1 June 25, 2014 ADDENDUM #2 RP Provide Merchant Processing Service on a Multi-Year Contract This addendum is being issued to provide answers to questions we received and for clarification purposes. Please make the following changes: DELETE: Page 29 and ADD: Revised Page 29 DELETE: Page 28 and ADD: Revised Proposal Fee Schedule (pages 1-10) ADD: Merchant Volume spreadsheet ADD: Copy of contract with current vendor IMPORTANT: We have decided to REMOVE the Convenience Fee requirement from this RFP. Therefore, please remove any verbiage that lists this as a requirement for this proposal. Your proposal submittal should only include non-convenience fee based model. Remember to submit the Revised Proposal Fee Schedule in a separate envelope and mark as Proposal Fee Schedule. 2 RP Addendum #2 RP Questions & Answers NOTES: Any exceptions (including exceptions to insurance, contract, etc.) should be listed under a separate tab titled Exceptions. Q1. You mentioned that Parks and Recreation currently has a proposal out for a new registration system and that it will be web based. Can you provide the name of the vendor? Can you tell us what platforms the new vendor is certified for? A1. REC1 has been awarded the contract for a new registration system, and it is a Web based design. Q2. Is a bid bond required? A2. No. Q3. Related to the Parks and Recreation vendor selection, can you confirm that merchant processing would at a minimum require a MID from your new partner and would it also require or provide the opportunity to provide a gateway? If we can found out network certification and gateway utilized, that would be ideal. A3. REC1 interfaces to many merchant processors by way of payment gateways. REC1 interfaces to about different payment gateways. Yet, these gateways are capable of interfacing to virtually any merchant account. The most common used gateway is Authorize.net which can essentially sit on the front-end of any merchant account. Yes, I still believe we will need two (2) MID s as we do now (one for on-site facility registrations and one for the internet registrations). Q4. Are you using tokenization in any of your departments today? Do you plan to use to tokenization or encryption under this new agreement? Do you plan on expanding the use of tokenization or encryption to all departments? A4. In Water Resources, we definitely use tokenization. However, I am not sure about the other departments. One of the requirements is to be PCI DSS compliant and I think that the token is allowing us to do that. Tokenization is the platform that we need to work from and we hope to expand to other departments. From the Office of Tax Commissioner we don t have that in place and I don t know that we are going toward that. Q5. Are any of your accounts right now charging a convenience or service fee and do you anticipate needing that in the future and passing it on to the customer? A5. No. I think it is a County objective not to do that. Licensing and Revenue does not charge a convenience fee for online payments only. Q6. Are you going to keep your settlement accounts with your current financial institution? A6. We plan on keeping the settlement accounts with our current financial institution. Q7. Would it be possible to obtain previous merchant statements for the last 3 months to compare what the County is currently paying? A7. Yes. We listed this information in the table on the next page:

The RFP seems to indicate that you may be interested in convenience fee model in some instances in the future. Would you consider a proposal that just addresses that? A8. No. The proposal submittal must address everything that is requested. Q9. The RFP actually asks for non-convenience fee based proposal as well as convenience fee based proposal. However, on the Fee Schedule it does not ask for convenience fee so is convenience fee not being considered? Reference Page 16 and Page 28 for these issues. The Tax Commissioners Office has a program that is not a part of this solicitation and those may currently be convenience fee programs. If there will be convenience fee based, which ones will be convenience fee based and which ones will be paid by the County? A9. All departments who currently employ a convenience fee do so using a third party software, and not our current merchant vendor. As such, we have decided to remove the Convenience Fee requirement from this RFP. Q10. Could we get an indication on the schedule if there is a convenience fee or not? If the MID that identified today could just be indicated as (Yes you would consider a convenience fee) then I think we could price that accordingly based on that volume. Also, if you could delineate further e-check activity that may be coming through that MID or some delineation on volume of that check conversion activity as well as a breakout of American Express and Debit. A10. All departments who currently employ a convenience fee do so using a third party software, and not our current merchant vendor. As such, we have decided to remove the Convenience Fee requirement from this RFP. Q11. Can you confirm that online tag renewal, online property tax and online court fees are not in the scope of this solicitation? A11. Those are not in scope for this solicitation. Q12. On page 7, item #29 it states: Encrypt user data and work with the County to minimize the collection of personal information such as users social security numbers or other private data. Encrypt as soon as card is swiped. Is the Tax Commissioner s Office in scope for that particular requirement?
