1 Fred & Pamela Buffett Cancer Center Third-Party & Community Fundraising Event Guidelines Thank you for your interest in raising funds to support the Fred & Pamela Buffett Cancer Center. We are grateful for both your interest and efforts. Before you launch your event, please review these Fundraising Event Guidelines and submit the Third-Party & Community Fundraising Event Application for review no later than eight (8) weeks prior to the proposed event. Until written approval is received, no individual or organization may solicit contributions to support or use the name Fred & Pamela Buffett Cancer Center for any purpose. We will make every effort to make a determination on your application within 10 working days. The Fred & Pamela Buffett Cancer Center can help with your fundraising event in the following ways: Upon receipt and approval of the Community Fundraising Event Application, a letter to validate the authenticity of the event and its organizers will be issued. The letter states that we are aware of the event organizer s intention to raise funds in support of the Fred & Pamela Buffett Cancer Center and that the event is not sponsored or organized by the Fred & Pamela Buffett Cancer Center. Provide initial guidance or advice for hosting a fundraising event. Promotional Materials: Fred & Pamela Buffett Cancer Center must review and approve all promotional materials, including but not limited to, use of logo, advertising, letters, brochures, flyers, and press releases prior to production and distribution. o If appropriate we may approve the use of and provide camera ready artwork (logos, images, etc.) for approved printed materials. o The name Fred & Pamela Buffett Cancer Center may not be used or reproduced on signs, banners, publications, literature, or printed materials without written or electronically written and transmitted approval from the Fred & Pamela Buffett Cancer Center. o Promotional materials shall state that "Proceeds to benefit the Fred &

2 Pamela Buffett Cancer Center." This statement may be expanded to include the name of a specific program or research. For example, "Proceeds to benefit the Breast Cancer Research Program at the Fred & Pamela Buffett Cancer Center. o The Fred & Pamela Buffett Cancer Center may only be identified as the beneficiary of the event. Event organizers must not title an event using the name Fred & Pamela Buffett Cancer Center. For instance, The Fred & Pamela Buffett Cancer Center Walkathon is not permitted. An appropriate event promotion would read, Walkathon to benefit the Fred & Pamela Buffett Cancer Center. o Event organizer(s) can include on promotional materials that proceeds benefitting the Fred & Pamela Buffett Cancer Center will be made to the University of Nebraska Foundation. Please contact us if you wish to designate your contribution to the Fred & Pamela Buffett Cancer Center to a specific area of interest, such as research, education, equipment, or a specific program within the Fred & Pamela Buffett Cancer Center. The Fred & Pamela Buffett Cancer Center may, at its discretion and at any time, post and/or promote, when appropriate, the event on the Fred & Pamela Buffett Cancer Center online properties, existing events, or other calendar listings and physical spaces. Staff Representation: Please contact us if you would like to have a Fred & Pamela Buffett Cancer Center representative participate in a check presentation at your event. We will make every effort to honor your request. However, we cannot guarantee a representative will be available. Please contact us if you would like to feature a Fred & Pamela Buffett Cancer Center staff member as a speaker at your event. While we will make every effort to assist you, we cannot guarantee a representative will be available to speak. Charitable Receipts: Under certain circumstances, we may be able to provide written tax receipts to donors who make checks payable to The University of Nebraska Foundation or The N.U. Foundation. Please contact us in advance of your event to discuss the issuing of charitable receipts.

3 Guidelines and Protocols: Sponsorships The Fred & Pamela Buffett Cancer Center and/or the University of Nebraska Foundation reserves the right to review sponsorship proposals and packages for appropriate use of the Fred & Pamela Buffett Cancer Center name, as well as language regarding charitable deductions and contributions. Event organizers must provide a list of existing or potential sponsors, including potential in-kind sponsors, to avoid duplication of efforts and excessive requests to any one potential donor. The Fred & Pamela Buffett Cancer Center reserves the right to limit or veto corporate sponsorships at any time. Volunteer Assistance It will be the sole responsibility of the event organizer(s) to recruit, train, and acknowledge any volunteers. Registration/Participation Fees It will be the sole responsibility of the event organizer(s) to receive each check or cash payment made by event participants or attendees. The University of Nebraska Foundation will not receive/deposit all individual checks from participants or attendees. It will be the sole responsibility of the event organizer(s) to receive any pure donations paid by cash or check written to the University of Nebraska Foundation. Charitable receipts for such donations will only be provided by the University of Nebraska Foundation if a typed or electronic listing of all donor names, donor mailing addresses and individual correlating donations is provided by event organizer(s). Raffles/Drawings The Fred & Pamela Buffett Cancer Center and the University of Nebraska Foundation do not conduct raffles, nor will we secure raffle permits. There is no charitable gift associated with a raffle ticket, lottery, or any game of chance. No charitable receipts will be issued for money collected through these means. In any event involving a raffle, lottery, or game of chance, it will be the sole responsibility of the event organizer(s) and sponsors to review and abide by the

