1 Seniors Rights Victoria Position Description Title: Classification: Salary Sacrificing: Employment: Hours of Work: Reports to: COMMUNITY LAWYER As per Social, Home Care and Disability Services Industry Award Community Development Worker LEVEL 6 Salary Range ($ 54,297 $58,650) Available in accordance with Australian Taxation Office legislation and regulations and in accordance with Council On The Ageing s Policy and Procedure. Full time, continuation dependent upon funding Monday to Friday 9.00am 5.00pm With an unpaid ½ hour for lunch. Manager, Seniors Rights Victoria Mission Statement Senior Rights Victoria (SRV) seeks to empower older Victorians so they can take steps to live in safety, with dignity and independence. Background Seniors Rights Victoria provides leadership across Victoria by addressing and responding to older people experiencing abuse. It operates under principles of the empowerment of older people and recognition of their rights. Seniors Rights Victoria provides information, support, advice and education to help prevent elder abuse and safeguard the rights, dignity and independence of older people. Elder abuse is any act which causes harm to an older person and is carried out by someone they know and trust such as family or friends. Abuse may be physical, sexual, financial, psychological, social and/or neglect. The services include a Helpline, specialist legal services, short term support and advocacy for individuals and community education. Seniors Rights Victoria also provides leadership on policy, systemic advocacy and law reform and works with organisations and groups to raise awareness of elder abuse. The Service advances the rights of older Victorians at risk of/or experiencing abuse. In addition to providing direct client services, Seniors Rights Victoria has a role in capacity building and working collaboratively with relevant sectors to better identify, address, and prevent incidences of elder abuse. 1

2 Seniors Rights Victoria is a program within COTA Vic. Funding is provided by Victoria Legal Aid (VLA), the Commonwealth Attorney General s Department, and the Department of Health. Position Context This position will be responsible for providing legal advice, casework and representation on an as needed basis to clients of the Centre. The incumbent is part of a small Seniors Rights Victoria legal team, which includes offsite lawyers. The legal team work alongside the advocacy team to deliver an integrated service to older people. Supervision Seniors Rights Victoria Principal Lawyer ROLES AND RESPONSIBILITIES The key responsibilities are: Service development & delivery Provide high quality legal advice and casework to clients via face to face and telephone appointments at the Centre s City office, or at outreach locations. Appear in the Magistrates Court on behalf of the clients in family violence matters and other civil matters; and the Victorian Civil and Administrative Tribunal on matters relating to guardianship, administration and powers of attorney Represent clients in court or tribunal ordered Alternative Dispute Resolution processes. Prepare briefs to Counsel and instruct Counsel on a broad range of matters relating to elder abuse Provide information and advice to friends, family and community members regarding issues relating to abuse of older people and issues relating to ageing, in accordance with the service guidelines Provide secondary consultation, legal information and advice service to community workers or lawyers regarding issues of abuse of older people and also older people and the law Liaise and collaborate effectively with partners and suppliers of Seniors Rights Victoria services Provide legal information and advice to organisations that provide services to older people about options for their clients and related legal remedies Effective use of the data management system to record client data in a timely way Contribute to the development of legal and community education programs and publications for the legal sector and members of the community, with a view to raising awareness and addressing issues of abuse of older people and issues relating to ageing Provide education and training to service providers and members of the general public Engage in systemic advocacy and law reform projects Contribute to the development of journal papers addressing issues of abuse of older people 2

3 Communications Contribute to the development and implementation of the communication strategy, including the development of content for the website, e Newsletter, and other targeted communications Communicate effectively with other departments of COTA to ensure effective delivery of service systems KEY SELECTION CRITERIA: Qualifications and Experience 1. Admitted to practice as Barrister and Solicitor in the State of Victoria Professional 2. Demonstrated post articles experience, including expertise in elder abuse and other legal matters commonly encountered by older people and an interest in the prevention of elder abuse 3. Willingness and capability to appear in Magistrates Courts and VCAT 4. Excellent written and oral communication skills 5. Demonstrated ability to deliver both community and professional legal education 6. Demonstrated ability to apply principles of natural justice and transparency in decision making 7. Demonstrated ability to collaborate with other services 8. Experience working with people from Culturally and Linguistically Diverse (CALD) backgrounds 9. Strong computing skills, including the ability to learn new systems and a willingness to produce own documentation Interpersonal 10. Personal attributes in the ideal candidate will include: ability to collaborate and to work under pressure 11.
