2 Context 1 This Overarching Partnership Agreement (OPA) provides a set of guiding principles at corporate and strategic level between the Department for Work and Pensions (DWP), the Convention of Scottish Local Authorities (COSLA) and Scottish Government (SG) in respect of the delivery of Local Support Services in Scotland. 2 The OPA provides an agreed framework for DWP and each Local Authority to pursue a partnership within the context of the Community Planning Partnership (CPP) arrangements that exist in Scotland to plan and deliver holistic local support service packages tailored to meet local needs. 3 While it is not a legal requirement that Local Authorities engage in these partnerships, the value of jointly planning and delivering these services to local communities has been recognised by COSLA, SG and the UK Government in the Local Support Services Framework which has been co-produced by COSLA, Welsh Local Government Association (WLGA), Local Government Association (LGA) and DWP. Overarching Agreement 4 For the purposes of this agreement, local support services should be taken to mean triage, advice, information, digital access and digital support, debt management, money advice and financial inclusion services which are necessary to support people to make and maintain a Universal Credit claim and manage the changed requirements of Universal Credit. This also includes assessment and recommendations for Alternative Payment Arrangements. 5 This support will be provided until, and is meant to enable where possible, claimants being in a position where they can manage their UC claim independently, on line, whilst preparing for work or moving towards reducing their dependence on benefit through fulfilling their working potential. It is understood that some claimants will have ongoing and complex needs and that support for this group may need to be more intensive and for a longer duration where that is appropriate. 6 There may be occasions where a Local Partnership may wish to go beyond this, for example supporting a joint approach to work readiness and employability. Any such move will need to be agreed by both partners and take cognisance of any pre-existing local provision and contractual arrangements. 7 Where National Programmes, Projects or Funds are available for the provision of Local Support Type services, every effort will be made to ensure these complement the local priorities identified by the DPA. Delivery Partnership Agreements 8 DWP and Local Authorities will be the equal lead partners in Delivery Partnership Agreements (DPAs) set up within the context of Community Planning in each of the Local Authorities in Scotland. If local arrangements or successful partnerships already exist they should be utilised but efforts should be made to ensure that they report into the Community Planning Partnerships to achieve the senior, collective and strategic buy-in and oversight of the wider local partners. 9 Local Authorities (individually or jointly) and the DWP District Manager who has responsibility for DWP operations in the locality will sign the DPA.
3 Accountability for the delivery of the DPA will be placed with the DWP District Manager and an identified Local Authority Senior Officer. However, it is anticipated that partnership working at local level will be between DWP District staff (e.g. District Partnership / Operation Managers) and other Local Authority representatives with the appropriate delegated authority. 10 District Managers, operationally, will have the ability and authority to innovate, vary priorities and provision to tailor services to local needs, and to agree the DPAs. Local Authorities will have the legal responsibility for commissioning and managing services on behalf of the CPP, with DWP and Local Authorities working collaboratively to establish agreed performance measures, targets and the approach to performance management, which will best ensure agreed joint objectives are met. Both partners to the DPAs will make every effort to evidence this against the following core criteria: that the partnership has considered the wider community benefits of the services being provided. The expectation is that the benefits will outweigh the cost of delivery and that they can be clearly identified and measured that the partnership are getting the most from their spend on Local Support Services that due process has been followed to determine that bids submitted to deliver Local Support Services offer the taxpayer the best price for the service usually measured/quantified via evaluation of bids against a mix of qualitative and financial offers 11 There will be two basic principles for commissioning services: via the partnership (where the LA is the delivery partner of choice) via the Community Planning Partnership The laws of Scotland, and the Local Authority legal opinions, will take precedence where the Local Authority is the Lead Commissioning body. The Local Authority will commission all services unless the DWP has a specific responsibility for doing so. 12 The onus will be on DWP and individual Local Authorities to resolve any disputes locally - only invoking the escalation process in exceptional circumstances. In those circumstances both partners can escalate the issue to a senior DWP official. If a local authority prefers, this can be done through COSLA. Forming a Partnership 13 Partnerships will be formed on an appropriate geographical basis, between DWP Districts and individual Local Authorities, or between DWP Districts and groups of Local Authorities. Any extension of partnerships beyond individual CPPs should be agreed by all parties. 14 DPAs will be between DWP and the Local Authority or Authorities only, however representatives of other sectors, such as the Third Sector, may be involved in both the design and practical delivery of local support services. Within the context of the CPP, the potential for cohesively planning the delivery of all local provision for local support services should be encouraged, particularly where this will result in a mutually beneficial alignment of local resources and claimant outcomes. 15 Commissioning of services should ensure compliance with EU Legislation and appropriate procurement regulations, policies and standards. As the commissioning body, local authorities will be responsible for this but it is important that all parties are comfortable with any approach that is taken.