4 RP Addendum #2 A12. Encryption is required to maintain PCI compliance. The Tax Commissioner s Office s over the counter automotive transactions are the only transactions that are a part of this RFP. All other Tax Commissioner s transactions are handled through a separate agreement. Q13. Please confirm that the County will not be charging a convenience fee to the customers. A13. That is our overall objective. We don t want to deter our customers from using these payment options. I can t give any guarantees of what will happen within the next 5 years regarding changes that might occur regarding charging a convenience fee. Parks and Recreation has no intention of charging convenience fees now or in the near future. Q14. Can you breakdown for 2 convenience fees: One for Water Resources and one for everything else? We would have a flat fee on one and a percentage on the other so we need to know the breakdown. A14. All departments who currently employ a convenience fee do so using a third party software, and not our current merchant vendor. As such, we have decided to remove the Convenience Fee requirement from this RFP. Q15. If we are responding on X amount of transactions at this department and we put a total fee in there, we need to know what percentage of those are at tokenization and maybe an add-on cost for a convenience fee. Can you add a couple of columns on page 28 and show what percentage of transactions within that MID falls under tokenization and what does not? A15. Right now, Water Resources is the only one with tokenization. Therefore, if we break out water separate, that would be implying that tokenization is included in that cost. Q16. In our response, depending upon what the updates are, if we choose one way or the other will we be disqualified if we do not process a proposal with the convenience fee and only a merchant based proposal? A16. You must provide what the requirements state. However, stated in this addendum, we are removing the Convenience Fee requirement from this RFP. Q17. Are there any front-end processes where you are in partnership (like Parks & Recs where you are looking for a new vendor for the front-end process and they have looped in a gateway potentially and you have the option on the MID) in the water space or in any of these other spaces do you anticipate that we would not be able to at least provide a merchant ID because of some bundled package that you have on the front-end? A17. No. Q18. Are there any major changes or negotiations coming that are known at this point around any of those departments within the next five years to look to new vendors that may pull that volume away from us at some point if we awarded the business? A18. No. Q19. Invoicing of fees was also mentioned in the proposal. Would the County consider automatic debiting of the fees? A19. Per item 25, the County expects monthly invoicing delivered to each department detailing their individual fees and a chain invoice delivered to the Department of Financial Services, however, as noted in item #27, fees should be auto debited from the master concentration account. Q20. The proposal stated that you want to settle to current vendor, Wells Fargo. Would you consider settlement to any other account if they could still process funds to the Wells Fargo account? A20. No. Q21. You mentioned SAP 6.0, do you want these accounts to all integrate with that as far as your accounting program? A21. Yes. Our financial record system is SAP so it has to flow into SAP.
