1 Long-Term Care Homes Licensing Overview Prepared for the Ministry-LHIN-LTC Operator Education Sessions March-April 2015

2 Objective Provide an overview of the licensing process. Identify roles and responsibilities relating to licence requests. Engagement with the LHINs Moving forward with the Enhanced Long-Term Care Home Renewal Strategy 2

3 Overview of Ontario s Long-Term Care Home Sector Long-term care (LTC) homes provide residential accommodation and care to individuals 18 years of age and older who require assistance with activities of daily living and/or 24/7 nursing care. The Long-Term Care Homes Act, 2007 (the LTCHA) is the primary legislation governing LTC and provides the framework of the LTC Licensing Program. As of January 2015, there are 633 LTC homes with 78,614 licensed/approved beds. Characteristics of LTC homes: Variety of ownership and governance models (not-for-profit, for-profit, municipal); Wide variance in home size, geographic location; and varying design and structure. Total forecasted expenditure for LTC homes in 2013/14 = $3.8B. A total of 25,695 residents were admitted to LTC homes in 2013: Admission rates have been stable over the past three years with approximately 30% annual turnover of residents. The average age of a LTC Percentage home resident of Resident is 82 years Population old. Residents with no aggressive behavior Residents with 3 or more active conditions Residents with dementia or Alzheimer's disease Female residents Residents 85 years or older 50% 60% 70% 80% 90% 100% 3

4 LTC Licensing and Approvals Program In accordance with the LTCHA, all LTC homes must be licensed or approved. The term of the licence is determined by the structural classification of the home. A LTC home may have multiple licences with varying terms (i.e. C-bed home that has redeveloped part of it s beds to new beds would receive a licence for the C beds with a 15 year term and a licence for the new beds with a 30 year term) Type of / Approval Regular long-stay beds Type of Home Municipal Term Minister s approval with no term. with fixed terms. Term varies by the structural classification of the LTC home. For-profits & Non-profits Structural Classification New Beds - Built since 1998 to current design standards A Beds Built prior to 1998, but almost meets current standards B Beds Substantially exceed 1972 standards but do not meet A- bed criteria. C Beds Meets 1972 design standards D Upgrades Upgraded through the 2002 D Bed program but do not meet the 1972 design standards Term of 30 years years 15 years 15 years 10 years D Beds Do not meet 1972 design standards. Upon expiration, these beds will not receive a new licence unless they are upgraded to meet current design standards. 4 years 4

Long-Stay Temporary Beds: Created to increase the capacity to enable occupancy by residents who need LTC for longer than 90 days. 1. Interim Beds: Created to provide increased LTC capacity for ALC patients (i.e., no longer require acute hospital care), and who are eligible for long-stay admission but are on a waiting list for a LTC home. 2. Convalescent Care Beds: Created for persons who need time to recover strength, endurance or functioning and who are expected to return to the community within 90 days. 3. Respite Beds: To provide temporary support for caregivers who require relief from their caregiving obligations. Residents in respite beds are expected to return to their residences within 60 days after admission. Issued in cases where it is necessary to remove residents from a home due to circumstances affecting the home. For the purpose of adding an additional bed at a home where a person requires immediate admission to a LTC home due to his/her condition or circumstances Can be issued for a period of up to 5 years. Can be issued for a period of up to 5 years. Up to 60 days. Up to 30 consecutive days. 5

7 Stages Involved with Issuing/Transferring a Public Interest Tests (responsibility of the Minister) Needs Test (s.96) Concentration Test (s.97) Non-profit/ For-Profit Balance Test (s.97) Public Meetings Eligibility of the Licensee Description of Requirement Changes in the location of beds requires that the Minister determine the need for beds in both areas. During this process, the Minister considers recommendation received from the affected LHIN(s). transfers involving a change in location are complex and require that the Minister and the Director weigh a number of factors before determining if the transfer would serve the public interest and meet the requirements of the LTCHA. The Director must conduct a public consultation to allow the local communities to provide input as part of the review process. The date(s), time(s) and location(s) of the public meeting(s) are announced in local newspaper(s) 30 days in advance. The public can attend the meeting or provide a written submission. The Director must determine that the proposed licensee is eligible to operate a LTC home as required under s. 98 of the LTCHA. 8 LHIN Consultation Each licence transaction requires the LHINs perspective, as local system planners, on the impact of the licence request on LTC bed demand and capacity LHINs are also consulted on: Knowledge of the proposed licensee s conduct. Opinion of the proposed licensee s compliance with the LTCHA and it s regulations. Whether the past conduct indicates that the Home will be: Operated with honesty and integrity Operated in a manner prejudicial to the health, safety and welfare of residents The competence of the proposed licensee This informs the Minister s determination on both, public interest and need. 8
