy of MJI that each fall the MJI Security Officer will provide the required data to the OPE using a Web-based data collection tool. The statistics will present alleged criminal offenses reported to the MJI Officer (CSO) or local police agencies. These data, as collected will not necessarily reflect prosecutions or convictions for crime. (Note also: because in some instances non-police authorities will provide the statistics, the data will not be directly comparable to data from the FBI s Uniform Crime Reporting System, which only collects statistics from police authorities.) The MJI Officer (CSO) also prominently posts a comprehensive campus security report regarding MJI security statistics at the Office of Academic Administration and/or on the MJI website at Per Federal Title IV requirements, a current

All MJI employees, students and other visitors having legitimate business on campus will be oriented annually on this policy and procedure. DEFINITIONS: AGGRAVATED ASSAULT An unlawful attack by one person upon another for the purpose of inflicting severe or aggravated bodily injury. This type of assault is usually accomplished by the use of a weapon or by means likely to produce death or great bodily harm. It is not necessary that injury results from an aggravated assault when a gun, knife, or other weapon is used which could and probably would result in serious personal injury if the crime were successfully completed. ARSON To unlawfully and intentionally damage, or attempt to damage, any real or personal property by fire or incendiary device. BURGLARY The unlawful entry of a structure to commit a felony or theft. For reporting purposes this definition includes: unlawful entry with intent to commit a larceny or felony; breaking and entering with intent to commit a larceny; housebreaking; safecracking; and all attempts to commit any of the aforementioned. CRIMINAL HOMICIDE Murder and Non-Negligent Manslaughter The willful (non-negligent) killing of one human being over another. Negligent Manslaughter The killing of another person by gross negligence. DRUG ABUSE VIOLATION Violations of State and local laws relating to the unlawful possession, sale, use, growing, and manufacturing of narcotic drugs including marijuana.

3 Effective Date: June 2003 Page No. 3 of 12 HATE CRIMES Any crime involving bodily injury in which the victim was intentionally selected because of race, gender, religion, sexual orientation, ethnicity or disability. LIQUOR LAW VIOLATION The violations of laws or ordinances prohibiting the manufacture, sale, transport, furnishing, or possessing intoxicating liquor: maintain unlawful drinking places, bootlegging: operating a still: furnishing liquor to minors, or using a vehicle for the illegal transporting of liquor. MOTOR VEHICLE THEFT The theft or attempted theft of a motor vehicle. ROBBERY The taking or attempting to take anything of value from the care, custody, or control of a person or persons by force or threat of force or violence and/or by putting the victim in fear. SEX OFFENSE-FORCIBLE Any sexual act directed against another person forcibly and/or against that person s will where the victim is incapable of giving consent. WEAPON POSSESSION VIOLATION The violations of laws or ordinances prohibiting the manufacture, sale, transport, furnishing, possessing, carrying of deadly weapons, and all attempts to commit any of the aforementioned. PROCESS: MJI is concerned about the safety and welfare of its students, faculty, staff and guests, and seeks to provide a safe and secure campus environment. A significant part of every campus security program is prevention, including cooperation and precautionary steps taken by all parties having legitimate business on campus. In 1990 the Congress of the United States passed the Crime Awareness and Campus Security Act. This act provides for the reporting of specific information about campus security and crime. There are seven specific areas that are required. These are

Crime Definitions 4. Crime Statistics/Security Policies 5. Police Liaison and Security Authority 6. Access to Campus Facilities 7. Crime Prevention & Security Awareness Program 1. Procedures for Reporting Criminal Actions What to report: Arson Assaults Hate crimes Injuries or illness People in possession of alcoholic beverages/illegal drugs and other controlled substances Robberies Suspicious person, vehicles or activities Thefts Threats Vandalism Violence Criminal actions on campus during office hours should be immediately reported to the designated MJI Officer (at this time, Mr. Bruce Fidler) who in turn will contact the appropriate authorities. Incidents will be recorded on the Incident Form provided by the Officer (CSO) and signed by the witness and the CSO.

