The following list offers examples of the types of cases the department handles every day. Slip and fall injury- when someone is injured while on another person s property, the owner of the property can be held liable for their injuries. Car accident- auto, truck and motorcycle accidents can result in serious personal injury to those involved in the collision. Wrongful death- when someone is killed as a result of another s negligent actions, the family of the deceased may have grounds for a wrongful death claim. Defective product injury- defective products, such as foods and household products can cause serious personal injury. Exposures to toxic material- toxic materials used in the workplace, or those which contaminate the environment are often the cause of personal injury claims. Medical malpractice- medical negligence, hospital malpractice, and doctors mistakes may be the subject of personal injury claims. Nursing home abuse- also known as nursing home neglect, nursing home abuse occurs when a resident of a nursing home is subjected to physical abuse, mental abuse, or abandonment. Drug injury- the makers of defective drugs and those with serious undisclosed side effects or that are the subject of a drug recall can be held responsible for the injurious effects of the drugs. Job injury- in addition to workers compensation claims, construction accidents, industrial accidents, and other on-the-job accidents often result in simultaneous personal injury claims. Dog bite injury- owners of dogs that injure another person can often be held liable for any personal injury the victim sustains. Workers Compensation For over 35 years Rosenthal, Levy & Simon has represented injured workers. The Workers Compensation team is lead by Senior Partner Gerald A. Rosenthal, one of the first attorneys in Florida to be certified by the Florida Bar as a specialist in workers compensation law. The team is led by board certified workers compensation and trial attorneys Gerald Rosenthal and Jonathan Levy. 6 Employment Law Some employers allow their employees to be treated poorly. You know when you have been treated wrong. These actions may also be unlawful. Speak to our Employment Law team and find out if your situation falls into one of the categories below. Unpaid Overtime & Commissions Working overtime is hard enough. Not being paid properly or sufficiently is not only unfair, it is unlawful. Federal laws exist to ensure employees are paid sufficiently and fairly. Do you get paid time and a half for every hour over 40 hours you work? Were you paid time and a half at your previous job? If not, you may be entitled to recover back pay for as much as three years. Ask yourself the following questions: Question: Did you make less than $100,000 per year, work over 40 hours in a week and receive no overtime pay? Question: Did you get comp time instead of money in your paycheck? Question: Were your hours rounded off to 40? Question: Did you take home work, or work during off clock periods, such as during meals and before or after your regular shift? If you answered yes to any of these questions, you may be entitled to overtime pay. Beyond the basic questions above, many other factors determine whether you are entitled to overtime pay. People work overtime and don t even know it. Coming to work early and leaving late, even if you re off the clock is still work and you should be paid. Your boss knows this, but may never tell you. Harassment The act of persistent and/or continued unwanted attention, offensive language, jokes, photos, touching or gesturing by an individual or by a group. Violations of the Family and Medical Leave Act Failure of an employer to offer or comply with the provisions and protections granted by federal law to employees facing a serious medical condition. Retaliation/Whistleblowing Adverse action taken against an employee who reports or threatens to report allegations of illegal actions by the employer to a governing agency. Breach of Employment Contract When certain terms, conditions or promises contained in a contract between an employer and an employee are not kept or when the employer does not perform duties and obligations required in such a contract. Reasonable Accommodations Failure to provide jobsite accommodations which allow an employee with a disability to perform the essential functions of his or her position. Administrative Hearings Non-judicial hearings where evidence is introduced to the appointed administrative law judge or governing body for determination on the issues. Rosenthal, Levy & Simon s attorneys and staff will work tirelessly to see that you receive your due! If you are a veteran of the United States Armed Forces and you suffer a serviceconnected disability, whether physical or psychological, you may be eligible for compensation even if the disability is only partial. Another VA program pays benefits to disabled veterans whose disability is not service-connected. These veterans may be entitled to a non-service-connected pension. In order to receive the pension, the veteran must have served on active duty during a period of war, there must be a total and permanent disability (but the disability does not have to be service-connected) and, like SSI, the pension is income-scaled, which means that the veteran may or may not qualify for both a VA pension and Social Security Disability. Levy is a Board Certified Civil Trial Attorney, specializing in trial litigation. Only one percent of all Florida Bar Members are board certified civil trial attorneys. Jonathan has devoted his entire professional career to handling catastrophic medical malpractice, products liability, and automobile collision cases. In addition to litigating the underlying injury claims, Jonathan has worked to secure insurance benefits for clients after the insurance carriers denied these claims in bad faith. 9 NOTES Steven C. Simon Partner Steven C. Simon is a civil trial lawyer, concentrating his practice on the representation of individuals in personal injury claims, wrongful death cases, insurance disputes and social security matters. Early in his career, Steve represented insurance companies in tort litigation, including personal injury, professional malpractice, and products liability. He gained valuable insight into the ways insurance companies operate. His perspective and extensive litigation background are now devoted solely to upholding the rights of injured individuals. Steve directs the firm s personal injury practice in Port St. Lucie, where he has built an extensive network of medical professionals and rehabilitation experts. In addition to carrying a full caseload, he is extremely active in various civic and social organizations. Steve is a regular legal commentator on local Spanish radio.
