3 Challenge: Legal compliance is a top priority for Ifficient, and October 2013 updates to TCPA regulations prompted big changes to Ifficient s business process. With recent settlements like Capital One s $75.5 million payout, the threat of a TCPA violation is not one Ifficient takes lightly. Ifficient, a technology based interactive marketing company, facilitates connections between schools and prospective students. Utilizing a mix of first party and third party leads, Ifficient operates its own lead generation site, that functions as a one-stop shop for over 200 schools. Prospective students search by geographic region, program of interest and degree level. Ifficient also runs a call center to augment its online offerings. LeadiD s TCPA with Visual Playback solution is like an insurance policy for lead generation. Jon DelRusso, Ifficient s Chief Marketing Officer, puts it this way: You want to make sure you aren t going to be on the wrong side of a multi-million dollar lawsuit, because that destroys a company, especially a company of our size. We re profitable, but those big numbers could certainly destroy us. What if a school contends that Ifficient didn t have prior express consent to autodial a mobile number, or sends a lead back because the consumer claims that no consent was given? It wouldn t be long before Ifficient would need to appear in court to defend itself against such an allegation.
4 Solution: In order to cover all the bases, Ifficient goes to the next level when it comes to compliance. We ve created 700 variations on our TCPA statements, says DelRusso. With just a little over 200 schools, that translates to two or three different messages per institution. The schools we work with all have slight differences in phrasing, he explains. This concern for the customer and attention to detail sets Ifficient apart from the competition. LeadiD s Visual Playback technology records and time stamps every consumer action on a lead form, in the order it happened, even down to the detail of boxes checked, unchecked, and checked again. As the consumer types, data storage is initiated. When the form is completed, that data is stored in LeadiD s highly secure database and a visual playback can be rendered after the event takes place. If the consumer checks the box next to the TCPA disclosure, that s proof, and that action can be shown in court.
