1 TERMS & CONDITIONS italk Collectible Manchester United Contest Terms And Conditions By entering the italk Collectible Manchester United Contest (the Contest ), you (the Contestant ) agree to the following terms and conditions; A. Standard Terms 1. This Contest is organized by Telekom Malaysia Berhad (Co. No P) ( TM ). 2. By participating in this Contest, the Contestant agree to be bound by the Contest Rules and Regulations, the Terms and Conditions herein, notices and all decisions made by TM. B. Contest Period 1. The Contest commences on 6 th January 2014 and ends on 5 th April 2014 ( Contest Period ), both dates inclusive. 2. Notwithstanding the above, TM may during the Contest Period, at its sole and absolute discretion extend the Contest Period without prior notice ( the Extended Period ) and any participation in the Contest during the Extended Period (if any) shall be governed by these Terms and Conditions, which shall remain in full force and effect and shall be read and construed to be enforceable. 3. In addition, TM reserves the sole right to change, amend and/or vary the Contest Period at anytime without any prior notification. C. Contest Eligibility 1. This Contest is open to all Malaysian citizens who meet the following criteria: Valid MyKad holder. Aged eighteen (18) years old and above. Existing and New italk users. 2. The following group of individuals are not eligible to participate in the Contest: Permanent or contract employees of TM and its Group of Companies including their immediate family members [children, parents, brothers and sisters] and their spouses; or Representatives, employees, servants and/or agents of advertising and / or promotion service providers of TM and its Group of Companies [including its affiliated and related companies], and their immediate family members [children, parents, brothers and sisters] and their spouses; or Non citizen; or Citizen aged below 18 years old. 3. TM reserves the right to reject any entries at its sole and absolute discretion without having to assign any reasons whatsoever. 4. 2 delinquent behavior or in the event that the Contest is not conducted in a proper and satisfactory manner or any other unlawful means. D. Submission of Entries/ How to Participate To participate in this Contest, participants are required to purchase a Manchester United italk Card RM10 and follow the mechanism as illustrated below: 1. The Prizes for this Contest consist of the following: Monthly Prize (For 3 Months) Twenty four (24) Winners will be selected for 3 months. 6 3. Winners names will be announced at and will be notified via Telephone through their contact details provided to TM when they register to this Contest. Winner Notification Letter will be send via and TM will not be held liable in the event of non-receipt or delayed delivery of the notification to the winner (s). TM shall not be responsible or be liable if any of the winners cannot be contacted. TM further reserves the full right to disqualify any winner if any attempt to contact them has failed for any reason whatsoever. Contest winners will be further notified if there is a prize giving ceremony. 4. TM reserves the right to announce and/or advertise the Contest winners name in any identified newspapers after the Contest Period or Extended Period ends. 5. All Contest Prizes must be claimed within thirty (30) days from the date of Notification. Any unclaimed Contest Prizes after the expiry of the stipulated time shall be forfeited and TM will not compensate and/or be held liable for Contest winners failure to claim the prize(s). Any appeal will not be entertained. Such prizes may be awarded to the next eligible winner. 6. In the event that TM is unable to contact the Contest winner to make arrangements with regard to the prizes to the extent that it may cause unnecessary inconvenience or TM incurring additional cost, at TM's option, TM reserves the right to contact the next Contest winner or forfeit the prize. The non-contactable Contest winner shall have no claims whatsoever against TM on the cancellation and/or the forfeiture of the prizes. 7. All Contest Prizes must be claimed by the winners in person. Contest winners must produce original identity card and a copy of Winner Notification Letter from TM for verification. In special situations, and subject to the absolute discretion of TM, Contest winners may nominate a designated representative to collect a prize. The representative will be required to produce identity cards and written authorization from the Contest winners. 8. The Contest winner may be required to collect the Contest Prize at venue as communicated to him/her by TM. All costs and expenses for the purpose of collection of the Contest Prizes shall be solely borne by the Contest winners. Acceptance and use of Contest Prizes by winners shall be at their own and entire risk at all times. 9. All Contest Prizes are not transferable, non-refundable and non-exchangeable/redeemable for cash. Winners are fully responsible for all taxes that may be payable or taxable (if any). 10. All Contest Prizes are subject to availability. TM reserves the right without prior notice or assigning any reason whatsoever and has sole discretion to substitute the Contest Prizes with something of equal or greater value without prior notice or compensation to the winner. 11. In the event a Contest winner is found to be ineligible at any point of time during or after the Contest Period, TM reserves the right to disqualify the said Contest winner and to cancel/ withdraw/ recall the prizes from being delivered to the ineligible winner. 