4 rules and regulations of the Nebraska Gaming Commission and all applicable federal, state, county, and municipal laws and regulations. Silent and Live Auctions Each item of a silent auction should be valued at the fair market value. This value must be listed on the bid sheet at the auction table, as well as in any printed list of auction items. Donors of items for a silent or live auction should provide the Fair Market Value of their items/service. If the item is a collectible, reasonable efforts should be made to assess the value. Only winning bids that are over the stated Fair Market Value can receive receipt information on their charitable gift. Event organizers shall be responsible for the issuance of all receipts for auction items. Any and all documentation to the winner must be provided by the event organizer(s). If an item is not valued, or valued as priceless, the final auction bid then establishes the item s fair market value and, therefore, no portion is tax-deductible. Event Budgeting, Expenses, and Revenue Reporting Event organizer(s) will be liable for all event expenses. Neither the Fred & Pamela Buffett Cancer Center, nor the University of Nebraska Foundation or any of their associated entities, employees, or governing bodies, shall be liable for any expenses, debts, or fees associated with organizing any thirdparty event. All expenses incurred as a result of the event must be paid in full prior to net proceeds being donated to the University of Nebraska Foundation. Once funds are received as a donation, they can only be directed for the intended purpose to the Fred & Pamela Buffett Cancer Center and cannot be used to pay any expense related to the event. Within 6 0 days after the event, the organizer(s) must submit net proceeds to University of Nebraska Foundation. The check should be payable to and sent to "University of Nebraska Foundation, 1010 Lincoln Mall, Suite 300, Lincoln, NE, Insurance/Permits The event organizer(s) are solely responsible for obtaining all necessary permits, licenses, and insurance. The Fred & Pamela Buffett Cancer Center and University of Nebraska Foundation cannot be held responsible in any way for casualties and/or situations that may occur at an event.

5 Liability The Fred & Pamela Buffett Cancer Center and University of Nebraska Foundation is not financially or otherwise liable for the promotion or staging of a Community Fundraising Event. All outside organizations sponsoring events on University premises must provide proof of general liability insurance. Such insurance shall be in the amount of $1 million per occurrence and $3 million per event and shall name The Fred & Pamela Buffett Cancer Center, the University of Nebraska, the University of Nebraska Medical Center, Nebraska Medicine and University of Nebraska Foundation as an additional insured. Please contact Tom Thompson, for more information about sponsoring an event on University premises and proof of general liability insurance requirements. Indemnity Clause Right of Refusal The event organizer(s) agree to indemnify, defend, and hold harmless the Fred & Pamela Buffett Cancer Center, the University of Nebraska, the University of Nebraska Medical Center, Nebraska Medicine and University of Nebraska Foundation University and its affiliates, from all claims and liabilities that may arise from any acts or omissions of its agents, volunteers, or employees, or from any claim by it or anyone else relating to the quality, performance, or failure to perform during the specified time period of the event. The Fred & Pamela Buffett Cancer Center reserves the right to refuse association with any event and/or event organizer(s) if deemed in the best interest of the Fred & Pamela Buffett Cancer Center, the University of Nebraska Medical Center, Nebraska Medicine and the University of Nebraska Foundation. Receipting and Tax-Deductibility of Charitable Donations Please make a check representing net proceeds payable to University of Nebraska Foundation within 60 days after the event. If your organization is not a 501 (c)(3), please contact T o m T h o m p s o n ( ) or for further guidance on how to proceed.

6 As policy, the Fred & Pamela Buffett Cancer Center and the University of Nebraska Foundation cannot perform the following activities or functions for events it does not directly sponsor: Extend our sales tax exemption. Issue receipts for donations not made directly to University of Nebraska Foundation, which includes in-kind donations. Provide insurance coverage or secure permits. Provide mailing lists of donors, physicians, employees, or volunteers. Provide Fred & Pamela Buffett Cancer Center or University of Nebraska Foundation letterhead for your event use. Provide banking, funding, or reimbursement of expenses. Solicit sponsorship revenue for your fundraising activities. Guarantee attendance of the Fred & Pamela Buffett Cancer Center or University of Nebraska Foundation staff, faculty, physicians, or patients at the event. Provide auction services or systems.