5 Effective Date: June 2003 Page No. 5 of 12 During evening and weekend courses, incidents may be reported to any MJI instructor available at the time. The MJI instructor will, in turn, report the incident to the CSO within one business day. Incidents thus reported by MJI instructors will be also recorded on the Incident form and signed by the instructor and student, when next available. ALL URGENT OR EMERGENCY EVENTS SHOULD BE IMMEDIATELY REPORTED TO THE WEST BLOOMFIELD POLICE DEPARTMENT (MJI WEST BLOOMFIELD CAMPUS) OR OAK PARK DEPARTMENT OF PUBLIC SAFETY (MJI OAK PARK CAMPUS) BY DIALING 911 FROM ANY TELEPHONE ON CAMPUS, AND ONLY AFTER THEN, BE REPORTED TO THE CSO AS SOON AS POSSIBLE. 2. Off Campus Student Organizations and Criminal Activity MJI does not sanction, maintain or authorize any off campus facilities, including dorms, or other housing, for use by individual students or used by any student organizations. 3. Crime Definitions Please see Definitions Section above. 4. Crime Statistics/Security Policies Institutions of postsecondary education that participate in the Federal student financial assistance programs are required under section 485 of the Higher Education Act to provide campus crime statistics. MJI meets these requirements as described in the Policy Section, above. 5. Police Liaison and Security Authority The MJI CSO does not have police authority but can be immediately in contact with local, state, and federal authorities. The CSO performs a variety of protective and service-

6 Effective Date: June 2003 Page No. 6 of 12 related functions: she maintains incident reports; insures that all new hires receive a copy of the policy and procedure manual, including this policy; and, schedules annual communications to the campus community regarding security issues. 6. Access to Campus Facilities To insure academic freedom and the free exchange of ideas, access to MJI facilities is open during all operating hours. However, all faculties and other staff receive training regarding the questioning of any strangers who may appear on campus. In recent years faculty and staff have also been trained to respond to any unusual parcels or packages left unattended on campus. At the close of the operating day, campus maintenance staff are responsible to walk the campus in search of any remaining visitors and to secure and lock all doors and windows, before leaving for the night. The MJI Campus in Oak Park, is located on one of the main thoroughfares of the City of Oak Park and is therefore under routine surveillance by Oak Park Department of Safety patrol cars. The same is true for the MJI Campus in West Bloomfield, which is patrolled by the West Bloomfield Police Department. 7. Crime Prevention & Security Awareness Program The Student Right to Know and Act requirements are implemented at MJI using a variety of methods. STUDENTS: All students receive their own copy of the MJI Academic Catalog and Student Handbook when they are first admitted to the college. They are free to request additional copies as needed or whenever the catalog is updated. The catalog is also available on the MJI website at This catalog contains discussion on campus crime statistics (including a summary table of past incidents) and security. Crime statistics

7 Effective Date: June 2003 Page No. 7 of 12 are also prominently posted at the MJI Office of Academic Administration and Computer Labs. On a routine basis, students also meet with MJI academic advisors to discuss their program plans and academic progress. At these times, students receive a copy of their individualized plans and are requested to sign a form indicating that they have received the catalog, a program plan and that they are aware of MJI crime statistics and security policies and procedures, amongst others. MJI EMPLOYEES: All employees receive the MJI via the MJI intranet. Additionally, each semester, faculty members receive an orientation CD describing the new semester and which also includes a number of MJI policies and procedures, including this policy. These CDs are available to all MJI employees. The mid-semester faculty meeting Agenda Template includes a discussion item regarding campus security matters and thus these are discussed with faculty at least twice a year. The faculty meetings are documented via meeting minutes prepared soon after each meeting. These minutes are maintained by the Dean of Academic Administration and are available for review in both electronic and hard copy versions. CASUAL VISITORS TO CAMPUS: Crime statistics are posted as described above. There are also posters in and about the campus describing substance abuse policies, warnings against harassment, emergency escape routes and others. From time to time, various relevant security brochures and other literature are made available at the brochure kiosks maintained by the MJI Marketing Department. CRIME AND SECURITY PROGRAMS AT MJI: Because MJI is a small college and its internal programming resources limited, on-campus security and crime prevention programs are not routinely offered. Rather, the Office of Academic Administration and the CSO maintain information on such community based programming. All MJI personnel are