12. Notwithstanding to the contrary, TM reserve the right to determine the delivery arrangements of the Contest Prizes to the Contest winner(s). For the avoidance of doubt, TM shall not be responsible for any damage and/or loss to the Contest Prizes during the delivery and shall not take delivery of any Contest Prizes returned by the winner for whatsoever reason. TM shall further not be responsible for any Contest Prize(s) that are defected, lost, damage or stolen. F. General Terms and Conditions 1. The Judges for the Contest will be appointed and determined by TM. The Judges' decisions are final and binding and cannot be question for any reason whatsoever. 7 2. TM reserves the right to alter, cancel, terminate or suspend the Contest or the prizes or any part thereof without any prior notice. For the avoidance of doubt, the alteration, cancellation, termination or suspension by TM of the prize, Contest or any part thereof shall not entitled the Contestants/Winners to any claim or compensation against TM (in cash or in kind) for any and all loss or damage suffered or incurred by the Contestants/Winners as a direct or indirect result of the act of alteration, cancellation, termination or suspension. 3. The Contestants will assume full liability in the case of any mishap, injury, damage, claim or accidents resulting from their participation in the Contest and/or redemption of the prizes 4. TM shall not be liable to the Contestants for (a) any loss or damage suffered by the Contestants arising from their participation or non-participation in the Contest due to any act or omission by TM and; (b) for any misuse of any prize or for any claims or liability arising from the use of the prizes. 5. All or any additional and/or ancillary expenses other than those declared as Contest Prizes under item E above will be at the Contest winners own expenses. 6. To the fullest extent permitted by law, TM makes no representations and/or warranties with respect to any Contest Prizes provided under this Contest. In particular, TM gives no warranty with respect to the merchantability, quality of the Contest Prizes or their suitability for any purposes. 7. TM shall not be liable for any misinterpretation of facts in respect of the Contest Prizes offered and published in any mass media, marketing or advertising materials. 8. TM is not responsible for any misrepresentation of facts, injuries or loss of lives or valuables resulting from any of the Contest Prizes won through this Contest and further shall not be liable, whether direct or consequential, for any loss or damage and/or whatsoever suffered by the Contestant(s) resulting from their participation in the Contest or as a result of any act or omission on the part of TM. 9. If the Contest and/or anything to be done by TM or any other entity in respect of the Contest is prevented or delayed by causes, circumstances or events beyond the control of TM or any other entity, including but not limited to computer viruses, tempering, unauthorized intervention, interception, fraud, technical failures, floods, fires, accidents, earthquakes, riots, explosions, wars, hostilities, acts of government or other causes of like or similar or other character beyond the control of TM, then TM shall not be liable for the same to the extend so prevented or delayed, and will not be liable for any consequences thereof. 10. The Contestants agrees that he/she shall not make any public announcement on the Contest (including without limitation to the Contestants Prizes) if they have been selected as one of the winners without the prior written consent of TM. 11. By participating in this Contest, Contestant/Contest winners hereby grant TM perpetual and non-exclusive license the right to broadcast the names, pictures or display any matter related to any of the Contest winners for advertising purposes and publicity related to the Contest without any further notice to the Contest winners. The Contest winner is not entitled to claim any payment in any form, fee or compensation for the use of their images or details in relation to the above. 12. Any Contestant Personal Data provided by Contestant to TM in connection with the Contest shall be kept confidential except to any activities mentioned thereto. 8 precautions to preserve the integrity and prevent any corruption or loss, damage or destruction of Contestant Personal Data. 13. By participating in this Contest, Contestants will be deemed to have read, understood and agreed to be bound by these Terms and Conditions. TM reserves the exclusive rights to change the mechanism of the Contest and/or amend, delete or add on these Terms and Conditions without any prior notice. 14. TM reserves the absolute right to vary, change, reschedule or discontinue the Contest and/or to vary, substitute, discontinue any or all the prizes at any time without assigning any cause or reason thereof and without being in any way liable for any loss for such act. 15. In the event of any dispute, conflict, uncertainty or ambiguity relating to the Terms and Conditions hereto, or any matter involving this Contest, TM will resolve the matter in its absolute and unfettered discretion and the entire decision in the matter by TM shall be conclusive and final. 16. English is the governing language of this Terms and Conditions. All documents, data, descriptions, books, catalogues, diagrams, instructions, invoices and correspondence will be in English language. 17. The Terms and Conditions of this Contest shall be governed and construed in accordance with the laws of Malaysia, and the Contestant irrevocably submits to the exclusive jurisdiction of the Courts of Malaysia.
