2 1 Intrductin This dcument sets ut the plicy f the University f Surrey in relatin t student fee cllectin alng with the debt management prcedures fllwed in furtherance f this plicy. The University has many surces f incme, which are cllected by different methds. This plicy specifically cvers the cllectin f fees and charges payable t the University by current and frmer students fr tuitin, accmmdatin, library services, miscellaneus charges and fines. It is vital that all decisin makers in the University are aware f the imprtance f cash management and fully c-perate with the staff wh manage the administratin prcess. Members f the Finance Department will prvide assistance and advice t the University n credit cntrl and debt management issues. 1.1 Purpse The aim f the plicy is t minimise levels f student debt and f bad debts, t Maximise resurces available fr investment in teaching and research excellence Prtect students frm the adverse cnsequences f failing t deal with unmanageable persnal debt. 1.2 Scpe This plicy is applicable t all current students f the University f Surrey and frmer students with utstanding debt. 1.3 Equality Analysis An equality analysis has been undertaken and this has determined that n prtected grups will suffer adverse cnsequences as a result f this plicy. Data relating t fee and debt management will be reviewed as it becmes available in rder t ensure that n grup in particular is impacted by difficulties relating t fee management. 1.4 Definitins Spnsrs rganisatins that may prvide funds fr r cntributes tward tuitin fees and / r living csts. Any such arrangement remains between the student and their spnsr. Spnsrs have n liability fr fee payment unless a cntractual agreement exists with the University. Student Finance Team members f the Finance Department respnsible fr cllectin f verdue payments. This team may als be referred t as Student Receivables. 3 Prtectin frm Evictin Act 1977 Equality Act Health & Safety Implicatins Nt Applicable 2 Plicy 2.1 Principles Financial Requirements Fr All Students The majrity f students n a prgramme f study at the University f Surrey will be required t pay tuitin fees and ther charges (the exceptin t this being funded PhD students n schlarships whse fees are paid n their behalf). Fees and charges may be in respect f a defined perid f study r fr a mdule f study Fees are nrmally cllected in the academic year in which the perid f study r mdule starts. Prgressin thrugh a prgramme f study may be affected if this financial bligatin is nt fulfilled. Students are persnally respnsible fr ensuring that all apprpriate fees, fines and ther charges, including any element f fees payable by spnsrs, are paid in accrdance with the requirements set ut belw. In accepting the ffer f registratin, the student accepts a cntractual liability t pay the tuitin fee fr the duratin f their curse in accrdance with these requirements. Students in University accmmdatin are required t pay an ccupatin / licence fee fr the duratin f their licence perid. Weekly rates fr accmmdatin are prvided t each student prir t ccupatin. Students are respnsible fr ensuring that all apprpriate fees, charges r fines levied are paid in accrdance with defined due dates. Occupatin f University accmmdatin is subject t a signed licence agreement which includes terms and cnditins fr ccupatin. The University may remind students f fees, fines and ther charges due by means f invices, letters and statements, hwever, these are reminders nly and students are cntractually respnsible fr paying fees, fines and ther charges n time whether invices, ntices r statements are received r nt. The Finance Department s primary methd f cmmunicatin will be thrugh the student s University address. It is the student s respnsibility t access this address regularly. Failure t check this address is nt an acceptable reasn fr late r nn-payment f fees r charges due. All payments made t and frm the University in respect f student fees, fines and ther charges must be made in sterling. Any currency cnversin csts r ther charges incurred by a student r spnsr in making a payment r in receiving a refund shall be brne by the student r the third party making r receiving the payment and shall nt be deductible frm the amunts due t the University. In the event that a student chses t pay tuitin r accmmdatin fees by credit card r nn UK debit card, a surcharge f 1.5% will be levied at the pint f payment. Payment via Western Unin bank transfer r UK debit card will nt incur a charge. Academic staff are nt empwered t vary fees r agree payment schedules with students n behalf f the University. Students wh have nt paid their tuitin fees by the due dates will be subject t sanctins and debt management prcedures which frm part f this plicy. 2.2 Tuitin Fees Tuitin Fees Payable All students registered at the University f Surrey will each year be liable fr tuitin fees fr the full academic perid. Tuitin fees are chargeable fr the academic perid required by the prgramme, with annual amunts charged fr each academic year f the prgramme unless therwise stated. 3