5 RP Addendum #2 Q22. Should interchange and assessment costs be included in the fees? A22. Yes, please include all fees so the county can fully calculate costs. Q23. Section I, H Convenience Fee programs offered through other contracts: Can you expand on the arrangement involved in the collection of convenience fees? Are convenience fees only collected for the programs listed? A23. The Tax Commissioner s office and Recorder s Court charge convenience fees but they have contracts through a vendor that is not governed by Financial Services. All departments who currently employ a convenience fee do so using a third party software, and not our current merchant vendor. As such, we have decided to remove the Convenience Fee requirement from this RFP. Q24. Section II, C, #6: For what payment does the County expect next business day funding? A24. All payments. Q25. Section II, #14: Is the County currently PCI compliant? Is the County seeking PCI consultation services to achieve PCI compliance, if not currently compliant? A25. Gwinnett County is officially compliant in the sense that we have addressed our environment and have a plan in place to move forward with. Gwinnett County has used Experis for consulting services. Q26. Section II, #33: Is participation in the Visa Tax Pilot program and MasterCard Convenience Fee Program(s) required at the time of proposal? A26. As stated on page 7, the vendor will satisfy the following minimum requirements. Participation in the Visa Tax Pilot program and MasterCard Convenience Fee program(s) is listed as one of the minimum requirements. Yes, participation is required at the time of proposal submittal. Even though we have decided to remove the Convenience Fee requirement from this RFP, we want the vendor to participate in these programs for possible future utilization. Q27. Section III, pages 6 & 7, #27: Indicates that fees are to be debited from the Treasury account, and question 25 requires a monthly invoicing. These requirements appear to be in conflict. Please confirm the requirement. A27. Please see answer to Q#19. Q28. Is it acceptable to have chargebacks debited from the DDA? A28. Chargebacks may be debited from the DDA; however, a detailed summary will need to be sent to the individual departments for accounting purposes. Q29. Section III, page 6, #14: States that awardee will be required to conduct PCI compliance reviews. PCI reviews require the awardee to be a PCI Qualified Security Assessor (QSA), which acquirers are not. Is it the County s intention to have the awardee complete the assessment or collaborate to answer questions regarding PCI? A29.Yes. Q30. Section III, page 6, #17: Is it the intention of the County that their consultants would be contacting the awardee of the RFP? A30. Third party consultants should be contacting Gwinnett County with any issues. Any contacts with the awarded vendor would be from internal end user departments. Q31. Section VII, # 17: As a follow-up to the pre-proposal meeting, please confirm if we are to include pricing for service and convenience fee programs. If we are to include pricing for a service/convenience fee pricing, would we be able to price the model where the respondent manages the fees collected and the County would not receive an invoice or bill? A31. All departments who currently employ a convenience fee do so using a third party software, and not our current merchant vendor. As such, we have decided to remove the Convenience Fee requirement from this RFP.
6 RP Addendum #2 Q32. Fee Proposal Schedule: All acquirers are assessed the same Card Association Interchange and Assessment which is the majority of the expense associated with card processing. To simplify the analysis for the County and remove the subjectivity of which interchange class and fee to apply, is the County willing to stipulate that Interchange and Card Association fees be provided as pass-through cost and the only fees to be calculated on the schedule would be the respondent s standard fees? A32. No, please include all fees. Q33. Considering the significance of the questions received and any modifications needed, is it possible to extend the due date of the proposal? A33. The due date was extended in Addendum #1 to July 8, 2014 at 2:50 PM (local time). Q34. Can you provide a copy of the contract(s) with your current e-payment vendor(s)? A34. A copy of the current vendor s contract is attached. Q35. Why is the County issuing this RFP? A35. This service is one of our multi-year contracts. The current contract for this service expires November 3, Therefore, we are requesting proposals in order to prevent an interruption in this service. Q36. What services is the County seeking which are not currently provided by its vendors? A36. None. Q37. What improvements would the County like to see to the services being provided today? A37. Any improvements would be discussed with awardee. Q38. What are the County s current rates for payment processing? A38. See the attached Merchant Volume spreadsheet. Q39. Are the total dollar volumes listed in Exhibit II of the RFP, page 28 only for e-payments in 2013? Please break down by card brand/payment type (MasterCard, American Express, Discover, Visa and e-checks), payment channel (in person, online, mail/phone). A39. DWR s SAP report shows a total of 463,205 online payments from 1/1/13 12/31/13. Visa - 226,693, Mastercard - 62,782, Discover - 7,677 and Check 16,053. Q40. How many physical office locations would require e-payment services? A40. There are a total of 36 locations Q41. How many total cashiering stations are there? A41. Between all departments there are 212. Q42. Which cashiering software does the County use? A42. DWR uses inovah. The Tax Commissioner s Office does not currently interface with the State GRATIS system for over the counter motor vehicle transactions. This may change in the future. Q43. How many chargebacks occur each month? A43. Chargebacks range from per month across all departments. Q44. Which departments listed in Section F on page 3 use an absorbed cost model, and which use a convenience fee model? A44. Parks and Recreation absorbs the fees. DWR absorbs the cost. Tax Commissioner s Office absorbs the cost for over the counter transactions. All departments who currently employ a convenience fee do so using a third party software, and not our current merchant vendor. As such, we have decided to remove the Convenience Fee requirement from this RFP.
