FAA , NOTICE OF PROPOSED RULEMAKING, AIR AMBULANCE AND COMMERCIAL HELICOPTER OPERATIONS, PART 91 HELICOPTER OPERATIONS, AND PART 135 AIRCRAFT OPERATIONS; SAFETY INITIATIVES AND MISCELLANEOUS AMENDMENTS The National Air Transportation Association (NATA), the voice of aviation business, is the public policy group representing the interests of aviation businesses before Congress, federal agencies and state governments. NATA s 2,000 member companies own, operate, and service aircraft. These companies provide for the needs of the traveling public by offering services and products to aircraft operators and others such as fuel sales, aircraft maintenance, parts sales, storage, rental, airline servicing, flight training, Part 135 on demand air charter, fractional aircraft program management and scheduled commuter operations in smaller aircraft. NATA members are a vital link in the aviation industry providing services to the general public, airlines, general aviation, and the military. NATA, as a representative of Part 135 operators impacted by these proposed changes, offers the following comments in response to the Federal Aviation Administration s (FAA) Notice of Proposed Rulemaking (NPRM). Aircraft Manifest Changes The FAA intends to expand the manifest requirement of to apply to all aircraft operated under Part 135. This proposal is the single most costly aspect of the NPRM. NATA agrees in part with this proposal. As partial justification for the change, the FAA references the Part 125/135 Aviation Rulemaking Committee (ARC) recommendation on this subject. The FAA has however not correctly reflected the ARC recommendation.

2 Page 2 of 5 Specifically, the ARC recommended that be modified to require all turbinepowered aircraft to complete a manifest. 1 The change now proposed by the FAA would apply the rule to all aircraft, a significant departure from the ARC recommendation. NATA supports the original ARC recommendation and suggests the FAA modify the final rule to require manifest completion for turbine powered aircraft, not for all aircraft. Adopting the ARC recommendation would significantly reduce the burden and costs for small businesses, a concern the FAA articulated in the NRPM. NATA is in support of the electronic transmission and recordkeeping aspects of proposed The association is concerned with some of the language in paragraphs (c) and (d) of proposed The proposed regulatory text stipulates that the manifest must be prepared in duplicate, unless the certificate holder receives a copy of the load manifest (75 FR 62668). Further, the preamble explains that the manifest, must be received by the certificate holder s approved location (75 FR 62661). NATA requests that the FAA adopt a reasonableness standard for receipt of the electronically transmitted manifest. That is, we recommend that the regulatory standard be that the departure may occur if the pilot reasonably believes the manifest has been received prior to takeoff. This standard is important due to the nature of on demand operations and the occasional technological lapses, often unknown to users, which occur from time to time. There are a great many Part 135 certificate holders that are very small businesses, including owner operator single pilot operations. Should the FAA not follow the ARC s recommendation to require only turbine powered aircraft to complete manifests, this point becomes especially important. 1 See docket FAA , document ID FAA

3 Page 3 of 5 Part 135 operators are not required to have a staffed 24 hour operations center at a fixed location. Presumably, the FAA could approve sending the manifest via an to a designated account established by the certificate holder. At some operators facilities, there may not be a person at the certificate holder s base of operation. There may be a management employee who can access the account, but that person may not be at the certificate holder s facility at that time. Also, the operational control functions necessary for release of the aircraft on a particular flight may be wholly or partially delegated to the pilot(s). In other cases, such as single pilot operators, there may simply be no one at the operator s base that could affirm that the manifest has been received. These operations should not be denied the ability to use electronic transmission authority simply because it is not practical or feasible to verify a successful transmission immediately. Changes for All Part 135 Helicopters and For Air Ambulance Helicopters NATA is concerned with the cumulative costs being imposed on helicopter operators, particularly air ambulance helicopters, in a relatively short period of time. Many of the proposed requirements are effective either immediately or within three years of a final rule. The FAA expressed concerns with the cost burden of the proposed requirements at multiple times in the NPRM. NATA recommends that the FAA may best address this concern by adopting a more staggered implementation and/or longer implementation timetable. In the agency s required consideration of alternatives, the FAA only evaluated extending all equipment requirements to four years. This was rejected by the FAA, and the agency states it does not believe the alternative is acceptable because safety enhancements are delayed. NATA disagrees. First, the FAA s determination of safety delayed is focused only on the equipment requirements proposed. The NPRM contains several recommendations related to

4 Page 4 of 5 crew qualifications and training, aircraft operating requirements and which operational rules (Part 91 or 135) apply. Most of these changes are to take effect immediately under the NPRM. Certainly, the FAA would not argue that these changes won t improve safety; otherwise, they would not have been proposed. Second, the FAA failed to consider multiple alternatives, including incrementally imposing the additional requirements. This approach would permit safety enhancements to begin immediately and continue every year thereafter until fully implemented. NATA strongly recommends that the FAA consider adopting compliance dates that are staggered rather than largely simultaneous. NATA especially recommends additional compliance time for Operations Control Centers under and for the Light Weight Aircraft Recording System (LARS), should it ultimately be required. One possible alternative for the operational control center requirement of is to require those with perhaps twenty or more air ambulance helicopters to meet the requirement within two years while those with fewer helicopters would need to comply within four years. Operational Control Specialists With regard to the proposal to create operational control specialists in , NATA suggests that the FAA amend (e)(1)(ii) to permit those who have direct experience in Part 135 aircraft operations, planning and scheduling also to receive credit for training. The Part 135 operators impacted by this new requirement may have many dispatch/scheduling staff who do not possess FAA aircraft dispatcher certification but nonetheless may have extensive directly applicable knowledge and experience that should receive credit.

5 Page 5 of 5 NATA objects to the duty limit established for operational control specialists at (h). NATA suggests that the FAA align operational control specialist duty periods to flight crewmember duty periods. For most Part 135 operators that operate under (d), a 14 hour duty period is typical. It is logical and carries benefits for a single specialist to be assigned to a flight crew and aircraft for their entire duty cycle, and the regulations should permit this.