4 It is t be expected that tuitin fees will increase n an annual basis. Many students receive full r partial supprt fr their fees, whether frm Student Finance England, frm an emplyer r ther spnsring agency. Spnsred students are required t prvide written evidence f their spnsrship befre r at the time f enrlment, s that the spnsr can be billed. Failure t prvide this infrmatin will result in the student being inviced fr the full fee as a self-funded student. Where the spnsr is a cmmercial rganisatin, the University reserves the right t undertake credit searches in rder t establish their ability t pay fees due. The University is nt under any bligatin t accept an rganisatin as a spnsr. In the event that a fee paying bdy fails t pay, r unduly delays payment, the student remains liable fr the amunt due. Hme / EU undergraduate students may be eligible fr a tuitin fee lan. If they take the lan fr the full tuitin fee amunt, they will nt have t pay twards their fees during the time they study at the University. If they are taking a partial fee lan they will receive an invice frm the University fr the balance f fees nt cvered by the tuitin fee lan. It is the respnsibility f the student t ensure that the lan applied fr is crrect and sufficient. In the event that a change in circumstances ccurs which affects eligibility fr funding, either during r after a perid f study, resulting in a claw back f fees by the awarding bdy, the student will be liable fr any resulting shrtfall in fees Tuitin Fee Due Dates Invices will be raised fllwing fee assessment. The date invices are raised may vary, but students are reminded that they are cntractually bliged t pay tuitin fees regardless f whether an invice is received r nt. Tuitin fees are payable fr the full academic perid; hwever under nrmal circumstances students will be given the pprtunity t pay in instalments. Instalment dates are dependent n the fee status f the student as detailed belw. Failure t meet bligatins r agreements may result in the ptin t pay by instalments being withdrawn resulting in all amunts due being payable in full. Instalment ptins fr fee payments are as fllws: UK / EU Undergraduate Self Funding *2 instalments 50% Octber 50% January Internatinal Undergraduate *2 instalments 50% Octber 50% January Pstgraduate (initial year) *3 instalments 2000 by 1 st August fllwed by 50% f balance Octber 50% f balance January Pstgraduate (subsequent years) *2 instalments 50% Octber 50% January *Nte, exact instalment dates are subject t change. Details fr the current academic year can be fund in Fee Management Guidance fr Students and Appendix A Pstgraduates cmmencing in January, February, April r July will have the number f instalments available reduced as apprpriate. Students whse fees are payable n a mdular r stage basis are nt eligible t pay their fees by instalment. 4

5 2.2.3 Spnsrs On receipt f a valid spnsrship letter and acceptance f the rganisatin as a spnsr, the Student Finance Team will invice the spnsr directly. Payment terms applicable t spnsrs are strictly 30 days frm the date f invice. Shuld a spnsr fail t pay within terms, the invice will be cancelled and re-issued t the student. Any spnsrship agreement is between a student and their spnsr. By raising an invice t a spnsr, the University des nt enter int a cntractual agreement with that spnsr. The liability fr payment remains with the student regardless f spnsrship arrangements. 2.3 Accmmdatin Fees Accmmdatin Services will ntify students f the fees due fr University let accmmdatin. Accmmdatin ffered by Accmmdatin Services is dependent n the student signing a Licence Agreement fr the perid f accmmdatin. The University apprved payment ptins fr accmmdatin fees are: 1. A single payment in full within 7 days f the date f ccupancy 2. In 3 instalments Octber February May Instalment amunts will be dependent n the type f accmmdatin ccupied and the duratin f the stay. Students will be advised f the weekly fee rate prir t signing the licence agreement. Students wh d nt pay their accmmdatin fees in full r pay the required amunt by the specified instalment dates will be subject t sanctins and debt management prcedures which frm part f this plicy. 2.4 Payment Methds The preferred methd f payment fr tuitin and accmmdatin fees is by UK debit card via the University s secure card payment gateway. Students making payment frm an verseas bank accunt may make an nline bank transfer thrugh Western Unin. This is a secure methd f payment which incurs n cst t either the student r the University. The currency cnversin rate is subject t prevailing rates set by Western Unin. Payment may als be made by credit card r nn UK debit card via the secure payment gateway; hwever payments will be subject t a surcharge. In rder t make payment, students shuld refer t Early Withdrawal Students wh wish t withdraw frm their curse f study and / r accmmdatin may d s, hwever there are strict time limits and fees may still be payable. 5

6 2.5.1 Withdrawal frm Studies Students wh withdraw frm their prgramme f study r have an agreed absence, will remain liable fr a percentage f fees fr all r part f the remaining academic year as detailed belw. Befre withdrawing, students must be encuraged t discuss matters in detail with their academic department, and the Student Finance Team. These may include but nt be limited t library fines; hardship lan repayment; prvisin f ther resurces. Such invices are payable within 30 days f the date f invice. The invice will clearly state the due date. Students wh fail t pay such invices will be subject t debt management prcedures which frm part f this plicy. 6