7 RP Addendum #2 Q45. Are the Tax Commissioner s Property Tax payments included in the scope of this RFP? A45. No. For the Tax Commissioner s Office, this RFP only covers over the counter motor vehicle transactions. Q46. Section I Introduction, F Composite: This section states that Elavon processes Visa, MasterCard and Discover card transactions but on the Tax Commissioner s FAQ on-line, it states that American Express is accepted. Will American Express be accepted as a form of payment? A46. No. The Tax Commissioner s Office accepts American Express for their property tax payments only. That is processed through a separate system and is not a part of this RFP. Q47. Section II Scope of RFP, C Scope Overview, #5: This section states, Provide electronic authorization, data capture, and settlement services for all Visa, MasterCard, Discover, credit and debit transactions. Will American Express be accepted as a form of payment? A47. No. Q48. Proposal Fee Schedule: Can you identify the MID/DBA for property tax payments? Can you break out the volume/transactions by payment type: Pinless Debit the $3.95 rate), Pinless Debit (non-tax), Discover, American Express, e-checks, Visa? A48. Per Q#45, property tax payments are not in the scope of this RFP. Q49. Page 7, #43: Please confirm the intent is for the vendor to determine which applications are eligible to be funded through convenience fees. If not, please identify for which departments/applications the County prefers the e-payment solution to be convenience fee funded, versus funded through County absorbed fees. A49. All departments who currently employ a convenience fee do so using a third party software, and not our current merchant vendor. As such, we have decided to remove the Convenience Fee requirement from this RFP. Q50. Page 10, Section III. Certification of Meeting Minimum Requirements: If this form is not signed as is, will that result in a rejection of the proposal provided? There are a number of items that the proposer may not be able to meet and cannot certify that proposer can meet all specified minimum requirements. For example, next day funding is listed as a requirement in number 6 but number 42 appears to allow funding in 2 business days and even 3-5 days with collateralization. If proposer cannot offer next day funding, this would not be in agreement with number 6 but would adhere to the requirements in number 42. Proposer could not sign this form under these circumstances although the offering still seems to meet the County s needs (based on number 42). A50. If you are unable to meet all minimum requirements, please make a note on the Certification of Meeting Minimum Requirements form, and specifically list which items you are unable to meet. The County will still consider those proposals; however, the omitted items will be considered in the scoring process. In reference to the specifically mentioned items 6 and 42, they are not in conflict. The County expects next day funding. For instance, real time systems would automatically have next day funding. Batch environments would fund next day based on the processing of the batch. Specifically note if you have a cutoff time for batched environments. It is acceptable for next day to be more than 24 hours in the cases of weekends and holidays. Specifically note if weekend transactions would post Monday or Tuesday. Q51. Page 15, #14 Compliance: An SSAE16 is used in lieu of a SAS70 for the proposer. The SSAE16, however, does not note the proposer s PCI compliance. This status can be found on Visa s public web site. Does the County require a copy of the SSAE16? If so, would the County be willing to sign a non-disclosure agreement in advance of its release? Due to the sensitive nature of the information contained within the SSAE16, a signed non-disclosure agreement is required by the proposer. A51. Unfortunately because of the Open Records Act requirements for the County, we will not be able to sign a non-disclosure agreement. However, we will work very closely with our legal counsel to protect any proprietary or confidential information. Q52. Page 27, Exhibit II: Is the equipment listed as Virtual Merchant the name of a virtual terminal offering that is proprietary to your current provider or is it a third party solution like PayFlowPro or Authorize.net?
