Buening, Jr., Executive Director of the Kansas State Board of Healing Arts ("Board"), in summary proceedings pursuant to K.S.A After reviewing the agency record and being duly advised in the premises, the following findings of fact, conclusions of law and orders are made for and on behalf of the Board: 1. License number issued to Jamie L Stinemetz, DC ("Licensee") to practice as a doctor of chiropractic medicine in the state of Kansas expired on December 3 1,2007, pursuant to K.A.R K.A.R requires each Licensee desiring to renew a doctor of chiropractic medicine license to submit to the Board documented evidence of completion of a minimum of 50 CME hours with a minimum of 20 hours of Category I and a maximum of 30 hours of Category I1 for hours earned July 1, 2006 through December 3 1, 2007, or 100 CME hours with minimum of 40 hours Category I and a maximum of 60 hours of Category I1 for hours earned July 1,2005 through December 3 I, 2007, or 150 hours with a minimum of 60 hours Category I and a maximum of 90 hours of Category 11 for hours earned July 1,2004 through December 3 1,2007. licensure. 3. On or about December 12, 2007, Licensee submitted an application for renewal for

As part of the renewal process, Licensee certified that the rules regarding proof of continuing education had been read, the completion of 50 continuing education hours had been achieved since July 1, 2006, and that documentation of those hours would be maintained for a three-year period and produced to the Board upon request. 5. As part of the renewal process, Licensee firther certified that the notice regarding the Board's procedures for auditing continuing education compliance had been read. 6. Licensee was randomly selected to provide verification of compliance with the continuing education requirements and on February 28, 2008, was mailed a letter requesting that Licensee provide, no later than March 3 1, 2008, the records relied upon when the Licensee certified achievement of 50 continuing education hours. 7. The letter also informed Licensee of a $ fine for failing to provide the requested information by the March 31,2008 deadline. 8. Licensee failed to respond to the Board's request by the March 31,2008 deadline. 9. On April 7, 2008, a second letter was mailed to Licensee indicating the failure to respond to the Board's initial request and again request proof of the continuing education hours. 10. Licensee faxed proof of the continuing education on April 8, Based on the Policy Statement 08-03, Licensee should be assessed a civil fine in the amount of $500.00, payable within 30 days of the effective date of this order for the failure to respond to the Board's request by the March 31,2008 deadline. IT IS THEREFORE ORDERED that the Licensee is assessed a civil fine in the amount of $500.00, payable within 30 days of the effective date of this order, for failure to respond to the Board's request by the March 3 1,2008 deadline.

3 PLEASE TAKE NOTICE that this is a summary order. A party to whom a summary order is issued may file a written request for a hearing within 15 days following service of the summary order. If a hearing is not requested, the summary order shall become effective as a final order of the Board upon expiration of the time for requesting a hearing. Buening, Jr., Executive Director of the Kansas State Board of Healing Arts. After reviewing the file and being duly advised in the premises, the Executive Director makes the following determinations. 1. On 'May 27,2008, the Executive Director, on behalf of the Board, issued a Summary Order under Policy in which it was determined that Jamie L Stinemetz, DC should be assessed a fine in the amount of $500.00, payable within 30 days of the effective date of the order, for failure to provide requested information by the March 3 1, 2008, deadline. 2. The Summary Order was filed and mailed on May 27,2008, and contained a notice that it would become effective within 15 days following service if no request for a hearing was received prior to the effective date of the Summary Order. 3. No hearing has been requested by any party and, therefore, the Summary Order became effective on June 17, 2008; and as stated in the Summary Order, a civil fine of $ is payable within 30 days.
