4 MOTONS AND ORDERS RELATED TO CELL PHONES Durng the course of an nvestgaton t may be necessary to seek cell phone nformaton ncludng subscrber nformaton numbers daled or receved from a cell phone or locaton nformaton usng the cell phone as a trackng devce. Ths artcle wll revew the federal and state statutory requrements for each category. These statutory requrements are necessary when law enforcement cannot obtan the consent of the subscrber for the nformaton. Subscrber nformaton The Stored Wre and Electronc Communcatons Act 18 USC (1986) permts law enforcement to receve stored cell phone subscrber nformaton from a servce provder wth a court order. Subscrber nformaton ncludes the name and address local and long dstance records sesson tme and duraton nformaton. Law enforcement can also receve nformaton concernng the length of the servce contract and methods of payment. The Moton and Order should be submtted to a Superor Court Judge. The court wll ssue an order when specfc and artculate facts show there s "reasonable grounds to beleve that the records are relevant and materal to an ongong crmnal nvestgaton". The order wll specfy that the subscrber wll not be nformed of the moton or order and the servce provder wll not reveal the nformaton. The Polce Attorneys' Offce has the templates for the Moton and Order and each Moton must be sgned by a Polce Attorney. Pen Regster And Trap And Trace nformaton Federal law 18 USC and State law 15A set forth the procedures necessary to obtan current numbers that are beng daled and/or receved by a cell phone subscrber. Law enforcement must submt an applcaton to a Superor Court Judge swearng under oath that they have reasonable suspcon to beleve a felony or Class A 1 or class 1 msdemeanor has been commtted. They must show there are reasonable grounds to suspect an dentfed ndvdual and that the nformaton requested wll be of "materal ad n determnng whether the suspect commtted the offense."the order wll drect the servce provder to furnsh the techncal assstance necessary to nstall and use a pen regster and/or trap and trace devce for a specfed cell phone and number for up to sxty (60) days. The order wll also specfy that the nformaton contaned n the Moton and Order not be revealed by the servce provder. The Polce Attorneys' Offce has the templates for the applcaton and order. The applcaton form must be Sgned by a Polce Attorney pror to submttng to the Superor Court Judge. The federal law recognzes a lmted emergency stuaton when an order s not mmedately requred. When there s "mmedate danger of death or serous bodly njury" a servce provder may nstall a pen regster and/or trap and trace devce wthout a court order. Under 18 USC 3125 the offcer must submt an order to the servce provder approvng the nstallaton wthn forty-eght (48) hours after the emergency nstallaton. Trackng nformaton The Communcatons Assstance for Law Enforcement Act 47 USC 1001 et seq. (1994) requres telecommuncaton carrers provde law enforcement wth call-dentfyng nformaton pursuant to a Court Order. Call-dentfyng nformaton s defned as dalng or sgnalng nformaton that dentfes the orgn drecton destnaton or termnaton of each communcaton generated or receved by a subscrber of a telecommuncaton carrer. Ths nformaton also can provde the locaton of the suspect through ether the cell towers used (trangulaton of towers provdes general locaton) or the cell phone's GPS devce (more exact locaton obtaned). Trackng requests requre a showng of probable cause before an order wll be ssued because the person tracked may enter nto areas that have Fourth Amendment protecton. Under 47 USC 1007and 18 USC 3117 law enforcement must swear under oath to specfc facts showng there s probable cause to beleve the ndvdual tracked s a suspect and that obtanng

5 hs locaton wll produce hs arrest or materal evdence n the case. The order should authorze trackng for no more than forty-fve (45) days. The applcaton and order should be under seal wth specfc language prohbtng release of nformaton concernng t. PURPOSE To provde employees wth gudelnes about the use access and release of records and other nformaton n the possesson of the CMPD and to dstngush publc records from confdental nformaton.. POLCY The CMPD realzes that records of crmnal nvestgatons and crmnal ntellgence nformaton are confdental and wll not be released to unauthorzed personnel or to the publc. However Department records ncludng certan personnel records may be publc records and f so may be requred to be released n accordance wth North Carolna publc records law.. DEFNTONS A. Department nformaton: Any nformaton accessed or mantaned by the CMPD ncludng nformaton generated by other certfed law enforcement agences/government agences and nformaton avalable for use by CMPD employees wth a legtmate need. B. Records of Crmnal nvestgatons: All records or any nformaton that pertans to a person or group of people that s compled by the CMPD for the purpose of attemptng to prevent or solve volatons of the law ncludng nformaton derved from wtnesses laboratory tests survellance detectve work confdental nformants photographs and measurements. C. Records of Crmnal ntellgence nformaton: Records or nformaton that pertan to a person or group of people that s compled by the CMPD n an effort to antcpate prevent or montor possble volatons of the law. D. Personnel Records: Any nformaton n any form gathered by the Cty and/or the CMPD wth respect to an employee and by way of llustraton but not lmtaton relatng to an employee's applcaton selecton or non-selecton performance promotons demotons transfers suspenson and other dscplnary actons evaluaton forms leave salary and termnaton of employment. The term "employee" ncludes former employees of the Cty and/or the CMPD. V. PROCEDURE A. CMPD employees must observe securty measures n order to mantan the prvlege of usng avalable nformaton sources. B. The dsclosure of crmnal record or hstory nformaton shall be only to members of authorzed crmnal justce agences who have an offcal need for such nformaton and n complance wth the restrctons set forth by the Dvson of Crmnal nformaton (DC ). Volaton of Natonal Crme nformaton Computer (NCC) or Dvson of Crmnal nformaton (DC ) securty measures could result n the termnaton of the