8 RP Addendum #2 A52. Virtual Merchant is the current provider s gateway which we use for our internet registrations. Parks and Recreation currently has to use a 3 rd party (PayFlowPro) for the onsite facility registrations for our current registration system. Q53. Page 28, Proposal Fee Schedule: Is this volume inclusive of all card types (Visa, MC, Discover and AmEx)? If the proposer is conveying a card type such as AmEx, a discount rate would not apply to that portion of the volume. Would the County be able to provide this spreadsheet with a breakdown by card type? Does Gwinnett County wish to accept American Express transactions going forward? A54. No. Q55. Page 5, Section II Scope of RFP, Section A, items 4 & 5: As noted in items 4 & 5, please explain the e-check services Gwinnett wishes to use going forward. Please list any equipment used to process the e- Checks. Please also provide the dollar volume and number of e-check transactions processed in the revised Proposal Fee Schedule A55. DWR is thinking about implementing Check 21 (maybe in 2015). Parks and Recreation currently does not use E-check. Q56. Page 5, Section II Scope Overview, Item #1: Does Gwinnett County wish to move forward with EMV capable equipment should it need to be replaced or added? A56. EMV is an item we would consider, but is not a requirement for this RFP. Q57. Page 6, Section II Scope Overview, Item #14: Who assists with the PCI compliance review for Gwinnett today and confirms compliance? Do you use a QSA? Is Gwinnett PCI compliant today? A57. Gwinnett County will use Experis after a PCI audit. Yes, we use a QSA. Yes, the County is compliant per the established requirements of question #25. Q58. Page 6, Section II Scope Overview, Item #25: Please explain what format is needed, CSV, HTML, etc. How does Gwinnett County pull this data today and what system is it pulled from? A58. The reporting format will need to be compatible with SAP, our accounting software. Additional formats that are used for the Finance department are PDF and Excel. Q59. Page 7, Section II Scope Overview, Item #29: Is encryption required for all card present and card-notpresent transactions? A59. Yes.
9 RP Addendum #2 Q60. Page 8, Section II Scope Overview, Item #46, item b, #1 and #3: Are these projects with GRATIS part of the State of Georgia DDS solutions? Related to #1 listed above, do you anticipate using a State based solution through GRATIS for card present transactions as this is available? Related to #3 above, is this for the activity current capture through the State of Georgia DDA web solution in partnership with Official Payments? A60. No, the GRATIS projects are not part of the State of Georgia DDS solution. No, we do not anticipate using a State based solution. No, this RFP is only for over the counter motor vehicle transactions with the Tax Commissioner s Office. Q61. Page 8, Section II Scope Overview, Item #46, item d, item i: Related to the new Community Services registration system if the vendor provides the VAR and/or gateway, please provide the VAR and version or the gateway specifications to be used and the network(s) that they are certified to for processing. If Gwinnett County is able to choose a gateway, please indicate if the chosen vendor will code to a gateway of Gwinnett County s choice. We understand this information may not be available for sharing until after the award is made. A61. Gateways differ based on the department. All are compatible with the major networks. Q62. We do not provide our SAS70 without a signed non-disclosure agreement. Will the County sign our NDA? A62. See the answer for question #51. Q63. Will the County be interested in participating in our State of Georgia agreement? A63. No. Q64. Please identify the specific return items that should be returned in a file as required under C Scope, item #11. A64. With respect to public inquiries, the service provider is expected to work with, communicate with, and provide any information that a current contracted Gwinnett County vendor requires for cash management, payment processing, and information technology purposes to satisfy the requirements of any existing contract. Q65. Does the County perform PCI Compliance reviews of County activity today and can compliance be confirmed? A65. Yes. Q66. What PCI level is the County under today? A66. Level 3. Q67. Does the County have onsite implementation today with their current provider? Please describe the specific onsite implementation projects. A67. Gwinnett County has not needed an onsite implementation but we have worked with Elavon for our functional implementations. Q68. What specific functionalities is the responder expected to respond to inquiries on by the public under C Scope, Item #18? A68. See Q#64. Q69. Please provide specific details of the expected integration of payment applications for no additional cost for channels listed proving the number of applications, number of channels and S.O.W. for each. A69. Proposer s systems would have to be compatible with existing 3 rd party software which differs by department. Gwinnett County will not cover the programming costs if the proposer s software is incompatible. A total list of software is not available at this time.
