1 HAVERING FOUNDATION YEARS AND INDEPENDENT ADVICE SERVICE DIRECTORY AND FUNDING AGREEMENT THIS AGREEMENT is made on the day of 2013 BETWEEN (1) THE LONDON BOROUGH COUNCIL OF HAVERING Town Hall, Main Road, Romford RM1 3BD. ( the Local Authority ) and (2) Ofsted URN ( the Provider ) WHEREAS (1) The Local Authority is required to keep an up to date Directory for all Nonmaintained Providers within their area (2) In order to be included in the Directory, Providers must be eligible as set out in the criteria specified in clause 2 below (3) The Local Authority will also provide funding to the Provider who meets the funding criteria set out in clause 3 below (4) This Agreement is based on the current Early Educational Entitlement Free Places for 3 and 4 Year Olds A Detailed Guide for Providers and the appendices contained within which shall be read and complied with as part of this Agreement. By signing this agreement the Provider acknowledges that they understand the guidance described and will meet the requirements therein. NOW IT IS AGREED: 1. Definitions OFSTED PVI Office for Standards in Education the Private, Voluntary, Independent Schools, Pre- Schools and Private Nurseries in the London
2 Borough of Havering DfE Department for Education (Previously named Department of Children Schools and Families DCSF) The Directory Electronic database of Ofsted registered providers maintained by the Local Authority. This information is regularly updated through information received directly from OFSTED and by Providers themselves Early Educational Entitlement Free Places for 3 and 4 Year Olds A Detailed Guide for Providers The current Local Authority guidance for providers on the provision of free early education places for three and four year olds made available to you via Provider The individual location of a nursery, school or childminder EYFS Quality Mark Mandatory curriculum framework A quality assurance scheme supported by the Local Authority On-going and On-entry Assessments The Local Authority s support document to record value added statistics for 0 5 year olds Ofsted Self Evaluation Scheme The support package for evaluation and planning compiled by OFSTED GOOD Standard A standard equivalent to a Good grading issued by OFSTED following an inspection or calculated using the OFSTED Self Evaluation Scheme and Page 2 of 6
3 confirmed by the Local Authority. SATISFACTORY Standard A standard equivalent to a Satisfactory grading issued by OFSTED following an inspection or calculated using the OFSTED Self Evaluation Scheme and confirmed by the Local Authority 2. To be eligible for initial inclusion in the Directory the Provider must fall into one of the following categories: (a) be registered by OFSTED as a Day Care Provider under the Children s Act 2006 (or a Day Care Provider exempt from such registration) (b) (c) (d) an independent school registered with the DfE a non-maintained special school A registered childminder approved on the Local Authority Network Once eligible to be included, providers must: (e) have obtained an inspection grading on the Early Years register of at least SATISFACTORY from OFSTED Early Educational Entitlement (EEE) Funding 3. To receive EEE funding from the Local Authority a Provider must: 3.1 Meet the standards set out in the Early Educational Entitlement Free Places for 3 and 4 Year Olds A Detailed Guide for Providers. 3.2 Agree, on an annual basis, a rating Red, Amber or Green against the current London Borough of Havering Targeted Support Package. 3.3 Maintain records regarding children for whom the grant is paid for a minimum of 2 years (following the last claim), ensuring they are kept safe and in line with the Data Protection Act. 4 3.4 Jointly work with relevant qualified Local Authority staff to improve the standard of early education provided. 3.5 Attend training in line with the current London Borough of Havering Targeted Support Package. 3.6 Enrol on a quality assurance scheme agreed with the Local Authority. 3.7 Update the Directory termly. 3.8 Adhere to the Training Programme policy and procedures 3.9 Provide Termly and Annual Census information to the Local Authority as specified in the Annual Schedule Adhere to the current Safeguarding Policy and Procedures and ensure all staff are aware and implement good practice Ensure proactive engagement with the Local Authority for the appropriate dissemination of information via forums or electric information Comply and co-operate in providing information on request Following any OFSTED inspection, after the 1 September 2008, which results in a grading of only SATISFACTORY the Provider will accept assistance from suitably qualified staff of the Local Authority in order to improve the Provider s performance to a GOOD Standard. Failure to accept assistance within two weeks of receipt of the Ofsted report, or failure to improve performance to a GOOD Standard within 12 months of the Ofsted report will result in withdrawal of funding and removal from the Directory Following an Ofsted inspection, after 1 September 2008, which results in a grading of INADEQUATE the Provider will accept assistance from suitably qualified staff of the Local Authority in order to improve the Provider s performance to a SATISFACTORY Standard. Failure to accept assistance within two weeks of receipt of the Ofsted report, or failure to improve performance to a SATISFACTORY Standard within 6 months of the Ofsted Report will result in withdrawal of funding Page 4 of 6
5 and removal from the Directory. Once a SATISFACTORY Standard has been achieved the Provider must comply with the requirements of clause 3.13 above. Agreement Period 4 This Agreement will remain in force until 31 March 2014 unless the Agreement is terminated as set out in clause 6.1. The Local Authority s Obligations 5.1 Subject to section 7(1) of the Childcare Act 2006, the Local Authority will meet its statutory duty and the schedules as contained within the Early Educational Entitlement Free Places for 3 and 4 Year Olds A Detailed Guide for Providers 5.2 The Local Authority will make available appropriate advice training and support for Providers in support of both developing the Setting and developing staff. 5.3 The Local Authority will work in a co-operative spirit with the Provider in order to promote high quality provision. Termination 6.1 This Agreement will terminate if the Provider ceases to be registered with OFSTED. The Local Authority will in this event require the Provider to repay any funding which may have been paid to the Provider which relates to the period after the date the Provider ceases their registration with OFSTED, and may require the Provider to repay all of the funding paid to the Provider for the term in which OFSTED registration ceases. 6.2 In the event that a Provider fails to comply with any of the provisions set out in clause 3 above and/or the Guide for Local Authorities on Delivery of Free Early Years Provision for 3 & 4 year olds and the Early Education Entitlement the Local Authority will issue an improvement notice to the Provider which specifies the Page 5 of 6
6 breach and the timescale within which the breach must be remedied. If the breach is not then remedied within the timescale to the reasonable satisfaction of the Local Authority then the Local Authority may terminate this Agreement and the Provider shall repay to the Local Authority all the funding paid to the Provider for the period after the improvement notice was issued. 6.3 In the event that the council s statutory obligation and/or the funding for early education entitlement substantially alter the Council may terminate this agreement on 6 months notice given in writing to the Provider at the address stated above.