ACCESS TO DEPARTMENT NFORMATON Employees may access department nformaton ncludng polce routne personnel nformaton NCC DC and any other county or cty database only for the ntended purpose on a justfed law enforcement bass. Access and subsequent release of such nformaton should be n accordance wth all laws and CMPD procedures. V. USE OF NFORMATON A. Use and Release of Department nformaton 1. Employees wll not request or run a Computerzed Crmnal Hstory (CCH) wthout a justfed law enforcement need. Legtmate purposes would be the nvestgaton of an actve case or conductng a background nvestgaton for law enforcement employment. Employees wll not dssemnate CCH to noncrmnal justce persons or to Crmnal Justce personnel wthout an offcal need. 2. Employees wll not request and/or run a Drver's Hstory or DMV nqury wthout a justfed law enforcement need nor should employees dssemnate drvers' hstory nformaton unless authorzed by CMPD polcy or by law. 3. Employees wll not release local arrest nformaton offense nformaton or warrant nformaton pertanng to a crmnal nvestgaton except wth a justfed law enforcement need n accordance wth proper procedures or as otherwse requred by law. 4. Employees wll not allow ctzens to vew crmnal nvestgatve or crmnal ntellgence nformaton on any CMPD computer screen. Ths nformaton s for law enforcement purposes and wll not be released to the publc. 5. Employees workng secondary employment should use nformaton systems for law enforcement use on a justfed bass only. Employees may provde nformaton consdered publc record to secondary employers when the nformaton s obtaned whle off duty and through publc access. To secure nformaton consdered a matter of publc nformaton for secondary employers an offcer must complete approprate forms and follow the same procedures as any ctzen would follow. 6. Offcers ncludng detectves are not to dscuss a case wth other offcers who do not have a legtmate need for the nformaton. 7. The CMPD has access to databases of other departments. Ths nformaton does not belong to the CMPD. No access or dssemnaton should be made of

B. nformaton That May Be Released 1. Descrptons of found or unclamed property whch s scheduled to be sold at a publc aucton. 2. Drectves and polcy statements. 3. Requests for unpublshed crme statstcs wll be referred to the Research Plannng and Analyss Dvson (RP&A). RP&A wll evaluate the request respond pursuant to ths drectve and consult wth the Polce Attorney's offce as needed 4. Survey requests from sources/agences outsde the CMPD wll be referred to the RP&A Dvson for evaluaton and response pursuant to ths Drectve. 5. Requests for nformaton from crmnal nvestgaton fles ncludng Traffc Fataltes or any felony offense should be routed through the Polce Attorney's offce. The Polce Attorney's offce shall consult wth the approprate detectve and chan of command to determne what f any nformaton can be released and under what crcumstances. 6. nformaton from a crmnal ntellgence fle can be released to the general publc only upon approval of the Commander of the Specal nvestgatons Bureau. C. nformaton That Must Be Released Upon Request (Publc Records) 1. Orgnal ncdent reports 2. Traffc crash reports 3. Adult arrest reports (ncludng arrest photographs) 4. The tme date locaton and nature of a volaton or apparent volaton of the law reported to the CMPD. 5. The name sex age address employment and alleged volaton of law of a person arrested charged or ndcted. 6. The crcumstances surroundng an arrest ncludng the tme and place of the arrest whether the arrest nvolved resstance possesson or use of weapons or pursut and a descrpton of any tems sezed n connecton wth the arrest. 7. The contents of "911" and other emergency telephone calls receved by or on behalf of CMPD except for such contents that reveal the name address