4 Service Delivery 16 Partnership determination of which services are to be delivered should reflect the LSSF although local variation in prioritisation and delivery is expected to reflect local needs and local circumstance. Local partnerships should establish clear boundaries, where tensions exist between the objectives of DWP and Local Authorities these should be resolved. 17 The best outcome for the claimant will be at the heart of each DPA. Services should be designed and delivered to support individuals or small groups through their claimant journey until they are able to be independent and self supporting. 18 DPAs will need to consider bringing the right people and partners on board; assessing and mapping local population needs; commissioning services to support claimants; communicating arrangements to claimants, front line staff and any other interested parties; managing changes across diverse networks; developing proportionate management information/monitoring and evaluation using the established governance and chairing arrangements within the context of the Community Planning Partnership 19 In organising services, delivery partnerships will try to reuse, build on or leverage existing services where appropriate, avoiding duplication where possible. This recognises that each partner has wider responsibilities to fulfil both within and outside of the delivery of local support services and must agree where resources can be mutually utilised. 20 DWP and Local Authorities will share data securely, within appropriate protocols, to help achieve the objectives of the LSSF. However any tensions around the use of sanctions and data sharing should be acknowledged and clear ethical walls/boundaries established. Service Objectives 21 It is expected that services being delivered will strive to meet one or more of the following outcomes as a minimum: Awareness o people understand the implication of UC for them and their families o those who need support are identified early, are made aware of the support on offer Access/Uptake o people get access to services quickly and conveniently o those claimants who require Alternative Payment Arrangements are identified and supported o support for the most vulnerable groups such as prisoners and disabled people is effectively designed, aligned with policy and supportive of future policy development 22 It is also expected that the following objectives of UC are met o there is increased confidence amongst claimants to make a claim digitally o claimants have bank accounts and are able to pay their bills etc. with them o claimants pay their rents and do not fall in to rent arrears
5 o the rate of error in UC applications is consistently being reduced Management of funding 23 COSLA and DWP will agree a financial package for Scotland. The distribution criteria for funding allocations within Scotland will also be agreed by COSLA and DWP nationally. The distribution of LSSF resources between DWP and LAs will be jointly agreed as part of the DPA. 24 A model of grant distribution between DWP and Local Authorities will be established. DPAs will have consistent conditions of grant distribution. 25 The DPAs will also identify other funding streams which the DWP and Local Authorities agree can be utilised as part of the wider resources available for, or complementary to, the delivery of Local Support Services. Performance Management and Continuous Improvement 26 Delivery partnerships will work within an agreed performance framework based on a shared view of critical success factors and service objectives with the claimant at the heart of local service provision. 27 Delivery partnerships will implement a culture of continuous improvement and learning from pilots, projects, trials, insight and any other initiatives as they become available. Informing further development and design of the provision of local support services and also enabling Scottish wide data for consideration by the Overarching Partnership where needed to identify national trends. 28 Learning and development will be shared between DWP, other Local Authorities and the Scottish Government where appropriate, as well as across the whole of GB including DWP, WLGA and LGA, to ensure that the implementation and delivery of the LSSF develops in a congruent way. Governance & Dispute Resolution 29 Localised governance, management and evaluation arrangements will be determined by DPAs. 30 In an exceptional case where a dispute cannot be resolved locally, the matter will be escalated to a senior DWP Official who will agree a way forward with the signatories of the OPA. In Scotland this will be DWP, COSLA and SG. 31 DWP, COSLA and the Scottish Government will review the Scottish OPA twice-yearly and renew the Scottish OPA in line with new iterations of the Framework and/or future UC rollout expansion.