7 Disciplinary matters may result in a miscnduct fine being impsed. The student will be infrmed in writing f the amunt due and the date fr the fine t be paid; invices are nt issued fr these fines. Miscnduct fines must be paid in accrdance with the Student Disciplinary Regulatins and nrmally within 28 days. Students wh fail t pay amunts due will be subject t further disciplinary actin in accrdance with the Student Disciplinary Regulatins (Appendix B). 2.7 Nn-Payment f Fees and Charges In applying the Fee Management Plicy, the University Finance Department will at all times seek t be sympathetic t, and understanding f, individual students financial circumstances, hwever, fr the University t d s, students must engage in dialgue with the Finance Department if they are experiencing difficulties. Actin t enfrce settlement f debt fr utstanding fees and charges will be taken against current and frmer students wh have failed t engage with the Finance Department t find a slutin t any utstanding debt issues, r wh have failed t hnur agreements t pay. Such actin may include, but nt be limited t the referral f individual cases t a Debt Cllectin Agency and enfrcement thrugh the Cunty Curt. Specific detail relating t cllectin activity by the Finance Department can be fund in the Debt Management Prcedures which frm part f this plicy. 3 Debt Management Prcedures 3.1 Tuitin Fee Debt Tuitin fees may be paid in full, r must be paid by instalment n dates accrding t the fee status f the student. Students will be ntified f instalment dates Late Payment Where a student is suffering financial difficulty he/she must cntact the Student Finance Team at the earliest pprtunity, preferably befre an instalment becmes verdue. Students wh d nt make cntact prir t an instalment date will be cntacted by by a member f the Student Finance Team 7 days after an instalment becmes verdue and mnthly thereafter. This crrespndence will advise the student f the amunt utstanding and the due date. The student will be asked t make immediate payment r t cntact a Student Finance Advisr. In additin t standardised mnthly s, the Student Finance Advisr respnsible fr the debtr accunt will endeavur t make cntact with the student by telephne r nnstandard . In all cases, the student will be ffered an interview with a Student Finance Advisr. If there is evidence f genuine difficulty in making payment, the Student Finance Advisr will try t agree a realistic prgramme f payment, which is within the means f the student and payable ver a perid f time acceptable t the University. Students will be advised that they are nt entitled t prgress t the next academic year f study if any tuitin fee debt remains utstanding. Students must be able t prvide evidence f their financial circumstances verifying that they can either meet all f their bligatins including any payment arrangement made, r that the situatin causing the hardship will change and enable full payment Sanctins Students wh fail t make payment f the verdue instalment r an agreed payment will be subject t sanctins apprved by the University. These sanctins will be: UK/EU Undergraduate Failure t pay the first instalment f fees prir t the start f the Spring Semester (dates as published annually) will result in immediate terminatin f registratin. 7

8 Failure t pay the secnd instalment f fees befre the start f the next academic sessin will result in immediate terminatin f registratin, with n entitlement t prgress t the next academic sessin. Students eligible fr an award - where tuitin fees greater than 100 remain unpaid; the University reserves the right t withhld the award f a degree. Students will nt be eligible t attend a degree ceremny. Internatinal Undergraduate Failure t pay the first instalment f fees prir t the start f the Spring Semester (dates as published annually) will result in immediate terminatin f registratin and reprting t UKVI in accrdance with the University s Tier 4 Spnsrship Licence Failure t pay the secnd instalment f fees befre the start f the next academic sessin will result in immediate terminatin f registratin and reprting t UKVI in accrdance with the University s Tier 4 Spnsrship Licence, with n entitlement t prgress t the next academic sessin. Students eligible fr an award - where tuitin fees greater than 100 remain unpaid; the University reserves the right t withhld the award f a degree. Students will nt be eligible t attend a degree ceremny. Pstgraduate Failure t pay the first instalment f fees befre the Easter vacatin will result in immediate terminatin f registratin and, in the case f internatinal students, reprting t UKVI in accrdance with the University s Tier 4 Spnsrship Licence. Failure t pay the secnd instalment f fees befre the start f the next academic sessin will result in immediate terminatin f registratin and in the case f internatinal students, reprting t UKVI in accrdance with the University s Tier 4 Spnsrship Licence, with n entitlement t prgress t the next academic sessin. Students eligible fr an award - where tuitin fees greater than 100 remain unpaid; the University reserves the right t withhld the award f a degree. Students will nt be eligible t attend a degree ceremny Reinstatement The Student Finance Team will in all cases endeavur t reslve debt issues withut recurse t sanctins, hwever in sme cases these will be unavidable. Where sanctins are applied but a student subsequently clears all utstanding tuitin fees befre the end f the academic year in questin, reinstatement may be cnsidered. Reinstatement