The contents of communcatons between or among employees of the CMPD that are broadcast over the publc arways. 9. The name sex age and address of a complanng wtness unless the release of the nformaton would pose a threat to the health or safety of the wtness or materally compromse a contnung or future crmnal nvestgaton: a. Employees wll temporarly wthhold dentfyng nformaton of a complanng wtness n reported crmes of rape and sex offenses crmes of domestc volence and for any crme when the complanng wtness communcates the desre to have hs or her name and address reman confdental. f the complanng wtness s a juvenle vctm release of dentfyng nformaton can be made only subject to the restrctons of ths Drectve and state law. b. n crcumstances where the release of nformaton descrbed n the above secton V. B.1-8 would jeopardze the rg ht of the State to prosecute a defendant or the rght of a defendant to receve a far tral or wll undermne an ongong or future crmnal nvestgaton the CMPD may seek a court order through the Polce Attorney's Offce to prevent dsclosure of the nformaton. 10. Employee personnel records a. The followng nformaton s publc record concernng present or former employees: name age date of orgnal employment or appontment to the servce; the terms of any contract by whch the employee s employed whether wrtten or oral past and current to the extent that the cty has the wrtten contract or a record of the oral contract n ts possesson; current poston ttle current salary date and amount of the most recent ncrease or decrease n salary date of the most recent promoton demoton transfer suspenson separaton or other change n poston classfcaton and the offce to whch the employee s currently assgned. The term "salary" ncludes pay benefts ncentves bonuses and deferred and all other forms of compensaton pad by the cty. b. Release of any other personnel nformaton must comply wth N.C.G.S. 160A-168 allowng others to have access to a personnel fle or removng copyng or examnng confdental personnel fles consttute a Class 3 msdemeanor. Any person seekng personnel nformaton concernng an employee or former employee wll be referred to the Human Resources Manager or desgnee

RGHTS OF A CTZEN Ths polcy s not ntended to restrct any crmnal justce employee from nformaton that would be avalable to any other ctzen. However when actng n a non-law enforcement capacty the employee must access such nformaton n the same manner and under the same procedures as a ctzen. V. PURPOSE The purpose of ths drectve s to dentfy the purposes for whch crmnal ntellgence may be obtaned by the Charlotte-Mecklenburg Polce Department (CMPD) the purpose for whch t may be used who may access the nformaton and methods for dentfyng the relablty of the nformaton. n addton the drectve dentfes the securty and mantenance requrements for housng ntellgence fles and procedures for the dssemnaton of nformaton contaned n the fles. t s the purpose of the CMPD ntellgence functon Jo gather nformaton from all sources consstent wth the law n support of efforts to provde tactcal or strategc nformaton on the exstence denttes and capabltes of crmnal suspects and enterprses generally and n partcular to further crme preventon and enforcement objectves dentfed by CMPD.. POLCY A. The collecton retenton dssemnaton and dsposton of crmnal ntellgence are essental functons of law enforcement. t s the polcy of CMPD to gather nformaton drected toward specfc ndvduals or organzatons where there s reasonable suspcon that these ndvduals or organzatons may be plannng or engagng n crmnal actvty to gather such nformaton wth due respect for the rghts of those nvolved and to dssemnate such nformaton only as authorzed. When acqured nformaton s used to prevent crme pursue and apprehend offenders and obtan evdence necessary for convcton. B. Although crmnal ntellgence functons may be assgned to specfc personnel wthn CMPD all members of ths agency are responsble for reportng nformaton that may help dentfy crmnal consprators and perpetrators. All CMPD employees shall adhere to gudelnes establshed n ths drectve and the 28 Code of Federal Regulatons (CFR) Part 23 (as applcable) to ensure the securty confdentalty and proper mantenance and dssemnaton of crmnal ntellgence.. DEFNTONS A. Crmnal ntellgence: Data that has been collected analyzed and dssemnated based on actvtes and assocatons of ndvduals groups busnesses and organzatons that are dentfed as beng nvolved or potentally nvolved n crmnal behavor. B. 28 CFR Part 23: A federal regulaton for law enforcement agences to mplement standards for operatng federally funded mult-jursdctonal crmnal ntellgence systems. t apples to systems operatng through federal fundng under the Omnbus Crme Control and Safe Streets Act of C. Strategc ntellgence: nformaton concernng exstng patterns or emergng trends of crmnal actvty desgned to assst n crmnal apprehenson and crme control strateges for both short and long-term nvestgatve goals. D. Tactcal ntellgence: nformaton regardng a specfc crmnal event that can be used mmedately by the Dvsons and Unts assgned to the CMPD Servces Groups to further a crmnal nvestgaton plan tactcal operatons and provde for offcer safety