8 Effective Date: June 2003 Page No. 8 of 12 invited to inquire about the availability of community based programs for: Crime Prevention Mental Health Self-Defense Sexual Assault Education, Prevention and Response Substance Abuse Education Others GENERAL SECURITY POLICIES Student Orientation: New students receive security/safety information during their enrollment interview and are encouraged to report safety concerns, emergencies, and/or crimes to the appropriate staff member. Fire Safety and Prevention: All public rooms, classrooms and offices are equipped with posters mapping emergency escape routes. MJI buildings also have alarm systems. Fire Drills are conducted on a regular basis. Tampering with fire equipment or refusing to vacate the building during an alarm are serious offenses and are violations of state and local fire codes. Violations will be referred to local law enforcement agencies and may result in a fine of up to $1, and/or imprisonment for 1 year. Security and Access Policies: Since our student body consists of commuter students, security and access problems are reduced. Although the school does not employ a security force, MJI campuses are routinely patrolled by the West Bloomfield Police and Oak Park Department of Public Safety (as described in Section 6, above.) Parking lots are lighted at night and building access and departure are controlled as described in section 6 above.

9 Effective Date: June 2003 Page No. 9 of 12 Alcohol and Drug Policies: MJI policies prohibit the unlawful possession, use, distribution and sale of alcohol and illicit drugs by students and employees. These policies apply to all full-time and part-time students and employees. Disciplinary actions and/or treatment referral practices are described in the MJI controlled substances policy statement and the Academic Catalog. (At the time this policy was last revised, MJI had a referral arrangement with Clinical Psychologist, Dr. Jeffrey Last, West 12 Mile Road, Suite 190, Southfield, Michigan Phone: (248) Dr. Last is available for students, faculty and administrative staff seeking help and/or counseling for substance abuse or other issues. Dr. Last does not release any client information to MJI without express and written authorization from the client. Faculty, staff and students may elect to use other counseling services that are appropriately licensed by the State of Michigan.) Sexual Offense Campus Procedures If a sex offense has occurred, students are encouraged to report the incident to the MJI CSO. The CSO can provide assistance in contacting local authorities and/or counselors. Due to the nature of the offense and evidence needed for criminal prosecution, it is important that students seek immediate assistance, either from the MJI CSO, other staff during the absence of the CSO or other medical/local authorities. Disciplinary Action for Sexual Offenses: In the event that disciplinary action is required, both the accused and the accuser will be accorded the same rights. Both the accuser and accused are entitled to the same opportunities to have others present during a disciplinary proceeding and will be informed of the school s final decision. If it is determined that an act of misconduct or a violation of the school s policy regarding sexual offenses has occurred, disciplinary action can and will result in expulsion.

10 Effective Date: June 2003 Page No. 10 of 12 Disciplinary Action for Other Serious Offenses, such as but not limited to, Arson, Assault, Vandalism and Violence: Persons engaging in any of the above activities will be immediately denied further admission on any MJI campus until final disposition of the matter is achieved. In the event that such action is required, both the accused and the accuser will be accorded the same rights. Both the accuser and accused are entitled to the same opportunities to have others present during disciplinary proceedings and will be informed of the school s final decision. If it is determined that a serious violation has occurred, the guilty party s relationship with MJI will be severed (employees of the college will be terminated and students will be expelled from the college). Campus Safety Tips: Stay away from isolated areas. Park in a well lighted area. Don t walk alone safety in numbers. Ensure outside doors close securely when entering or leaving the suite. Keep car keys in your hand ready to unlock the car when leaving the building.
