Living together and pre-marital agreements Because many couples now choose to live together rather than marry, it can be very helpful for co-habiting couples to have a clear framework before they move in together or purchase a property together. A living together agreement can specify details such as individual contributions to the joint home and can help to avoid problems in the future in the event of a break up or death of one partner. Similarly, pre-marital agreements can also be used to set out what each party will be entitled to in the event of a divorce. These need to be set up before a couple embark on marriage and are especially useful if one or both partners have previous family ties, business concerns or high earnings. Separation and divorce It s always unsettling and often upsetting when couples separate or divorce, but having clear objectives combined with a sensitive approach can make the process easier. If you are planning to separate, we can advise you on setting up a formal separation agreement. 4 Mediation At a time of separation or divorce, mediation is an alternative way to resolve family matters. Through mediation, you can resolve disputes, make arrangements for children and reach agreements about finances and the family home. Nelsons provides a mediation service that is accredited by the Legal Services Commission. Collaborative Law This is a relatively new way for a divorcing or separating couple to work together without Court involvement by using a trained Collaborative lawyer to help settle matters in a positive and amicable way. Unlike conventional methods, both partners and their lawyers sign an agreement to work at reaching a settlement out of Court. Nelsons has a specially trained collaborative lawyer who can advise on this cost-effective option.