will be cntingent n all academic requirements being met and tuitin fees fr the new academic sessin being paid in full prir t the re-registratin deadline date Terminatin f Registratin Where registratin is terminated, the University will advise the student that the debt is being referred t a nminated Debt Cllectin Agency (DCA). The agency will act n behalf f the University. The agency will cntact the student and endeavur t make a realistic payment arrangement. Where this is nt pssible, the agency will be instructed t cmmence legal prceedings against the debtr. Where the debtr is n lnger in the UK, the agency will instruct an alternative agent in the debtr s lcatin t cllect the debt n behalf f the University. Where legal actin is necessary the agency, n behalf f the University, will prceed t btain a mney judgment against the debtr under the Cunty Curt Act In the event that the University instigates legal prceedings as detailed in this plicy, and this results in a Cunty Curt Judgment (CCJ) being registered in favur f the University, the students future ability t btain credit will be affected. This includes the ability t enter int a mbile phne cntract, brrw frm banks / lenders (including mrtgage lenders), r enter int any rental cntract. 8

9 Once judgment has been btained, the University will cnsider instigating actin t enfrce the judgment, Careful cnsideratin will be given t the students knwn circumstances. In sme cases, enfrcement actin may be held in abeyance until such time as it is apparent that the student shuld be in a psitin t pay, r make payment twards, the debt. 3.2 Accmmdatin Debt Students living in University wned r managed accmmdatin are licensees and enter int a cntractual licence agreement fr a fixed perid. If a student decides t leave the residence befre the end f that fixed perid they will still be required t pay rent fr the full duratin f the licence agreement. When students apply fr accmmdatin, they agree t abide by the Cnditins f Residence. These cnditins include the requirement t pay rent either in full at the beginning f the licence r in three instalments, the dates f which are specified n the licence agreement and the invice which is sent t the student within 14 days f arrival. Students shuld be aware that the requirement t make payment is nt cntingent n their receiving a frmal invice. If full payment is nt received at the beginning f the license perid, it is assumed that the student will pay in instalments. At least 4 days befre an instalment is due, students are sent a ntice by reminding them that payment is due. Where a student is suffering financial difficulty he/she must cntact the Student Finance Team at the earliest pprtunity, preferably befre an instalment becmes verdue Late Payment f Instalments In the event that an accmmdatin instalment remains unpaid beynd the due date, a reminder letter will be ed t the student requesting immediate payment. This reminder als infrms the student that failure t pay may result in their being given ntice t vacate the rm. Shuld the student fail t pay n receipt f the reminder, and / r fail t cntact the Student Finance Team in rder t discuss the matter, a secnd reminder will be generated. The Student Finance Team will als endeavur t make direct cntact with the student during this perid. If there is evidence f genuine difficulty in making payment, the Student Finance Advisr will try t agree a realistic prgramme f payment, which is within the means f the student and payable ver a perid f time acceptable t the University. Students will be advised that they may be required t vacate their rm if they are unable t make r maintain any payment arrangement made. Students must be able t prvide evidence f their financial circumstances verifying that they can either meet all f their bligatins including any payment arrangement made, r that the situatin causing the hardship will change and enable full payment Sanctins If the first instalment remains utstanding by late Nvember (exact date variable) and n realistic payment plan has been agreed, students will be issued with Ntice t Quit. This ntice infrms them that cntinued nn-payment f the first instalment will result in the requirement t vacate the rm by a specified date. It is always the intentin f the University that evicting a student is avided where pssible and as such the Student Finance Team will endeavur t cntact students directly and make reasnable payment arrangements. In sme circumstances, it may be deemed apprpriate t visit a student in their rm, r t ask the Warden respnsible fr the accmmdatin t speak t the student t encurage dialgue with Student Finance Team. In additin t this curse f actin, we may restrict services available t the student. This may include, but nt be limited t: Restricting in rm internet access Refusal f requests t prvide cnfirmatin f residence letters 9