10 RP Addendum #2 Q70. Does the County process pin debit transactions today? If so, please provide the number of transactions and dollar volume accepted annually. A70. Yes, over the last 12 months there have been 163,352 pin based debit transactions. Those transactions totaled $23,438, Q71. Does the County process pin-less debit transactions today? If so, please provide the number of transactions and dollar volume accepted annually. A71. Yes, however due to the way they process through our current provider, the transactional data is not readily available. Q72. Please identify the specific broadcast methods, number of users and system to be utilized by the responder identified in C Scope, Item #28. Is this in place today? A72. notifications are currently used today. Recipients would include individuals within the Department of Financial Services and designated personnel of the end user departments. Q73. Can the County confirm that all current internal and third-party vendors and systems have user data encryption and card swipe encryption capabilities and are supported by each specific application as required in C Scope, Item #29? Do these encryption technologies adhere to PCI Compliance standards? Are they utilized today? A73. Yes to all questions. Q74. Can the County confirm that all current internal and third-party vendors, systems and applications have tokenization capabilities as required in C Scope, Item #31? A74. Currently only the Department of Water Resources uses tokenization. Q75. Does the County have the ability to de-tokenize a transaction once tokenized? A75. No. We cannot de-tokenize. Q76. Please provide specific details on all systems, operating languages, programming language supported, data elements, each field and size, to allow the responder to determine impact, timeline and ROI to requirement under C Scope, Item # 35. A76. Information is not available at this time. Q77. Please provide the payment application, interface, middleware, host switch or gateway company, name and applicable versions and each processor and/or each platforms certified to process payment transactions though for each of the various systems listed in C Scope, Item 46. A77. DWR online bill pay, Revenue License, Solid Waste, DWR IVR, Community Services RecWare. Q78. Does the County have licenses and maintenance agreements in place with each of the third-party application providers today? A78. Yes. The County has licenses and maintenance agreements in place with third party application providers. Q79. Does the support provided by third-party vendors meet the County s requirements? A79. Yes support by third party vendors does meet requirements. Q80. Is it the County s intention to continue utilizing these third-party vendors and products? A80. Yes the County does plan on continuing to use third party vendors and tools. Q81. Please identify the number of merchant accounts that the County utilizes today. A81. We have a total of 30.
11 RP Addendum #2 Q82. Does the County have a PCI Security policy? A82. Yes the County does have a PCI Security policy in place. Q83. Does the County have an EMV acceptance strategy? A83. Not currently - would consider it as an option, but it is not a requirement for this RFP. Q84. We have submitted a document for your use that combines Exhibit I and Exhibit II data. Please complete the shaded areas to update or confirm the details requested by Merchant ID or location. Confirm if a convenience fee is taken today (X) Provide Debit $ volume activity annually, if accepted (Y) Provide AMEX# of transactions, if accepted (Z) Confirm if e-check is required with or without guarantee. If required, please also fill the column with the estimated number of checks and dollar value of the checks that would be estimated annually. Update as appropriate the terminal and PIN pad fields. A84. We are not able to utilize the document you provided. However, we have attached a revised Proposal Fee Schedule with additional information to use. Since all acquirers are assessed the same Card Association Interchange and Assessment, these will be considered pass-through costs and should not be included in the percentages listed below. In addition, the County has the sole right to terminate this contract absolutely and without further obligation on its part at the close of the calendar year in which it was executed and at the close of each succeeding calendar year for which it may be renewed. The contract shall automatically renew unless positive action is taken by the County to terminate the contract for a total lifetime Agreement term of five (5) years and one month, upon the same terms and conditions. Termination for Cause: The County may terminate this agreement for cause upon ten days prior written notice to the contractor of the contractor s default in the performance of any term of this agreement. Such termination shall be without prejudice to any of the County s rights or remedies by law. Termination for Convenience: The County may terminate this agreement for its convenience at any time by written notice to the contractor. In the event of the County s termination of this agreement for convenience, the contractor will be paid for those services actually performed. Partially completed performance of the agreement will be compensated based upon a signed statement of completion to be submitted by the contractor, which shall itemize each element of performance. Termination for fund appropriation: The County may unilaterally terminate this Agreement due to a lack of funding at any time by written notice to the Contractor. In the event of the County's termination of this Agreement for fund appropriation, the Contractor will be paid for those services actually performed. Partially completed performance of the Agreement will be compensated based upon a signed statement of completion to be submitted by the Service Provider which shall itemize each element of performance.