Reasonable Suspcon: s establshed when nformaton exsts whch establshes suffcent facts to gve a traned law enforcement or crmnal nvestgatve agency offcer nvestgator or employee a bass to beleve that there s a reasonable possblty that an ndvdual or organzaton s nvolved n a defnable crmnal actvty or enterprse. Reasonable suspcon s the mnmum threshold necessary for submsson of a crmnal ntellgence record to a crmnal ntellgence database. F. Partcpatng Agency: An agency or local county state federal or other governmental unt that exercses law enforcement or crmnal nvestgaton authorty and that s authorzed to submt and receve crmnal ntellgence nformaton through an nterjursdctonal ntellgence system. A partcpatng agency may be a member or nonmember of an nter-jursdctonal ntellgence system. G. Thrd Agency Rule: Concept of ntellgence sharng that means any recept of ntellgence from an orgnatng agency s prohbted from sharng that nformaton wth another (Le. thrd) agency. Ths affords some degree of accountablty yet may be waved by the orgnatng agency when approprate. H. Need-to-know: Defned as the necessty to obtan or receve crmnal ntellgence nformaton n the performance of offcal responsbltes as a law enforcement or crmnal justce authorty.. Rght-to-know: Defned as the legal authorty to obtan or receve crmnal ntellgence nformaton pursuant to court order statute or decsonal law. V. PROCEDURE A. Responsbltes: The crmnal ntellgence functon s prmarly carred out by the Analyss Dvson however t s the responsblty of all members of CMPD to report any actvty whch may be of a crmnal ntellgence nature. Such nformaton should be routed n a supplement report or va emal to the approprate Bureau Dvson or Unt. B. Collecton of Crmnal ntellgence: 1. The collecton of crmnal ntellgence shall be for the purpose of suppressng crmnal actvty n the jursdcton of CMPD. The types of ncdents for whch ntellgence nformaton may be obtaned nclude but are not lmted to: a. Narcotcs manufacturng and/or traffckng; b. Unlawful gamblng; c. Extorton; d. Vce and pornography; e. nfltraton of busnesses for llegtmate purposes; f. Brbery;

Ths shall nclude but not be lmted to as many of the followng dentfers that are avalable: 1. Full name; 2. Date of Brth; 3. Address; 4. Alases; 5. Socal Securty number; 6. Drvers Lcense number; 7. PhYScal Descrpton; (heght weght eye and har color) 8. Place of brth; 9. Ctzenshp (f alen dentfcaton Number) 10. Dstngushng scars marks or tattoos; 11. Volence potental; 12. Crmnal dentfcaton number;

Pror to enterng any gathered ntellgence nto any system the relevant supervsor shall evaluate the nformaton. The evaluaton shall nclude the relablty of the source of the nformaton and the strength/valdty of the nformaton. Only nformaton whose relablty and valdty had been evaluated wll be entered n a system.e. f relablty s unknown and the valdty cannot be judged t wll not be entered nto a system as t would not meet the reasonable suspcon standard. 2. Persons n recept of any type of gathered ntellgence should undertake efforts to determne the relablty of the source and valdate the nformaton receved. E. Dssemnaton of Crmnal ntellgence: 1. Request for nformaton from crmnal ntellgence fles shall be drected to the commander of the approprate nvestgatve Bureau Dvson or Unt. The request shall contan the name of the person requestng the nformaton the date tme and purpose of the request. n addton the request should dentfy specfc dentfyng nformaton on the person for whom the nformaton s beng requested. The Chef of Polce or desgnee or any of the Deputy Chefs may dstrbute nformaton contaned n ntellgence fles to members of CMPD or other law enforcement agences. nformaton dssemnated from ntellgence fles shall be desgnated as such. Members of CMPD are prohbted from forwardng or re-dssemnatng nformaton from ntellgence fles to persons outsde CMPD wthout the express permsson of ether the Chef of Polce or desgnee or any of the Deputy Chefs. 2. When nformaton from crmnal ntellgence fles s dssemnated the Commander of the approprate nvestgatve Bureau Dvson or Unt shall record the followng nformaton wthn the fle: a. The date of dssemnaton of the nformaton; b. The name of the ndvdual requestng the nformaton; c. The name of the agency/organzaton requestng the nformaton; d. The reason for the release of nformaton; (need to know/rght to know) e. The nformaton provded to the requester; f. The name of the person dssemnatng the nformaton. g. The submsson of ntellgence nformaton to regonal or natonal crmnal ntellgence databases shall be n conformance wth 28 CFR

The Deputy Chef of the Admnstratve Servces Group or desgnee shall be responsble for the dssemnaton of terrorst related nformaton wthn the CMPD and shall approve the re-dssemnaton of terrorst related nformaton to other organzatons. When approprate such nformaton shall be n the form of a wrtten report accompaned by supportng documentaton. 2. nformaton developed by the assgned JTTF detectve through ther work wth the JTTF wll be mantaned n accordance wth FB regulatons. The detectve assgned to the JTTF requres a securty clearance.