10 Refusal f requests t prvide references fr external landlrds Where the deadline fr payment f the first instalment has passed and the Ntice t Quit is enfrceable but the student has failed t vacate the rm, Accmmdatin Services will cmmence evictin prceedings in accrdance with the Husing Act 1988 and Prtectin frm Evictin Act Where the deadline fr payment f the first instalment has passed and the student has vacated the rm, the student details will be passed t a nminated Debt Cllectin Agency (DCA). The agency will act n behalf f the University. The agency will cntact the student and endeavur t make a realistic payment arrangement. Where this is nt pssible, the agency will be instructed t cmmence legal prceedings against the debtr. Where the debtr is n lnger in the UK, the agency will instruct an alternative agent in the debtr s lcatin t cllect the debt n behalf f the University. Where legal actin is necessary the agency, n behalf f the University, will prceed t btain a mney judgment against the debtr. This will result in a Cunty Curt Judgment being registered in favur f the University. This will remain visible against the student s credit recrd until such time as the debt is settled. Any such judgment is likely t affect the students ability t btain credit in future. Once judgment has been btained, the University will cnsider instigating actin t enfrce the judgment, Careful cnsideratin will be given t the students knwn circumstances. Subsequent Instalments Shuld a student fail t pay the secnd r any subsequent instalment, the University reserves the right t issue a Ntice t Quit. As with nn-payment f the first instalment, the Student Finance Team will students and request payment, and endeavur t cntact the student persnally. Where it is clear that the student is experiencing genuine hardship we will make reasnable payment arrangements. In additin t this curse f actin, we may restrict services available t the student. This may include, but nt be limited t: Restricting in rm internet access Refusal f requests t prvide cnfirmatin f residence letters t Refusal f requests t prvide references fr external landlrds Shuld a student either fail t pay the instalment r an agreed amunt despite cllectin activity, the student details will be passed t a nminated Debt Cllectin Agency (DCA). The agency will act n behalf f the University. The agency will cntact the student and endeavur t make a realistic payment arrangement. Where this is nt pssible, the agency will be instructed t cmmence legal prceedings against the debtr. This curse f actin will be taken regardless f the students registratin status. Students wh have accmmdatin debt utstanding at the end f an academic year will nt be entitled t summer accmmdatin, r University accmmdatin in subsequent years. Students eligible fr an award where accmmdatin fees remain unpaid, students may attend an award ceremny but will nt be permitted t purchase guest tickets. 3.3 Financial Hardship 10

11 Where a student shws that they have a genuine hardship issue which is preventing payment f either tuitin r accmmdatin fees, they will be referred t the Student Mney Team fr infrmatin, advice and guidance. Any student engaging with the Student Mney Team will be expected t cntinue interactin with the Student Finance Team. It will be made clear that whilst referral t the Student Mney Team will nt necessarily result in discretinary funds being made available t assist with financial difficulties being experienced the team will investigate all available ptins. 3.4 Other Debt Students may n ccasin be required t pay amunts t the University nt related t tuitin fees r accmmdatin rental fees. Sums due may include but nt be restricted t Repayable hardship lans Library fines (lst bks / late return fines) Fines arising frm Disciplinary Actin Accmmdatin (nn-rental) charges Sanctins Where such balances are utstanding, the University Finance Department (r in the case f miscnduct fines, OSCAR) will engage with the student in rder fr the debt t be cleared. Where such debt remains utstanding despite requests fr payment alternative sanctins may be invked. These may include, but nt be limited t Restrictin / withdrawal f library privileges Restrictin / withdrawal f in rm internet access Withdrawal f access t further hardship funding A ban n future residence in University accmmdatin Further disciplinary actin (in the case f failure t pay miscnduct fines) Shuld students fail t pay utstanding balances; details may be passed t a nminated Debt Cllectin Agency (DCA). The agency will act n behalf f the University. The agency will cntact the student and endeavur t make a realistic payment arrangement. Where this is nt pssible, the agency will be instructed t cmmence legal prceedings against the debtr under the Cunty Curt Act This curse f actin will be taken regardless f the students registratin status. Students wh remain in debt t the University at the time they are eligible fr an award will nt be allwed t purchase guest graduatin tickets. This includes the ability t enter int a mbile phne cntract, brrw frm banks / lenders (including mrtgage lenders), r enter int any rental cntract. 3.5 University Financial Awards Where a student qualifies fr a University financial award (e.g. bursary, schlarship r hardship funds), the University reserves the right t use the mnies frm any award t settle any r all verdue debts which may be utstanding t the University. 3.6 Cmplaints There may be instances where a student, using the crrect dcumented prcedure, registers a cmplaint with the University. Under these circumstances cllectin activity will cntinue, hwever passing the accunt t an external Debt Cllectin Agency will be held pending the utcme f any investigatin int the cmplaint. Prir t instigating legal actin, as part f the debt recvery prcedures, Student Finance will cntact relevant departments within the University in rder t establish whether there are any disputes / cmplaints pending. 11
